1. SC-11 – How many gallons of No. 2 diesel will be required to run the oil burner heating unit on the vessel for the anticipated 30 day yard period?

Heating unit will not need to run during the 30 day period

2. SC-15 – Our shipyard runs two shifts, 0730 – 0030, with 24-hour recorded security cameras. Will this be sufficient to cover item SC-15?

This will be sufficient

3. TP 1.02 – Gas-Freeing of the machinery spaces listed may or may not require an environmental cleaning company to wash and dispose the bilges. We will not know for sure until our Competent Person has had time to inspect them in our yard after the vessel’s arrival. Should the potential cost of cleaning be included in our price? There is no bilge cleaning item in the SOW.

SECTION C - DESCRIPTIONS AND SPECIFICATIONS

The following have been modified:

SPECIFICATIONS FOR 2025 REPAIRS TO DCV "HAYWARD"

STATEMENT OF WORK

SW-1 Description of Work

a. The work consists of furnishing all labor, materials, fittings, equipment, tools, power, compressed air, heat, water, etc., and performing all work on U.S. Drift Collection Vessel "HAYWARD" specified herein. The principal dimensions and physical data for the vessel are shown below:

b. The major workscope includes drydocking the vessel, assisting with ABS and USCG required inspections, and miscellaneous modifications and repairs in accordance with these specifications.

c. The Contractor is not responsible for the costs associated with providing the inspection services of ABS. ABS will be performing an ABS Special Survey during the drydocking.

d. Wherever the term "Plant" is used in these specifications, it is understood to refer to the items of floating plant named in the general description above, together with their normal appurtenances, equipment, and supplies.

e. General vessel arrangements and details are included in the attached file named

“Reference Drawings.pdf.” The accuracy of these drawings has not been verified.

Therefore, the Contractor shall template all work from the vessel. Potential bidders are encouraged to inspect the vessel prior to submitting a bid. See Contract Clause SW-6 for more details.

f. The Contractor shall furnish the necessary facilities for and shall bear the expense of any movement of the plant while it is in his or her possession.

g. Removal and/or relocation of any parts, equipment, fluids, etc. for interference or access shall be the responsibility of the Contractor. Similarly, all interference and access removals shall be reinstalled by the Contractor at his/her expense. Any damage from removal or relocation of parts, equipment, etc. shall be repaired or replaced at the Contractor’s expense.

h. The Contractor's work shall comply with ABS "Rules for Building and Classing Steel Vessels" and USCG "Rules and Regulations for Subchapter I, Vessels" as found in the Code of Federal Regulations (Title 46, CFR).

i. The Contractor’s work shall meet the following additional standards:

National Electric Code (NEC)

Institute of Electrical and Electronic Engineers Standards, Publication No. IEEE-45 –

Recommended Practice for Electrical Installations on Shipboard.

The National Shipbuilding Research Program (NSRP 0490), January 1998, “Industrial Standards for Hull Structural Penetration Design Criteria and Details.”

SW-2 NOT USED

SW-3- Mastership Agreement

Prior to the award of this Contract, the Contractor shall enter into a "Mastership Agreement for Repair and Alteration of Vessels". If the Contractor has entered such an agreement prior to this Contract, that agreement may be utilized. For more information, see DFARS Subpart 252.217- 71, Master Agreement for Repair and Alteration of Vessels.

SW--4 Contract Duration

The Contract duration is thirty (30) calendar days after Notice to Proceed is issued and the first calendar day after delivery of the vessel to Contractor’s yard. The Contractor is responsible for completing all work items within the thirty (30) calendar day Contract duration. See Paragraph SC-1 for additional details.

SW--5 Distance Restriction From Caven Point Terminal

All Contract work shall be performed at a location no further than 300 nautical miles from Caven Point Terminal, Jersey City, New Jersey.

SW-6 Pre-bid Vessel Inspections

Pre-bid inspections may be held to allow all prospective Offerors to inspect the vessel. The pre-proposal inspections can be held by appointment in Jersey City, NJ. Representatives of prospective Offerors wishing to attend should contact William Lyness at (908-902-4234) for the specifics of the exact location and time.

During the pre-proposal inspections, Offerors will be allowed unencumbered access throughout the entire vessel. Representatives of the Government will be available, but only to the extent necessary to escort Offerors and assist with access. Government Representatives on the vessel will not discuss the scope of the work or make any technical clarifications or interpretations.

After each inspection, a meeting will be held with all participants to allow for the presentation of any questions. This meeting is not for the purpose of educating Offerors that have not carefully reviewed the plans and specifications and have come unprepared. Questions will not be answered at that time but will be acknowledged and recorded. The Government will prepare answers to all questions and forward a copy of both the questions and answers to all prospective Offerors through form Solicitation Amendment.

SPECIAL CONDITIONS

SC-1 Pre-Award Survey, Delivery, Commencement, Completion of Work and Return of Plant

a. A Pre-Award Survey may be requested prior to award in accordance with FAR 9.106 to verify that the Contractor is able to comply with the required performance schedule, taking into consideration all existing commercial and government business commitments and has the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

b. To minimize the vessel’s time out of service and to allow for flexibility in scheduling, the

Government will deliver the plant to the nearest slip at the Contractor's facility on a date mutually agreed on by the Government and Contractor, not to exceed 45 Calendar Days after Contract Award.

c. The Government will accept return of the plant in open water, clear of the Contractor's yard or any other berthing facility used in connection with Contract work upon completion of the Contract.

d. The Contractor shall execute all work within the duration stated in the Contract. The

Contract duration shall be computed from and including the first calendar day after delivery of the vessel to the Contractor.

e. The time for completion shall be computed to the hour at which the plant is accepted by the

COR in open water clear of the Contractor's yard. The date of completion shall be considered as half a day if the plant is accepted by the COR before 12:00 o'clock Noon and as a whole if accepted after 12:00 o'clock Noon. If all work is not satisfactorily completed when the plant is returned to the COR, the Contractor shall complete the work remaining to be done and any working time lost by the plant thereafter, because of any activities of the Contractor in completing said work, shall be included in the computation of time.

SC-2 BERTHING, DRYDOCKING AND SERVICES

The Contractor shall have a suitable drydock facility available at award. Upon receipt of the vessel, the Contractor shall drydock the vessel within five (5) calendar days and for such time that will be necessary to complete all underwater work included in these specifications.

Following completion of underwater work, a drydock shall remain available at all times to the vessel for the duration of the contract.

DRYDOCK SUBMITTALS

1. DRYDOCK CERTIFICATION SUBMITTAL

Prior to award at the pre-award survey, the Contractor shall submit to the Contracting Officer certification for the drydock or tentative drydocks to be used to lift the vessel. The drydock shall be certified for docking the vessel of the dimensions and weight given by one of the following only:

(a) US Navy, Naval Sea Systems Command, or US Coast Guard

(b) American Bureau of Shipping (ABS)

(c) An independent registered Professional Engineer specialized in drydocks, who shall cover the inspection requirements of item (a) or (b) above.

The Inspection Certificate shall be within three (3) years if the age of the dock is less than ten

(10) years old and within two (2) years if the age of the dock is over ten (10) years old.

Floating drydocks shall be one integral unit. The Government will allow the coupling of two rated docks to meet the load requirements of the vessel, provided that the lifting plan used shall include provisions for ensuring integrity of the coupling in the event of foul weather. Linked drydocks shall be certified as an entity.

SC--3 NOT USED

SC--4 CONTRACTOR'S CUSTODY OF PLANT

a. On entering and leaving dry dock, or marine railway, the Contractor shall have charge of and be responsible for a vessel not operating under its own power. If tug or pilot service is required during delivery or return of the plant or at any time during Contractor's custody for maneuvering the plant between open water and dry dock, slip or berth at the Contractor's yard or other facility, or for moving the plant for any reason during the course of Contract work, such service shall be promptly furnished by the Contractor at his/her expense. This shall not exclude the right of the Government to move its plant around the Contractor's premises using the Government's personnel and facilities if the Government representative considers such movement of the plant to be in the interests of safety of the plant, or otherwise in the Government's interests.

b. The Government shall have the right to access the vessel while in the Contractor's custody with Government owned or hired floating plant or personnel for the purpose of delivering equipment, materials or personnel to the plant in the Contractor's custody.

c. The Contractor shall not permit the plant to go aground or bear upon the bottom of any waterway or any submerged object while in his/her possession. The Contractor shall not perform any Contract work on the plant if it should accidentally go aground or bear upon any submerged object and shall notify the COR immediately and take the necessary steps to refloat the plant. The sole exception to this shall be that the plant shall be allowed to rest or bear upon a drydock which is properly prepared, in accordance with the plant's drydocking plan.

d. If the Contractor anchors the plant offshore for the purpose of performing Contract work on the plant, the Contractor shall convey Government inspectors, crew and hired personnel to and from the plant at the convenience of the Government at the Contractor's expense. While at such anchorage, the plant shall be considered in the custody of the Contractor and subject to any pertaining provision of these conditions.

SC--5 ACCIDENT PREVENTION

The Contractor shall provide a fire protection plan, flood prevention plan, and safety plan to the COR. All plans shall be in compliance with all federal, state, and local regulations as well as USCG, ABS, and USACE regulations. This information shall be submitted no later than 10 days after the Contract award date and shall be a prerequisite to the start of any work on the vessel.

The bulleted items listed below refer to specific areas of accident prevention, however this in no way limits the Contractor’s responsibility to perform all work under this Contract in strict accordance with their fire protection, flood prevention, and safety plans as well as all federal (ex.

29 CFR), state, local, USCG, ABS, and USACE regulations (EM 385-1-1).

a. The Contractor shall take all necessary precautions for the protection of the life and health of employees and other persons; for prevention of damage to property, materials, supplies, and equipment; and for avoidance of work interruptions in the performance of this Contract. The Contractor shall comply with all pertinent provisions of the Mastership Agreement for Repair and Alteration of Vessels and the Corps of Engineers Safety Manual EM 385-1-1, dated 15 March 2024 entitled "Safety and Health Requirements Manual" as amended and shall also take or cause to be taken such additional measures as the COR may determine to be reasonably necessary for the purpose. The Contractor shall also comply with OSHA Safety and Health Standards 29 CFR. The Contractor shall designate the entire area of work as a hardhat area.

b. A qualified employee shall be designated by the Contractor to be directly responsible for full and immediate compliance with all applicable safety and fire protection requirements. The COR will make a safety inspection of shipyard facilities within 48 hours of the vessel's arrival at the Contractor's yard. At such time the Contractor's safety program will be reviewed with the Contractor's safety representative.

c. In addition to other fire protection measures and hose lines required, the Contractor shall connect a shore fire line to the ship's fire main of the same pressure as required by USCG regulations for service at sea. If at any time, it becomes necessary to disconnect the ships fire main or any part thereof, the Contractor shall furnish individual hose lines to the unprotected locations as required by the Inspection and Manner of Doing Work Clause of the Mastership Agreement for Repair and Alteration of Vessels (DFARS Clause 252.217-7005 - Inspection and Manner of Doing Work). When the specifications require work in areas fitted with the fixed CO2 systems (i.e. machinery spaces), the COR shall be notified prior to commencing work. All work in these areas shall be in strict accordance with 29 CFR 1915.506 and substitute fire protection equipment shall be furnished by the Contractor during the test or repair period.

d. Fire watches shall be posted wherever hot work is performed. Fire watches shall also be posted on the opposite side of all adjacent bulkheads, decks, and overheads where the hot work is performed. All fire watches shall remain on site until 30 minutes after the hot work is completed. For additional requirements, see 29 CFR 1915. It should be noted that 29 CFR

1915.52 (b)(3) only requires additional fire watches for specific conditions, however the Contractor shall provide fire watches for all hot work as mentioned above.

e. The Contractor is responsible for compliance with USCG regulations for handling of inflammable and combustible liquids. Whenever hot work is to be performed, a certified marine chemist's gas free certificate shall be furnished to the Government representative at the Contractor's expense prior to commencing work. Additionally, a copy of the most recent gas-free certificate shall be posted near the vicinity of the work and at each gangway for the vessel. The Contractor shall have the marine chemist recertify the vessel for all ongoing hot work permits in the event of any vessel movement or change in ballasted condition or in the case of any combustible liquid spillage. Following any of these events, inspection for recertification by a Competent Person is unacceptable.

f. All work in confined areas or enclosed spaces shall be performed in accordance with

Sections 06.I and 19.A.08 of Engineers Safety Manual EM 385-1-1, dated 15 March 2024 as amended. In such areas or spaces, the Contractor shall test for the concentration of oxygen and have immediately available a sufficient number of respirators for everyone working in such areas or spaces. An attendant shall be stationed outside every confined space while work is being performed therein and a rescuer equipped with respirators and retrieval lines shall be immediately available in case of an emergency.

g. The Contractor shall furnish a gangway, conforming to Engineers Safety Manual EM 385-1-

1, dated 15 March 2024, of suitable strength and construction for safe and convenient boarding of the vessel at all times. The gangway shall be installed at an angle of less than 40 degrees and shall have 39-inch high guardrails at both sides. Hatches and openings that present a falling hazard shall be provided with suitable and substantial guards.

h. All exits and passageways shall be kept free of obstructions and shall be kept well lighted at all times.

i. The Contractor shall maintain an accurate record of, and shall report to the COR, in the manner and on the forms prescribed by the COR, exposure data and all accidents, resulting in death, traumatic injury, occupational disease, and/or damage to property, materials, supplies and equipment incident to work performed under this Contract.

j. The COR will notify the Contractor of any non-compliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately correct the conditions. Such notice, when delivered to the Contractor or his/her representative at the site of the work, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the KO may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of a claim for extension of time or for excess costs or damages by the Contractor.

k. Compliance with the requirements of this provision (SC-5) by any subcontractors shall be the responsibility of the Contractor.

l. The Contractor shall utilize a locout/tagout procedure in accordance with 29 CFR 1915.89 the Control of Hazardous Energy (lockout/tagout). Within five (5) days after contract award, the Contractor shall provide the COR with a written outline of the system lockout/tagout procedures that will be utilized.

SC--6 PERFORMANCE OF WORK BY THE GOVERNMENT

The Government reserves the right to quarter and subsist the crew on the vessel and to perform certain work while the plant is in the Contractor’s possession. Government personnel, as well as any other Government Contractors, materials, equipment, and tools, shall be permitted to access the vessel while in the Contractor’s possession and to perform the work mentioned above.

SC--7 Labor Reports

The Contractor shall keep and maintain complete payroll records for the duration of time covering the work under this Contract for a period of three (3) years from the end of such periods, and such records shall be made available for Government inspection upon request.

SC--8 Workmanship

a. General

1. All labor shall be especially skilled for each kind of work, thorough and first class in every respect, and under competent direction.

2. Where work of one trade joins, passes through or is on other work, there shall be no discrepancy or misfit when completed. In engaging one kind of work with another, marring or damaging of previously acceptable construction shall be cause of Contractor's replacement at no additional cost to the Government.

3. All parts of the work intended to join or bear upon others shall have complete and solid surface contact and fit together neatly without excessive cold work during erection. All faying surfaces shall be painted and be clean and smooth before bolting up. Shims or liners shall not be used for the purpose of overcoming a bad fit. Stop waters shall be used only in seams or landings passing through or attached to watertight members.

4. All watertight staples and collars shall be malleable castings or forged from angles close fitting and with solid bearing over the entire faying surface. They may be riveted and caulked or welded watertight.

5. Ends of outstanding flanges shall be cropped.

6. Lightening holes may be punched or burned, and all edges shall have burrs removed.

7. All hull castings shall be machined or ground to bear solidly against the connecting structure and all holes drilled. Holes in members having sharp curvature shall be avoided whenever practicable.

8. Limber and air holes in adequate size shall be cut in floors and elsewhere to provide free drainage and passage of air. Limber holes shall be located at the level of any cement waterways.

9. All new and disturbed iron and/or steel work shall have its finish restored in kind, or as otherwise indicated by specification.

b. Cutting

1. All edges and corners of plates and shapes shall be smooth and free of burrs. The use of a cutting torch is permissible for cutting plates and shapes to size, but burning of bolt or rivet holes will not be permitted. New hull or bulkhead plates installed under this Contract shall have 2" minimum radius corners unless otherwise directed by the COR.

c. Welders and Welding

1. All welding performed under this Contract shall be accomplished only by welders who have successfully passed the qualification tests of ABS, the American Welding Society and/or the ASME for the type of welding to be performed by each welder. Copies of the certifications of each welder the Contractor wishes to use for Contract work shall be provided to the COR by the Contractor prior to the beginning of Contract work.

2. The Contractor shall bear the expense of conducting these tests and shall certify by name to the COR, welders who have successfully passed the prescribed test. The Contractor shall require any welder to repeat these tests when, in the opinion of the COR, the work of the welder indicated a reasonable doubt of his/her efficiency. In such cases, the welder shall be re-certified as above if he/she successfully passes the re-test.

3. The electrodes used throughout the work shall be suitable for use with the parent metal at each weld. Electrodes shall be received on the job in unbroken packages bearing the manufacturer's label or be otherwise marked. Certified statements shall accompany each shipment of electrodes to the effect that sample pieces, representatives of each kind and size in each shipment, have satisfactorily passed the tests required by ABS.

4. All welding procedures shall conform to American Bureau of Shipping standards where applicable.

5. Welding procedures, as to direction, length, number and sequence of beads, shall be carefully planned so as to minimize locked up stresses, shrinkage and distortion.

d. Standard Parts

1. All articles, fittings, equipment, machinery and supplies used in the work covered by these specifications shall, as far as possible, be the manufacturer's standard articles, of reliable make, the manufacturer's current product, for which spare parts are readily available.

2. All materials, equipment, and machinery installed in or delivered with the vessel shall be new and of the quality specified herein.

SC--9 General Requirements for Surface Preparation, Coating System, and Painting

a. All paint specified to be applied under this Contract shall be furnished by the Contractor unless stated otherwise.

b. Surface preparation, painting, staining, and varnishing of new and old construction, shall be in compliance with "Painting: New Construction and Maintenance", EM 1110-2-3400, 30 April 1995. All paint in use shall be thoroughly mixed at frequent intervals. Any materials not specified shall be the best of their kind suitable for marine work and subject to the approval of the COR.

c. During all exterior sandblasting and painting operations, the Contractor shall ensure that all areas of the drydock that are open to the atmosphere are covered (i.e. curtained) to prevent the dust cloud from spreading to other areas, specifically outside of the drydock. Similarly, if a marine railway is used for removing the vessel from the water, the Contractor shall ensure that all areas surrounding the vessel are covered to prevent the dust cloud from spreading to other areas.

d. Following the completion of all sandblasting, the Contractor shall remove and properly dispose of all sandblasting grit.

e. Hydro blasting may be utilized in conjunction with sandblasting; however, all surfaces shall be sandblasted to provide surface profile.

f. Paint shall not be applied when atmospheric conditions will affect its application or durability.

g. Each coat of paint should adhere firmly and uniformly to the surface to which it is applied.

Sufficient drying time shall be allowed between coats.

h. In general, if paint is sprayed, each coat of paint shall consist of a double spray coat in which the surface or section of a surface to be coated is sprayed in a series of half lapped passes over the surface or section of the surface, and then sprayed again at right angles to the first spraying direction in half lapped passes.

i. Following completion of all coatings, the Contractor shall provide a report from the coatings manufacturer’s representative. The report shall document all coatings, environmental parameters during the application of coatings, and all coating thickness readings. The report shall include a statement from the manufacturer’s representative certifying that the application of all coatings has been performed in accordance with their requirements.

SC--10 Standard Hull Materials

All structural hull material shall be in accordance with the current rules of ABS, or with the following specifications:

Standard Specifications for Structural Steel: ASTM A131/A131M Rev A;

Standard Specifications for Carbon and Alloy Steel Forgings for Thin-Walled

Pressure Vessels: ASTM A372/A372M;

Standard Specifications for Steel Castings, Carbon, for General Application: ASTM

A27/A27M;

Standard Specifications for Steel Castings, High Strength, for Structural Purposes:

ASTM A148/A148M

Standard Specifications for Gray Iron Castings: ASTM A48/A48M.

SC--11 ELECTRIC POWER, STEAM, WATER, COMPRESSED AIR, AND HEATING

OIL

The contractor shall furnish all necessary steam, compressed air, and electric power for lighting and heating, and for the operations of necessary deck and auxiliary machinery of the plant while it is in his/her possession. The Contractor shall provide water for use on the vessel. The water is intended to be used for sinks and toilets and therefore does not need to be potable. The Contractor shall also furnish No. 2 diesel oil in a portable oil tank for connection to the oil burner heating unit on the vessel.

The Contractor is responsible for providing all labor, hoses, electrical cable, and any other equipment or material needed to make up the connections for the services identified above. The Contractor is also responsible for disconnecting the services at the completion of the Contract.

SC--12 WHARFAGE, DOCKAGE, GARBAGE DISPOSAL, ETC.

While the plant is in his/her possession, the Contractor shall be responsible for any, and pay all expenses of wharfage, dunnage, dockage, mooring lines, garbage disposal, security, etc. The Contractor, after making repairs shall move the boat to a convenient berth for the purpose of testing machinery and taking on supplies. Fresh water for the use of the plant shall be provided by the Contractor, at his/her expense, while the plant is in his/her possession, and all freshwater tanks shall be properly filled on completion of the work and return of the plant to the Government.

SC--13 TESTS AND TRIALS

All machinery or other equipment installed, repaired or worked on by the Contractor shall be tested upon completion of all work to demonstrate proper installation and operation to the COR.

This shall include all removals for access and/or interference (See Contract Clause SW-1-h. for details).

Rework on any such equipment to demonstrate proper installation and operation shall be performed at the expense of the Contractor.

SC-14 CONTRACTOR COOPERATION WITH THE U.S. COAST GUARD, THE

AMERICAN BUREAU OF SHIPPING AND THE CONTRACTING OFFICER’S

REPRESENTATIVE

The Contractor shall provide the services of a marine surveyor to audio gauge various locations throughout the vessel in accordance with requirements of this clause. During the drydocking ABS will be performing Special Periodical Survey No. 9. See Reference “ABS Requirements - Special Periodical Survey – Hull 9” and “ABS Requirements – Special Periodical Survey – Machinery 9” for detailed requirements for the ABS survey. The Contractor shall cooperate with the COR in the recertification and/or inspection of the vessel by the U.S. Coast Guard (USCG), ABS and the COR. All costs associated with the Contractor's cooperation shall be the responsibility of the Contractor. The Contractor's cooperation during or in connection with such investigations may include, but not be limited to, the following:

a. Dye penetrant, water hose, air lance, and/or vacuum box testing of any welds performed under this Contract;

b. Flooding of areas of decks, small voids, small tanks and small spaces for testing of watertight integrity whether worked on under this Contract or not;

c. Hydrostatic pressure testing of all new piping and all piping that has been worked upon by the Contractor;

d. Manual movement of any unattached objects or any objects which can be easily dismounted or opened and moved anywhere on the vessel;

e. Minor interruptions of work for purposes of inspection not to exceed eight (8) man-hours of such interruptions.

f. Scheduling of work to accommodate inspections of sea valves, sea chests, tanks, hull sections and spaces, machinery and electrical items.

For the purpose of monitoring the quantity of man-hours used for items e. above, the Contractor shall maintain a log sheet to document the number of man-hours worked throughout the Contract completion. The Contractor shall request approval and signature of the Government Representative on site for each entry on the log sheet to verify the information.

Audio Gauging Requirements

The Contractor shall provide the services of a marine surveyor to audio gauge various locations throughout the vessel in accordance with 7-3-2/5 ABS Steel Vessel Rules for Special Periodical Survey No. 4 and Subsequent Special Periodical Surveys (Age > 15 Years). This survey will be the Special Periodical Survey No. 9 for the Hayward. The Contractor is responsible for all coordination to ensure that the marine surveyor and their equipment are acceptable to ABS and USCG prior to the start of any audio gauging work. The minimum requirements for thickness measurement at Special Periodical Surveys is as followed:

Two (2) transverse sections within the amidships 0.5L, (in way of two (2) different cargo

(or ballast) spaces, if applicable), avoiding those spaces previously gauged.

Internals in forepeak and after peak tanks.

All cargo hold hatch covers and coamings (stiffeners and plating).

Lowest strake and strakes in way of tween decks of all transverse bulkheads in cargo spaces together with internals in way.

Wind-and-water strakes, port and starboard, full length.

All exposed main deck superstructure deck plating

Flat keel plating full length. Also, additional bottom plates in way of cofferdams, machinery spaces and aft ends of tanks.

Plating of sea chests. Shell plating in way of overboard discharges as considered necessary by the attending Surveyor.

The Contractor is also responsible for having the marine surveyor provide a detailed report of the audio gauge readings.

As part of this work, the Contractor is also responsible for providing all labor and equipment for removal of paint in way of a reading and repairing paint, including non-skid where applicable.

Any additional suspect areas throughout the vessel that are noted by the attending Surveyor shall be audio gauged. This audio gauge work shall be covered by the additional audio gauging work identified under OPTION 3 – Additional Audiogauging.

SC--15 WATCH SERVICE REQUIREMENTS

The Contractor shall provide a 24-hour watch service to respond to any emergencies/alarms on the vessel while in the Contractor’s possession. The watchman will be given a key to the HAYWARD for use at night, on weekends and on holidays. The Contractor shall provide the name and qualifications of the watchman in writing to the COR. This information shall be submitted no later than 10 days after the Contract award date and shall be a prerequisite to the start of any work on the vessel.

SC-16 VESSEL SECURITY

The Contractor is responsible for security while the vessel is in the Contractor’s possession.

Physical means of preventing unauthorized access (i.e. gated access) to the vessel shall be provided in accordance with Federal Acquisition Regulation (FAR) Clause 252.217-7016 - Plant Protection.

SC-17 PROJECT SCHEDULE

The Contractor shall submit to the Government a project schedule with their initial proposal and update it and submit it to the Government on a weekly basis following award. The schedule shall identify the intended start and end date for work under each work item as well as percentage completed for each work item.

SC-18 INTERPORT COST DIFFERENTIAL

The Work Performance Location shall be limited to the area within the Project Boundary labeled “Limit of Drift Removal Project,” as shown on the project map “New York Harbor NY and NJ Collection and Removal of Drift,” dated 30 September 1986, plus extended locations outside of this Project Boundary, deemed safely navigable to reach by DCV HAYWARD as follows:

No further than a 550 nautical mile (round trip) voyage via navigable waters beginning and ending at the South Project Boundary in the Atlantic Ocean (Atlantic Highlands). Any coastwise Atlantic Ocean transit shall not extend past the entrance to Delaware Bay. Any transit route past this point must be via the Delaware River, C&D Canal, or Chesapeake Bay.

No further than a 200 nautical mile (round trip) voyage via navigable waters beginning and ending at the East Project Boundary in Long Island Sound (Port Chester).

No further than a 140 nautical mile (round trip) voyage via navigable waters beginning and ending at the North Project Boundary in the Hudson River (Tappan Zee). An Interport Cost Differential shall be applied for voyage travel distances beyond the East Project Boundary in Long Island Sound (Port Chester) or beyond the North Project Boundary in the Hudson River

(Tappan Zee) or beyond the South Project Boundary in the Atlantic Ocean (Atlantic Highlands).

This differential shall be calculated using the following formula.

Interport Cost Differential = (Round Trip Voyage Travel Distance Beyond Boundary in Nautical Miles x $100 per Nautical Mile) + $44,334.72 This Interport Cost Differential shall be applied to any proposals where the Work Performance Location is outside of the Project Boundary when determining final cost for comparison.

Technical Provisions

Hull Repairs

TP 1.01 Drydocking

a. The vessel shall be drydocked within five (5) calendar days after delivery of the vessel to

Contractor’s yard. See Paragraph SC-1 for additional details on vessel delivery. The vessel shall be drydocked for such time as may be necessary to complete the work required by this Contract. In particular, but not limited to the following, the vessel shall be drydocked for any exterior hull cleaning and painting below the waterline and for any interior or exterior hull plating, cutting, welding, plate replacement or structural repair or replacement within or upon the hull including hull anodes, rudders, shafts and propellers.

b. Irrespective of whether the vessel is in drydock, the Contractor is responsible for ensuring that there is a suitable drydock available for the plant for the entire Contract duration in the event that an emergency drydocking of the plant should be necessary for any reason.

c. The COR may allow exceptions at his/her discretion to the necessity for drydocking for various items of work on a case-by-case basis only when informed by the Contractor and allowed to render a decision prior to any work being performed on the requested exception.

d. The vessel shall be drydocked in accordance with the drydocking plan prepared by the U.S.

Army Corps of Engineers Marine Design Center, Drawing Number 574-E170-01. See the attached file named “574-E170-01.pdf” which is included in the Contract package.

e. Drydocking blocks and other drydocking supports shall not obstruct access to remove, work upon, or replace docking plugs, discharge openings, sea chests, anodes, shafts, struts, stern tubes, propellers, rudders, keel coolers or any other hull fittings. The Contractor shall remove and relocate drydocking blocks and/or supports, or refloat and re-drydock the plant, as needed at no additional cost to the Government in order to assure complete coverage in cleaning and painting or for any other work as specified herein. Prior to doing so, the Contractor shall notify the COR of their plan to relocate the blocks to adequately support the vessel.

f. The Contractor shall install temporary grounding straps from the vessel's hull to the dry dock's steel structure. The Contractor shall ensure that the straps will adequately protect the vessel from any stray currents that may be present from shore side power source.

g. Any direction by the COR for work required under these specifications including the direction of contract options which extends drydocking time within the overall Contract duration shall not result in any additional cost to the Government.

h. Prior to undocking the vessel, the Contractor shall notify the COR and the master of the vessel. Notification shall be provided a minimum of twenty-four (24) hours prior to undocking.

i. When undocking the vessel, all interior spaces and systems affected by work performed under this Contract shall be inspected for leakage, watertight integrity and/or seaworthiness by the Contractor and witnessed by COR or designated Government Representatives onsite.

TP 1.02 Gas-Freeing Compartments

a. Within three (3) calendar days after drydocking the vessel, the Contractor shall furnish all labor, material, equipment, and services to gas-free all hull compartments and make each space safe for entry and hot work. The contractor shall use forced air if needed to gas free the hull compartments.

b. The hull compartments to be gas-freed, tested, and certified are listed below (15 total):

c. The Contractor shall provide a licensed marine chemist’s gas-free certificates for each space and shall then maintain the chemist’s gas-free conditions for entry and hot work throughout the vessel modifications, including contract options, until all work has been verified as complete by the COR, ABS, and USCG.

d. If the gas-free conditions are violated at any point during the performance of this work, the contractor shall bear the full expense of gas-freeing the space and providing an updated marine chemist’s gas-free certificate.

e. The Contractor shall strictly comply with the requirements of the most up to date EM 385-1-

1 “Safety and Health Requirements Manual” as stated above in SC-5 “Accident Prevention” in regard to gas freeing all spaces requiring hot work.

NOTE – Costs associated with gas-freeing shall only be included under TP 1.02 and shall not be included under SC-5.

TP 1.03 Docking Plugs

a. The Contractor shall remove the thirteen (13) docking plugs near frame locations 6, 16, 23, 36 and 48, port and starboard, according to the docking plan. The contractor shall drain and clean the hull compartments and dispose of all fluids in accordance with all applicable Federal, State and Local regulations. Prior to vessel refloating, the contractor shall allow Government personnel to inspect and dry the interior surfaces of any compartments prior to the reinstallation of the docking plugs by the contractor. (Locations of fills: frames 3s, 7s, 16 p/s, 25 p/s, 30 p/s, 50 p/s, transom cl. Locations of drains: 7s, 16 p/s, 25 p/s, 30 p/s, 34 p/s, 35 p/s, 50 p/s.)

b. Any drainage through the docking plugs from both normal accumulations and from any cleaning in (a) above will be disposed by the contractor as per OPTION 10 – Bilge Water Disposal, in accordance with all Federal, State, and Local regulations.

c. Docking plugs shall be reinstalled with new gaskets after cleaning and drying of the interiors paces, if such cleaning and drying is specified elsewhere in these specifications, and prior to any sandblasting/sand washing of the hull exterior or refloating of the vessel.

TP 1.04 NOT USED

TP 1.06 Sea Chest Maintenance

a. The Contractor shall remove and clean the sea chest bottom strainer plates. The interiors of the sea chests shall be cleaned and then painted with Apexior No. 3 (Dampney Co., Everett, Mass.) or approved equal.

b. The Contractor shall replace all of the sea chest zinc anodes. The Contractor shall assume there are a total of six (6) 20-25 lb bolt on zinc anodes in the sea chest to be replaced.

Renewal of zincs under this provision shall be paid for only under this provision. Sea chest bottom strainer plates shall be re-installed following work in the sea chest.

TP 1.07 Rudders

a. The Contractor shall disconnect and remove the port and starboard rudders. The Contractor shall weld pad eyes onto the rudders to facilitate the removal of the rudders. The contractor shall remove the access plates and drain plugs on the two (2) rudders and allow the rudders to drain prior to removal.

b. The Contractor shall clean each rudder post, key, and rudder bore in way of the taper fit. The

Contractor shall take rudder post bronze bushing clearances immediately upon removal of the rudders and furnish the COR with a written report of the clearances. The Contractor shall keep rudder post bores open and accessible for joint inspection of the rudder post bearings and bearing housings by the COR and ABS. Depending on the condition found, the Contracting Officer may direct the changing of the rudder stock bearings under OPTION 8 – Rudder Stock Bearings.

c. The Contractor shall pressure test the rudders in the presence of the COR…
