52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

The acquisition is solicited on an unrestricted basis using full and open competition.

1. BASIS FOR AWARD

(a) The Government will award a contract resulting from this solicitation to the lowest priced technically acceptable (LPTA) responsible Quoter whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor I - Technical to include:

- Subfactor 1: Company Qualification

- Subfactor 2. Contract Manager and Alternate Contract Manager

- Subfactor 3. Personnel Qualifications

- Subfactor 4. Technical Experience (Reference Information Sheet – Attachment 3) Factor II - Price Factor III - Supplier Performance Risk Factor

See FAR 52.212-1 Instruction to Quoters and its addendum for detailed instructions on documentation to be submitted with the quote addressing each of the factors.

(b) A rating of no less than “Acceptable” must be achieved for all non-price factors and sub-factors. Receiving a rating of “Unacceptable” in any of the non-price evaluation factors and sub-factors as listed above will result in a rating of “Unacceptable". The non-price evaluation will consist only of determining the acceptability of each offer.

Offers will not be ranked based on the acceptability evaluation.

(c) The Government intends to evaluate offers and award a contract without discussions. Therefore, each initial quote should contain the Quoter’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

2. EVALUATION APPROACH

(a) All quotes shall be subject to evaluation by a team of Government advisors. Careful, full, and impartial consideration will be given to all quotes received in response to this solicitation. Quotes will be evaluated to determine compliance with all requirements of the solicitation, including any Attachments and exhibits. The evaluation criteria will be applied to all quotes in the same manner. The Government will evaluate each quote strictly in accordance with its content and will not assume that performance will include areas not specified in the quote.

(b) To be considered for selection a quote must conform to all terms and conditions contained in the solicitation. No quote will be accepted that does not address the total amount of work specified in the solicitation.

(c) FACTOR I - Technical Factor and Subfactor Evaluation:

The Government will evaluate quotes based on documentation provided, as described below.

Technical Factor Rating Definitions:

ACCEPTABLE - Quote meets the minimum requirements of the solicitation.

UNACCEPTABLE - Quote does not meet the minimum requirements of the solicitation.

Subfactor 1. Company Qualifications: The Government will evaluate the Quoter’s submitted certificates or licenses to be authorized repair agent of air compressor systems or to be authorized to service the manufacturers listed in Attachment 2. This subfactor is met when the Quoter provides an active certification or license to be an authorized air compressor system manufacturing company or an authorized agent of the manufacturers or maintenance listed in Attachment 2.

Subfactor 2. Contract Manager and Alternate Contract Manager Qualifications: The Government will evaluate the Quoter provided information for the proposed Contract Manager and Alternate Contract Manager which demonstrates a minimum of three (3) years of work experience in an air compressor system manufacturing or maintenance company or in a company which holds a license (work-commitment) to a manufacturing company and they are a certified engineer (Ingenieur, Techniker, Meister) in electronic or mechanical field. This subfactor is met when the Quoter has provided valid information and active certifications of the proposed individuals and when the Quoter provides a statement if the individual proposed is currently employed as in-house personnel or provided a letter of commitment.

Subfactor 3. Personnel Qualifications: The Government will evaluate the Quoter provided information for a minimum of one (1) personnel to perform the required services which demonstrates a minimum of three (3) years’ experience performing the required services and shall have the below certifications at a minimum of one of the following:

1. Apprenticeship diploma electrical engineering (unaltered German version (“Gesellenbrief/Facharbeiterbrief Elektrotechnik”)

2. Apprenticeship diploma mechanical engineering (unaltered German version (“Gesellenbrief/Facharbeiterbrief Mechanik”)

3. Apprenticeship diploma mechatronic engineering (unaltered German version ("Gesellenbrief/Facharbeiterbrief Mechatronik")

AND

shall also possess certificates of training for Air Compressor Systems and High Pressure Air Compressor Systems (more than 300 bar) for the following:

1. The manufacturer, supplier and installer of the expected system,

2. The manufacturer of the existing Air Compressor Systems in accordance to the inventory list (Attachment 2 Inventory List).

All certifications obtained abroad must be translated to German and certified by the Federal Ministry for Education (Bundesministerium fuer Bildung und Forschung) per www.anerkennung-in-deutschland.de.

This subfactor is met when the Quoter has provided valid information and active certifications of the proposed individuals and when the Quoter provides a statement if the individual proposed is currently employed as in-house personnel or provided a letter of commitment or provided a signed subcontractor agreement.

Subfactor 4. Technical Experience: The Government will evaluate the Quoter Reference Information Sheets that are recent and relevant as defined below. The Government shall review two (2) but no more than four (4) referenced contracts. Past performance is a measure of the degree of quality to which a Quoter has satisfied customers in the past, and complied with Federal, state, and local laws and regulations. To be acceptable, information obtained from the Quoter, POCs, or other sources must be from recent and relevant performance, and the quality of service is predominantly positive to provide the Government a reasonable expectation that the Quoter will successfully perform the required effort or the Quoter’s performance record is unknown. Information indicating poor quality of past performance may result in an unacceptable rating. Further, a Quoter that is or recently has been seriously deficient in contract performance shall be presumed to be unacceptable unless the circumstances were properly beyond the contractor’s control, or that the contractor has taken appropriate corrective action. The Government may contact references to verify the accuracy of the information provided by the Quoter.

"Recent" is defined as the efforts that are completed or ongoing during the past four (4) years prior to the issue date of this Solicitation.

"Relevant" is defined as similar to work contemplated under this Solicitation with respect to scope, type of work, and value. The minimum value for each reference sheet submitted shall be EURO 20,000.00 per year of performance.

Note: In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the Quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Acceptable.”

Quoters are cautioned that in conducting the past performance assessment, the Government will use data provided in the Quoter's quote and data obtained from other sources such as:

(a) Government’s knowledge of previous contractor performance;

(b) Customer surveys and reference information sheets;

(c) The Government wide Contractor Performance Assessment Reporting System (CPARS);

(d) Any other basis that the contracting officer determines to be reasonable.

The Government may reject a quote if it is found that any information that has a negative impact on the Quoter’s past performance record has been deleted, misrepresented, or withheld.

(d) FACTOR II – Price Evaluation

1. The Government will evaluate the Quoter completed Attachment 1 and completed fill-ins in the SF1449 “Schedule Supplies/Services”. After determination of technical and past performance acceptability, each quote will be evaluated and award made to the quote with the lowest Total Evaluated Price (TEP). The award will be based on the lowest price determined to be reasonable, complete (all items are priced). The successful Quoter shall be contractually bound to all quoted prices and rates. Quoters must ensure there are no rounding errors to the nearest cent.

2. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option period(s) possible under Clause 52.217-8 (maximum six months), Option to Extend Services, the Government will take the price for all CLINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.

(e) FACTOR III - Supplier Performance Risk

The Government will consider Risk in accordance with the provision at 252.204-7024, Notice on the Use of the Supplier Performance Risk System. The Government will consider Supplier Risk as described in the provision. The Government will NOT consider Item Risk or Price Risk as described in provision. For purposes of this Risk assessment, the Government will only consider information contained in the Supplier Performance Risk System (SPRS). Any questions or concerns the Quoter has concerning its SPRS risk assessments should be addressed as described in paragraph (d) of the provision.
