5139.101-90 Policy.

(a) Commercial information technology hardware and software.

(1) The Army’s Computer Hardware, Enterprise Software and Solutions (CHESS) program, under the Program Executive Office Enterprise Information Systems, is the mandatory source for commercial information technology (IT) hardware and software purchases. CHESS contracts provide IT products and services that comply with U.S.

Army Network Enterprise Technology Command, Army and DoD policy and standards.

Purchasers of commercial hardware and software must satisfy their IT requirements by utilizing the CHESS contracts and DoD Enterprise Software Initiative (ESI) agreements first, regardless of dollar value or appropiation. Additionally, purchasers of IT requirements through a third party such as a system integrator must ensure solicitations and contract vehicles include the requirement to purchase through the CHESS and the DoD ESI agreements.

(2) Any IT hardware or software purchase made outside of the CHESS contracts requires an Army Chief Information Officer (CIO)/G6 approved Information Technology Approval System (ITAS) Waiver, unless the purchase meets one of the exceptions in (a)(3) below. The ITAS Waiver along with supporting documentation shall be part of the procurement package submitted to the contracting officer and shall also be part of the resulting solicitation and contract file(s). Supporting documentation must include documentation submitted with the ITAS Waiver request such as a CHESS Statement of Non-Availability (SONA) for items that are not available from CHESS or other rationale for not using CHESS. The CHESS website located at http://chess.army.mil provides a complete list of CHESS contracts as well as information concerning ITAS Waivers and CHESS SONAs. The ITAS Waiver website is located at https://www.eprobe.army.mil/enterprise-portal/web/itas/home, and the Army CIO/G6 policy page is located at http://ciog6.army.mil/PolicyLegislation/tabid/64/Default.aspx.

(ix) The provision at 52.212-2, Evaluation -- Commercial Items, is applicable. The evaluation criteria to be included in paragraph (a) of that provision are:

See FAR 52.212-2 Evaluation of Offers—Commercial Items ADDENDUM for evaluation factors.

(x) Include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. (This clause does not have to be completed if you are registered in SAM at https://www.sam.gov)

(xi) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition.

(xii) The clause at 52.212-5 (DEV), Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition.

The following additional FAR and DFAR clauses are applicable to the acquisition:

FAR 52.212-1 Instructions to Offerors—Commercial Items ADDENDUM.

This addendum replaces provision FAR 52.212-1 in its entirety.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation via email to eric.l.kirkpatrick.mil@mail.mil with courtesy copy to william.r.dunmire.civ@mail.mil at or before the exact time specified in this solicitation. Offers shall be submitted using the CLIN structure in paragraph (v) of this combined synopsis and solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, telephone number and email address of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR

52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 45 calendar days from the date specified for receipt of offers.

(d) N/A

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.

(2) Any offer, modification, revision, or withdrawal of a offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition.

(g) Issuance of Contract. The Government intends to evaluate offers in accordance with FAR

13.106. The Government will not use the formal source selection procedures described in FAR Part 15. The Government may issue a purchase order to other than the offeror with the lowest priced offer. After the evaluation of offers, the Government may negotiate final terms with one or more offerors of the Government’s choice before issuing any contract.

(h) Multiple contracts. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise.

(i) Contractor and Government Entity (CAGE) Code or NATO Contractor Government Entity (NCAGE) Code. The offeror shall enter its CAGE or NCAGE code in the block with its name and address on the cover page of its offer, in accordance with FAR 52.204-16.

(j) Data Universal Numbering System (DUNS) Number. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the offeror’s name and address. The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. A offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. A offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is a offeror for a Government contract when contacting the local Dun and Bradstreet office.

(k) System for Award Management. Unless exempted by the Contracting Officer, the offeror shall be registered in the SAM database prior to issuance of purchase order, during performance and through final payment. If the offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

(l) Requests for Information: The Contracting Officer will not notify unsuccessful offerors.

Offerors may request information on purchase order(s) resulting from this solicitation.

(End of provision)

FAR 52.212-2 Evaluation of Offers—Commercial Items ADDENDUM.

This addendum replaces provision FAR 52.212-2 in its entirety.

(a) The Government will issue a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered, in accordance with FAR 13.106. The following factor(s) shall be used to evaluate offers:

1. Technical

i. Completeness and adequacy of the design submitted.

ii. Proposed schedule

iii. Recency, relevance, and scope of three (3) past projects completed within the last three (3) years

2. Past performance, to include a review of available information in CPARS, PPIRS, and other information systems available to the US Government.

3. Price

(i) Additive items

(A) At the time of evaluation of offers, the Government will determine the amount of funds available for the project.

(B) The low offeror shall be the Offeror that—

(1) Is otherwise eligible for award; and

(2) Offers the lowest aggregate amount for CLIN 0001, plus those additive items that provide the most features within the funds determined available.

(ii) The Contracting Officer shall evaluate the price of all offers on the basis of the same additive items.

(A) If adding another item from the list of additive CLINs would make the award exceed the available funds for all offerors, the Contracting Officer will skip that CLIN and go to the next item from the list of additive CLINs; and

(B) Add that next item if an award may be made that includes that CLIN and is within the available funds.

Award will be made on the basis of technical, past performance, and price.

(c) Notification. For acquisitions for which automatic notification is not provided through an electronic commerce method that employs widespread electronic public notice, notification to unsuccessful offerors shall be given only if requested or required by FAR 5.301.
