(ii) Request the Government to extend payment due dates until such time as the Government makes payment by EFT (but see paragraph (d) of this clause).
(b) Mandatory submission of Contractor's EFT information. (1) The Contractor is required to provide the Government with the information required to make payment by EFT (see paragraph (j) of this clause). The Contractor shall provide this information directly to the office designated in this contract to receive that information (hereafter: “designated office”') by (the Contracting Officer shall insert date, days after award, days before first request, the date specified for receipt of offers if the provision at 52.232-38 is utilized, or “concurrent with first request” as prescribed by the head of the agency; if not prescribed, insert “no later than 15 days prior to submission of the first request for payment”). If not otherwise specified in this contract, the payment office is the designated office for receipt of the Contractor's EFT information. If more than one designated office is named for the contract, the Contractor shall provide a separate notice to each office. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the designated office(s).
(2) If the Contractor provides EFT information applicable to multiple contracts, the Contractor shall specifically state the applicability of this EFT information in terms acceptable to the designated office. However, EFT information supplied to a designated office shall be applicable only to contracts that identify that designated office as the office to receive EFT information for that contract.
(c) Mechanisms for EFT payment. The rules governing Federal payments through the ACH are contained in 31 CFR part 210.
(d) Suspension of payment. (1) The Government is not required to make any payment under this contract until after receipt, by the designated office, of the correct EFT payment information from the Contractor. Until receipt of the correct EFT information, any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.
(2) If the EFT information changes after submission of correct EFT information, the Government shall begin using the changed EFT information no later than 30 days after its receipt by the designated office to the extent payment is made by EFT. However, the Contractor may request that no further payments be made until the updated EFT information is implemented by the payment office. If such suspension would result in a late payment under the prompt payment terms of this contract, the Contractor's request for suspension shall extend the due date for payment by the number of days of the suspension.
(e) Liability for uncompleted or erroneous transfers. (1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for--

(i) If the funds are no longer under the control of the payment office, the Government is deemed to have made payment and the Contractor is responsible for recovery of any erroneously directed funds; or
(ii) If the funds remain under the control of the payment office, the Government shall not make payment and the provisions of paragraph (d) shall apply.
(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.
(g) EFT and assignment of claims. If the Contractor assigns the proceeds of this contract as provided for in the assignment of claims terms of this contract, the Contractor shall require as a condition of any such assignment, that the assignee shall provide the EFT information required by paragraph (j) of this clause to the designated office, and shall be paid by EFT in accordance with the terms of this clause. In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.
(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information provided by the Contractor's financial agent.
(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address in the contract.
(j) EFT information. The Contractor shall provide the following information to the designated office. The SATOC is for design-build construction services to meet the requirements and time constraints for military, civil, and Interagency and International Services (IIS) customers within Southwestern Division (SWD) Boundaries, and mainly for Tulsa District customers.
1.2 The Government is looking for ways to streamline construction, manage labor and other resource constraints in an effort to reduce costs and achieve an aggressive schedule in executing task orders to meet the Army’s Transformation program goals of faster project execution at lower cost, while taking advantage of industry standards, means and methods.
1.3 This SATOC contract is set-aside for Total Small Business. The estimated amount of the contract is $48 million. The contract shall have a three-year base period and no option periods.
The Government intends to award one IDIQ SATOC contract.
1.4 The scope of this SWD SATOC includes, but is not limited to, construction, renovation, repairs, preventive maintenance, and environmental abatement activities. The contracts are not only intended to execute new construction and design-build, but to provide a timely response to repair of real and personal property facilities, e.g., maintenance, repair, asbestos and leadbased paint abatement, and major and minor construction situations relating to, but not limited to, architectural, civil, mechanical, plumbing, structural, electrical, heating, ventilation and air conditioning (HVAC), instrumentation, anti-terrorism and force protection.
1.5 The contractor shall perform in accordance with the attached Scope of Work, with the Scope of Work provided with each Task Order, and with strict accordance with the terms and conditions specified herein.
1.6 Phase 1. The first phase consists of a process known in commercial design-build as the “Request for Qualifications” or the acronym: “RFQ”. This solicitation refers to it as “Phase 1”. In Phase 1 of the 2 phase design-build selection procedure, interested firms or joint venture entities (referred to as “Offerors”) submit specified performance capability proposals, demonstrating their capability to successfully execute the design-build construction contract resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described herein and will select no more than three (3) of the highest rated Phase 1 Offerors to compete for the design-build contract in Phase 2.
1.7 Phase 2. In Phase 2, the selected Offerors will submit preliminary technical-design proposals and the remainder of the performance capability proposals, including identification of key subcontractors, the proposed contract duration, a preliminary schedule, plus a price proposal in response to a Task Order 0001 Request for Proposal. The Government will evaluate the Phase 2 proposals, in accordance with the criteria described for Phase 2 in Section 00 20 20 PROPOSAL SUBMISSION REQURIMENTS, EVALUATION CRITERIA, AND BASIS OF AWARD, and award a firm fixed-price contract to the responsible Offeror, whose proposal conforms with all the terms and conditions of the solicitation and whose proposal is determined to represent the overall best value to the Government, considering technical-design quality, performance capability, and cost. The final evaluation rating used for comparison, selection, and award will reflect both the rating received in Phase 1 and the evaluation rating received in Phase 2. Cost information will not be rated in either phase but will be evaluated for reasonableness in accordance with the cost limitations set out in Section 00 73 10 Supplemental Contract Requirement, paragraph 1 entitled “Construction Cost Limitation (CCL)”.
1.7.1 The proposal must describe the capability of the Offeror to perform the work, describe the Offeror’s understanding of the requirements contained in the Statement of Work and set forth full, accurate, and complete information as required by the RFP. The proposal should be prepared simply and economically and be legible, clear and coherent.
1.7.2 Offerors will not be participating in a sealed bid procurement process under this acquisition method. Issuance of this Request for Proposal does not constitute an award commitment on the part of the Government.
1.7.3 Proposal Submissions and the Trade-Off Process. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. Offerors submit their performance and capability information for review and consideration by the Government. Relative weights among technical factors are provided in Section 00 20 20 PROPOSAL SUBMISSION REQURIMENTS, EVALUATION CRITERIA, AND BASIS OF AWARD. The Source Selection Evaluation Board (SSEB) reviews, evaluates, and rates the proposals against the source selection criteria in the RFP. A competitive range consisting of the most highly qualified technical Offerors will be established prior to discussion (if held). The SSEB will review, evaluate and rate the initial task order project technical proposals against the source selection criteria in the RFP for those Offerors included in the competitive range. Concurrently, the Government analyzes price proposals of Offerors utilizing the initial task order project cost proposal. Price will not be rated, but will be a factor in making the final best value determination for award. The Source Selection Authority (SSA) compares proposals to one another and determines the best value for the government. The perceived benefits of the higher priced proposal must merit the additional cost, and the rationale for tradeoffs must be documented.
1.7.4 Initial Task Order Project. Those Offerors selected to compete during Phase 2 of the solicitation shall submit Technical and Cost (Price) proposal for the initial task order as part of Phase 2 Proposal submittals (See Section 00 20 20 PROPOSAL SUBMISSION REQURIMENTS, EVALUATION CRITERIA, AND BASIS OF AWARD). The scope of work for an initial task order TO-0001 project will be provided in Section 01 10 00 TASK ORDER STATEMENT OF WORK, as part of the Phase 2 solicitation. The initial task order project cost proposal will be used to evaluate price for the basic SATOC contract. Proposed contractor General and Administrative (G&A) Rates and Overhead Rates will be evaluated in the proposal to allow the Government to evaluate the total cost impact to the government and its customers for the life of the total $48 million SATOC Contract. The best value initial task order will be awarded to the successful contractor for the SATOC if it is in the best interest of the Government.

5.0 TAB B – FACTOR 1 - SPECIALIZED EXPERIENCE
5.1 SUBMISSION REQUIREMENTS
The prime contractor and the design firm(s) (or prime contractor if design is to be self-performed) shall each demonstrate recent, relevant experience on similar projects, using Construction – Specialized Experience form – (Attachment 2), and Designer – Specialized Experience Form – (Attachment 3) at the end of the section. Offerors may identify state and local government and private contracts that are similar to the Government’s requirements. Construction and Design experience with Army and Air Force Installations is preferred as these are the primary customers of the Tulsa District. If the offeror is a joint venture, each firm shall provide information, demonstrating experience relevant to their role on this project. Submit projects selected from those discussed in the experience narrative that are currently well underway (designed and at least 50% construction progress completed) or completed and turned over no longer that five (5) years preceding the date of this Solicitation. If any firm has multiple functions or divisions, limit the project examples to those preformed by the division or unit submitting the offer or by the team member. Design firms may list prime contractors they have worked for or government, private or commercial customers. If projects were design-build please identify them as such.
Submit at least three (3) recent projects performed concurrently within the last five (5) years that demonstrate complex maintenance, repair, and/or alteration requirements within areas that disassemble, clean/inspect, remove materials, heat treat, weld, apply thermal coatings, plate, assemble and test major aircraft components. At least one project must be a relevant design/build project with a minimum cost of $5,000,000 performed as the prime. The other two projects may be design/build or construction services projects but must have a minimum cost of $3,000,000 each performed as the prime that demonstrates knowledge and past experience relating to the work described previously. Include a brief description and identify the capacity the firm worked on the project, the risks associated with execution of the work and how those risks were mitigated, the contract type (list “by task order” if IDIQ), contract or task order value, percent complete or date completed, name and title of customer point of contact and point of contact current phone number.
5.3 The offeror may provide a supplemental narrative (not project lists), not to exceed two pages, explaining how any corporate experience that is not directly related to the specific projects above is applicable to this project and how the Government will benefit. The following information may be considered.
5.4 The offeror should describe any previous teaming experience between current team members, if not described in the project list. Describe team members’ experience on LEED projects, if not included on the project list. Offeror may describe design-build experience on other type projects.
The above information is limited to projects that are well underway or that have been completed and turned over no longer than the past five years preceding the date of this solicitation.
5.5 EVALUATION CRITERIA:
5.5.1 The Government will evaluate the extent of recent, related experience of the prime contractor and design firms in design, construction or design-build, as relevant to their role on this project. If the design will be accomplished in-house, rather than by subcontract, then the design element of specialized experience will still be evaluated, realizing that the work is being done in-house.
Experience on the similar projects identified in the project lists will receive more consideration than experience provided in the supplemental narrative. The Government may place greater importance on projects performed as a prime contractor than as a subcontractor, depending upon overall role and relevancy considerations. Federal Government project experience will not be rated inherently more important than non-Federal Government project experience.
5.5.2 The Offeror must submit the requested information to demonstrate a record of recent, related experience in both design and construction, for the facility types (which may include similar state or local government or private counterparts) included in this contract, as described in Section 00 22 00. Recent experience includes projects well underway (see above criteria) or those completed and turned over within five (5) years of the proposal issue date for this RFP for design or construction experience. Joint Venture partners should each demonstrate experience commensurate with their role on this project or explain in the supplemental narrative how their experience qualifies them for their role on this project.
5.5.3 The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Corps of Engineers Construction Contractor (or Architect- Engineer) Appraisal Support System (CCASS/ACASS), other DOD or Government appraisal systems or to interview owners or references. The Government may check any or all cited references to verify supplied information.
5.5.4 To receive credit for extent (amount) of experience, the Offeror and its proposed design firm(s) shall demonstrate a history of recent, relevant experience. A firm will not receive credit under this factor for the relevant experience of key personnel proposed for this project.
5.5.5 The Government will consider extent of recent experience, degree of relationship of such experience to this project, demonstrated familiarity with applicable codes and local conditions.
Some examples of relevancy to this project may include, but not be limited to:
(1) Number, size, type work, complexity, location
(2) Dates (well under way or completed no more than 5 years preceding date of Solicitation)
(3) Firm's role and extent of work self-performed (brokering out all work and simply “pouring the sidewalks” on a cited project are examples of less relevant experience)
5.5.6 Previous design-build experience is not necessary for an acceptable rating. The Government may consider previous D-B experience a strength, even if the experience is on different type projects than this project. Similarly, the Government may consider previous recent teaming experience among the team members as value added, even if on different type design and/or construction projects than this project. The more relevant the experience, the more credit will be given.
5.5.7 The firm(s) preparing the design must demonstrate qualifications and experience in sustainable design and development and design, based on project experience on projects that have achieved US Green Building Council’s LEED certification or were certifiable at LEED silver or better or project experience on completed Corps of Engineers design-build projects that were validated as having achieving LEED silver rating for an acceptable rating. Additional consideration will be given if both the constructor and the design firm(s) demonstrate qualifications and experience on
LEED.
