STATEMENT OF WORK
Performance Work Statement (PWS) Fort Detrick Bottled Water Service
1. REQUESTED SERVICES
The single objective of the work described in this PWS is to provide bottled drinking water to property owners in the vicinity of Ft. Detrick, in Frederick, Maryland.
The Government determines which property owners will be supplied bottled water.
TASK 1: Bottled Water Service (January 01, 2013-December 31, 2013)
The contractor shall provide bottled water service for the residents identified by the Government.
The service will be continued until such a time as the Government deems appropriate. For the purposes of this SOW there is a maximum possible delivery ceiling of 50 properties providing bottled water and a hot/cold dispenser for 12 months of service covering the period from January 01, 2013 to December 31, 2013. In addition, the contractor will provide unit costs for hot/cold dispenser rental and sufficient bottled water for 1 (year) period of time (in increments of 1 month). It is understood that the number or residents being provided bottled water may vary during the contract period as property owners are added and removed from the list of residents receiving bottled water.
A list of the names and addresses of private residences who are to receive bottled water service will be provided to the Contractor by Fort Detrick Environmental Office or their designate. This list may vary from month to month and the Contractor is expected to make adjustments as directed by the Fort Detrick Environmental Office or their designate.
OPTIONAL TASK 2: Additional Year of Bottled Water Service (January 01, 2014- December 31, 2014)
2. MEASUREMENT
Upon receipt of the Order, the Contractor shall be given a list of property addresses of active study participants. The Contractor should plan bottled water delivery for up to 50 properties and for duration of up to 12 months of service. Bottled water shall only be delivered to those properties listed as active participants. The Government reserves the right to amend the list of active participants at any time. Upon notice from the Government, the Contractor shall cease delivery to non-active participants. The actual unit delivery to active participants shall be used as the basis for payment as follows. Non-active study participants will not receive water and the Government shall make no payment for any water delivered to non-active study participants.
3. PAYMENT
Payment for bottled water is determined by the list of active participants. This list will be given to the Contractor by the Government and/or the Government’s designated administrator. The list will be updated as active participants are removed and as new study participants are added.
Payments will be made on a monthly basis for bottled water delivered to only active participants.
A payment will constitute the monthly per unit cost to provide water to a specified property multiplied by the number of participants for the given month. For illustration purposes only, if the monthly per unit cost is $1.00 and there are twenty active participants, then the payment is $20.00. Due to fluctuation in participants, the final contract cost amount may be significantly lower than the contract cost ceiling (50 properties for up to 12 months). Per the formula described herein, the Government shall pay only the amount due for approved payments.
If there is a changed in bottled water or other related costs, the Government shall not be responsible for these cost changes. If the Contractor continues to deliver water to a non-active participant or delivers to an incorrect property, the Contractor will bear the full extent of these costs. No additional payment for gasoline, tolls, mileage, vehicle maintenance or repair, equipment rental, travel expenses, per diem, telephone, or other charges will be made.
If the Contractor or its designee are unable to perform the tasks described in the specifications, the Government will be compensated by the Contractor for any and all costs that might incur as a result of the inability of the Contractor to perform, including but not limited to the cost of purchasing and delivering bottled water from another entity.
4. CONTRACTOR MANPOWER REPORTING
The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address https://contractormanpower.army.pentagon.mil . The required information includes:
(1) Contracting Office, Contracting Officer, Contracting Officer’s Technical Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractor); (6) Estimated direct labor dollars paid this reporting period (including sub-contractor); (7) Total payments (including subcontractor); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); (9) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (10) Locations where contractor and sub-contractors perform the work (specified by zip code in the United States and nearest City, Country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language, and, (13) Number of contractor and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending September 30 of each government fiscal year and must be reported by 31 October of each calendar year.
4.1 Monthly Progress Report
The contractor shall submit by the 10th day of each month a monthly progress report summarizing activities of the preceding month (if at least 15 days of contract performance occurred in that month) and planned activities for the following month. The report shall be a concise summary and include at a minimum, the following information: (1) Contracting Office, Contracting Officer, Contracting Officer’s Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by the report; (4) Date of the report; (5) Contract completion date; (6) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (7) Summary of accomplishments for the report month and planned accomplishments for the following month; (8) Safety reporting including field exposure hours and recordable and/or reportable accidents; (9) Record of deliverables submitted; (10) record of communication, correspondence, and invoices; (11) Estimate of percentage complete for each task and overall percentage complete; (12) Personnel changes, and, (13) If applicable an updated network analysis schedule.
Reports shall be submitted to the COR in hard copy as well as via email. Email attachments, if any, shall be in Adobe pdf or MS Word format only. Email submittals shall include the project manager and emdc.admin@usace.army.mil on the cc line. The subject of the email shall be the contract number with task order followed by “Monthly Progress Report” followed by the year and month of the report (for example “W912DR-99-P-9999 9999 Monthly Progress Report
YYYY MM”).
4.2 Quality Management
The Contractor must ensure that the quality of all work performed or produced under this contract meets Army approval, through the COR. Quality control/assurance plans must be prepared and approved by the COR prior to performance of physical work.
4.3 Quality Assurance
A Quality Assurance Surveillance Plan (QASP) will be generated by the Government to monitor Contractor performance for services to ensure conformance with contract requirements. The QASP sets forth procedures and guidelines that the USACE will use in evaluating the technical and safety performance of the Contractor. Activities identified in the QASP should be appropriately coded in the project schedule to allow for planning of QA inspections.
The QASP is intended to accomplish the following, at least on a basic level: (a) Define the roles and responsibilities of participating Government officials; (b) Define the types of work to be performed with required end results; (c) Document the evaluation methods that will be employed by the Government in assessing the Contractor’s performance; (d) Provide the Surveillance Activity Checklists and Corrective Action Request (CAR) forms that will be used by the Government in documenting and evaluating the Contractor’s performance; (e) Describe the process of performance documentation; and (f) Outline quality assurance procedures to be employed by the Government during performance of the task order to confirm that work is conducted according to accepted standards.
4.4 Quality Control
Quality Control (QC) shall be provided by the Contractor whenever sampling or analysis for chemical constituents is required in order to achieve milestones. Quality control for traditional soils or geotechnical testing shall also be included. All sampling and analysis shall comply with the requirements of the most recently approved DoD Quality Systems Manual (QSM). The laboratory (ies) to be used by the Contractor shall be DoD Environmental Laboratory Accreditation Program (DoD ELAP) certified or equivalent. The Contractor may establish an on-site testing laboratory at the project site if determined necessary by the Contractor. However, on-site testing laboratory (ies) shall be DoD ELAP certified or equivalent and meet the requirements of USEPA, specific state regulator requirements, and all requirements of the most recently approved DoD Quality Systems Manual (QSM).
Following contract award and during project implementation, the Contractor shall develop and submit documentation of project-specific quality assurance (QA) and QC activities prepared in accordance with the Uniform Federal Policy for Quality Assurance Project Plans (UFP-QAPP).
The Government will review and return the quality systems documentation, with comments, indicating acceptance or rejection. If necessary, the Contractor shall revise the documentation to address all comments and shall submit the revised documentation to the Government for acceptance. In addition, the Contractor shall develop and submit Quality Control Summary Reports to summarize the quality control details of the contract project. The problems and successes of the work done to control the quality of the chemical measuring activities and other chemically related cleanup activities shall be included in the summary reports.
A typical QA/QC process may involve the Contractor conducting a Quality Management Audit on each phase of a project. The Contractor may randomly select and audit a project site undergoing each phase of work. Examples include:

Auditing each phase of work for a project constitutes a Quality Management Audit. The audit should evaluate compliance with the Performance Work Statement/Scope of Work, the UFP- QAPP, proper implementation of QC procedures, and proper documentation of QC inspections/findings. Results of each phase of the audit should be captured in a format to document deficiencies and subsequent corrective actions. The Contractor may compile the audit results from all phases of work into a QA Management Assessment Report.

QUALITY ASSURANCE SURVEILLANCE PLAN

Introduction
This Quality Assurance Surveillance Plan (QASP) has been developed to evaluate contractor actions while implementing this PWS. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed objective on the Performance Requirements Summary (PRS) in the maintenance contract.
The QASP provides a systematic method to evaluate the services the contractor is required to furnish.
This QASP is based on the premise the Government desires to maintain a quality standard in operating, maintaining, and repairing assets and that a maintenance contract to provide the work is the best means of achieving that objective.
The contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government is quality assurance to ensure contract standards are achieved.
In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a "self-correcting" contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success.
Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

95% of bottled water is delivered without customer complaints
SURVEILLANCE: The Contracting Officer's Representative (COR) will receive complaints from Government personnel and pass them to the contractor's quality control inspector (QCI) for correction.
STANDARD: 95% of all work is without customer complaints for the service period.
For example, if there is 50 line items being serviced for this contract, the COR should receive no more than 3 complaints during the service period. The COR shall notify the Contracting Officer for appropriate action in accordance with FAR 52.212.4, Contract Terms and Conditions-Commercial Items (February 2007) or the appropriate Inspection of Services clause, if any of the above service areas exceed 3 customer complaints.
PROCEDURES: Any Government employee that observes unacceptable services, either incomplete or not performed, for any of the above performance objectives should immediately contact the COR and the COR will complete appropriate documentation to record the complaint.
The COR will consider the customer complaint valid upon receipt from the customer. The COR should inform the customer of the approximate time the unacceptable performance will be corrected and advise the customer to contact the COR if not corrected. The COR will consider customer complaints as resolved unless notified otherwise by the customer. The COR shall verbally notify the QCI to pick up the written customer complaint. The QCI will be given two hours after verbal notification to correct the unacceptable performance. If the QCI disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the QCI will notify the COR.
The COR will conduct an investigation to determine the validity of the complaint. If the COR determines the complaint as invalid, he will document the written complaint of the findings and notify the customer. The COR will retain the annotated copy of the written complaint for his/her files. If after investigation the COR determines the complaint as valid, the COR will inform the QCI and the QCI will be given an additional hour to correct the defect. A defect will not be recorded if proper and timely correction of the unacceptable condition(s) is accomplished. The QCI shall return the written customer complaint document, properly completed with actions taken, to the COR, who will file the complaint for monitoring future recurring performance. Recurring customer complaints are not permitted for any of the above service items. If a repeat customer complaint is received indicating the same deficiency during the service period (month, quarter, etc.), the COR should contact the Contracting Officer for appropriate action.
SURVEILLANCE: The Government COR will evaluate the services required by each delivery order to ensure compliance.
STANDARD: The Contractor shall perform all work required by the task or delivery order in a satisfactory manner in accordance with the appropriate SOW paragraph. The COR shall not consider the task or delivery order complete until all deficiencies have been corrected.
PROCEDURES: The Government COR will inspect all work tasks required by the task or delivery order to ensure contractor compliance with the appropriate paragraphs 1 and 2 of the SOW each time the service(s) is performed. Record results of inspection, noting the date and time. If inspection indicates unacceptable performance, notify the contract manager or QCI of the deficiencies for correction. The Contractor shall be given two hours after notification to correct the unacceptable performance.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days which the Contracting Officer may exercise the option).
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 10 days which the Contracting Officer may exercise the option); provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
