SWD REGIONAL SATOC IDIQ FOR D/B & CONSTRUCTION SERVICES FT. SILL

Section revised in total 00110 - 1 W912BV-09-R-2018 by Amendment 0004

SECTION 00110

PHASE 1 OF 2 PHASE DESIGN-BUILD SELECTION PROCEDURES

1.0 OVERVIEW OF PHASE 1 AND PHASE 2 SELECTION PROCEDURES

1.1 This is a two-phase competitive solicitation for a firm, fixed-price Indefinite Delivery Indefinite, Quantity (IDIQ), Single-Award Task Order Contract (SATOC) which will be awarded using the Best Value Trade-Off Process. The SATOC is for design-build and construction services to meet the requirements and time constraints for military, civil, and Interagency and International Services (IIS) customers within Southwestern Division (SWD) Boundaries, and for Tulsa District customers. This contract is primarily for Ft. Sill Resident Office projects, but may encompass work in other states covered by the geographic region included in the SWD Boundaries and other SWD Customers.

This SATOC contract is set-aside for Small Businesses. The estimated amount of the contract is $49.5 million. The contract shall have a base period plus up to four option periods. A guaranteed minimum, of $30,000.00, will be on the base year only. The Government intends to award one IDIQ SATOC contract.

The scope of this SWD SATOC includes, but is not limited to, construction, renovation, repairs, preventive maintenance, environmental abatement activities. The contract are not only intended to execute new construction and design-build, but to provide a timely response to repair of real and personal property facilities, e.g., maintenance, repair, asbestos and lead-based paint abatement, and major and minor construction situations relating to, but not limited to, architectural, civil, mechanical, plumbing, structural, electrical, heating, ventilation and air conditioning (HVAC), instrumentation, anti-terrorism and force protection.

The contractor shall perform in accordance with the attached Scope of Work, with the Scope of Work provided with each Task Order, and with strict accordance with the terms and conditions specified herein.

1.1.1 Phase 1. The first phase consists of a process known in commercial design-build as the “Request for Qualifications” or the acronym: “RFQ”. This solicitation refers to it as “Phase 1”. In Phase 1 of the 2 phase design-build selection procedure, interested firms or joint venture entities (referred to as “Offerors”) submit specified performance capability proposals, demonstrating their capability to successfully execute the design-build construction contract resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described herein and will select no more than five of the highest rated Phase 1 Offerors to compete for the design-build contract in Phase 2.

1.1.2 Phase 2. In Phase 2, the selected Offerors will submit preliminary technical-design proposals and the remainder of the performance capability proposals, including identification of key subcontractors, the proposed contract duration, a preliminary schedule, plus a price proposal. The Government will evaluate the Phase 2 proposals, in accordance with the criteria described for Phase 2 in Section 00120 PHASE 2 DESIGN-BUILD SELECTION PROCEDURES AND BASIS OF AWARD, and award a firm fixed-price contract to the responsible Offeror, whose proposal conforms with all the terms and conditions of the solicitation and whose proposal is determined to represent the overall best value to the Government, considering technical-design quality, performance capability, and cost. The final evaluation rating used for comparison, selection, and award will reflect both the rating received in Phase 1 and the evaluation rating received in Phase 2. Cost information will not be rated in either phase but will be evaluated for reasonableness in accordance with the cost limitations set out in Section 00810 SUPPLEMENTAL CONTRACT REQUIREMENTS, paragraph 1 entitled “Construction Cost Limitation (CCL)”.

1.1.3 The proposal must describe the capability of the Offeror to perform the work, describe the Offeror’s understanding of the requirements contained in the Statement of Work and set forth full, accurate, and complete information as required by the RFP. The proposal should be prepared simply and economically and be legible, clear and coherent.

Section revised in total 00110 - 2 W912BV-09-R-2018 by Amendment 0004

1.1.4 Offerors will not be participating in a sealed bid procurement process under this acquisition method.

Issuance of this Request for Proposal does not constitute an award commitment on the part of the Government.

1.2 Proposal Submissions and the Trade-Off Process. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal.

Offerors submit their performance and capability information for review and consideration by the Government. Relative weights among technical factors are provided in Section 00120 PHASE 2 DESIGN- BUILD SELECTION PROCEDURES AND BASIS OF AWARD. The Source Selection Evaluation Board (SSEB) reviews, evaluates, and rates the proposals against the source selection criteria in the RFP. A competitive range consisting of the most highly qualified technical Offerors will be established prior to discussion (if held). The SSEB will review, evaluate and rate the initial task order project technical proposals against the source selection criteria in the RFP for those Offerors included in the competitive range. Concurrently, the Government analyzes price proposals of Offerors utilizing the initial task order project cost proposal. Price will not be rated, but will be a factor in making the final best value determination for award. The Source Selection Authority (SSA) compares proposals to one another and determines the best value for the government. The perceived benefits of the higher priced proposal must merit the additional cost, and the rationale for tradeoffs must be documented.

1.3 Initial Task Order Project. Those Offerors selected to compete during Phase 2 of the solicitation shall submit Technical and Cost (Price) proposal for the initial task order as part of Phase 2 Proposal submittals (See Section 00120 PHASE 2 DESIGN-BUILD SELECTION PROCEDURES AND BASIS OF AWARD). The scope of work for an initial task order project is provided in Section 01 10 00 TASK ORDER STATEMENT OF WORK, as part of this solicitation. The initial task order project cost proposal will be used to evaluate price for the basic SATOC contract. The best value initial task order will be awarded to the successful contractor for the SATOC if it is in the best interest of the Government.

2.0 GENERAL INSTRUCTIONS

2.1 Who May Submit: Any legally organized small business firm may submit a proposal.

2.2 Where to Submit: Offerors shall submit their proposal to the Tulsa District at the address shown in Section 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS.

4.1.1 Submit the SF 1442, completed and signed by a person authorized by the Offeror.

4.1.2 Submit a completed Proposal Data Sheet. See the form at the end of this section.

4.2 Evaluation Criteria: Above submission items are not rated.

5.0 TAB B - FACTOR 1: CONSTRUCTION PAST PERFORMANCE. Offerors shall be evaluated on construction projects completed or substantially complete (at least 50% complete) in the last 5 years.

Projects submitted should reflect Design-Build and construction experience described in Section 00 90 00 DESCRIPTION/SPECS/WORK STATEMENT, paragraph 1.1. Past performance submitted should include some projects that are similar/same in nature to the task order with this RFP. The Offeror’s past performance will be evaluated to determine technical capability to perform the proposed contract and how well it satisfied its customers. The information presented in the Offeror’s submittal, together with that from other sources available to the Government, will comprise the input for evaluation of this factor. The following elements will be evaluated:

• Quality of Construction

• Timeliness of Performance

• Customer Satisfaction

• Subcontractor Management

• Documentation

• Safety Record

5.1 OFFEROR’S SUBMISSION REQUIREMENTS

5.1.1 Project Information Worksheets. Offerors shall provide project information on no more than ten

(10) completed or substantially complete projects, of which three (3) projects submitted can be currently under construction and at least 50% complete, that reflect prior past performance in the construction elements referenced in paragraph 5.0 above. The examples should document the Offeror’s full range of experience as described in Section 00 90 00 DESCRIPTION/SPECS/WORK STATEMENT, paragraph

1.1. At least two (2) of the submitted projects should be similar to Task Order 0001 in project type and scope as defined in paragraph 6.0 below. As a minimum, the contractor shall provide the data specified in the attached “Project Information” Worksheet. Section revised in total 00110 - 5 W912BV-09-R-2018 by Amendment 0004

5.1.3 Past Performance Questionnaires. For each project that does not have a final CCASS evaluation, Offerors shall provide a questionnaire to the point of contact, clearly identifying the project to be evaluated. A sample Past Performance Evaluation Questionnaire is included at the end of this section.

When completed, these forms shall be mailed, faxed or e-mailed to the Tulsa District Contract Specialist identified in the sample transmittal letter provided. It is the contractor’s responsibility to ensure that the reference documentation is provided, as the Government may not make additional requests for past performance information from the references. The evaluation form shall be provided to the Contract Specialist directly from the reference. Do not request past performance questionnaires on projects that have final CCASS evaluations.

5.1.4 Safety Record. The Offeror shall submit either OSHA Form 300 or 300a showing the incident rates for their firm for all projects within the past 3 years. This form, in Microsoft Excel format, can be downloaded from the Internet at:

http://www.osha.gov/recordkeeping/new-osha300form1-1-04.xls http://www.nccrimecontrol.org/HR/OSHA_Form_300.doc http://www.dir.ca.gov/dosh/dosh_publications/oshalog300.pdf

This data is to be converted using the following formula for each of the 3 years:

Number of Lost Time Accidents for the year (Column H on Form 300 or 300A) x 200,000 divided by Man- Hours Worked that Year (from Form 300A) = Incident Rate for the Year

The contractor shall calculate the lost time incident rate for each of the past 3 years using the appropriate OSHA Form data. These calculations shall be presented for each year with the mathematical average of all 3 years. The target average lost time incident rate is 1.0. Offerors with an average lost time incident rate exceeding 1.0 are encouraged to submit an explanation of their incident rate and/or what they have done to improve their safety record. All Offerors are encouraged to submit documentation indicating improvements in their safety record, safety awards, and other safety recognition.

If the Offeror has a safety incentives program, information shall be submitted describing this program. The description of the safety incentives program shall include as a minimum a description of what benefits the firm has seen by implementing the program, benefits to the customer and a description of how the program is administered.

5.1.5 Other Sources. The Government may contact sources other than those provided by the Offeror for information with respect to past performance on projects completed or substantially completed within the past 5 years and on projects that are substantially complete, at least 50% complete. These other sources may include, but are not limited to, CCASS, telephone interviews with organizations familiar with the Offeror’s performance, and Government personnel with personal knowledge of the Offeror’s performance capability.

5.1.6 New Companies and Joint Ventures. New companies and joint ventures entering the marketplace (without relevant company experience) are reminded that they, along with all other Offerors, may submit past performance information for key personnel, using the attached “Project Information” worksheets. If such information is submitted, how long key personnel stayed on their assigned projects and how well they managed their portion of the referenced projects shall be used to judge past performance, along with any other information regarding such key personnel from any other sources the Government may choose to contact. If no such information regarding key personnel is given, then the new company or joint venture shall be given a neutral rating.

5.2 Evaluation. The Government will evaluate the Offeror's responsiveness to the solicitation regarding past performance using the sources identified above. New Companies and Joint Ventures shall be evaluated on their own past performance, including the performance of key personnel as noted in

Section revised in total 00110 - 6 W912BV-09-R-2018 by Amendment 0004 paragraph 5.1.6, above, to determine the company’s ability to perform satisfactorily under the elements of evaluation.

Offerors may be provided an opportunity to address any negative past performance information about which the Offeror has not previously had an opportunity to respond. The Government treats an Offeror's lack of past performance as having no positive or negative evaluation significance. The Government will evaluate past performance based on the elements listed below:

• QUALITY OF CONSTRUCTION. Based on all information available, the Government will assess the quality of the actual construction undertaken and the standards of workmanship exhibited by the Offeror.

• TIMELINESS OF PERFORMANCE. The Government will evaluate all information available with respect to the Offeror completing past projects within the scheduled completion times.

• CUSTOMER SATISFACTION. The Government will evaluate all information available with respect to the Offeror’s past customer satisfaction, cooperation with customers, and interaction on past projects.

• SUBCONTRACTOR MANAGEMENT. The Government will evaluate all information available with respect to the Offeror’s management of subcontractors, including mitigation of conflicts and resolution of disputes at the lowest level. For large businesses, the Government will also evaluate compliance with subcontracting plans.

• DOCUMENTATION. The Government will evaluate all information available with respect to the Offeror’s level of meeting customer satisfaction on timeliness and quality of the documentation, reports, and other written materials completed by the Offeror on past projects.

• SAFETY RECORD. All information available with respect to the Offeror’s safety record, to include CCASS rating for safety, lost time incident rate, safety incentive program, safety awards, and other indications of improvements in safety will be taken into consideration in evaluating the Offeror’s overall safety record.

6.0 TAB C – FACTOR 2 – CORPORATE RELEVANT SPECIALIZED EXPERIENCE

Offerors will be evaluated on their experience in two areas: experience with task order type contracts and experience in various types of construction-related work, including new construction, alterations, renovations and repairs, and design-build construction. The following list is indicative of the variety of work that may be performed by task orders under this contract:

• SAFETY - Life safety upgrade, inflammatory gases and substances, industrial safety, industrial hygiene, fire protection, airfield pavements, confined space entry, radioactive and laser operations, hazardous materials, protection of work sites and property, and protection of workers.

6.1 Offeror’s Submission Requirements. No additional project information is required to be submitted for this factor. The Project Information Worksheets submitted under Factor 1 shall be used to evaluate the Offeror’s experience under this factor. Additional Project Information Worksheets shall not be submitted under this factor. Offerors are encouraged to submit a chart or table depicting their experience in the various types of construction activities listed in Paragraph 6.0 above.

6.1.1 New Companies and Joint Ventures. If Offeror represents the combining of two or more companies for the purpose of this RFP, the proposal shall clearly identify the contractual responsibilities of each firm and the work to be performed by each; describe the nature of the association; indicate whether the firms have experience working together in construction ventures, including how long and how many projects. In addition, each company including joint ventures shall list their Government contract experience. Provide a copy of the commitment letter of the firms or the joint venture agreement. Prior to award of any contract, a copy of the Joint Venture Agreement will be required. If approval of the Joint Venture Agreement is required by the Small Business Administration (SBA), failure to timely provide an approved Small Business Administration Joint Venture Agreement may prevent award of a contract.

6.2 Evaluation. The Government will review the projects provided by the Offeror to evaluate and rate the recent relevant specialized experience of the Offeror with similar projects. The Government will place a higher value on experience with similar task order contracts executed with the Corps of Engineers or other DoD Components. If the Offeror cannot provide suitable relevant experience and the evaluators consider that the information provided indicates that the Offeror has no relevant experience, a determination will be made as to the risk this lack of corporate experience presents to the Government and the proposal will be evaluated accordingly. The experience of individuals will not be evaluated under this factor.

7.0 TAB D – FACTOR 3 - DESIGN SUPPORT

Design capability is an important element of this contract. Design work incidental to construction as well as design/build task orders may be issued under this contract. 9.0 TAB F - FACTOR 5: RELEVANT SPECIALIZED EXPERIENCE FOR INITIAL TASK ORDER

PROJECT

Offerors shall be evaluated on at least two, but no more than five construction projects successfully completed or substantially complete (at least 50%) in the last five years that demonstrate the Offeror’s

Section revised in total 00110 - 11 W912BV-09-R-2018 by Amendment 0004 specialized experience in the construction of similar construction projects. For this proposal, similar projects are projects that meet the following criteria:

• Projects of similar dollar value

• Projects of similar complexity

• Similar construction type

Furnish detailed examples of Offeror’s experience of similar type work required by this solicitation, both for Government agencies and private industry. Examples shall show relevance of experience to those construction type methods required by the Technical Specifications.

9.1 Offeror’s Submission Requirements. Offerors shall submit project information for construction projects that reflect specialized experience in the construction elements referenced in paragraph 9.0 above. The examples should be similar to this solicitation in project type and scope. As a minimum, the contractor shall provide the data specified in the Project Information Worksheet (similar to the worksheets provided for Volume II, Tab 1). If the Offeror represents the combining of two or more companies for the purpose of this RFP, each company shall list project examples. The experience of individuals will not be credited under this factor. Offerors shall also provide a written narrative or comparison chart that indicates the similarities and technical relevancy of the submitted project as compared to the initial task order project.

9.2 New Companies and Joint Ventures. If approval of the Joint Venture Agreement is required by the Small Business Administration, failure to timely provide an approved SBA Joint Venture Agreement may prevent award of a contract.

9.3 Evaluation. The Government will review the example construction projects provided by the Offeror to evaluate and rate the recent relevant specialized experience of the Offeror with similar projects. The example construction projects should closely resemble the scope, size, and complexity of the project identified in this solicitation. The Government will place a higher value on experience with similar projects executed with the Corps of Engineers or other DoD Components. If the Offeror cannot provide suitable relevant experience and the evaluators consider that the information provided indicates that the Offeror has no relevant experience, a determination will be made as to the risk this lack of corporate experience presents to the Government and the proposal will be evaluated accordingly.

10.0 TAB G – FINANCIAL CAPACITY

10.1 Submission Requirements:

a. Financial Capacity. Submit a letter of current bonding capacity from an acceptable Surety/Bonding Company. The letter shall address the Offeror’s bonding capacity 1) for an individual task order and 2) aggregate bonding capacity. The information submitted will be considered for reasonableness considering the contract capacity of $49.5 million and the Offeror’s ability to secure additional bonding protection.

b. Pre-Award Information (e.g., Bank and Supplier References). In accordance with FAR 9.103(a) “… contracts shall be awarded to responsible prospective contractors only.” To be determined responsible, a prospective contractor must meet the standards at FAR 9.104 that requires a prospective contractor to have adequate financial resources to perform the contract or the ability to obtain them. As an aid in assessing responsibility, the Offeror shall notify their bank/suppliers that the Corps of Engineers may contact them, and shall authorize the bank/suppliers to release the following information regarding the

Offeror’s account. If a written authorization is required by their bank, Offerors shall provide that authorization with their proposal.

- Name and telephone number of bank’s point of contact

- Number of year’s business has been conducted with each bank

- Types of open accounts (checking, loans, etc.)

- Balance of current accounts (the banks will provide a "range of figures" for this information, such as, medium five-figures range)

- Means by which loans are secured and if paid as agreed

- Point of contact and telephone number of three (3) different suppliers

10.2 Evaluation requirements:

This is a GO/NO GO item. Data will be evaluated and scored as it relates to the ability of the Offeror to successfully accomplishing the proposed effort.

11.0 PHASE 1 OVERALL RATING

11.1 In addition to individual factor and subfactor ratings, the Government will assign an overall rating for the Phase 1 proposal.

12.0 PHASE 1 EVALUATION PROCEDURES

12.1 Source Selection Evaluation Board (SSEB).

12.2.1 The SSEB will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal, proposal corrections and any information obtained from other sources, e.g., past performance information. The SSEB will not consider any information or data incorporated by reference. Identities of SSEB members are confidential and members will not be available for contact or discussion.

12.2 Evaluation

12.2.1 The SSEB will evaluate the proposals and assign a consensus rating for each proposal factor and subfactor. Offerors are cautioned to put forth their best efforts for the Phase 1 submission, and to furnish all information clearly to allow the Government to determine their performance capability. Offerors should not assume that they will have an opportunity to clarify or correct anything in their proposal after submitting it in response to Phase 1.

12.2.2 The Government reserves the right to allow proposal corrections and/or to conduct discussions, if the Contracting Officer determines they are necessary or are otherwise in the Government's best interest to determine the most highly qualified Offerors for Phase 2.

12.2.3 If discussions are to be conducted, the Contracting Officer will include only those firms deemed to be the most highly qualified. In certain circumstances, the Government may limit firms in the discussions to the greatest number that will permit an efficient competition among the most highly rated offers. The Government reserves the right to exclude an offer if it is so deficient as to essentially require a new Phase 1 proposal. The Government reserves the right to exclude an offer requiring extensive discussions and major revisions such as to allow an Offeror unfair advantage over those more competitive offers.

12.2.4 Upon conclusion of discussions, those Offerors still considered the most highly qualified, will be afforded an opportunity to submit their Phase 1 proposal revisions for final Phase 1 evaluation.

12.2.5 If (1) discussions are not considered necessary after initial proposal evaluation or (2) after discussions and final Phase 1 proposal submission, the SSEB will provide consensus input to the

Section revised in total 00110 - 13 W912BV-09-R-2018 by Amendment 0004

Contracting Officer, including the relative advantages and disadvantages between the higher rated Phase 1 offers.

12.2.6 The Contracting Officer, independently exercising prudent business judgment, will select up to five (5) of the most highly qualified Offerors to compete in Phase 2.

12.3 Establishment of a Competitive Range (if necessary)

A “Competitive Range” is a subjective determination of the most highly rated proposals in the event that discussions with Offerors are required in either Phase 1 or Phase 2. The Contracting Officer will establish a competitive range of all the most highly rated proposals.

12.4 Possible Exchanges During the Selection Process

12.4.1 Clarifications. A clarification is defined as limited exchanges, between the Government and Offerors that may occur when award without discussions is contemplated. If award is to be made without discussions, Offerors may be given the opportunity to clarify certain aspects of proposals, including an Offeror’s past performance, or to resolve minor or clerical errors. When clarifications are needed, communication with an Offeror will be handled through the Contracting Officer. Clarifications do not provide the Offeror an opportunity to revise or modify its proposal, except for correction of apparent clerical mistakes that would ultimately result in a revision.

12.4.2 Communications. Communications may take place with Offerors before the establishment of a competitive range. Communications are exchanges, between the Government and Offerors, after receipt of proposals, leading to establishment of the competitive range. Communications may only be held with Offerors whose past performance information is the determining factor, preventing them from being placed within the competitive range.
