1.0 OVERVIEW
1.1. A pool of up to five (5) MATOCs will be awarded through FAR Part 15, One-Step Best Value “Trade-Off” Source Selection. When combined all non-cost factors are significantly more important than price. The Government is concerned with achieving the most advantageous balance between technical merit (quality) and price.
The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor.
1.2. The MATOCs are Indefinite Delivery Indefinite Quantity contracts as defined in FAR 16.504. Services will be provided by Firm-Fixed-Price (FFP) Task Orders (TOs). Only the Tulsa District shall issue Task Orders against this contract unless specifically authorized by a Tulsa District Contracting Officer.
1.3. Each MATOC will be a five (5) year contract (three (3) year base plus two (2) one year options). The Government is under no obligation to issue any Task Orders in excess of the minimum contract obligation of $3,000.00. The shared sum of all Task Orders among the MATOCs (total contract capacity) shall not exceed the estimated amount of $49,500,000.00.
1.4. General Description of Work: This MATOC will support a wide range of design-bid-build (DBB) requirements to include but not necessarily limited to projects for new utilities, relocation of existing utilities, maintenance, repair, and rehabilitation of roads and other paved surfaces, small inhabitable structures, revetment and shoreline protection, small concrete outlet work and control structures, foundation drainage systems, and other ancillary features that support flood control and navigation infrastructure. Disciplines and related work requirements may include, but not limited to: (1) Civil Construction and Related Activities. Construction surveying, grading and earthwork, dredging, surface and subsurface storm drainage and drainage control structures, storm water management, erosion and sediment control, shoreline protection, clearing and grubbing, paving and surfacing for roads, parking areas, and sidewalks, parking layout, pavement markings, traffic control and signage, gates and fencing, curbs and gutters, railroads, dewatering, landscaping, seeding, sprigging, and sodding, riprap and stone protection, retaining walls, buried structures, slope stabilization, foundations, borings, trenching, berms and utility relocation; (2) Structural Construction and Related Activities. Rehabilitation or replacement of concrete structures associated with flood control or navigation infrastructures; and (3) Utilities. Sanitary sewers, lighting, and installation or relocation of other utilities as required for road repair and rebuilding or other site work.
1.5. Location of Work: Projects may be located anywhere within the USACE Tulsa District Boundaries, which for Civil Works includes all of Oklahoma, and portions of Texas and Kansas.
1.6. Upon receipt of a task order, the Contractor shall provide all labor, materials, supplies, parts (to include system components), plant, supervision, equipment, and related services (except when specified as Government furnished), to perform the work as specified. Contractor’s work and responsibility shall include all Contractor planning, programming, administration, and management necessary to provide all work as specified. The Contractor shall conduct all work in strict compliance with the contract and all applicable Federal, State, and local laws, regulations, codes, and directives. The Contractor shall provide related services such as preparing and submitting required reports, performing administrative, and submitting necessary information as specified under this contract and within each task order. The Contractor shall ensure that all work provided meets the requirements of the base contract and the individual task orders scope of work to include any drawings, specifications, or other applicable document issued with the task orders.
2.0 BASIS OF AWARD
2.1. The Contracting Officer intends to award a pool of no less than three (3) but no more than five Indefinite Delivery Indefinite Quantity MATOCs from this FAR Part 15 One-Step Best Value “Trade Off” Source Selection.
2.2. The intent of the solicitation is to obtain the best proposal for the work within the solicitation to not only include the specific seed task order, but also for anticipated work identified in paragraph 1.4 “General Description of Work”.
2.3. The Government reserves the right to accept other than the lowest price offer, or to reject all offers.
2.4. The Government will not award a contract to a Firm whose proposal contains a deficiency, as defined in
FAR 15.001.
2.5. After the Source Selection Evaluation Board’s evaluation of the Offeror’s Technical Proposals is complete, a matrix will be prepared listing the following for all Offerors:
a) Overall Rating for Factors 1, 2, and 3, including proposal risk rating
b) Overall Consensus Rating for the Technical Proposal
c) Overall Proposal Risk for the Technical Proposal
2.6. After Price Analysis has been performed on each Offeror’s Price Proposal for the Seed Task Order, the price will be added to the Matrix.
2.7. Award of the MATOCs will be made through comparative analysis of the evaluated ratings for Factors 1, 2, 3, and 4. The Source Selection Authority (SSA) will determine which Offerors best conform to the a firm fixed-price contract to the responsible Offeror whose proposal the Source Selection Authority determines conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, considering all non-price factors described herein, and price. All evaluation factors, other than price, when combined, are considered significantly more important than the price.
2.8. After award of the MATOCs, the Seed Task Order will be awarded to one of the MATOCs through a comparative analysis between the evaluation of Factor 3 and the price proposed in Factor 4 for all of the MATOCs (i.e. trade off). The SSA will determine which MATOC best conforms to the solicitation (Factors 3 and 4), is fair and reasonable, and offers the best overall value to the Government.

5.0 VOLUME 1 – FACTOR 1 – PERFORMANCE CAPABILITY FOR MATOC
5.1. VOLUME 1 – TAB B: SUBFACTOR 1 – SPECIALIED EXPERIENCE
5.1.1. Submission Requirements:
5.1.1.1. The Offeror shall demonstrate recent, relevant experience on similar projects using the Company – Specialized Experience Form – Attachment 1 at the end of this section. Offerors may identify state and local government as well as private contracts that are similar to the Government’s requirements as outlined in paragraph
1.4 of this section. If the Offeror is a joint venture or teaming arrangement, each firm shall provide information, demonstrating experience relevant to their role on this project. Offeror shall provide a copy of the joint venture agreement or letters of commitment from all teaming contractors and / or subcontractors (agreements and letters of commitment will not count towards the page limitation). Contractors other than the prime to include key subcontractor’s experience will not be considered without the required agreements or letters of commitment.
Offeror shall submit projects that are currently underway and at least 50% complete or completed and turned over no longer than five (5) years preceding the date of this solicitation. If any firm has multiple functions or division, limit the project examples to those performed by the division or unit submitting the offer or by the team member.
5.1.1.2. Prime contractor must submit at least one relevant project involving civil works construction as described in the General Description of Work for this MATOC (paragraph 1.4), with a value of $3,000,000.00 or greater; the remainder of the projects submitted to demonstrate the experience of the prime shall be at least $500,000.00 in value. The prime contractor must submit a minimum of three (3) projects.
5.1.1.3. The Offeror may at their discretion submit up to eight (8) total projects (inclusive of the 3 mandatory projects identified in paragraph 5.1.1.2) either completed by the prime contractor or key team members / subcontractors. Key team members and subcontractors shall also utilize the Company – Specialized Experience Form – Attachment 1 at the end of this section. Letters of Commitment from key team members / subcontractors must be provided for their specialized experience to be considered in the evaluation for this subfactor.
5.1.1.4. The Offeror may provide supplemental narrative (not project lists), not to exceed two (2) pages, explaining how any corporate experience that is not directly related to specific projects above is applicable to this MATOC, and how the Government will benefit.
5.1.1.5. The Offeror should include in the supplemental narrative any previous experience between current team members, if not described in the submitted Company – Specialized Experience Forms. The above information is limited to projects that are well underway or that have been completed and turned over no longer than the past five
(5) years preceding the date of this solicitation.
5.1.2. Evaluation Criteria:
5.1.2.1. The Government will evaluate the extent of recent experience of the prime contractor as relevant to their role on this project. Experience on the similar projects identified in the project lists will receive more consideration than experience provided in the supplemental narrative. The Government will place greater importance on projects performed as a prime contractor than as a subcontractor, depending upon overall role and relevancy considerations.
5.1.2.2. The Government will evaluate the extent of recent experience of the proposed key team members as relevant to their role on this project. Experience on the similar projects identified in the project lists will receive more consideration than experience provided in the supplemental narrative.
To determine strengths and weaknesses, the agency will give more consideration to the following:
a. Projects constructed for the Corps of Engineers.
b. Projects with a value of $3 million or greater.
c. Fully completed projects rather than substantially complete projects.
e. Projects completed after 2017.
f. Projects that demonstrate experience of the team members commensurate with their proposed role on this project.
5.1.2.3. The Offeror shall submit the requested information to demonstrate a record of recent, related experience, for the project types (which may include similar state or local government or private counterparts) included in this contract, as described in this section. Recent experience includes projects well underway (see above criteria) or those completed and turned over within five (5) years of the proposal issue date for this RFP. Joint Venture partners or teaming partners should each demonstrate experience commensurate with their role on this project or explain in the supplemental narrative how their experience qualifies them for their role on this project. If any of the information required is not included in the forms (Attachment 1), then the Contractor will be considered non-responsive and evaluated as unacceptable.
5.1.2.4. The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing Past Performance Information Retrieval System (PPIRS), Construction Contractor Appraisal Support System (CCASS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), other databases; or interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency or to interview owners or references.
The Government may check any or all cited references to verify supplied information.
5.1.2.5. To receive credit for extent (amount) of experience, the Offeror shall demonstrate a history of recent, relevant experience. A firm will not receive credit under this subfactor for the relevant experience of key personnel proposed for this project. If Offeror represents the combining of two or more companies for the purpose of this RFP, the proposal shall clearly identify the contractual responsibilities of each firm and the work to be performed by each; describe the nature of the association; indicate whether the firms have experience working together in construction ventures, including how long and how many projects. In addition, each company, including joint ventures, shall list their Government contract experience. Provide a copy of the commitment letter of the firms (see Attachment 5) or the Joint Venture Agreement.
5.1.2.6. The Government will consider extent of recent experience, degree of relationship of such experience to this project, demonstrated familiarity with applicable codes and local conditions. Some examples of relevancy to this project may include, but not be limited to:
1) Number, size, type work, complexity, location
2) Dates (well under way or completed no more than five (5) years preceding date of Solicitation)
3) Firm's role and extent of work self-performed (brokering out all work and simply “placing the sidewalks” on a cited project are examples of less relevant experience)
5.1.2.7. The Government will consider the breadth of experience of the Offeror. Offerors that are able to demonstrate specialized experience in multiple project types referenced in paragraph 1.4 above will receive more consideration than offerors that only demonstrate experience in one of the referenced project types.
5.1.2.8. The Government may consider previous recent teaming experience among the team members, JV partners or key teaming subcontractors, as value added, even if on different construction projects than this project. The more relevant the experience, the more credit will be given.
5.1.2.9. If because of reasons beyond the control of the Offeror, the proposed team members to include subcontractors named in this proposal are not able to participate as identified, replacement team members or subcontractors for this project shall be required to have qualifications and experience meeting or exceeding those identified in the proposal. Replacements shall be presented for acceptance and approval by the Contracting Officer.
5.2. VOLUME 1 – TAB C: SUBFACTOR 2 – KEY PERSONNEL
5.2.1. Submission Requirements:
5.2.1.1. Offeror shall provide resumes for key personnel involved in the overall management of the Civil Works MATOC; including team members, which demonstrate the qualifications necessary for this project, which includes proposed role, relevant education and training; and previous relevant experience in similar type work, to manage, control and perform construction. Resumes shall include detailed experience in proposed role, relevant education & training, total relevant experience. Clearly indicate whether each individual has had a significant role in any of the cited project examples from Sub-Factor 1. If re-assignment of personnel is considered possible, provide alternate professionals in each assignment. For each person provide a brief resume, using the Key Personnel Resume forms (Attachment 3) at the end of this section, minimum years of experience must be verifiable, with example projects from the present back the minimum number of years, to include dates of work performed. 5.2.2.2. The Government will give additional consideration to key personnel that have demonstrated experience on projects same / similar to those contemplated with the General Description of Work in paragraph 1.4 of this section.
5.2.2.3. Minimum Qualifications of Key Personnel Include:
a. Program / Project Manager – Bachelor’s degree and 5 years construction experience
5.2.2.4. To determine strengths and weaknesses, the Government will take the following into consideration with respect to key personnel. This list is not necessarily all-inclusive:
a. Proposed Key Personnel who exceed the qualifications described above.
b. Key Personnel that worked on projects used to demonstrate specialized experience under Subfactor 1.
c. Key Personnel that demonstrate experience in the same role proposed for this MATOC on projects same / similar to those described in the Description of Work in paragraph 1.4 of this section.
5.2.2.5. If alternates are proposed for key positions, the evaluation rating will consider the lesser qualified or experience individual, if there is a difference.
5.2.2.6. If because of reasons beyond the control of the Offeror, the key personnel named in this proposal are not able to participate as identified, replacement personnel for this MATOC shall be required to have qualifications and experience meeting or exceeding those identified in the proposal. 6.0 VOLUME 1 – TAB E: FACTOR 2 – PAST PERFORMANCE
6.1. Submission Requirements:
6.1.1. General Submission Requirements
6.1.1.1. There is no page limit for this factor. For each of the projects submitted under Factor 1, to ensure the agency has all relevant past performance information, the offeror shall submit copies of Federal/DoD/Navy/Army performance reviews that are likely already in the agency’s databases or likely within the agency’s arm’s reach, i.e.
Contractor’s copy of CCASS or CPARS evaluations.
6.1.1.2. For each project under Factor 1 that does not have a CPARS evaluation, offerors shall provide a Past Performance Questionnaire form PPQ-0 (Attachment 2) to a representative of the owner that can provide the owner’ s opinion of the offeror’ s past performance for the project. The Past Performance Questionnaire (Form PPQ-0) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1. Ensure correct phone numbers and email addresses are provided for the client point of contact. Offerors should organize all Past Performance Information based on the Factor 1 Projects, which normally have project titles and are numbered 1-8, so that reviewers can match the owner’ s opinion with the corresponding Subfactor 1 Project. If a PPQ currently exists, it must have been completed within the last year.
6.1.1.3. Form PPQ-0 at Attachment 2 shall be utilized and offerors shall submit the PPQ with their proposal submission to the Contracting Office designated proposal submission location. The contract specialist or Contracting Officer will not require the PPQ to be sent directly from the client. The offeror may submit the completed PPQ-0.
Completed Past Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.
If the client requests, questionnaires may be submitted directly to the Government’ s point of contact, Rudolpho Morales via email Rudolfo.Morales@usace.army.mil prior to proposal closing date. If you have questions regarding the attached questionnaire, or require assistance, please contact the Contract Specialist at (405) 869-2617.
6.1.1.4. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.
6.1.1.5. The offeror is responsible for ensuring that the completed questionnaires are submitted by the closing date.
6.1.1.6. The Government will evaluate the responses from the customers from which Past Performance Questionnaires have been received. The Government may contact and interview points of contact on the Past Performance Questionnaires. The Government reserves the right to interview other individuals acting for the listed references, if the listed reference is not available. In addition to the above, the Government may review any other sources of information for evaluating past performance.
