Attachments related to a Quoter’s experience will not count against the page limitation listed in the table above.
2) "Recent" is defined as the efforts that are completed or ongoing during the past five (5) years prior to the issue date of this Solicitation.
3) "Relevant" is defined as similar work contemplated under this Solicitation with respect to scope, type of work, and value. The minimum value for each reference sheet submitted shall be minimum annual value of EURO 50,000.00.
4) The Government is not bound by a quoter’s opinion of the relevance of its organization experience.
e. VOLUME III – FACTOR II - PRICE
i. Quoters shall utilize the Price Book 1 (Attachment 1) to calculate pricing for each CLIN.
In Attachment 1, the Quoter shall fill in the yellow-highlighted cells on each worksheet, and all other amounts will be automatically calculated.
ii. NOTE: For “On-Call Repairs” (CLINs 0003, 1003, 2003), the offeror will fill in its proposed labor rate, and that labor rate will be automatically multiplied by the Government’s estimated on-call labor hours, which has been pre-filled in by the Government.
iii. Quoters are not required to propose an amount for “On-Call Materials” (CLINs 0004, 1004, 2004) as the estimated, not-to-exceed amount for each year of performance has been pre-filled by the Government. The Offeror will submit a completed copy of Price Book Attachment 1 with its proposal. Do not alter or tailor the spreadsheets or change any formulas. Do not lock or protect the excel worksheets or submit them in pdf format.
It is not the Government’s intent to change any entries, but to assist in calculations. The Quoter is solely responsible for ensuring any formulas or calculations within the price book or any other submitted document/file are correct prior to submission to the Government. Quoters must ensure there are no rounding errors to the nearest cent.
iv. Quote shall provide a firm fixed price for CLIN 0005, which pertains to the replacement of the old burner system in accordance with Paragraph 5.2.7 in the PWS. See Exhibit B Specifications for specifics regarding the burner replacement.
v. The Quoter shall fill-in its proposed prices in the “Schedule Supplies/Services” section of the SF 1449 for all CLINs, as calculated by Price Book Attachment 1.
f. The completion and submission to the Government of the above items will constitute the quote.
The quote shall communicate the Quoter’s unconditional assent to the terms and conditions in this solicitation, including any attachments and documents incorporated by reference. The Quoter’s failure or refusal to assent to any of the terms and conditions of this solicitation or the Quoter’s imposition of additional conditions or any material omission in its quote may constitute a deficiency that will make the quote unacceptable to the Government. The Government reserves the right to permit Quoter to revise their quote if in the Government’s best interest.
g. All information shall be confined to the appropriate volume. The Government will not consider information found in other volumes. Quoters shall confine submissions to essential matters, sufficient to define the quote and provide adequate basis for evaluation. Quoters are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of their quote. Proprietary information shall be clearly marked.
h. If a quotation is missing any of the elements listed in this RFQ, the quotation may be deemed to be “unacceptable” and may not be evaluated further. The Government may also determine a quote “unacceptable” if the offeror takes any exceptions to the terms and conditions of the RFQ or imposes conditions.
8. Para (c) Period for acceptance of offers, is hereby revised as follows: "The Offeror agrees to hold the prices in its quote firm for 90 calendar days from the date specified for receipt of offers."
9. Para (d) Product Samples. This paragraph does not apply.
10. Para (h) Multiple Awards. This is amended as to state that only one award will be made from this solicitation.
11. Para (i) Availability of Requirements document cited in the solicitation. This paragraph does not apply to this solicitation.
12. The following is hereby added: Para (m) System for Award Management (SAM). Per FAR 4.1102, prospective Contractors shall be registered in System for Award Management (SAM) database prior to award of a contract or agreement.

CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV
2021)
(a) The Government will award a single contract resulting from this solicitation to the lowest priced technically acceptable (LPTA) responsible Quoter whose quote conforms to the solicitation in accordance with FAR 13.106. Quotes that do not conform to the requirements of the solicitation may be rejected without further evaluation or clarifications. The following factors shall be used to evaluate quotes:
Factor I - Technical Approach;
Subfactor A - Qualifications / Key Personnel
Subfactor B – Experience
Factor II - Price
1. A rating of no less than “Acceptable” must be achieved for all non-price factors and sub-factors. Receiving a rating of “Unacceptable” in any of the non-price evaluation factors and sub-factors as listed above will result in an overall technical rating of “Unacceptable". The non-price evaluation will consist only of determining the acceptability of each quote. Quotes will not be ranked based on the acceptability evaluation.
2. The Government intends to evaluate quotes and award a contract without exchanges.
Therefore, each initial quote should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct exchanges if determined to be in the Government’s best interest or determined necessary by the Contracting Officer.
3. EVALUATION APPROACH:
i. VOLUME I
OFFER AND REPRESENTATIONS AND CERTIFICATIONS: To be rated “acceptable”, the Quoter shall ensure all documents, representations, certifications, attestations, and information requirements listed for Volume I in FAR 52.212-1 are submitted with the quote package.
ii. VOLUME II
a. Factor I – Technical Approach The Government will evaluate this factor for acceptability to determine the Quoter’s understanding of the solicitation (clauses, provisions, PWS) and its ability to meet all contractual requirements based on the Quoter’s technical capabilities. Technical capability statements may include narratives, charts, graphs, pictures, tables, drawings, service literature, or other documents that discuss the Quoter’s capabilities, methods, and understanding to successfully perform the requirements listed in the PWS. A technical quotation which is primarily a copy-and-paste version of the PWS document for the solicitation requirements will be deemed “unacceptable” without further review of the quotation for award. If quotes are more than fifteen (15) pages, only the first 15 pages of the quote will be evaluated (see exceptions in addendum to FAR 52.212- 1).
b. Subfactor A – Qualifications / Key Personnel The Government will evaluate this factor for acceptability to determine the Contractors ability to provide properly qualified, certified, and experienced personnel to meet all of the requirements within the PWS (paragraph 1.10).
Quoters shall submit:
1. Documentation certifying it is licensed as a specialized company in accordance with para 19 (1) German Water Conservation Law (Wasserhaushaltsgesetz (WHG)),
2. Documentation to certify it is registered with the Chamber of Trade (Handwerkskammer) or the Chamber of Commerce (Industrie-und Handwerkskammer (IHK), or equivalent.
3. Documentation, or shall attest in writing, that it maintains industry standards and will provide technicians who are meet all of the qualifications listed in the PWS and FAR 52.212-1.
4. Resumes, or other documentation, demonstrating the proposed employees for “key personnel” position meet the minimum qualification listed in paragraph
1.10.2 of the PWS.
A Quoter that fails to provide the documentation required under this subfactor will be deemed “UNACCEPTABLE” and ineligible for award.
c. Subfactor B – Experience:
This subfactor shall be rated “acceptable” if the Quoter can provide at least two (2), but no more than three (3) relevant, and recent, contracts that demonstrate satisfactory work performed of the same size and scope as this procurement.
“Recent” is considered work performed in the past five (5) years. “Relevant” means work similar to what is required within the PWS of this solicitation in terms of complexity, length of performance, scope, and a minimum annual value of EURO 50,000.00.
All experience submissions must be based upon the criterial listed above and include all information requirements listed in the submission instructions to be considered “acceptable”. An offeror that fails to identify a minimum of two (2) relevant and recent reference contracts that clearly shows that the Offeror has provided services relevant and recent to those required in the PWS will be deemed “UNACCEPTABLE” and ineligible for award.
iii. VOLUME III
Factor II – Price: After determination of technical acceptability, each quote will be evaluated, and award made to the lowest Total Evaluated Price (TEP) quote.
The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. To account for option period(s) possible under FAR Clause 52.217-8 (maximum six months), Option to Extend Services, the Government will take the price for all CLINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount will be the TEP. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise options. The successful Quoter will be contractually bound to all proposed prices and rates.
iv. Supplier Performance Risk System (SPRS): In accordance with Defense Federal
Acquisition Regulations (DFARS) 204.76, the Government is required to utilize SPRS risk assessments for quotations or offers in response to solicitations for supplies and services, to include solicitations using FAR Part 12 procedures for the acquisition of commercial products and commercial services, unless excepted by Department of Defense Instruction (DoDI) 5000.79, Defense-wide Sharing and Use of Supplier and Product Performance Information. The SPRS retrieves item, price, quality, delivery, and contractor information from contract in Government reporting systems in order to develop risk assessments of Contractors. While not a formal evaluation factor for the purposes of this procurement, the KO shall consider price risk and supplier risk, if available in SPRS, as part of the award decision. Quoters without a risk assessment in SPRS shall not be considered favorably or unfavorably. See DFARS Provision 252.204-7024 Notice on the Use of the Supplier Performance Risk System, for details.
