1. GENERAL INFORMATION
1.1. Quotes shall be received no later than the time and date specified on page 1 (Standard Form 1449) in Block 8.
The time for submission of quotes is Central European Time (CET), Wiesbaden, Germany local time. Late quotes will not be considered. It is the offeror's responsibility to ensure quotes are received timely.
1.2. Offerors shall submit quotes via email only. Submissions shall be sent to all email addresses listed below.

1.3. Questions Pertaining to the Solicitation
All questions regarding this solicitation shall be submitted to all email addresses in paragraph 1.2 above in writing.
The applicable solicitation section or applicable specification paragraph shall precede questions. The subject of the email shall be “Questions W912CM-24-Q-0017”.
To allow the Government sufficient time to respond prior to the closing date the Government requests that all questions be submitted by 9 May 2024. The Government cannot guarantee questions received less than one (1) calendar days prior to the date and time for submission of quotes will be answered prior to closing of the solicitation.
Questions shall annotate a reference to the specific part of the solicitation (for example, page number and paragraph number) to which they pertain. Answers to questions will be posted to SAM.gov website under the solicitation number. It is the Offerors’ responsibility to monitor the web site for posting of amendments, answers to questions, and other instructions, if any.
1.4 The Government will update the RFQ with an updated Schedule Itinerary (Attachment 3) and Offeror Capacity Chart (Attachment 4) on or around 17 May 2024. An Amendment will be issued to include this update and posted on SAM.gov
1.5 The Government will award a single contract on a Lowest Price Technically Acceptable (LPTA) basis pursuant to the award evaluation criteria stated in FAR 52.212-2. The Government intends to evaluate quotes and award a contract without discussions with Offerors. Therefore, the Offeror's initial quote should contain the Offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and waive informalities and minor irregularities in quotes received.
2. INSTRUCTIONS FOR WRITTEN SUBMITTALS
2.1 Quote Format and Content: This solicitation utilizes streamlined acquisition procedures. Each quote shall contain:

1. DD Form 1449 “SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS” shall be completed and signed by an official authorized to bind the Offeror.
2. Acknowledge ALL Amendments, if any.
3. Completed FAR 52.212-3 ALT I Offeror Representations and Certifications -- Commercial Items ALTERNATE I. Note: With the exception of paragraphs (b) and (v), completion of the provision is not required if the offeror has an active SAM registration. Offerors with an active SAM registration shall complete the annual representations and certifications electronically via the System for Award Management (SAM) website.
4. DFARS 252.229-7001, TAX RELIEF - ALTERNATE I

2.2 Content Requirements: All information shall be confined to the appropriate volume. The Government will not consider information found in other volumes. Offeror shall confine submissions to essential matters, sufficient to define the quote and provide adequate basis for evaluation. Offeror is responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of their quote. Proprietary information shall be clearly marked.
2.3 Compliance with Submission Requirements: Incomplete quotes, including those that failed to provide required material information, will be rated “unacceptable” and may be excluded from further evaluation. The Government may also determine a quote unacceptable if the offeror takes any exceptions to the terms and conditions of the solicitation or imposes conditions. The Government will not read or consider any information contained in pages beyond the specified limit for each volume. Offerors are advised that exceeding specified page limits may result in a rating of "unacceptable".
Certifications and Representations - Each Offeror shall complete (fill-in and sign) the solicitation sections indicated below using the document (without modification to the document) provided with the solicitation.
3. VOLUME I – SOLICITATION, OFFER AND AWARD DOCUMENTS AND CERTIFICATIONS
/ REPRESENTATIONS:
3.1 Standard Form 1449 duly executed by an official authorized to bind the offeror. Ensure that blocks # 12, 17a, 30a, 30b, and 30c are completed.
3.2 The offeror shall complete FAR 52.212-3 ALT I Offeror Representations and Certifications -- Commercial Items. Offerors registered in SAM need only complete paragraph b of the above clause, if applicable.
3.3 Acknowledgment of all Amendments to the solicitation (if any amendments are issued) prior to the hour and date specified as the solicitation closing date by completing item 8 and 15 of Standard Form 30 and returning one
(1) signed copy of the amendment.
3.4 The completion and submission to the Government of the items in Volumes I, II, and III will constitute the quote. The quote shall communicate the Offeror’s unconditional assent to the terms and conditions in this solicitation, including any attachments and documents incorporated by reference. The Offeror’s failure or refusal to assent to any of the terms and conditions of this solicitation or the Offeror’s imposition of additional conditions or any material omission in its quote may constitute a deficiency which will make the quote unacceptable to the Government. The Government reserves the right to permit Offeror to revise their quote if the Government thinks it is in its interest to do so.
3.5 Data previously submitted to the Government, if any, will not be used in the evaluation of your response to this solicitation. Previously submitted data shall not, therefore, be included in your quote "by reference."
4. VOLUME II - TECHNICAL
4.1 The PWS describes the services that will be acquired through this solicitation. The Technical Volume shall not exceed 15 pages single spaced.
4.2 The offeror shall submit in the technical volume:
Factor I - Technical:
a. A completed Offeror Capacity Chart (Attachment 4) describing capacity to perform services as described in the PWS, to include vehicle availability to complete number of movements for each of the days and types of vehicles offered. If the offeror is proposing an alternative vehicle mix to meet the requirement, the offeror must highlight the changes in Attachment 4 and Attachment 3 and provide a summary of proposed changes (Microsoft Word or Adobe PDF) sufficient detail to determine vehicle mix will meet the required movement of passengers outlined in Attachment 3;
b. A statement the Offeror has checked all planned drivers’ licenses, litigation history, driver license expiring date to confirm a valid Personenbeförderungsschein (or equivalent), and provide the names for a minimum of 15 drivers that were checked.
NOTE: Only U. S. Government terms and conditions will apply. Any additional terms and conditions provided as part of an offeror’s quote will not be considered by the U. S. Government and any award made will not include any offeror terms and conditions.
5. VOLUME III - PRICE
Factor II – Price:
Offeror shall complete and submit the “Schedule of Supplies/Services” for contract line items 0001, and 0002. The Government will evaluate offers for award purposes by adding the total price for all contract line items. If quantity proposed is less than quantity requested the Government will multiply the unit prices proposed by the quantities requested in contract line items 0001, and 0002 for evaluation purposes. If the offeror is proposing an alternative vehicle mix to meet the requirement, the offeror shall update the quantities in the “Schedule of Supplies/Services” for contract line items 0001, and 0002 on the SF1449 to align with their technical approach.
6. Factor III – SUPPLIER PERFORMANCE RISK FACTOR:
The Government will consider Risk in accordance with the provision at 252.204-7024, Notice on the Use of the Supplier Performance Risk System. The Government will consider Supplier Risk as described in the provision. The Government will NOT consider Item Risk or Price Risk as described in provision. For purposes of this Risk assessment, the Government will only consider information contained in the Supplier Performance Risk System (SPRS). Any questions or concerns the offeror has concerning its SPRS risk assessments should be addressed as described in paragraph (d) of the provision.
NOTE: PAST PERFORMANCE will be reviewed as part of the Government's determination of Contractor responsibility. The Offeror is not required to include any Past Performance information with their quote
Past performance information is an indicator of a Contractor's ability to perform the contract successfully. The
Government will evaluate Contractors for past performance as a part of the Government's determination of Contractor responsibility for award.
Past performance review may be conducted on one or more of the following:
(a) Government’s knowledge of previous Contractor performance;
(b) Customer surveys, and Reference Information Sheets;
(c) The Government wide Past Performance Information Retrieval System (PPIRS), System Award
Management (SAM), etc. or
(d) Any other basis that the Contracting Officer determines to be reasonable.
(e) Information contained in the Supplier Performance Risk System (SPRS)
In the event of a Contractor without a record of recent and relevant past performance, or for whom information on past performance is not available, the Contractor will be determined responsible.

PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT (PWS)
Transportation Services US Army Europe and Africa, G5 International Operations Division
9-13 June 2024
Part 1 General Information
1. General: This is a non-personal service contract under which the personnel rendering the service are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.
1.1 Description of Services/Introduction: This is a non-personal service contract to provide business class, chauffeured transportation services for personnel and their staff from Munich International Airport to Edelweiss Lodge and Resort, or local hotel, in Garmisch-Partenkirchen and return.
1.2 Background: The US Army Europe and Africa (USAREUR-AF) will host a conference at the Edelweiss Lodge and Resort in Garmisch-Partenkirchen from 10 to 12 June 2024. USAREUR-AF has invited 27 personnel and their staff to participate who will need business class, chauffeured transportation services between the Munich International Airport, or train station in Munich or Garmisch-Partenkirchen, and the Edelweiss Lodge and Resort, or local hotel, in Garmisch-Partenkirchen, Germany. The majority of the personnel and their staff will arrive at the Munich International Airport on 10 June 2024 and will require transport to the Edelweiss Lodge and Resort, or local hotel, within 30 minutes of exiting the arrivals terminal. A small number of personnel and their staff may arrive at the Munich International Airport on 9 June 2024 and will require transport to the Edelweiss Lodge and Resort, or local hotel, within 30 minutes of exiting the arrivals terminal. The conference is anticipated to conclude between 1230 and 1430 on 12 June 2024 and the personnel and their staff will require transport to the Munich International Airport to take afternoon and evening flights, to a hotel in Munich, Germany, or train station in Munich or Garmisch-Partenkirchen. Some personnel and their staff will remain overnight, 12 June 2024, at the Edelweiss Lodge and Resort, or local hotel, and will require transport to the Munich International Airport, or train station in Munich or Garmisch-Partenkirchen throughout the day, Thursday, 13 June 2024. Arrival and departure times will, more than likely, be spread across a 12-18 hour timeframe. Travel parties will range in size from 2 to 5.
1.3 Scope: The Contractor shall provide non-personal service for professional drivers with a Personenbeförderungsschein (passenger transport license) or equivilant and business class vehicles (sedans and vans) that meet all appropriate motor vehicle requirements, within the Federal Republic of Germany and the State of Bavaria, necessary to perform services as described in the PWS and associated contract documents. The vehicles should be of executive or business class style and able to, comfortably, accommodate up to five passengers with luggage. The Contractor shall perform to the standards and acceptable quality levels identified in this PWS and associated contract documents such as the Quality Assurance Surveillance Plan.
1.4 Objectives: The objective of this contract is to provide professional, safe, secure and timely business class, chauffeured transportation for personnel and their staff between the Munich International Airport and the Edelweiss Lodge and Resort, or local hotel, in Garmisch-Partenkirchen on the days of 9, 10, 11, 12 and 13 June 2024.
1.5 General Information
1.5.1 Quality Control Plan (QCP): The Contractor shall develop and maintain a QCP to ensure services are performed in accordance with (IAW) this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is the means by which it assures that the work provided complies with the requirements of the contract.
The Contractor’s Proposed QCP shall be submitted to the Contracting Officer (KO) through the Contracting Officer’s Representative (COR) for review within three (3) days after date of contract award or two (2) work days prior to the first movement, whichever is sooner (Deliverable A.001).
The Government will review and either notify the Contractor in writing of acceptance of the plan or return their comments to the Contractor within two (2) work days. If the Government has provided comments, the Contractor shall then have two (2) work days to submit a Final QCP. After receipt of the Final QCP, the Contractor may receive the Contracting Officer’s acceptance in writing. Any proposed changes to the accepted QCP are required to be resubmitted for acceptance by the Contracting Officer no later than five (5) days prior to the anticipated change and before implementation by the Contractor. The timeline noted above will apply for review and acceptance for proposed changes. At a minimum, the QCP must include and answer the following to be acceptable:
a. The name and contact information of the scheduling manager.
b. The plan shall include a list of drivers that provides the full name of the driver (last name, first name), date of birth, place of birth, driver’s license number, national identity number (passport or Ausweiss), and Personenbeförderungsschein.
c. The plan shall include a list of vehicles with the make, model, license plate of the vehicle and assigned drivers. If changes are made, this list should be revised, and notifications made to the COR prior to movement.
d. The plan shall address procedures to follow in case of emergency and in response to threats to the safety and security of the passengers.
e. The plan shall address the contractor’s ability to respond to unexpected changes in schedules, traffic delays, and detours.
f. The plan shall address the contractors ability to respond to unexpected changes in schedules within the fixed price contract.
1.5.1.1 RESERVED.
1.5.1.2 Issue Reporting: The Contractor shall inform the COR of issues or potential issues that might affect the performance within .25 hours (15 minutes) of identifying those issues. Verbal reports to COR shall be followed up by a summary written report at the end of the period of performance listing all experienced issues from verbal reports that affected performance. (Deliverable A.002).
1.5.2 Quality Assurance: The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the acceptable quality levels (performance thresholds).
1.5.3 Recognized Holidays: RESERVED

1.5.4 Operating Hours: The Government facility office hours, facility operating hours, and the Contractor support hour requirements often coincide, however, they may differ. Please refer to the following.
1.5.4.1 Government Facility Office Hours: RESERVED
1.5.4.2 Government Facility Operating Hours: The Government facility operating hours occur two (2) hours prior to the first arrival and two (2) hours after the last departure. The Government facility (Edelweiss Lodge) is open 24 hours. The COR or alternate POC will be available for emergency contact 24hrs per day during the period of performance.
1.5.4.3 Contractor Support Hours: The Contractor shall provide support two (2) hours prior to the first arrival and up until the last departure. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. A more accurate schedule of arrival times/locations/flight itinerary and departure times/locations will be provided by the Government three (3) calendar days before arrival and two (2) days before departure, for planning purposes only. Contractor should monitor flight arrival times to identify changes in schedules and adjust transportation plans accordingly.
1.5.4.3.1 Contractor Work Plan: RESERVED

1.5.6 Place of Performance: The work to be performed under this contract will be performed at the Munich International Airport, at the Edelweiss Lodge and Resort, or local hotel, in Garmisch-Partenkirchen, at lodging venues in Munich and on safe transportation corridors between Munich (Nordallee 25, 85356 München-Flughafen, Germany) and Garmisch-Partenkirchen (St.-Martin-Straße 120, 82467 Garmisch-Partenkirchen).Transport from/to a train station in Munich or Garmisch-Partenkirchen may be required and, if applicable, will be identified in the final schedule itinerary.
1.6 Security Requirements: The following information is provided on security related matters.

1.6.3 Installation Access: Access to U.S. installations and controlled areas is limited to personnel who meet security criteria and are authorized by Host Nation law to work in that country. Failure to submit required information/data and obtain required documentation or clearances in accordance with Army in Europe (AE) Regulation 190-16 (AE Reg 190-16) Installation Access Control or (AE) Regulation 604-1 for Germany specific contracts, will be grounds for denying access to U.S. installations and controlled areas. The Contractor shall ensure that any subcontractors used in performance of this contract complies with these requirements and that all employees, of both the Contractor and any subcontractor utilized by the Contractor, are made aware of and comply with these requirements. Should anything in this paragraph conflict with AE Reg 190-16 or (AE) Regulation 604-1, the regulation takes precedent.
The Contractor shall be aware of and comply with the requirements associated with Installation Access Control. The Government is not liable for any costs associated with performance delays due solely to a firm’s failure to comply with Installation Access Control System (IACS) processing requirements.
1.6.3.1 The contractor shall provide information for drivers and vehicles as identified in 1.5.1.b. and 1.5.1.c. This information will be added to an access roster and only those names and vehicles on the roster will be granted access to Sheridan Kaserne and the Edelweiss Lodge and Resort. The contractor should immediately notify the Contracting Officer through the COR of any changes so that the access roster can be modified and to prevent any delays in the contractor’s access to the installation (Deliverable A.001), Quality Control Plan.
1.6.3.4 Common Access Cards (CAC): RESERVED
1.6.4 Background Checks: The Contractor shall provide the information, as outlined in Section 1.5.1.b.: full name of the driver (last name, first name), date of birth, place of birth, driver’s license number, national identity number (passport or Ausweiss), and Personenbeförderungsschein (Deliverable A.001), required for the U.S. Government to perform background checks on the proposed drivers..
1.6.5 Physical Security: RESERVED
1.6.6 Operations Security (OPSEC) Requirements: Contractor personnel shall adhere to facility security policies and restrictions. The Contractor shall immediately report suspicious activities to security personnel.
1.7 Key Control: RESERVED
1.8 Post Award Conference/Periodic Progress Meetings: The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
1.8.1 The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours.
1.9 Contracting Officer’s Representative (COR): Refer to Part 2 of this PWS for the definition of a COR. As determined by the Contracting Officer, a COR will be appointed and identified by letter of designation, a copy of which will be provided to the Contractor by the Contracting Officer. The designation letter states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates.
The COR is not authorized to change any of the terms and conditions of the resulting order. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is not authorized to obligate the Government. If the work is not written in the contract, the COR is not authorized to request new work. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract, perform inspections necessary in connection with contract performance, maintain written and oral communications with the Contractor concerning technical aspects of the contract, issue written interpretations of technical requirements, including Government drawings, designs, specifications, monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies, coordinate availability of Government property, and coordinate site entry of Contractor personnel.
1.10 Key Personnel: The following personnel are considered key personnel by the Government: Scheduling Manager. The Contractor shall provide a Scheduling Manager who shall be responsible for the performance of the work. The name of this person shall be provided in writing to the Contracting Officer no later than three (3) work days after contract award, or two (2) work days prior to the first movement, whichever is sooner, as part of the Quality Control Plan (Deliverable A.001). The Scheduling Manager shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The Scheduling Manager shall be available from 2 hours prior to the first scheduled movement of the day until the final movement is completed. Qualifications for all key personnel are listed below:
a. Scheduling Manager: Shall have demonstrated experience in managing the safe, secure and timely movement of at least 25 personnel. The Scheduling Manager should have knowledge of the transportation corridors between the Munich International Airport and Garmisch-Partenkirchen to be able to route and direct drivers between the two locations in the most effective manner possible to minimize delays and ensure the safety and security of the travelers.
1.11 Identification of Contractor Employees: All Contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties must identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. The Contractor shall ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.
1.12.1 RESERVED
1.12.2 Contractor Identification Badges: Contractor personnel shall be easily identifiable through the display of badges IAW Contractor Identification (AE Reg. 27-715). The Contractor (to include subcontractors) shall provide each of their employees an easily readable identification badge. The badge must include the employee’s name, the contractor’s company name, and a recent color photograph of the employee.

1.15 Data Rights: The Government has unlimited rights to all documents and materials produced under this contract.
All documents and materials, to include the source codes of software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership and copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the Contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.
1.16 Non-Disclosure Requirements: Performance under this contract may require the Contractor to access data and information proprietary to a Government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this work statement would be adverse to the interests of the Government or others. The Contractor and Contractor personnel, shall not divulge or release data or information developed, or obtained under performance of this PWS, except to authorized Government personnel or upon written approval of the Contracting Officer. The Contractor shall not use, disclose, or reproduce proprietary data, which bears a restrictive legend, other than as specified in this PWS. All documentation showing individual names or other personal information shall be controlled and protected under the provisions of the Privacy Act of 1974, Public Law 93-579, 5 United States Code (U.S.C.) Section 552a.
1.17 The use of propaganda violates DoD Commercial Use of Imagery Guidelines stated at https://www.dimoc.mil/resources/limitations/ The Contractor shall not cite any information (e.g., contract information, pictures, locations, etc.) obtained through this contract on any marketing tools to include its company website.

1.24 Authorization to Perform Services in Germany
1.24.1 Contractors performing services in the Federal Republic of Germany (FRG) shall comply with German law.
The Contractor shall determine whether performance requires registration with German authorities or authorization to do business in Germany and, if so, shall comply with all requirements. Whether or not registration or authorization to do business is required, the Contractor shall determine what documents or authorization its employees and any subcontractor employees must possess to work in Germany. The Contractor shall ensure affirmatively that its employees and subcontractor employees possess such documents or authorizations.
1.24.2 Contractor employees who: (a) are not nationals of Germany or other European Union countries; (b) are not members of the force, the civilian component or their dependents; or c) do not have assimilated status under Articles 71, 72, or 73 of the Supplementary Agreement to the NATO SOFA shall possess work and residence permits.
1.24.3 By acceptance of and performance under this contract, the Contractor affirms that it has complied with the requirements above. Compliance with this requirement and German law is a material contract requirement.
Noncompliance by the Contractor or subcontractor at any tier shall be grounds for issuing a negative past performance evaluation and terminating this contract for default.

DEFINITIONS & ACRONYMS
2. Definitions and Acronyms
2.1 Definitions: Although not inclusive of every term used within this PWS, the following provides a list of definitions used throughout this PWS and commonly used in the acquisition field.
Contracting Officer – means a person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.
Contracting Officer's Representative (COR) – As defined in DFARS 202.101, means an individual designated and authorized in writing by the Contracting Officer to perform specific technical or administrative functions. Department of Defense Instruction (DoDI) 5000.72, Part II Definitions states the following when defining a COR: “Defined in subpart 202.101 of Reference (f). Any individual delegated responsibilities pursuant to subpart 1.602-2 of Reference (e), regardless of local terminology, must be certified in accordance with this instruction. For example, local terminology can be COR, contracting officer’s technical representative, technical point of contact, technical representative, alternate COR, administrative COR, assistant COR, line item manager, task order manager, quality assurance personnel, quality assurance evaluator, or COR management.” In addition, Army Regulation 70-13, Chapter 2, paragraph 2-2g, states, in part, the following when providing support personnel to assist the COR, “…These other surveillance support personnel may serve as on-site representatives of the COR in performance of actual contract surveillance if they meet all COR requirements and have been appointed by the Contracting Officer as alternate CORs.”
Contractor – means a supplier or vendor awarded a contract to provide specific supplies or service to the Government.
The term used in this contract refers to the prime.
Contractor-acquired property - means property acquired, fabricated, or otherwise provided by the Contractor for performing a contract, and to which the Government has title.
Day – means, unless otherwise specified, a calendar day.
Defective Service – means service output that does not meet the standard of performance associated with the Performance Work Statement.
Deliverable – means anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
Government-furnished property - means property furnished to the contractor the Government and subsequently furnished to the Contractor for performance of a contract. Government-furnished property includes, but is not limited to, spares and property furnished for repair, maintenance, overhaul, or modification. Government-furnished property also includes Contractor-acquired property if the Contractor-acquired property is a deliverable under a cost contract when accepted by the Government for continued use under the contract.
Government property - means all property owned or leased by the Government. Government property includes both Government-furnished property and Contractor-acquired property. Government property includes material, equipment, special tooling, special test equipment, and real property. Government property does not include intellectual property and software.
Property Administrator - means an authorized representative of the Contracting Officer appointed in accordance with agency procedures, responsible for administering the contract requirements and obligations relating to Government property in the possession of a Contractor.
High Level Objective (HLO) – means a key overarching result-based objective for a project necessary to achieve the project’s vision. HLOs are similar to Level 2 in a Work Breakdown Structure. Each HLO may contain several statements to flesh out the areas necessary to meet the objective.
Movement – The transfer of VIP level passengers from point to point.
Physical Security – means that part of security concerned with physical measures designed to safeguard personnel;
to prevent unauthorized access to equipment, installations, material, and documents; and to safeguard against espionage, sabotage, damage, and theft.
Quality Assurance – (or Government contract quality assurance) means the various functions, including, inspection, performed by the Government to determine whether a Contractor has fulfilled the contract obligations pertaining to quality and quantity.
Quality Assurance Surveillance Plan (QASP) – means the key Government-developed surveillance process document, and is applied to Performance-Based Service Contracting (PBSC). The QASP is used for managing Contractor performance assessment by ensuring that systematic quality assurance methods validate that Contractor quality control efforts are timely, effective, and are delivering the results specified in the contract or task order. The QASP directly corresponds to the performance objectives and standards (i.e., quality, quantity, timeliness) specified in the Performance Work Statement (PWS). It provides specific details on how the Government will survey, observe, test, sample, evaluate, and document Contractor performance results to determine if the Contractor has met the required standards for each objective in the PWS. The QASP, with very few if any exceptions, is an internal to Government document.
Quality Control – means all necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
Statement – means the specific results-based activities required to satisfy HLOs. A statement contains a result, the context of the statement, and the required action(s). Statements focus on “what” is to be accomplished; however they are not prescriptive in describing “how” the outcome is to be achieved. Each HLO may have several statements to flesh out the areas necessary to meet the objective. Statements are similar to Level 3 in a Work Breakdown Structure.
Subcontractor – means one that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.
Work Day - The number of hours per day the Contractor provides services in accordance with the contract.
Work Week - Monday through Friday, unless otherwise specified.

PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. Contractor Furnished Property and Services
4.1 General: The Contractor shall furnish all licenses, certifications, personnel, and vehicles necessary to perform services as described in the PWS and associated contract documents. Contractor will be responsible for all parking fees, tolls, fuel, and any variable transportation costs.
4.2 Secret Facility Clearance: RESERVED

4.4 Vehicles and Equipment: The Contractor shall provide business class vehicles that can accommodate the comfortable transport of up to five (5) passengers and their luggage. The vehicles should be clean and compliant with all transportation and safety requirements as required by the Federal Republic of German and the State of Bavaria.
4.5 Background Checks: The Contractor shall provide Background Checks in accordance with this PWS and as determined by the Government.
PART 5
SPECIFIC TASKS
5.1 Basic Services: The Contractor shall provide services to enable the movement of 27 personnel and their staff between the Munich International and the Edelwiess Lodge and Resort in Garmisch-Partenkirchen as well as Edelwiess Lodge and Resort in Garmisch-Partenkirchen to Munich, compliant with all vehicle and transportation laws, regulations and standards. The contractor should be prepared to complete 27 movements of personnel from Munich to Garmisch-Partenkirchen and 27 movements of personnel from Garmisch-Partenkirchen to Munich for a total of 54 movements. Some of the movements can be accomplished with a sedan, but the Government anticipates use of vans for 10 movements each way for a total of 20 movements may be required.
5.2. Tasks
5.2.1 Scheduling Management
The Scheduling Manager shall be available two (2) hours prior to the first arrival and up until the last drop-off is completed. The contractor shall set up to receive passengers in accordance with the arrival list schedule. The drivers will meet the Government escort at the time and location identified in the schedule and will wait for the personnel and their staff to arrive.
5.2.1.1 Scheduling Manager: The Scheduling Manager shall, consistent with the Quality Control Plan, develop a comprehensive movement control plan (Deliverable A.003) (Due 24hrs after receipt of arrival list schedule) to satisfy all movement requirements. The movement control plan shall include:
a) Schedule Movement from Munich to Garmisch-Pertenkirchen: Develop a schedule of departure from the arrival terminal based on actual arrival time and party size (actual arrival could be earlier or later than scheduled). The departure time should consider at least 30 minutes from arrival to the passenger’s exit from the terminal. Passengers should not wait more than 30 minutes for departure after exiting the arrivals terminal. The scheduling manager should monitor actual arrival times to identify changes and adjust schedules as appropriate and to avoid additional costs. The schedule should also consider unexpected delays in the passenger’s exit from the terminal.
b) Driver Assignments: Assign driver and vehicle to each movement and rendezvous with U.S. Escort:
identify location for driver to make contact with the U.S. escort. This should be at the arrival terminal corresponding with the flight arrival schedule. (NOTE: A U.S. escort may not be assigned to each movement from Munich to Garmisch-Partenkirchen). The contractor shall be prepared to adapt with vehicles and drivers to respond to unexpected schedule changes.
c) Schedule Movement from Garmisch-Partenkirchen to Munich: Develop a schedule of departure from the Edelweiss Lodge and Resort, or local hotel in Garmisch-Partenkirchen, to a hotel in Munich or the Munich International Airport. (The Government will provide departure times preferred by passengers with the final destination. A U.S. escort will not be assigned to these, return, movements. The schedule shall include an estimated arrival time at the final destination. The vendor should account for a possible delay of about an hour for the first scheduled departures due to conference termination.
d) Movement Management: The Scheduling Manager shall monitor transportation corridors, alert drivers of diversions and recommend alternate routes to ensure the safe, secure, and timely movement of passengers and to minimize delays.
