AMENDMENT 1 - Q&AS
Question: The RFP on pg 23/84 52.216-27 states “the government may elect to award to single or multiple sources under this solicitation.”
This appears to be in conflict with pg 73/84 Scope 2.0 General requirements that states “this is a single award task order contract” SATOCC. Please clarify if this solicitation is a SATOC or MATOC?
Answer: This solicitation is a SATOCC. We intend to award one contract from this solicitation.
Question: Is it the USG’s intent to award without discussion as indicated in section 7.3 or will negotiation be opened prior to award?
Answer: It is our intent to award without discussions but we reserve the right to conduct discussions should they be necessary.
Question: Regarding Pg 43/84 Price preference for Hubzone small business, Would 10% be added to Prime bidders under this solicitation? OR is the intent to give preference on task order proposals, submitted by awardee, that include a Hubzone second tier subcontractor?
Answer: The HUBZone price preference applies during the selection phase does not apply after award.
Question: Regarding Scope pg 76/84 “8.4 “Work hours shall be eight hours long, five days per week, with a standard work shift”. The coefficient schedule on pg 3/84 does not include off-shift hours. How does the government intend to deal with off-shift work when task order scope may require it ? Is it allowable to use RS Means factors to adjust for overtime, weekend, holiday, or off shift time premiums?
Answer: The intent for non-standard hours is to utilize RS Means to establish these costs should an individual task order require this.
Question: Regarding Section 00010, 2.0. Coefficient factors, exceptions, 2.1.5, includes 56.32.50 “Watchmen”. Is it the USG’s intent that when facilities require security escorts that they will be provided by the government at no expense to the contractor?
Answer: The scope of work for each task order will identify if escorts will be provided or whether the contractor will be required to provide. If the contractor is required to provide for them, the Government will pay for them in accordance with the Statement of Work for the individual task order.
Question: Regarding Div 01 Specifications, Temporary Facilities, 3.5. Includes a provision for resident engineers office. As the quantity of these office trailers are unknown at this time, would the USG consider excluding this requirement from the basic solicitation and place the requirement instead in each task order scope as needed, and NPP, Non Pre- Priced item?
Answer: No. Historically, only projects over $3M have required resident engineers offices and of those only one to two year have been required. Additionally, it is anticipated that resident offices would only be required for projects not located on Fort Meade or Fort Belvoir. Historically, 80% of the projects have been located on these two installations.
Question: Regarding solicitation FAR clause 52.211-12 Liquidated damages; “to be issued per task order”, Will the government provide an anticipated daily amount, or percentage of task order value, to use now as a guide? Would the amounts be according to a range based on value of the task order?
Answer: Liquidated damages are used to compensate the Government for probable damages. Therefore, the liquidated damages rate must be a reasonable forecast of just compensation for the harm that is caused by late delivery or untimely performance of the particular contract. Since LDs must be project specific it is hard to speculate what those rates would be. Historically, LDs for this office have ranged from $500 per day to $4,000. However, we have had projects with LDs as high as $55,000 per day.
Question: Regarding Pg 6/84 Tab C states “Bid Bond. The bonding requirement for this contract is as following.
Performance and Payment Bonds will be issued per task order and may range from $2,000 to $103,000,000.
Therefore, to determine the required amount for a bid bond, the full value of the contract, $103,000,000, will be used”. Therefore is the amount of bid guarantee to be provided under FAR 52.228-1 BID GUARANTEE 20% percent of the bid price or $3,000,000.00, whichever is less? Our understanding In this case is the lesser amount applies and the bid guarantee is to be 20% of $3M or $600,000 USD?
Answer: The bid bond is 20% of the contract amount of $103,000,000 which would be $20,6000,000 or $3,000,000.
Question: Do the projects submitted under Factor 1 have to be fully completed (with design and construction)?
Answer: The offeror should provide information on a minimum of three and a maximum of five task order construction contracts that have had a performance period within the past five years from the date of the original issuance of this solicitation. The entire contract, nor all of the individual task orders need to be fully completed to be submitted and evaluated.
Question: Please reference SF1442. In Block 10, it is stated that "the period of performance of the contract is five years from the date of award." However, in Block 11, it is stated that performance is to be completed within 1825 CD (5 years) after receiving Notice to Proceed. Please advise which requirement is applicable.
Answer: The contract will be a five year contract from date of award.
Question: Please reference Section 00010 - Solicitation Contract Form. A dollar value is required to be entered under Item No. 0001 "MAX NET AMT." Please advise if this value is to reflect the proposed FFP for the execution of the sample (seed) project. If not, what should this value represent?
Answer: You do not need to fill that in. That is for the total value of the contract, which will be $103,000,000.00 when awarded.
Question: Please reference SF1442 and Section 00010. In SF1442, it is indicated that the minimum guaranteed value for the contract is $50,000. However, in Section 00010, it is indicated that the minimum quantity and order value is: 1/$2,000. Please advise what constitutes the minimum guaranteed total award under this IDIQ contract.
Answer: The minimum guarantee on the contract is $50,000. The minimum value per task order is $2,000, i.e. we will not issue a task order less than $2,000.
Question: Please reference the proposal submission requirements for Binder 3 (Price). Under Tab C, we are required to submit a Bid Bond. However, the requirements for this bid bond are not clear. Please advise whether the bid bond is to be submitted for the sample/seed project. If not, please clarify what is to be submitted under this Tab C.
Answer: A bid bond is required for the contract. A bid bond is not required for the task order for the proposal of the contract. The bid bond for the contract is to be submitted under Tab C.
Question: Please reference Section 00100 of the RFP. This section incorporates FAR clause 52.215-20 whereby it is stated: "The Offeror shall prepare and submit certified cost or pricing data, data other than certified cost or pricing data, and supporting attachments…” Considering that the RFP requirements for this SATOCC include the submission of coefficients and pricing for the sample project utilizing RS Means cost data, this FAR clause does not appear to apply. Accordingly, we respectfully request that this FAR clause be deleted from the solicitation.
Answer: This clause may be applicable to task orders issued throughout the life of this contract, so it will not be removed. A Certified Cost and pricing data document is not required for the submission of the proposal for the contract.
Question: Please reference the proposal submission requirements for Technical Factor 2 - Past Performance with Task Order Construction Contracts. Please advise if it is acceptable to submit past performance questionnaires for individual task orders that were completed under the task order construction contracts described in Technical Factor 1 in lieu of or in addition to past performance questionnaires for the overall task order contracts.
Answer: You may submit past performance questionnaires in addition to to supplement the overall performance of the entire contract but not in lieu of.
Question: Please reference the Solicitation Contract Form in Section 00010 and Factor 6 - Price. It appears that the same coefficients are required to be provided in both documents, which are to be included in Tabs F and G respectively in Binder 3. Please confirm that this is the case. Also, please clarify how the content of each of these two Tabs will be evaluated.
Answer: Tab G was listed in error and has been removed. For Binder 3, there is no requirement for a Tab G. The evaluation of these factors is described in paragraph 6.6.
Question: Please reference the proposal submission requirements for Technical Factor 1 - Experience with Task Order Construction Contracts. Please advise if it is acceptable to submit the list of individual task orders under each task order contract on 11x17 due to the extensive amount of information required by the RFP.
Answer: Yes, this is acceptable.
Question: Please reference Sections 00600 and 00700 of the RFP. These sections incorporate by reference FAR clauses 52.222-33 "Notice of Requirement for Project Labor Agreement" and 52.222-34 "Project Labor Agreement," respectively. In both cases, there is no indication if any of the Alternates are applicable. 1) Are any of the alternate clauses applicable? The answer to this question will impact whether the PLA is due at the time of submission of the proposal or prior to award. 2) These clauses refer to a PLA being negotiated and applicable “for the term of the resulting construction contract.” Is the “term of the resulting construction contract” the term of the IDIQ or the term of each individual Task Order? 3) Given that a PLA is a project specific (and therefore geographic specific) agreement, how is it possible to have one PLA agreement covering all of the Individual Task Orders that will be awarded subsequent to the award of the IDIQ itself?
Answer: A PLA is not required with this solicitation. The above referenced clauses have been removed.
Question: Please clarify if the price component for the Sample Project is to be included in Binder 4 (Proposal for Sample/Seed Project) or in Binder 3 (Price).
Answer: The price component of the Sample Project is to be included in Binder 4.
Question: On Pg 75/84 the solicitation Includes Contractor provided RS Means Price volumes. Should bidders take this list of cost volumes to be the exclusive sets that will be allowed to price task orders from? Would RSFO consider adding the RS Means “Green Building Cost Data” books for pricing of LEED specific line items?
Answer: Both the Green Building Cost Data Book and the Commercial Renovation Cost Data Book, along with their electronic Data Bases, shall be added to the list. See revised paragraph 6.1 in the summary of changes section.
Question: Can a Task Order Superintendent have a dual role as the Site Safety and Health Officer (SSHO)?
Answer: Per EM 385-1-1, paragraphs 01.A.02, 01.A.03, 01.A.11, 01.A.12, and 01.A.17 and Appendix A, the superintendent will not be able to be the Site Safety and Health Officer (SSHO). Other on site personnel can have more than one responsibility in accordance with EM 385-1-1 and as documented in the Accident Prevention Plan (APP). The task order QC manager may also be the SSHO, for example. All representatives of the contractor's QC team and other employees may be assigned Safety duties. However, all personnel acting as safety officers must meet the requirements of EM 385-1-1 and must be "competent" persons meeting all requirements and having the certificates required for an SSHO.
Can the Certified Safety Professional (CSP) and Certified Industrial Hygienist (CIH) be assigned to multiple task orders?
Answer: Generally, yes. It is recognized that this may make sense with a group of smaller task orders or multiple task orders within a building or a small geographic location. However, on larger, complex project, the Government reserves the right to direct a specific CSP and/or CIH for an individual task order. The contractor may request this scenario during the proposal phase for the individual task order. The Contracting Officer will make the determination on a case by case basis.
Question: Does the 100-page limit apply only to Binder 1 Technical Proposal or does the limit apply to the cumulative total page count of Binders 1 - 4?
Answer: The total number of pages required is at the discretion of the offeror. It is anticipated that no more than 100 pages should be necessary for the entire proposal.
Question: Please clarify whether or not the existing flooring is on a raised access floor system.
Answer: Yes, there is a 6” raised access floor.
Question: What is the classification of the data and communications systems (i.e. what level of TEMPEST)?
Answer: TEMPEST levels should be built to contain TOP SECRET communication systems.
Question: Are all data and communications homeruns intended to tie to existing electrical / communications closets?
Answer: Yes.
Question: Can power be pulled from existing electrical room without additional filtering? Also, please confirm whether all power, data, and communications systems are clean.
Answer: All power pulled from the closets will be internal to the SCIF. The electrical room is currently inside the existing SCIF. This SCIF is simply being expanded to encompass the project area. No filtering is required for electrical runs that do not exit the SCIF.
Question: Are there any additional electronic security requirements (i.e. motion detectors)? If so, where do they report to?
Answer: SCIF shall be built to the requirements of the ICD 705 Technical Specifications for Construction and Management of Sensitive Compartmented Information Facilities, and shall meet all TEMPEST and physical security requirements established by this document.
Question: Does a current mechanical as-built drawing exist? If so, is it possible to make this document available to offerors for our use in bidding?
Answer: They do not exist.
Question: Is there any description as to what is required in Binder 4?
Answer: Paragraph 5.3.9 Sample Project, states, in part, “The offeror is required to submit their proposal to the attached sample project. The format is at the discretion of the offeror but should include both a narrative of the offeror’s approach to the project as well as the price element to include the RS Means line items and the offeror’s applied coefficients.”
Question: Section 00100 paragraph 5.3.9 Sample Project. What is to be submitted under this section in Binder 1?
What is different about this section and Binder 4?
Answer: Nothing is to be submitted under this section in Binder 1. The last sentence of paragraph 5.3.9 has a note that says that the proposal for the sample task should be submitted in Binder 4.
Question: In light of the complexity of the Statement of Work associated with the Subject Solicitation (W912DR- 11-R-0032) and the number of Requests For Information that likely will be received by the U.S Government on that solicitation, we respectfully requests a ten (10) work day extension from the proposal due date to allot sufficient time for contractors to develop comprehensive proposals based on RFI responses.
Answer: We will not be extending the offer acceptance period of this solicitation.
Question: Please reference the proposal submission requirements for Binder 3 (Price). Under Tab E, we are required to submit a completed Certificate of Corporate Principal/Authority. However, this document is not included as part of the RFP. Please issue this document as soon as possible.
Answer: This document is not a Government document and you may submit it is any form. However, a sample is provided.

SCOPE OF WORK
6.0 Contractor Provided Items: As part of the basic contract, the contractor shall provide the following:
6.1 1 Means Cost Works: One complete set of the most current year Means Cost Works CD Software and
Databases for each Data Book indicated below, along with 40 user licenses for use on a network system running the Microsoft XL Professional network operating system. The software shall include online updates every three months. The software shall also include Cost Works Estimator for every licensed user. The software shall be purchased through the RSFO Representative to ensure all licenses being provided through different contracts are capable of being utilized concurrently. This name can and will be provided when requested. The software shall be provided to the Government.
The following databases and cost books/packages shall be provided: Building Construction Cost Data Book, Mechanical Cost Data Book, Electrical Cost Data Book, Plumbing Cost Data Book, Square Foot Cost Data Book, Heavy Construction Cost Data Book, Assemblies Cost Data Book, Light Commercial Cost Data Book, Site Work & Landscape Cost Data Book, Concrete & Masonry Cost Data Book, Facilities Construction Cost Data Book, Facilities Maintenance and Repair Cost Data Book, Commercial Renovation Cost Data Book, Green Building Cost Data Book and the Interior Cost Data Book. The Building Construction Cost Databases and Cost Data Books shall be used as the primary source of pricing data. These include the Mechanical, Electrical, Plumbing, Heavy Construction, Light Commercial, Site Work & Landscaping, Concrete & Masonry, and the Interior Databases and books. The Square Foot, Assemblies and Green Buildings Cost databases and cost data books shall be used as required, without regard to the databases and books references above. The Facilities Construction, Facilities Maintenance and Repair and Commercial Renovation Cost Databases and Cost Data Books shall not be used to price any work unless specifically required by the Task Order Statement of Work or by the Contracting Officer.
Ten sets of books for each of these titles shall also be provided.
The contractor will provide the newest software and 40 licenses and ten sets of books in January of each year throughout the duration of the contract.
6.2 RS Means Cost Works Estimating Training Seminar: The contractor is required to provide one seminar.
The seminar will be one eight hour session at a publicly accessible facility containing a conference or seminar room located within 15 miles of Fort Meade, MD. Each student will be provided with a course workbook and a PC or laptop loaded with the estimating software, for student use during the training session. The training sessions will be taught by RS MEANS instructors. The date of the seminar shall be scheduled with the Government. A maximum of 20 Government personnel will attend this instruction.
6.3 Primavera 6: Provide ten stand alone licenses and softward for the following software programs:
Primavera P6 Enterprise Project Portfolio Management and Primavera P6 Professional Project Management.
6.4 Primavera 6 Training Seminar: The contractor is required to provide one training seminar. The seminar will be one eight hour session at a publicly accessible facility containing a conference or seminar room located within 15 miles of Fort Meade, MD. Each student will be provided with a course workbook and a PC or laptop loaded with both software packages as indicatead above, for student use during the training session. The training sessions will be taught by Primavera instructors. The date of the seminar shall be scheduled with the Government. A maximum of 20 Government personnel will attend this instruction.
The contractor shall not release information regarding individuals without authorized prior written consent of the Contracting Officer. All documents showing individuals' names or other personal information, including Social Security Numbers, shall be controlled and protected. The provisions of the Privacy Act of 1974, Public Law 93-579, 5 U.S.C., Section 552a, shall apply. All products, deliverables, and documents developed under this contract shall be considered to be classified at a minimum level of “Unclassified/For Official Use Only.”
