Types of wastes to be managed may include, but not be limited to petroleum-oil-lubricant (POL), toxic waste as defined by Toxic Substances Control Act, freon, and polychlorinated biphenyls.
1.2 APPLICABLE WORK LOCATIONS.
This contract is meant to address Department of Defense (DoD) and other Federal Government customer requirements primarily within the SWD area of responsibility. However, it is anticipated that the contract will be predominantly used at Fort Bliss, Texas and New Mexico. Contract capacity may be shared with other CONUS geographic districts where the principles of the Project Management Business Process and ER-1-10 have been met. The geographic territory for this contract will include the geographic boundaries of the SWD and projects assigned to SWD including any of a variety of military installations, Federal agencies, and civil work entities where the USACE is otherwise authorized to respond. The Contractor shall provide environmental support as requested in the task orders (TOs) issued under this contract. This contract requires the Contractor to perform all work necessary to complete simultaneously executed TOs.
Note that the term “installation” is generically used within this Performance Work Statement (PWS) to refer to any potential location, agency, or facility as discussed above, that a TO may be awarded to/for under this contract. The Contractor may be required to perform tasks on-site or at their own facilities.
1.3 TECHNICAL REQUIREMENTS.
The general technical requirements specified in this PWS are intended to provide requirements for execution of the contract and an overall understanding of the functions that the Contractor may be required to perform. Specific services required under this contract will be described in detail within individual PWSs for each TO. The USACE will prepare the specific PWS for each TO. However, the Contractor may be required to provide input to support the planning, scheduling, and formulation of the USACE's PWS. Individual TOs will contain additional detailed requirements and/or plans and specifications for each specific project. The Contractor may also receive available data and work products from past environmental activities performed by other Contractors and/or government personnel.
1.4 GENERAL REQUIREMENTS.
The Contractor is required to furnish all plant, labor, materials, and equipment to provide environmental services at project locations, unless otherwise directed by individual TOs. The Contractor's personnel shall comply with Occupational Safety and Health Administration (OSHA) requirements. The Contractor shall provide all support activities, described herein or in individual TOs, necessary to ensure the safe and effective accomplishment of project criteria within specified completion times. All work will be performed in accordance with this contract, applicable Federal, State, and local installation regulations.
1.5 TASK ORDER REQUIREMENTS AND PERIOD OF PERFORMANCE.
TOs will be issued on a standard firm-fixed price (FFP) basis or may be issued as FFP performance-based TOs. For performance based TOs, the Contractor shall be responsible for developing technical and management approaches that directly satisfy the Government’s TO objectives, including working with and maintaining good working relationships with regulators on all aspects of their work. As will be detailed in specific TOs, the USACE and its customers will review and comment on all documents prior to their submission to the regulatory agencies.
Any TO issued during the effective period of this contract and not completed within that period of that contract, shall be completed by the Contractor within the time specified in the TO. The Contract shall govern the Contractor's and Government's rights and obligations with respect to that TO's Period of Performance.
2.0 GENERAL CONTRACT INFORMATION.
2.1 CONTRACT TYPE.
This is a competitive 8(a) indefinite delivery single award task order contract to collect and/or haul hazardous, non-regulated, and universal wastes within a local area, and/or operate hazardous waste transfer stations, and or manage hazardous waste operations as discussed in section 1.1, and it is effective for a period of 5 years from the date of award of the contract if all options are exercised.
2.2 DELIVERY.
Delivery or performance will be made only as authorized by TOs issued in accordance with each ordering clause. The Contractor shall furnish to the Government, when and if ordered, work for the items specified in individual TOs. There is no limit on the number or size of orders that may be issued, and the Government may issue concurrent orders requiring delivery to multiple destinations or performance at multiple locations.
2.3 COMMENCEMENT OF WORK.
The Contractor shall be required to commence the work required by a TO at the time specified on the TO, execute the work, and complete the entire project not later than the completion time specified on the TO.
Unless identified otherwise or modified in the individual TOs, all services, and Contractor personnel qualifications, will be in accordance with this section.
2.4 PURPOSE.
The express purpose of this contract is the provision of a full range of environmental and related services, associated with the management of hazardous, non-regulated, and universal wastes. In order to accomplish this, through TOs, the Contractor shall maintain a management staff and system that ensures flexibility, effective communications, and the diversity of disciplines necessary to successfully execute multi-faceted work. The Contractor shall maintain a staffing and program management system that will promote retention of institutional knowledge and continuity. The Contractor shall maintain a communication program that will apprise key personnel executing various TOs and the Government of any significant findings that may impact ongoing or planned environmental support activities. The Contractor shall initiate recommendations to the Contracting Officer's Representative (COR) about any alternative methods of executing a TO that would result in improved economy, productivity, or quality and immediately notify the COR of any conditions encountered during the execution of a TO that may impact performance.
2.5 REGULATORY COMPLIANCE AND GUIDANCE.
Work performed under this contract will be carried out in full accordance with the requirements of any and all applicable acts, laws, Executive Orders, promulgated regulations, implementing guidance documents, and State and local statutes and regulations. The Contractor is required to comply with all federal, state, and local regulations including but not limited to 40 CFR Part 260, 261, and 266 and 20
TAC 335.
It is anticipated that the majority of the work performed under this contract will be performed at Fort Bliss Military Reservation. The Department of the Army, Fort Bliss, Texas, Directorate of Public Works (DPW) Environmental Division requires waste management and environmental services to support the Fort Bliss Hazardous Waste Management and Pollution Prevention Program in accordance with AR 200- 1 and U.S Army Installation Management Command’s (IMCOM) Common Levels of Service (CLS).
Services under TO’s for Fort Bliss under this contract will be in accordance with IMCOM’s CLS requirements. Individual TOs may implement CLS 66C Provide Regulated Waste Management Services.
The Contractor must follow the requirements in all permits including but not limited to Texas Air Quality (NSR) Permit No. 101044, and Federal Operating Permit O-2865.
It is the Contractor's responsibility to know and comply with all applicable federal, state and local laws and regulations to fulfill the performance objectives of any awarded TO in a manner that is consistent with any applicable orders or permits, all existing cleanup agreements or guidance for any installation, and relevant DoD and Army policy, for the duration of a TO.
2.6 PROFESSIONAL REGISTRATION/CERTIFICATION AND REGULATED PROCEDURES.
In performing the work effort, the Contractor shall adhere to professional guidelines and procedures established or approved by applicable Federal, State, and local regulatory agencies. All mid and senior level disciplines must have appropriate certification or registration appropriate to their professional field of endeavor. If the Contractor is providing on-site support services, the Contractor may be required to provide suitably registered or certified personnel for applicable tasks in specific TOs.
The Contractor shall be responsible for employee training and maintaining certifications and annual refreshers, as needed to perform work. Contractor employees shall have, at a minimum, the following certifications, tests, or training:
(1) Department of Transportation CDL Hazmat Endorsement Driver’s License (for employees operating waste transport vehicles in excess of 5 tons)
(2) Title 49 CFR (Transportation) Sec 172.704 (Training Requirements) (for employees processing waste),
(3) Title 40 CFR (Protection of Environment) Hazardous Waste Management training certification (for employees handling hazardous waste),
(4) OSHA Emergency Response-HAZWOPER 40 hour (for all employees working under this PWS),
(5) OSHA Standard 1910.120 (e.g., First Aid training certification, respiratory fit-testing, baseline physical, etc.)
(6) HAZCOM (OSHA Hazard Communication Training), and
(7) Forklift Safety Operator Training per OSHA Standard 1910.170.
2.7 CONTRACT AUTHORITY AND WORK DEVIATION.
The Contractor shall thoroughly coordinate with the USACE KO or COR and other government agency representatives that are involved in the work effort. The USACE KO or COR are the only responsible parties for contractual matters; consequently, the Contractor shall not take any action relating to this contract at the direction of any other party. Any deviation from the established and approved PWS, including specific methods and techniques, must be proposed in writing by the Contractor and approved by the KO or COR prior to implementation. Unapproved deviations shall not result in any additional cost to the Government. A KO approved POC may be designated, per TO, to act as a local authority for contract deviation approval regarding minor scope variations or divergences. Primary contact for all technical matters will be established within each specific TO.
Though, as outlined above, the Contractor shall not take any action relating to this contract at the direction of any other party, all Contractors must comply with lawful orders issued by certain authorized officials. Examples of this would be, but not limited to, orders by an Installation Commander to address emergency directions or a Safety Officer’s prerogative to issue stop work notices on-site. Various installations have industrial hygiene, security, and range control programs which have authority to “direct” that certain actions occur or not occur on the installation. Additionally, many installation policies and regulations directly apply to Contractors and all Contractor personnel. Specific circumstances that may apply at any particular installation will be addressed prior to a TO commencement at each particular installation. If the Contractor receives any safety or security direction as outlined in this paragraph that will or potentially will impact TO execution and/or result in deviations that may have a cost impact, the Contractor must immediately notify the KO or COR.
2.8 USE OF SUBCONTRACTORS.
The Contractor shall not subcontract any portion of this contract to a party other than those identified in pre-existing partnerships established within the base contract or in proposals submitted in response to request for proposal for TOs without written authorization from the KO or COR. A KO approved POC may be designated per TO to act as a local authority for subcontractor variations.
2.9 SAFETY.
The Contractor shall at all times conduct operations in a safe manner and in accordance with all applicable Federal, State, and local statutes and regulations as well as the most current USACE Safety and Health Requirements Manual (EM 385-1-1). Based on TO award, the Contractor shall also comply with all applicable agency or installation/facility safety policies and requirements. The Contractor may be required to develop a health and safety management plan for any TO issued under this contract and to make such a plan available for inspection by the Government.

3.2 Administrative Services.
The Contractor may provide administrative services incidental to and required for efficient and effective provision of deliverables under this PWS. Administrative services will be carefully managed to prevent performance of personal services prohibited under this contract, that is, to prevent creation of employer-employee relationships between the Government and the Contractor’s personnel. At a minimum, administrative services will be explicitly under the supervision and control of other company employees and proposals will specify Contractor reporting protocols.
The Contractor may operate a Call Center: receive spill response requests; Schedule waste pick-ups;
maintain records and files of all calls that are received at the Call Center; and update all records on a TO specified basis. Additional services may include, but not be limited to the setup of a document management system by maintaining and managing all hazardous waste regulatory documents in a centralized location to ensure that a hard copy is available to respective personnel/agencies. Documents may include: TSDF weekly inspections, quarterly SAP inspections, 90 day storage inspections, NOR files, waste profiles, Material Safety Data Sheets per waste stream, Site Activity Reports, employee training records, waste shipment delivery orders, waste manifests, sampling results and reports, chain of custody records, waste analysis plan, TSDF operations plan, spill cleanup reports, safety meeting notes and agendas, and safety training records. The Contractor may also scan all regulatory documents and create electronic files.
Services may also include ensuring that RCRA certificates are sent out and maintaining hard copy and electronic files of all documentation associated with daily operations including but not limited to waste pickups, program metrics (e.g. frequency/location of waste pickups and volumes and quantity of waste handled), parts washer maintenance, P2 equipment issue, and sustainability center processes.
The Contractor may assist the installation in the preparation of purchase requests, obtaining quotes for materials and supplies from vendors, preparing meeting agendas and presentations, and preparing monthly invoicing.
3.3 Performance of Hazardous, Regulated, and Universal Waste Pick-up and Services.
The Contractor may assist with managing and operating a HWSF as described above. The Contractor may accept at the HWSF all hazardous, non-regulated, and universal waste generated on the installation. In addition, the Contractor may operate and manage <90-day storage facilities located throughout the installation as needed for additional storage should the capacity at the permitted facility be exceeded.
The Contractor may pick up and transport containers from all SAPs, <90-day storage facilities, and spill cleanup sites. The Contractor shall ensure that containers are compliant with the RCRA and DOT regulations prior to transporting to the permitted facility. The Contractor may supply labels, forms, replacement containers, and any other required items for pickup of waste and for the unit replacement items. The Contractor may obtain a turn-in document signature from the unit to properly account for associated funds needed to dispose of waste.
The Contractor may process waste and/or waste containers for transfer to off-site disposal, recycling, or for transfer to the Waste Minimization area for on-site recycling, reuse, or reclamation and consolidation.
The Contractor may establish a procedure for the processing of all types of waste in the HWSF.
Specific quantities of waste to be transported and serviced will vary per individual TO.
