This solicitation is for a single aw ard task order construction contract. It w ill be an indefinite delivery indefinite quantity (IDIQ) firm fixed priced contract.

The period of performance of the contract is f ive years from the date of aw ard.

The maximum capacity for this contract is $103,000,000.00.

The mimimum guarantee is $50,000.00

A Top Secret Facility Site Clearance is required for the offeror named in block 14 at the time the offer is due, at the time of aw ard and for the duration of the contract.

A sample project is included in the evaluation for this solicitation. To receive the sample task scope of w ork and draw ings, you are required to submit the request in w riting via email to carlen.capenos@usace.army.mil. Those documents w ill be provided to you.

There w ill be no site visit for the sample task. Offeors may submit w ritten “Requests for Information” (RFI) to the same email above. Offerors may also include assumptions as part of their submisson to the sample task proposal.

PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS

1. OVERVIEW.

1.1 This Request for Proposal (RFP) solicits for one Indefinite Delivery, Indefinite Quantity (IDIQ) Firm-Fixed Price Task Order Construction Contract for the Real Property Services Field Office of the Baltimore District Corps of Engineers. The resultant contract will be a five year contract with a maximum dollar value of $103 million.

1.2 The award will be an IDIQ contract that will be funded per individual task order. Task orders may be either Design-Build or Design-Bid-Build. The individual projects will be a variety of construction types from mechanical and electrical to new construction. The task orders will ranges in size and complexity from small to large and from non-complex to highly technical. Projects may be classified or unclassified. Funding may be either Military Constructions funding (MILCON) or Operations and Maintenance (O&M) funding. Occasionally, there may be other types of funding that could be utilized if authorized for constructions projects. All task orders will be firm fixed priced task orders. The period of performance for the contract will be five years. A Top Secret Facility Site Clearance is required for the awardee. The offeror successful in obtaining this contract award will be that offeror whose proposal represents the best value and is determined to provide the most benefit to the Government.

Further details regarding this project include the following. This contract is for a broad variety of major and minor repair, modification, rehabilitation, alterations and new construction projects in support of customers in the Intelligence Community, Department of Defense organizations and other agencies that are supported by the Real Property Services Field Office. Further projects may include demolition; geo-technical investigation: infrastructure;

interior fit-up; communications, security, and Supervisory Control and Data Acquisition (SCADA), and anti-terrorism/force protection (AT/FP) requirements. Projects may be either Design-Build or Design-Bid-Build. The geographic area for this contract will be the Continental United States (CONUS). Work performed may be either in secure or non-secure sites.

The Contractor and RSFO will be required to respond rapidly to Government requirements with outstanding professionalism and top quality craftsmanship, without compromising safety standards, current mission requirements, and readiness. It is imperative that the Contractor provide a flexible and multi-disciplined work force.

Most of the work to be accomplished will be in areas where classified Top Secret operations are conducted. It is mandatory that the Contractor maintain a balanced work force of cleared Top Secret personnel to work in such areas. Also, it is mandatory that the prime contractor has and maintains an active Top Secret Facility Site Clearance for the prime contractor.

For Design-Build task orders, no separate task order will be issued for design. The coefficient for that task order will be applied to the overall project that will include the cost for the design.

1.3 The purpose of these instructions is to establish a uniform evaluation procedure for the proposals by the Source Selection Evaluation Board (SSEB) and the development of the Best Value Decision by the Source Selection Authority (SSA) using the Trade-Off Process (See Federal Acquisition Regulation 15.101-1). In as much as the proposal shall describe the capability of the Offeror to perform the resulting contract, the proposal shall be specific and complete in every detail as well as be prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the contract.

1.4 For the purposes of this solicitation, the Government will utilize a single phase process.

2. GENERAL INSTRUCTIONS

2.1 Firms formally organized as design-build entities, design firms and construction contractors that have associated specifically for this project, consortia of firms, or any other interested parties may submit proposals. A design firm or construction contractor may offer more than one proposal by entering into more than one association.

Associations may be joint ventures or include key team subcontractors. Any legally organized Offeror may submit a proposal.

2.2 Contractor Team Arrangements. Contractor Team Arrangements are considered an arrangement in which (1) two or more companies form a partnership or joint venture to act as a potential prime contractor; or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program. In accordance with FAR Subpart 9.6, the Government will recognize the integrity and validity of contractor team arrangements; provided, the arrangements are identified and company relationships are fully disclosed in the offer. The Offeror shall identify the major or critical aspects of the requirement to be performed by those identified in the Contractor Team Arrangement. The submission must contain a narrative that clearly explains the relevance to a particular factor of information concerning a company that is part of a Contractor Team Arrangement. The Government will consider the adequacy of this explanation in deciding the relevance of the information to this procurement.

2.3 If applicable, the Offeror shall submit evidence from the Offeror’s SBA Servicing Agency that the Offeror has notified and discussed the proposed joint venture for this project with the appropriate SBA personnel.

2.4 Information submitted about any company other than the Offeror, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), subcontractors that will perform major or critical aspects of this requirement, or other associated business, will not be evaluated for any factor unless the proposal contains a detailed narrative explaining why this submitted information is relevant to this acquisition. The Government will consider the adequacy of this explanation in deciding the relevance and weight of the information to this procurement. Information about subcontractors may not be given much weight unless the proposal contains evidence that the subcontractor is committed to perform the work. If information about a subcontractor is properly submitted and given weight during the evaluation, the expectation is that this subcontractor will perform this work.

Before utilizing another subcontractor for this work, the Government must consent.

2.5 SPECIAL NOTE: This contract requires the firm to possess, at the time of proposal and the time of award, an active Top Secret Facility Site Clearance. This requirement is mandatory for the exact entity submitting the proposal. This means that the entity identified in block 14 of the Standard Form 1442 must have the Top Secret Facility Site Clearance in that name along with the matching Cage Code. For example, if Company A and Company B form a Joint Venture called Company AB, then Company AB must have an active Top Secret Facility Site Clearance. Even if both Company A and Company B each individually posses the clearance, unless Company AB posses its own Top Secret Facility Site Clearance, the proposal will not be eligible for award.

2.6 It is the intent of the Government to disqualify any proposal that, at the time of receipt of proposal, does not possess an active Top Secret Facility Site Clearance immediately and not further evaluate it.

2.7 Offerors shall submit their proposal to the address shown in Block 7 of Standard Form 1442.

2.8 Proposals are due no later than the time and date specified in Block 13 of Standard Form 1442.

3. GENERAL PROPOSAL FORMAT:

3.1 Title Page. Include the title of the solicitation, solicitation number, Offeror name, and date of the submittal.

3.2 Table of Contents. Each binder of the proposal shall contain a detailed table of contents. The complete table of contents shall be included in each binder. Any materials submitted but not required by this solicitation (such as company brochures) shall be relegated to appendices.

3.3 Printed Matter Submissions. Written material shall be on 8 ½ x 11 inch paper printed in no less than a 10 font.

Page limitations, where specified in the RFP, shall be considered a maximum. Pages in excess of any specified limitation shall not be evaluated. A single 8 ½ x 11 inch sheet with written material on one side only shall constitute one page. (for organization chart or schedules, a folded 11” x 17” format may be used) However, if both sides of the sheet bear written material then this single sheet shall be counted as two pages.

3.4 Binders. Proposals shall be submitted in tabbed, three ring binders.

The total number of pages required is at the discretion of the offeror. It is anticipated that no more than 100 pages should be necessary.

4. EVALUATION RATINGS

4.1 Proposal Ratings: Factors. Factors 1, 3 and 4 will be adjectivally rated. Factors 2 and 5 will be rated as risk ratings. Offerors submitting proposals for this project should limit submissions to data essential for the evaluation of proposals.

4.2 Technical Rating Definitions. The following rating definitions will be utilized in the evaluation of factors 1, 3 and 4. A Proposal Risk will be assigned using the same definitions. Proposal risks are those risks associated with the likelihood that an offeror's proposed approach will meet the requirements of the solicitation.

EXCELLENT: The proposal has exceptional merit and reflects an excellent approach which will clearly result in the superior attainment of all requirements and objectives. This clearly achievable approach includes numerous strengths, and essentially no weaknesses, which can be expected to result in outstanding performance. The proposal provides solutions which are unquestionably feasible and practical. These solutions are further considered to be exceptionally clear and precise, fully supported, and demonstrate a clear understanding of the requirements.

GOOD: The proposal demonstrates a sound approach which is expected to meet all requirements and objectives. This sound approach includes strengths, and few relatively minor weaknesses, which collectively can be expected to result in good performance. The proposal provides solutions which are considered feasible and practical. These solutions are further considered to be clear and precise, supported, and demonstrate an understanding of the requirements.

ACCEPTABLE: The proposal demonstrates a sound approach which is capable of meeting all requirements and objectives. The approach includes both strengths and weaknesses, where the strengths are not outweighed by the weaknesses. Collectively, the strengths and weaknesses are likely to result in acceptable performance. The proposal solutions are generally feasible and practical. These solutions are further considered to be somewhat clear and precise, partially supported, and demonstrate a general understanding of the requirements.

MARGINAL: The proposal demonstrates an approach which may not be capable of meeting all requirements and objectives. The approach has weaknesses of substance and strengths, which if they exist, are outweighed by the weaknesses. Collectively, the strengths and weaknesses are not likely to result in acceptable performance. The proposal contains solutions which may not be feasible and practical. These solutions are further considered to lack clarity and precision, are generally unsupported, and do not demonstrate a complete understanding of the requirements.

UNACCEPTABLE: The proposal demonstrates an approach which, based on a very high risk, will very likely not be capable of meeting all requirements and objectives. This approach has numerous weaknesses and strengths which, if they exist, are far outweighed by weaknesses. Collectively, the strengths and weaknesses will not result in acceptable performance. The proposal contains solutions which are not feasible and practical. The solutions are further considered to lack any clarity and precision, are unsupported, and do not demonstrate an understanding of the requirement.

4.3 Performance Risk Rating Definitions. Factors 2 and 5 will be evaluated using the following Performance Risk Levels:

VERY LOW – Essentially no doubt exists that the Offeror will successfully perform the required effort based on their past performance

LOW - Little doubt exists that the Offeror will successfully perform the required effort based on their performance record.

MODERATE - Some doubt exists that the Offeror will successfully perform the required effort based on their performance record.

HIGH - Significant doubt exists that the Offeror will successfully perform the required effort based on their performance record.

NEUTRAL – When an offeror is without a record of relevant past performance or for whom information on past performance is not available.

5. SUBMISSION REQUIREMENTS

For purposes of this RFP, an “Offeror” may include a group of two or more entities that have formed a “contractor team arrangement,” as that term is defined in the Federal Acquisition Regulation, Section 9.601. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor team arrangement, will be considered as a part of the evaluation of the Offeror’s proposal. In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this RFP, the prime contractor must have completed at least 50% of the total number of projects submitted for Factor 2 for consideration in response to the past performance requirements of this RFP. An Offeror that relies upon the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP. As a part of their proposal, the Offeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (teaming/partnering, joint venture, mentor/protégé, etc.) and their role on this project. This documentation shall be provided in Binder 1 of the Offeror's proposal.

5.1 FACTOR 1: EXPERIENCE WITH TASK ORDER CONSTRUCTION CONTRACTS: The offeror shall provide information that demonstrates the offeror’s experience with task order construction contracts. This should include both design-build and design-bid-build experiences. The offeror should provide information on a minimum of three and a maximum of five task order construction contracts that have had a performance period within the past five years from the date of the original issuance of this solicitation. At least three of the submitted projects must document the prime contractor’s experience. The remaining projects may come from other members of the contractor team arrangement, as defined above.

Information shall include: the contract number, the contracting agency, contact information for each contract, overall capacity of the contract. Additionally, for each contract provide a matrix that includes: all task orders issued, the description of all projects, dollar value of the initial task order, dollar value of completed task order, period of performance of each task order (or date) and actual period of performance completion (or date). Offerors may use the form entitled “CONTRACTOR PROJECTS” (Attachment A) if desired. This format is highly encouraged.

The offeror shall describe their past use of and experience with using RS Means (or similar) pricing methods for task orders. The offeror may also describe alternative pricing methods in IDIQ type construction contracts. The purpose of this inclusion is to give the Government information on the offerors' familiarity with Means (or similar) based pricing for assurance that the offeror understands how to properly bid pre-priced and non-pre-priced line items.

Similar contracts may include those that include task orders issued for construction projects in a variety of sizes, a variety of construction disciplines, varying degrees of technical complexity and both design-build type task orders as well as design-build task orders. The Offeror may submit other types of projects, but must explain the relevancy of those projects to the project that is being solicited in this RFP.

The offeror shall describe their past use of and experience with using RS Means (or similar) pricing methods for task orders. The offeror may also describe alternative pricing methods in IDIQ type construction contracts. The purpose of this inclusion is to give the Government information on the offerors' familiarity with Means (or similar) based pricing for assurance that the offeror understands how to properly bid pre-priced and non-pre-priced line items.

Project should demonstrate a variety of construction types and methods to assist in evaluating the offeror’s ability and approach to perform work, as described in the Statement of Work, including:

Security Systems;

Anti Terrorism Force Protection (AT/FP) Systems;

Electro Magnetic Radiation (EMR) shielding;

Sensitive Compartmented Information Facilities (SCIF);

Electronic Test and Repair Facilities;

Electronic Laboratories;

Communications Infrastructure or Support Facilities;

Structural Repairs and/or Construction;

Foundation Systems Repair, Construction, and/or Replacement Mechanical Systems Repair, Construction and/or Replacement;

Electrical Systems Repair, Construction and/or Replacement;

Fire Protection and Alarm Systems Repair, Construction and/or Replacement;

5.2 FACTOR 2: PAST PERFORMANCE WITH TASK ORDER CONSTRUCTION CONTRACS: The offeror shall provide information that demonstrates the offeror’s past performance with the task order construction contracts presented for Factor 1, Experience with Task Order Construction Contracts. This should include both design-build and design-bid-build experiences.

If a formal evaluation is unavailable, the Offeror shall obtain the information using the “PAST PERFORMANCE QUESTIONNAIRE” (Attachment B) or similar form that provides the same information. Formal performance evaluations are those that are similar to the Department of Defense Performance Evaluation (Construction) Form DD2626. The Offeror may provide an explanation if the performance evaluation rating is less than satisfactory.

Where applicable, the Offeror must explain facts related to any partial or completely terminated project and disclose any projects with an assessment of liquidated damages for the failure to meet the contractually required completion date.

The Government will also analyze past performance by reviewing the Construction Contractor Appraisal Support System (CCASS) and/or the Architect-Engineer Contractor Appraisal Support System (ACASS). The Offeror shall submit all customer completed questionnaires and performance evaluations with its proposal. The Offeror may provide information regarding any awards received for work done on any of the projects described. In the case of an Offeror without a record of relevant past performance, or for whom information on past performance is not available, the Offeror will be rated neutral.

5.3 FACTOR 3: WORK PLAN: To facilitate evaluation, the offeror should organize the submitted material sequentially under tabs. Submit this information in the form of narratives and an organization chart.

5.3.1 Contract Team Organization: Describe in narrative form, how the contract team shall be structured. Describe the principle firms involved and their responsibilities. Identify the team members. All disciplines shall be led by an experienced professional registered in the discipline (if professional registration is available). The Offeror shall submit documentation as to the availability of Key Personnel that indicates each individual’s current assignment and the Offeror’s plan to ensure that the named personnel will be used on this contract; however, if the named person isn’t available upon award, a person with the same or better qualifications shall be substituted and approved by the Government.

The offer shall discuss their approach to manage multiple, large-scale projects simultaneously. Identify the construction portion the Offeror intends to self perform and the items to be subcontracted. Similarly, the Offeror shall identify the areas they intend to design through consultants and list those design consultants.

5.3.2 Design Organization: This contract may involve a wide variety of construction projects, some of which will be executed in a Design-Build method. This section shall discuss how design will be managed and executed throughout the life of this contract. Multiple design firms may be necessary. The qualifications of the design and construction personnel shall be provided. The narrative shall state why your design team(s) is uniquely qualified to undertake this contract, its approach to sustainable design and process of working with the customer(s) during the design phase.

5.3.3 Construction Organization: This contract may involve a wide variety of construction projects. The Offeror shall discuss its construction organizational structure to manage multiple task orders with concurrent periods of performance. This section shall discuss how construction will be executed throughout the life of this contract. The narrative shall state why your team is uniquely qualified to undertake this contract, its approach to construction and working with the customer(s) during construction.

5.3.4 Quality Management Control System: The Offeror shall describe how they intend to manage quality throughout the contract. Discuss quality management methods proposed throughout the design and construction process.

5.3.5 Safety. The Offeror shall discuss how they intend to manage and execute their Safety program for the contract and each task order.

5.3.6 Organization Chart: The proposed organizational chart shall identify the members or entities of the organization and show the lines of authority and communication of all members of the design and construction entities.

5.3.7 Schedules: The offeror must describe how it will manage multiple task orders with concurrent periods of performance.

The offeror must discuss its scheduling capabilities and procedures to be used for this contract, which must include schedule updates, incorporating modifications into the schedule, and other steps to be taken to maintain the individual task order schedules.

5.3.8 Top Secret Clearances of Key Personnel: The offeror shall provide the names of the Key Personnel that posses a current Top Secret Clearance. At a minimum, the following positions will be required to possess a Top Secret Clearance throughout the duration of the contract: for construction: Superintendent, Program Manager, Project Manager, Quality Control Manager, Safety. For design (for design-build projects): Senior Architect, Senior Civil Engineer, Geotechnical Engineer, Senior Mechanical Engineer, Senior Electrical Engineer, Senior Structural Engineer and Security Engineer. This list shall be validated and provided on an annual basis to the Contracting Officer.

5.3.9 Sample Project: The sample project is included to demonstrate the offeror’s ability to utilize RS Mean’s pricing method. The offeror is required to submit their proposal to the attached sample project. The format is at the discretion of the offeror but should include both a narrative of the offeror’s approach to the project as well as the price element to include the RS Means line items and the offeror’s applied coefficients. Note: The proposal submission will be submitted in Binder 4.

5.4 FACTOR 4: SMALL BUSINESS PARTICIPATION PLAN (required for all offerors): This factor requires all offerors, regardless of size status to address their planned small business usage for this contract.

All offerors are required to provide a Small Business Participation Plan. It shall address their corporate approach and methodology for acquiring, soliciting and using small businesses in the performance of this contract. All plans shall address the Offeror's commitment to providing subcontracting opportunities, as well as evidence of planned and /or continued outreach efforts to encourage and use small businesses. This Participation Plan shall include all subcontracting tiers.

The Participation Plan shall demonstrate commitment to all federally designated categories of small business: Small Businesses (SBs), Veteran-Owned Small Businesses (VOSBs), Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) HUBZone Small Businesses (HUB), Small Disadvantaged Businesses (SDBs), Woman-Owned Small Businesses (WOSBs), and when applicable, Historically Black Colleges/ Universities/Minority Institutions (HBCU/MIs). The plan shall identify all categories for participation as part of the Offeror's team. This shall include a general description of the type of work, product or service anticipated to be supplied via a small business concerns. Identification of the names of specific subcontractors is not required for the small business utilization evaluation; however, providing specific subcontractors is desirable and may result in a better evaluation.

The proposed plan must demonstrate a clear and concise knowledge and understanding of the statutory requirements and regulations relating to Small Businesses, Small Disadvantaged Businesses (SDB), Service-Disabled Veteran- Owned Small Businesses (SDVOB), Historically Black Colleges and Universities/Minority Institutions (HBCU/MI), Woman Owned Businesses (WOB), HUBZones, and Veteran-owned Small Businesses.

5.5 FACTOR 5: PAST PERFORMANCE IN UTILIZING SMALL BUSINESS (required only for large businesses): This factor pertains only to large businesses.

The Offeror shall provide a description of the Offeror’s demonstrated small business achievements in all federally designated small business categories on up to five completed or substantially completed (75% of construction) projects during the past five years. For each project, offerors should provide a brief project description, dollar magnitude of the project, location, and the percentage of total work that was subcontracted to small businesses at a first tier and for all tiers, identifying specific SB categories used on each project.

For this submission, large businesses may submit information pertaining to their goals and actual accomplishments under approved Small Business Subcontracting Plans. Submissions of Individual Subcontracting Reports (ISRs) formerly known as SF 294s and Summary Subcontracting Reports (SSRs) are highly encouraged.

This participation plan will be an evaluation factor. A separate subcontracting plan meeting the requirements of FAR 19.7 shall be required by the apparently successful offeror. If the apparently successful offeror fails to negotiate a subcontracting plan acceptable to the contracting officer within the time limit prescribed by the contracting officer, the offeror will be ineligible for award.

5.6 FACTOR 6: PRICE: All offerors will fill in the bid schedule. The bid schedule is made up of the coefficients for the following breakdown of task orders. The Scope of Work, included in the solicitation, contains information as to what is included in the coefficient. This is located in paragraph 2.0 of Section 00010.

Sample Task: The sample task for this solicitation shall be priced utilizing RS Means and submitted in accordance with the proposal instructions as supplied in the sample task and as is required by the scope of work for this solicitation.

6. EVALUATION CRITERIA

6.1 FACTOR 1: EXPERIENCE IN TASK ORDER CONSTRUCTION CONTRACTS: Offerors must demonstrate sufficient experience in task order construction contracts as stated in paragraph 5.1. The Offeror will be rated on an adjectival basis. To achieve an “acceptable” the offer must submit information listed in paragraph

5.1 that demonstrates that the offeror is capable of meeting all requirements and objectives.

Extra consideration may be given for the following:

a. Experience with multiple task order type construction contracts in a concurrent period

b. High dollar and multiple task orders issued concurrently

c. Task order construction contracts with the Federal Government and/or the U.S. Army Corps of Engineers.

6.2 FACTOR 2: PAST PERFORMANCE IN TASK ORDER CONSTRUCTION CONTRACTS: Past performance will be rated in terms of how likely there is a performance risk to the Government; that is, low performance ratings will be taken as indicators of a high risk that the Offeror will successfully perform the work.

The more relevant a proposed project is the more weight it will be given. If an Offeror has no record of relevant past performance, or if information on the Offeror’s past performance is not available, the Offeror must state that fact. That Offeror will be rated as neutral.

6.3 FACTOR 3: WORK PLAN: For this factor, the Offeror will be rated on an adjectival basis. Offerors will receive one rating for this Factor. This rating considers all items in Factor 5.3. All items in 5.3 are evaluated equally.

The sample task will be evaluated in the context of the offeror’s ability to demonstrate how they will utilize RS Means method of proposing and executing work through task orders.

The Offeror shall meet the requirements of this factor if the section addresses all of the elements identified in paragraph 5.3. To achieve an “acceptable” the offer must submit information listed in paragraph 5.3 that demonstrates that the offeror is capable of meeting all requirements and objectives stated for each element.

Extra consideration may be given for the following:

a. Team Members who have experience the Federal Government and/or the U.S. Army Corps of Engineers.

b. Key Members having TS and/or TS/SCI clearances in excess of the minimum required

6.4 FACTOR 4: SMALL BUSINESS PARTICIPATION PLAN (required for all offerors): The Government will evaluate the Small Business Participation Plans provided. Those plans containing greater detail and specificity will be given greater credit than general statements and commitments.

6.5 FACTOR 5: PAST PEFORMANCE IN THE UTILIZATION OF SMALL BUSINESS (required only for large businesses): Small Businesses will receive a rating of Neutral. This neither counts for or against the offeror.

Past performance will be rated in terms of how likely there is a performance risk to the Government; that is, low performance ratings will be taken as indicators of a high risk that the Offeror will successfully meet the requirements of small business participation. If an Offeror has no record of relevant past performance, or if information on the Offeror’s past performance is not available, the Offeror must state that fact. That Offeror will be rated as neutral.

6.6 FACTOR 6: PRICE: Price Analysis: The process of examining and evaluating an offeror’s proposed price to determine if it is fair and reasonable will be conducted in accordance with FAR Part 15. The offeror’s proposed costs will also be evaluated for cost realism in accordance with FAR Part 15. Results of the cost realism analysis will be used in performance risk assessment. Price analysis and cost realism analysis may involve comparison with other prices; e.g., comparing an offeror’s proposed price with the proposed prices of competing offerors or with previously proposed prices for the same or similar items, comparing an offeror’s proposed price with the independent government estimate, and any of the other price analysis and cost realism analysis techniques specified in FAR Part 15. Price analysis and cost realism analysis will be performed on each proposed coefficient prior to aggregating the coefficients to one final coefficient for purposes of the tradeoff. Coefficient(s) determined to be unreasonable and/or unrealistic by the agency will negatively impact the offeror's chances of award.

The Government intends to utilize the following process to evaluate the price coefficients. The Government will take the offeror’s schedule of coefficients from Chart A and multiple them by the percentage estimated in Chart B.

These numbers will then be added together for one overall coefficient that makes up a weighted average of all sixteen coefficients. This weighted average will be used as a basis of analysis in performing price analysis. If awarded this contract, the proposed coefficients in Chart A will be the contractual coefficients and not the weighted average. Coefficients will also be analyzed for reasonableness to include offering balanced coefficients.

The following is an example of the analysis to reach the weighted average coefficient. Note: These coefficients are for demonstration only and are not an indication of the Government Estimate or existing rates on current contracts.

The PEB will perform a cost realism analysis in accordance with FAR 15.404. The sample task pricing will be utilized for this process. That information will be utilized to develop a report that summarizes and compares the offeror’s proposed price information to the independent government estimate. The report will be briefed to the

SSEB.

7. EVALUATION PROCEDURE

7.1 The Source Selection Evaluation Board (SSEB) will conduct a review of the Evaluation Board evaluations of proposals against the solicitation requirements and the approved evaluation criteria to ensure an equitable, impartial, and comprehensive evaluation against the solicitation requirements. The fundamental responsibility of the SSEB is to provide the Source Selection Authority with information to make an informed and reasoned selection. The SSEB will therefore prepare a summary report containing adjectival assessments for each factor and their supporting rationale; brief the SSA; and prepare any necessary items for discussion.

7.2 Ratings on individual factors as well as the proposal risk, to include all supporting documentation, will be provided to the Source Selection Authority. The Source Selection Authority, independently exercising prudent business judgment and determine the offeror that proposed the best offer to the Government.

7.3 Discussions: Offerors are advised that it is the intent of the Government to make an award without discussions.

Therefore, proposals should be submitted on the most favorable terms that the Offeror can submit to the Government. However, the Government reserves the right to hold discussions if it determines that discussions are necessary. If discussions are necessary, a Competitive Range shall be established that includes the “most highly rated" proposals. The Government retains the discretion in limiting the competitive range to a number of proposals that will enable efficiency.

7.4 Exceptions to the contractual terms and conditions of the solicitation (e.g., standard terms and conditions) may result in a determination to reject a proposal.

7.5 The Government reserves the right to reject any or all proposals at any time prior to award.

7.6 The Government reserves the right to accept other than the lowest priced offer.

7.7 Failure to submit all the data in the format indicated in this section may be cause for determining a proposal incomplete and, therefore, not considered for evaluation, and for subsequent award.

8. BASIS OF AWARD

When combined all non-price factors are significantly more important than price. Of the non-price factors the following factors are in descending order of importance: Factor 1, Factor 2, Factor 3, Factor 4, Factor 5.

Trade-off Analysis: After all of the evaluations have been completed, the SSA will consider all factors to determine which Offeror represents the “best value” to the Government for this project.
