SECTION 00 72 00 - CONTRACT CLAUSES

The following have been modified:

52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995) – ALTERNATE I (FEB 1995)

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

(b) An organized site visit has been scheduled for-- 18 March 2021 at 0900

(c) Participants will meet at-- Tenkiller Powerhouse

All in-person visitors will be required to follow CDC guidelines for manufacturing and all visitors will be screened for COVID-19 symptoms. Visitors will be required to certify in the English language they do not have symptoms including cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, and new loss of taste or smell in the past 24 hours. Visitors body temperature may be checked prior to entry into the plant to identify anyone with a temperature of 100.4°F or greater (or reported feelings of feverishness). Visitors will be denied entry if exhibiting any of these symptoms. Visitors will be checked for appropriate PPE including hard hat, safety boots, and face covering. Once admitted into the plant, visitors must maintain a social distance of six (6) feet from one another and their assigned escort. Cameras and cell phones will be permitted in most areas, but visitors must not photograph security features of the plant. Visitors must always remain with their assigned escort. All questions shall be addressed in writing on the Projnet website as described in paragraph 1.4 of Section 00 21 00, Instruction to Offerors.

Requirements to Attend the Site Visit In-Person Site Walk: Only registered persons will be permitted to attend the site visit in-person site walk. Only two persons from each business entity will be permitted to attend, and the site walk will be conducted with a maximum of 6 participants at a time.

U.S. Citizens:

To register, U.S. citizens interested in attending the site visit in-person site walk must submit a "SWT US Citizen Pre-Proposal Site Visit Request Form" to Shawn Brady, e-mail shawn.brady@usace.army.mil, no later than two (2) full business days prior to the site visit. If submitting the form in less than two days, the person may not receive approval for participation. Notification of approval or denial will be provided prior to the date of the site visit. The form is a pdf attachment on this amendment and is titled “SWT US Citizen Pre-Proposal Site Visit Request Form”.

Foreign Nationals (FNs):

FNs wishing to attend the in-person site walk shall request a “SWT Foreign Nationals Pre-Proposal Site Visit Request Form” from Shawn Brady by email to shawn.brady@usace.army.mil. Once the form is received and filled in, the form must be returned along with legible color copies of two of the following documents: Passport (unexpired or expired), Certificate of U.S. Citizenship (INS Form N-560 04 N-561), Certificate of Naturalization (INS Form N 550 or N-570), unexpired foreign Passport with I-551 stamp or attached INS Form I-94 indicating

unexpired employment authorization, an Alien Registration Receipt Card with photo (INS Form I-151 or I-551), unexpired Temporary Resident Card (INS Form I-688), unexpired Employment Authorization Card (INS Form I- 688A), unexpired Reentry Permit (INS Form I-327), unexpired Refugee Travel Document (INS- Form I571), or unexpired Employment Authorization Documentation issued by the INS which contains a photograph (INS Form I- 688B) to Shawn Brady, by encrypted email to shawn.brady@usace.army.mil. These documents must be submitted and approved prior to visitation. Because of the current U.S. COVID-19 travel situation, additional processes requirea waiver from the Department of Homeland Security for FNs who are not already in the U.S. For a waiver, the FN would already need to have an approved VISA in their passport. USACE is not responsible for coordinating travel or travel waivers.

There is currently an additional process that requires a waiver from the Department of Homeland Security for FNs who are not already in the US. For a waiver, the FN would already need to have an approved VISA in their passport as there is currently a Presidential Proclamation against issuing new VISAs. FNs DO NOT reserve travel until a waiver has been approved, otherwise the FN will not be allowed to board an aircraft from their current overseas location.

AUTHORITY: Information is solicited pursuant to Title 10, U.S. Code, Section 3013 and E.O. 9397.

PRINCIPAL PURPOSE: To provide information necessary for preparation of a scheduled visit of the facility, verify positive identification of visitor(s), and conduct background checks for determinations of the eligibility of individuals for access to U.S. Army Corps of Engineers facilities.

ROUTINE USES: Used by the U.S. Army Corps of Engineers to accompany a request for a scheduled tour of the facility.
