About this file

This document appears to be an Amendment to a federal solicitation, specifically Amendment 0003 to Solicitation W912BU24B0009 for the Beach Nourishment project on Long Beach Island, New Jersey. The amendment provides responses to Requests for Information (RFIs) and revises several specifications and contract documents, including the Bid Schedule, Option Table, and technical sections such as Construction Photography, Survey Requirements, and Dune Crossovers. The key changes include extending the bid opening date, revising the maximum dredging depth for the borrow area, clarifying survey and photo documentation requirements, and making minor technical specification updates. The solicitation is for a firm-fixed-price construction contract with a base bid quantity of approximately 1,750,000 cubic yards of beachfill, plus multiple options to place additional quantities. The contract period of performance is 270 calendar days.

Amendment No. 0003

IFB W921BU24B0009

Requests for Information and Responses

1) Can you please provide the latest survey data of the borrow area?

ANSWER: The latest survey we have is provided. The survey was performed in November

2020.

2) Can you please provide the anticipated date of NTP?

ANSWER: A specific date for the NTP cannot be forecasted at this time. NTP is dependent on the successful low bidder timely submission of pre-award survey documentations and timely submission of required post award documents. If all documents are approved, then NTP may be issued at that time.

3) In reference to section 01 32 33, Part 3, Section 3.1, is the pre-construction photo requirement a minimum of 25 images total for the entire project or 25 of each town/option area?

ANSWER: A minimum of 10 pre-construction photos are required for each town.

Specification section 01 32 33 has been revised to reflect this change.

4) In reference to section 01 32 33, Part 3, Section 3.1, are the weekly construction photos to be taken only of what is currently under construction?

ANSWER: Monthly construction photos are to be taken only of what is currently under construction. Specification section 01 32 33 has been revised to reflect this change.

5) In reference to section 01 32 33, Part 3, Section 3.1, can you confirm that the weekly construction photos required are 10 photos total and not 10 photos of each definable feature of work?

ANSWER: Monthly construction photos are 10 photos total, but request these photos consist as much definable features practical. Specification section 01 32 33 has been revised to reflect this change.

6) In reference to section 01 32 33, Part 3, Section 3.1.1, are hard copies of the construction photograph images required or just the digital images?

ANSWER: Only digital images are required.

7) In reference to section 01 32 33, Part 3, Section 3.2, do you want aerial obliques of the entire project each month or just the area under active construction?

ANSWER: Aerial obliques are to be provided for the entire project each month.

8) In reference to section 01 32 33, Part 3, Section 3.2.1, are hard copies of the aerial obliques required or just the digital images?

ANSWER: Only digital images of aerial obliques are required.

9) In reference to section 01 32 33, Part 3, Section 3.3.1, is there a required time frame for the aerial obliques to be taken in similar to the time frame for the geo-referenced aerial imagery?

ANSWER: Refer to the time frames specified in paragraphs 3.2 and 3.2.1 of specification section 01 32 33.

10) In reference to section 01 32 33, Part 3, Section 3.3.3, are hard copies of the geo-referenced aerial images required?

ANSWER: Only Digital images of the geo-referenced aerial images are required.

11) In reference to section 01 57 19, Part 3, Section 3.4.2, “Prior to the nesting season(s), ENSP will delineate the portions of the project area that contain highly suitable nesting habitat.

These are the areas, as well as existing nesting areas, that require monitoring during the nesting season. Monitoring of these areas shall begin a minimum of 2 weeks prior to construction activities within the suitable nesting habitat.” Is the two weeks prior to project construction as a whole or 2 weeks prior to construction activities in those particular areas?

ANSWER: This applies to construction as whole.

12) In reference to section 01 71 23, Section 3.6.1, is there a required time frame for the Pre-

Project and Post-Project surveys?

ANSWER: Refer to paragraph 3.2.4.1 of the revised specification section 01 71 23 included in this amendment.

13) In reference to section 01 71 23, Section 3.7.1, are the pre-placement condition surveys to be ran for the entire project at once or just the specific work areas 21 days prior to commencing work there?

ANSWER: Pre-condition surveys are to be collected for specific works areas 21 days prior to commencing work in that area. Specification section 01 71 23 has been revised for clarity.

14) Is planting to be conducted all at once, as the project progress after fencing has been installed in a particular location, or per town/option area as it is completed?

ANSWER: See Order of Work required in Section 32 92 00. Plantings can be installed at contractor’s discretion during the appropriate planting windows outlined in the specifications.

15) Can you please confirm if the contract time stated includes completion of all planting since planting is only allowed during a certain period of the year?

ANSWER: Dune grass planting and fertilizer may be completed outside of the 270 days due to seasonal planting and fertilizer time restrictions, but not later than one planting and fertilizer season after dune construction per specification section 32 92 00 Sand Fence and

Dune Grass.

16) We kindly request a two-week extension to the bid date.

ANSWER: Bid due date will be extended 14 days.

17) Could you please provide the most recent borrow area survey data for IFB W912BU24B0009

Beach Nourishment Barnegat Inlet to Little Egg Inlet Long Beach Island?

ANSWER: The latest survey we have is provided. The survey was performed in November

2020.

18) Appendix B41, Vibracore Logs on page 493 of 674 within the Contract Specifications. After reviewing the geotechnical data it is noted that there would not be a sufficient quantity of material in the borrow area if the base and all option items were awarded.

Paragraph 1.6.2 Restrictions on Borrow Area D-1 on page 443 of 674, states, “if during the progress of the work it is determined that the borrow area does not contain a sufficient quantity of material for completion of the project, the Contracting Officer may adjust the maximum allowable depth of the borrow area.”

a) Upon review of vibracore borings issued within Appendix B41 it is evident that many of the logs do not go deep enough to cover any additional depths added to the borrow area.

Will the Owner please provide additional geotechnical information on the material that may be encountered should the borrow area depths be extended for dredging?

b) If material encountered is not suitable for beach placement, will an additional/alternate borrow area be provided?

c) If an additional/alternate source is provided will the Owner please provide additional geotechnical information of this source?

ANSWER: Part A. The elevations on select vibracore logs were inaccurate and have been corrected. See AM0003.

Part B. A deeper maximum dredging depth is provided in AM0003. No additional borrow area will be provided.

Part C. No additional source will be provided.

19) On the projects Sam.Gov site, under description paragraph 2, it is stated that all work under this contract shall be completed no later than January 15ᵗʰ, 2025. While clause 52.211-10

Commencement, Prosecution and Completion, on page 36 of 674 of the contract specifications it states that the work must be completed NLT 270 days from receipt of NTP.

a) The Contractor is requesting clarification as to which will apply.

ANSWER: Work must be completed NLT 270 days from receipt of NTP.

20) Clause 52.211-10 Commencement, Prosecution and Completion, on page 36 of 674 of the contract specifications it is stated that the Contracting Officer can exercise any or all of the options within the durations listed on the optional table.

a) Due to the potential of additional cost for movement of pipelines the Contractor is requesting clarification on the award of the options, is it the Governments intent to award option items in a manner that would make them discontinuous with other adjacent beachfill reaches? For instance, the award of CLINs 50-52 “Surf City” without award of CLINS 47-49

“North Beach”, thus making the Surf City work potentially discontinuous.

b) If discontinuous reaches are encountered would the Contractor be allowed to place pipeline on the existing native non-filled beach in an effort to reach the awarded optional item section?

ANSWER: Part A. There may be an instance that no contiguous reaches may be issued.

Part B. This will be on case-by-case basis, with COR approval prior to entering an area.

21) In an effort to allow the best pricing and most flexibility for suitable equipment within the market the Contractor is requesting the Government change the work window from a must complete day format to a must complete date of March 1ˢᵗ, 2026.

ANSWER: Work must be completed NLT 270 days from receipt of NTP.

22) The Contractor is requesting the Government extend the bid due date by an additional 30 days.

23) Paragraph b. of Section 3.8.1 Completion Time Requirements on page 365 of 674 within the

Contract specifications states; the Contractor must complete after-beachfill surveys of a particular location no more than 14 calendar days after the commencement of the before-beachfill surveys. (14-day max performance period).

a) Due to the sail distances from the borrow area to the southern fill reaches, the potential of extreme weather events, sea state and atmospheric, it is not unheard of for particular locations taking more than 14 days to fill along this stretch of shoreline. The Contractor is requesting the Government alter/remove this statement from the specifications, thus allowing more time between before and after beachfill surveys.

ANSWER: Bid as shown

24) Section 11 of the Standard 1442 form issued with the Contract specifications states that the

Contractor shall begin performance within 10 calendar days and complete within 270 calendar days after receiving NTP.

a) The Contractor is requesting the Government specify when to expect NTP?

ANSWER: Notice to Proceed cannot be provided. See Answer 2 above.

25) Option 1 Brant Beach as listed on the table in clause 52.211-10 Commencement, Prosecution and Completion of Work, states that the Government would have up to 90 days after pre project survey approval to award this option. Due to the advancement of the national dredging fleet it would not be unheard of for a Contractor to complete the base bid items prior to that 90 day award window, thus allowing the potential of demobilization commencement prior to the end of the 90 day award window.

a) The Contractor is requesting the Government waive or change the award window for this work to a more suitable timeline.

b) The same question above applies for Options 11, 14, 20, & 23 as included on that table, all of which have a 120 award day window from the pre project survey approval.

ANSWER: Bid as shown.

26) The Contractor is having difficulty opening the XYZ data file issued with the contract documents for the borrow area.

a) The Contractor is requesting the Government verify the data format and re issue.

ANSWER: The XYZ data provided is the raw data that can be opened in notepad and turn into a text, or CSV file. The data must be manipulated to input into software such as AutoCAD.

27) This contract has many options with varying windows for possible award. Can the USACE confirm the following?

a) If a contractor shows up & completes all awarded work prior to the days allowed for awarding the options can the USACE confirm that the options will not be awarded once demobilization has begun?

b) For options that are widening or lengthening the beach can the USACE confirm that those options will be awarded by the time the contractor starts work within those sections and will not be awarded at a later time that the contractor would have to repump an area or lay additional pipe outside the ordinary advancement of beachfill activities on the beach?

ANSWER: Part A: Options may be awarded once demobilization has begun.

Part B: Bid as shown.

28) Can the USACE confirm what the intent is of having so many options vs quantity in the base bid

(i.e. is it funding or is it based on a need for sand in those areas)?

ANSWER: Potential need for sand based on Pre-Project condition surveys of areas outside of base.

29) This project is subject to the Project Labor Agreement (PLA) requirements of Executive Order 14063. Due to the time required to properly prepare an agreement between the contractor and all parties, please extend the bid date by 30 days.

30) We would like to submit a proposal for the photogrammetry and aerial photography scope.

Can you provide us with a list of bidding General Contractors? Or should we be submitting our proposal directly to you?

ANSWER: There are no bidding general contractor listings. All contractors interested in submitting a BID are encouraged to do so. BID submission instructions are in the solicitation.

31) I understand that this BID is due today. I have attached your BID page that shows the specifications on the Accessible Mats. These specs as they are written are for a specific product manufactured by our competitor. We see these specs repeated in most Beach

Replenishment Bids. The specs in our opinion, are too restrictive which does not allow us to compete. This to us appears to be a Brand Name Sole Source Opportunity yet that is not stated within the BID.

ANSWER: Specification section 32 15 00, paragraph 2.6.2 has been revised to reflect changes in anchoring requirements.

32) We also feel that this restricts the end user from receiving the best solution, whether it be mats or an alternative compliant product. I have attached the specs on our AccessMat and our AccessDeck USA for comparison and review.

ANSWER: Bid as shown.

33) Our company has a standing collective bargaining agreements with the Seafarers

International Union (SIU) and the International Union of Operating Engineers Local 25 Marine

Division. For the International Union of Operating Engineers, Local 825 in New Jersey, our company pays their members prevailing wages and benefits based on the local jurisdiction and trades involved in the project from that local. These existing agreements will be in effect for the duration of the contract. The existing agreements provide the most efficient and comprehensive solutions for labor disputes, labor management, productivity, health and safety, and prevention of strikes, lockouts, and similar job disruptions. Therefore, these standing agreements meet the basic requirements for a PLA under Executive Order 14063/

FAR 52.222-33-34 without disrupting the existing agreements with negotiations. The existing agreements also measure up to public policy concerns of the requirement by guaranteeing efficient and timely completion of the project. Please confirm these agreements will meet the requirements of Executive Order 14063/ FAR 52.222-33-34.

ANSWER: Responded under AM0001

34) The structure of this contract, a small base bid scope of work with multiple options totaling significantly more than the base, plus the extended timing regarding the award of options does not provide a clear picture of the project to be bid. At the time of award the contractor will not know if the scope of work is 1,750,000 cubic yards or 4,937,250 cubic yards. This is a significant scope of work without a clear completion contract date. These unknowns result in increased costs due to the contractor not being able to define the appropriate equipment, resources or work window. For contractors to prepare cost efficient estimates and provide competitive pricing we request the options be issued within 30 days of the award.

ANSWER: Options cannot be issued until after the pre-project condition surveys are reviewed and approved and for the base area options, until the pre-placement surveys are reviewed and approved. For the Base area, Options to be issued cannot be determined until the Pre-

Placement surveys are reviewed and approved.

35) In the Option Award Table, The Days to Exercise Option for Options 8-10 states 21 days after

Pre-Placement survey approval for station 780+00 to 967+00. The base beachfill stationing in the bid schedule is from 770+00 to 967+00. Is the option area meant to be 1,000’ less than the base area? Please clarify which stationing is correct.

ANSWER: Correct stationing is 770+00 to 967+00 for Options 8-10. The Option Table has been revised to resolve this discrepancy.

36) In the Option Award Table, The Days to Exercise Option for Options 14-16 states 120 days after Pre-Placement survey approval for station 373+00 to 447+00. The base beachfill stationing in the bid schedule is from 337+00 to 447+50. Is the option area meant to be different than the base area? Please clarify which stationing is correct.

ANSWER: Correct stationing is 337+00 to 447+50 for Options 14-16. The Option Table has been revised to resolve this discrepancy.

37) In the Option Award Table, The Days to Exercise Option for Options 17-19 states 120 days after Pre-Placement survey approval for station 447+00 to 520+00. The base beachfill stationing in the bid schedule is from 447+50 to 520+00. Is the option area meant to be different than the base area? Please clarify which stationing is correct.

ANSWER: Correct stationing is 447+50 to 520+00 for Options 17-19. The Option Table has been revised to resolve this discrepancy.

38) In each beachfill option area, does the USACE intend to award the large quantity (first option under each option beach section) before awarding the smaller quantity within that section? If the larger quantity is not awarded, will no other options be awarded in that beach section? If so, please add a note in the bid schedule that Options 2, 8, 11, 14, 17, 20 and 23 will be awarded first before any other option in that stretch of beach.

ANSWER: The First option for each of region outside of the base will be exercised prior to the other smaller sand only options for that region.

Example: Option 1 Brant Beach (Sta 520+00 to 570+00) will be exercised before any other option for Brant beach (Options 5, 6, or 7) can be exercised. The mobilization cost to move from base to Brant Beach goes into unit cost of Beachfill Item #31 of Option 1. It follows

North Beach (Sta. 310+00 to 373+00) Option 11 before Options 12 or 13; Surf City (Sta

373+00 to Sta 447+50) Option 14 before Options 15 or 16; Ship Bottom (Sta 447+50 to Sta

520+00) Option 17 before Options 18 or 19; LBT (Sta. 570+00 to Sta. 675+00) Option 20 before Options 21 or 22; LBT (Sta. 675+00 to Sta. 770+00) Option 23 before Options 24 or 25.

39) For Brant Beach, does the USACE intend to award Option 1 and/or Option 5 before they award Option 6 and 7? If so, please add a note in the bid schedule regarding this.

ANSWER: It is USACE intent that Option 1 will be awarded prior to either or all Options 5 or 6 or 7 being exercised.

40) On Page C-113 of the drawings, station 570+00 says it is the Base Contract Fill Limit, while the notation from STA 570+00 to 520+00 states this area is for Option 1 and Options 5 through 7.

STA 520+00 also states Base Contract Fill Limit stops at 520+00. The bid schedule states that

STA 520+00 to 570+00 is an area with options and not base work. A beachfill template is provided for Brant Beach, just like the base beaches. Please clarify whether this stretch of beach is base or option area.

ANSWER: Station 520+00 to 570+00 (Brant Beach) is Option Work only.

41) Both base beaches (Sta 120+00 to 310+00 and Sta 770+00 to 967+00) have areas within their stationing limits with significant gaps in the beachfill template. Should the contractor expect, if options are awarded, the quantity could be within these gaps (potentially less than 10 cy/lf) or within the beachfill template provided (making the fill density larger)?

ANSWER: Yes.

42) The bid schedule states the base work is in North Beach Haven, Beach Haven, and Holgate

(STA 770+967+00) while in Section 01 71 23 Page 8, states the base work areas is in North

Beach Haven, Beach Haven and Holgate (Sta. 770+00 to 962+33). Please clarify which beach stationing is correct so the contractor will know where the beachfill material will be placed.

ANSWER: Station 770+00 to Station 962+33 is correct. The Bid Schedule has been revised to resolve this discrepancy.

43) Will the contractor be allowed to transit the full length of Long Beach Island to move between base and option reaches?

ANSWER: Will be on a case by case basis with prior approval of COR and in accordance to restricted areas described in section 01 57 19.

44) The borrow area provided in the contract documents does not contain sufficient material to meet the contract pay quantity. The deficit is even more significant when allowing for reasonable buffer zones and the unavoidable losses associated with beach fill operations.

Please include an additional borrow area to the contract documents so that the full contract pay quantity can be met and contractors can accurately estimate beach fill costs based on the borrow source. Section 01 57 19 3.4 Biological Resources, b. "Record observation data of threatened and endangered animal and plant species on the attached Endangered Species

Observer Forms and submit with the Quality Control report to the COR on a daily basis." is the contractor required to have NFWS approved ESOs on board of the hopper dredge.

ANSWER: A deeper maximum dredging depth is provided in AM0003 to meet the contract pay quantity. No additional borrow area will be provided.

45) Section 01 57 19 3.4 Biological Resources, b. "Record observation data of threatened and endangered animal and plant species on the attached Endangered Species Observer Forms and submit with the Quality Control report to the COR on a daily basis." is the contractor required to have NFWS approved ESOs on board the hopper dredge?

ANSWER: No observer needs to be on board the dredge, but Endangered Species Form need to be completed per specifications. Munitions screens also need to be inspected according to the specifications.

46) Is there any timing restrictions on the Pre-Project Surveys? Will the contractor be allowed to conduct the Pre-Project Surveys once NTP is received?

ANSWER: Refer to paragraph 3.2.4.1 of the revised specification section 01 71 23 included in this amendment. (See specification section 01 71 23. paragraph 3.2.4.1). Additional applicable timing restrictions would apply. (See section 01 57 19 in the specifications).

47) Due to the multiple option locations throughout Long Beach Island, the contractor will be required to include in the main mobilization/demobilization line item, the cost to have multiple subline landings throughout Long Beach Island. Please consider having separate mobilizations for each option area not wholly contained within the footprint of the 2 distinct

Base Beachfill Areas.

ANSWER: Mobilization and Demobilization Estimated Amount Item#1 shall include only costs for mobilization for the BASE BID Items. The cost to move from Base Areas to Option Areas out side of base should be included in the unit costs for the first Beachfill item within each region. Item #’s 31, 47, 50, 53, 56, & 59, respectively.

48) Are dune repairs required only in areas shown on the drawings? Will there be dune repairs in areas where no beachfill is being paced? If so, where would the material be sourced from to fill the template?

ANSWER: Material will be sourced from Borrow Area D-1. Pre-conditional surveys will determine if additional dune repair is required.

49) Due to the complexity of the project and outstanding questions, the contractor requests that the bid date be postponed by 2 weeks.

ANSWER: Bid due date is extended 14 days.
