For the MAES SDB solicitation these were provided in Word and Excel for the offeror, and reference contacts for past performance questionnaires, to complete. Will the Government please provide the Attachments in Word and Excel?
Yes, The attachments will be uploaded as Word and Excel formats.

SECTION B

Page 3, Section B CLIN 0002, Contractor Manpower Report, ‐ Is the Offeror required to insert a dollar amount in this CLIN?
This applies to task orders.
Section B - Supplies or Services and Prices, page 3 of 88 states “Continuation of Schedule B is located at Attachment A.” Please confirm Schedule B is referencing a continuation of Section B and that there are no documents missing from the RFP or associated attachments.
Attachment A has been replaced with Attachment A-1. Attachment A-1 will become part of Schedule B for the award of the base contract and will be binding for the life of the contract.

SECTIONC

Pg. 7 of 88, under C.1.2.1 Engineering Support, second paragraph lists the “Professional qualifications in these primary disciplines may be required …” Section J, Attachment A, Continuation of Schedule B lists the “Direct Labor by Job Classification.” Will the government be amending the RFP so that both discipline lists match. If not, which list should be used when providing the total number of employees by discipline as required in Factor 6.
Offerors may use the list in C.1.2.1 for addressing requirements in Factor 6.
Pg. 14 of 88, under C.6.4 Radiation Protection/Safety Program, second paragraph states, “If the contractor has an active NRC or Agreement State License to perform decommissioning activities, this should be identified in the submittal.” Please advise if this is required for this procurement or if it is specific to an individual task order that will be issued after award of the contract. If required for this procurement, please advise where in the submittal (in which section) it should be identified.
The licenses may be required on an individual task order basis.
Pg. 15 of 88, under C.7 Chemistry Technical Requirements, first paragraph. Please advise if the Quality Control Coordinator listed is considered the same position as the Quality Control Manager as found on Pg. 76 of 88, under L.3.2.6, third paragraph for suggested key personnel.
Yes, they may be the same.
Drawing on page 3 of Attachment C, the “Conus Sample Task”. Specifically, on the drawing there are three square boxes of different sizes, each with an “X” inside them. One of these boxes is just above the “leachate collection pond”. The second is just above the word “Section” in “Western Section”. The third box is positioned just after the word “Groundwater” in the “Groundwater Flow” direction notation. What are these boxes supposed to be?? Or in any case, should they be considered significant to the sample problem? They are not identified in the legend.
The boxes represent buildings related to the operations of the landfill. They are not significant to the Hypothetical Scenario.
Pg. 7 of 88 under C.1.2.1. Engineering Support, second paragraph “Professional Qualifications in these primary disciplines may be required.” ‐ Item 20 “Munitions response engineering” and Item 22 “Explosives safety engineering”. Please advise if the discipline of “Munitions response engineering” is that of an Energetics Engineer; if not then please describe what qualifications are needed for munitions response engineering. Please advise if the discipline of “Explosives safety engineering” is that of a Safety Engineer or UXO Safety Officer (UXOSO); if not then please describe what qualifications are needed for explosive safety engineering.
The RFP has been amended to remove these two bulleted items.

Pg. 7 of 88, Section C.1.2.1. Engineering Support, second paragraph “Professional qualifications in these primary disciplines may be required.” – Item 12 “Certified Waste Broker.” Please advise if this category “Certified Waste Broker” is that of a Regulatory Specialist, or that of a Transportation and Disposal Coordinator for waste generated in a foreign country; if not then please describe what qualifications are needed for this category.

The RFP has been amended to remove this bulleted item.

Pg. 73 of 88, Section C.3.2.1(b) Sub‐factor 2 – Project Listing. Please confirm that a “project” may be one or more task orders for work at the same site under a single ID/IQ contract.
One or more task orders for work at the same site under a single IDIQ contract may be considered a “project”.

Section C.1. Contract Procurement Objective and Overview states “contracts awarded under this solicitation will be Indefinite Delivery/Indefinite Quantity contracts for Environmental Services in support of the U.S. Army Corps of Engineers Baltimore District (USACE) and its customers located primarily in the USACE North Atlantic Region boundaries but possibly OCONUS as well.” In which OCONUS locations is the work on this contract expected to be performed?

Currently there are no expectations. If this requirement is needed, it will be on an individual task order basis.

Factor 2: Section 4.0 of Attachment C, Performance Work Statement for CONUS Sample Task, Hypothetical Scenario identifies performance objectives and standard for a draft and final Quality Assurance Surveillance Plan (QASP). QASPs are not typically prepared by contractors; they are prepared by the Government with the contractor reviewing and providing comments. Please confirm that the District intends the contractor to only review and comment on the Government’s QASP for this Sample Task, rather than have the contractor prepare this document.
The RPP has been amended to revise the performance objective for the QASP. For the Hypothetical Scenario solution, the contractor should address how they would meet this objective were this an actual task order.

SECTION F

Pg. 22 of 88, Section F, Contract Period states “The contract awarded hereunder shall begin tentatively 11 February 2011…” This conflicts with Notes for Completion of Section J, Attachment E, Chart A, page 4, paragraph 16, which states “at the time of the award of this contract (which is estimated to be fourth quarter, Calendar Year 2010)”. Section J, Attachment G, Chart 2, page 4, last paragraph also states award is “estimated to be fourth quarter, Calendar Year 2010”. Please clarify the award date Contractors should assume for cost proposal purposes.
The tentative award date is 11 February 2011. The language in the charts will be change accordingly.

Chart 1A has been deleted in its entirety.

Attachment G, Chart 2 has been replaced with Attachment G-1, Chart 2.

SECTION G

Page 24 of 88, Clause G.3, Hazardous Duty Pay Differential interpretation by Contracting Officer – Please Clarify whether the 4% and 8% hazard pay differential rates should be included in Section B, and Charts 1A, 2A, and Chart 2, or whether these will be proposed on a task order basis.
These rates should be proposed on a task order basis.

SECTION H

Pg. 28 of 88, under H.1 ID/IQ Multiple‐Award Contracts, paragraph a, second sentence. “These contracts will be the result of an unrestricted business class.” Please advise if this a typo and will be updated to reflect Small Business Set‐Aside for NAICS 562910 (500 employees).
This paragraph has been changed to read “These contracts will be the results of a Small Business Set-Aside….”.

SECTION I

SECTION J – Attachment A
This section has been deleted in its entirety and replaced with Attachment A-1.
“Offerors shall add to the Government’s list all anticipated job titles and classifications for both prime and subcontractor(s) that are not included by the Government to include every job title and classification the contractor anticipates using over the life of the contract.” This conflicts with RFP Section J, Attachment A, page 4, # 10 which states “Any labor classification rates or other direct costs for the prime or subcontracts that are needed during the life of the contract but were not included in the Pricing Schedule will be negotiated on the task order and added by modification to the contract as necessary. “ Please clarify if Offeror and each team subcontractor is required to add all labor categories anticipated to be used over the life of the contract, or if additional labor categories, if required, will be negotiated on a task order basis
This has been deleted in its entirety.

Attachment A-1 will replace Attachment A.

Offerors are to list on Attachment A-1 any anticipated job titles that have not been recognize by the Government for the life of the contract.

There may be specialty job titles that are only unique to a particular task order and those must be identified on a task order basis.

Continuation of Schedule B, Item 46 “Professional Planner.” Please advise if this category is for either a Professional Logistics Planner, Professional Urban Planner, or a Professional Events Planner. If the Professional Planner discipline is for neither of these listed, please advise what qualifications are needed for a Professional Planner.
Attachment A-1 has corrected the Professional Planner title to Professional Urban Planner.

SECTION L

Section L.4.3 of the MAES SB RFP mentions that each fold out page in Volume I shall be counted as one page and that the Offeror shall not exceed 10 fold out pages. We assume that we could still use more than 10 fold out pages but each additional fold out will count as two pages. Please verify this is correct. We understand that the foldout pages are reserved for the 10 projects in the project listing. However, we do need to use a fold out page for a process chart which requires the use of a 11x17 page.
The proposal shall not exceed 10 foldout pages.
Reference page 73 of the RFP, 3.2.1 (b) Sub-Factor 2 – Project Listing: Can you please define what you consider a to be a “project”? Can we submit task order projects or can we provide contracts?
Individual Task Orders may be provided or multiple task orders on an individual IDIQ may be provided as a “project.”
Pg. 71 of 88, fifteenth paragraph “52.219‐24 Small Disadvantaged Business Participation Program – Targets (Oct. 2000).” Item (a) states, “This solicitation contains a source selection factor or subfactor related to the participation of small disadvantaged concerns in the contract.” However, no factor or subfactor relating to SDB participation was noted in Sections L or M of the RFP. Please advise if this clause is applicable to the SB RFP.
This clause has been deleted in its entirety.
Pg. 72 of 88, under Section L, paragraph 1.0 Purpose, fourth sentence. “This solicitation will be competed on a full and open basis.” Please advise if this a typo and will be updated to reflect Small Business Set‐Aside for NAICS 562910 (500 employees).
This paragraph has been amended.

Pg. 73 of 88, Section L.3.2.1 Technical Factor 1: Corporate Experience/Project Listing, (a) Subfactor 1 – Corporate Experience, second sentence. “Breadth of experience reflects the offeror’s experience in performing all of the tasks required under Section C.1, Statement of Work…” Pg. 81 of 88, Section M.1.1(a) Corporate Experience/Project Listing, (i) Sub‐factor 1 – Corporate Experience – Breadth, first sentence. “The Government will evaluate this submission to determine if the Offeror has experience in performing all of the services required under Section C, Statement of Work.” Please advise if Offerors when writing to address Breadth should consider all items under Section C as stated in the Section M evaluation criteria, or if Offerors should address only items under Section C.1 as stated in the Section L instructions.

All items under Section C, Statement of Work.

Pg. 73 of 88, Section L.3.2.1 Technical Factor 1: Corporate Experience/Project Listing, (b) Subfactor 2 – Project Listing, fifth paragraph. “The Contracting Officers or the Contracting Officers project manager (for government contracts) contained in this list are the customers who will provide the past performance data which, as specified in Section M, will form a critical component of the past performance evaluation.” The 11th bulleted item lists the name, address, phone, fax and email of the Contracting Officer’s Representative, and the 12th bulleted item listed the name, address, phone, fax and email of the Contracting Officer’s Project Manager. Please advise if the government is looking for the Contracting Officer and the Contracting Officer’s Project Manager, or the Contracting Officer’s Representative and the Project Manager to provide the past performance data. Note: For many government projects, the Contracting Officer’s Representative and the Contracting Officer’s Project Manager is the same person. Should the Past Performance Questionnaire be sent to only one reference (CO, COR, or COPM) per project?

The PPQ can be sent to any of the following: Contracting Officer (KO), Contracting Officer’s Representative, or Technical Project Manager.

Pg. 74 of 88, Section L.3.2.4 Technical Factor 4: Technical Capabilities and Safety states, “The technical discussion should demonstrate expertise in the entire spectrum of activities needed to satisfy all requirements in Section C SOW.” Section M.1.1(d) Technical Factor 4 – Technical Capabilities and Safety states, “Safety and Quality Control/Quality Management are of equal importance and more important than Comprehensive Understanding and Continuous Improvement, which are of equal importance.” Please advise if only Subfactors (i) – (iv) are the items being evaluated for Technical Factor 4, as there is no mention of evaluating the technical discussion of expertise in the entire spectrum of activities needed to satisfy all requirements in the SOW within Section M.

Only Subfactors (i) – (iv) are being evaluated in Technical Factor 4.

Pg. 75 of 88, Section L.3.2.5 Technical Factor 5: Past Performance. “The offeror shall submit 5 past performance questionnaires and all other identified major subcontractors may provide past performance information for up to five projects completed within the last three years using the standard form provided in Section J, Attachment B, with preference given towards projects cited in the project listing (Factor 3.2.1.b.).”

A. Please advise if only the offeror has to submit PPQs, and not all other major subcontractors as well.

B. Please advise what is the difference between the Past Performance Questionnaires and the past performance information that may be provided by major subcontractors.

C. Please advise if each major subcontractor is allowed to provide past performance information for up to 5 projects regardless if it is cited in the project listing (Section L, 3.2.1.b., Factor 1/Subfactor 2).

D. Please advise if the same stipulations for projects in the Project Listing are required for projects in Past Performance (i.e., at least 80% complete within the last three years).

E. Please advise if a narrative or other information in addition to the PPQs is desired to address evaluation criteria for Technical Factor 5—listed in on Pg. 82 of 88, Section M.1.1(e)(i‐iv), and if so, whether the narrative will be outside of the page count, as the RFP currently indicates that Technical Factor 5 does not count towards the overall page count.

F. If no additional Past Performance information or narrative is allowed to be provided under Technical Factor 5, please confirm that the Offeror is to submit only PPQs via their clients and will have no pages contained within the Technical Factor 5 tab of their proposal.

G. Pg. 82 of 88, Section M.1.1(e) Technical Factor 5 – Past Performance Evaluation Criteria items (i‐iv). The government states that it “places a high value on these items.” Please advise how these items will be evaluated since they do not appear on the Past Performance Questionnaires. Will the Offeror be allowed to provide past performance information that demonstrates its performance in these areas (items i‐v)?

A. Only the offeror has to submit PPQs. Others MAY. However is others then the Prime/JV PPQ is submitted, please indicate what prime/JV the subcontractor will be working for.

B. They are the same, read it as “subcontractors MAY also provide PPQs, but are not required to.”

C. This is acceptable but not required.

D. Same stipulations apply.

E. No narrative necessary, PPQ is the only requirement.

F. The PPQs shall be submitted via their clients, however the prime/JV shall provide a tab for Technical Factor 5.

G. PPQs here are the only submission necessary from the offeror. Anything else, the Government will evaluate through methods described in Section L 3.2.5.

75, Sec L, 3.2.5 Technical Factor 5: Past Performance. – Is it acceptable to include a list of contacts behind this tab that the Past Performance Questionnaires were sent to, to assist review of this section, or would the government prefer this tab be left empty? If a list of contacts is acceptable, will this page be counted toward the overall page limit?
Yes, you can enclose a list under this tab and no it will not count towards your page limitations.
Would Baltimore consider extending the project completion period from 3 years to 5 years. Typically, USACE Districts allow a 5 year period for projects.
No.
On page 73 (Section L, Instruction to Offerors), under (b) Sub-Factor 2 – Project Listing, the following statement is made: “…….have performed a substantial, critical effort OR at least 80% complete at the time of the proposal OR have been completed in the past three years”.
Please use best professional judgement to determine the definition of substantial, critical effort” and justify your decision.
Page 77 of 88, Section L, last paragraph states all team subcontractors must submit a Chart 1B. If there is a team subcontractor who provides specialized services that are neither proposed or invoiced using labor rates, (eg waste disposal firm or lab), can the requirement for a Chart 1B be waived for these type of team subcontractors?
This language has been removed in it entirety.
Section L.3.2.6 Technical Factor 6: Key Personnel Resources. Please clarify the definition of “Principal” under suggested key personnel. Is this term synonymous with a Program Manager?
Yes, synonymous with Program Manager
Section L.3.2.6 Technical Factor 6: Key Personnel Resources. Please clarify the difference between the Safety and Health Manager and the Certified Industrial Hygienist/Certified Safety Professional?
The Safety and Health Manager must be from the Prime and can be the signatory on all safety deliverables (that require a signature), a CIH or CSP can be supplemental resources from prime or subs.
On page 73, 3.2.1 (a) Sub-factor 1 -- It states that “For subcontractor’s corporate experience to be considered, offerors shall include letters of intent unconditionally committing subcontractors to performance under this contract should it be awarded to the offeror.” Does this require a letter from the offeror to the Corps indicating the unconditional commitment to use the subcontractors or does it require a letter from the Subcontractor to the prime indicating their unconditional support of the prime should they be awarded the contract? Or does it require a letter from the prime to the sub indicating unconditional support to use the sub.
The Prime/JV shall provide a signed letter between the subcontractor and the prime to acknowledge the commitment.
In Sub factor 3, the RFP asks to define the operational and scope limits or cost thresholds utilized in the selection of subcontractor vehicles, can you provide further clarification of the types of information you are looking for? What does the government refer to by “subcontracted vehicle”?
The prime must provide a statement on how you will procure a subcontractor.

In Section L; Section 3.2.4 Technical Factor 4: Technical Capabilities and Safety; (c) Sub-factor 3 - Comprehensive Understanding of Environmental Services and Remedial Activities it states: ”Ability to technically integrate large and complex efforts across a process and program, including digital data collection, analysis, storage and management”. Does the “Digital Data” refer specifically to Geophysical digital data or does it include data digitally stored such as electronic data deliverables from laboratories?

This requirement includes data digitally stored as well.

3.2.6 Technical Factor 6: Key Personnel Resources.

Offerors shall identify the names and titles of proposed key personnel and their organizational relationships, along with locations. Resumes of key personnel must be provided. In keeping with the performance-based nature of this contract, each offeror should determine and justify which personnel are considered key personnel in line with his/her proposed technical and management approach to this contract.

As this contract will be used for a number of different types of tasks and remedies, what type of information is required for the justification for personnel which are considered key personnel?

This section has been amended to remove the words “and justify”.

4.1 Volume I – Technical. The total number of pages shall not exceed 90 pages (excluding the past performance evaluations, letters of intent and teaming agreements, if applicable). Sections shall be prepared at the discretion of the offeror, but shall be within the overall page limitation. A breakdown of specific limits is as follows:

If less pages are submitted in one section could the offeror use those pages in a section not required by the RFP. If so will the entire 90 pages be reviewed?

No, The section page limitations are set.

If the pages exceed the page limitation as specified they will be remove and not reviewed.

TAB 8: Identification of Uncompensated Overtime must be prepared and submitted by all Offerors and all team members in accordance with FAR 52.237-10, Identification of Uncompensated Overtime, which had been included in full text elsewhere in Section L. The Cost/Price Proposal cost information must include the identification of any hours against which an uncompensated overtime rate is applied for prime and subcontractors. Also submit the Offeror’s policy addressing uncompensated overtime, to include accounting practices for establishing hourly labor rates relative to uncompensated overtime, under this Tab.

In the SB solicitation, this is the only Tab for Volume II that requires information from the Offerors and all team members. Is this an error? If not, do any of the other tabs require additional information from all team members?

This tab has been deleted in its entirety.

On page 73 of 88, in paragraph 3.2.1 (b) (paragraph titled “Sub-factor 2 - Project Listing”, under paragraph 3.2.1 “Technical Factor 1: Corporate Experience/Project Listing”, in section 3.2 “Contents of Volume I”) the RfP states that the Project Listing should identify projects on which the offeror or a major subcontractor:

“have performed a substantial, critical effort or at least 80% complete at the time of the proposal or have been completed within the past three years.”

Please clarify this part of the RFP text. The use of “or” in the phrase “or have been completed within the past three years” can be read to imply that the criterion of a project being completed in the last three years is an option rather than a requirement. Are we to assume that relevant projects, on which we have performed a substantial effort but have been completed more than three years ago, will be accepted in our proposal?

No, substantial critical efforts or at least 80% complete refers to projects that are ongoing.

Section L, 3.2.3 (c) states “Any operational or scope limitations, or cost thresholds utilized by your organization in the selection of subcontracted vehicles shall be defined in the proposal.” In using the term “selection of subcontracted vehicles,” is the government asking the offeror how it will determine which type of subcontract (FFP, CR, other) to issue to subcontractors?

Please define the terms “operational or scope limitations” and “cost thresholds.”

Yes, The Government would like to know how you plan to procure a subcontractor.

Operational or scope limitation and cost thresholds terms relate to the offeror’s limitation (if any) to self complete tasks based on scope and budget capabilities.

Pg. 75 of 88, Section L.3.2.4 Technical Factor 4, (c) Sub‐Factor 3 ‐ Comprehensive Understanding of Environmental Services and Remedial Activities states, “Ability to technically integrate large and complex efforts across a process and program ….” Please advise if a process is meant to be a regulatory process [RCRA/CERCLA]. If not, then please advise what type of process. Please advise if program is meant to be a series of large, complex sites under a base‐wide installation [Installation Restoration Program (IRP)/Environmental Restoration Program (ERP)]. If not, then please advise what type of program.

These are good examples of process and program, respectively, however, this Sub Factor is open to interpretation and the Offerors can use their best professional judgment when answering.

File details come from the government source that posted it. Updated .
