AMENDMENT 0002 RFI RESPONSES

W912BU23B0010-Indian River Inlet Repairs RFI Tracker RFI# Question Government Response

1 Can we provide the bathymetry data included on the plans in XYZ format?

Bid as shown; no additional bathymetric data will be provided.

2 Who owns the tall utility lines that cross over the site? Utility lines are owned by Delmarva Power.

3 What are the bottom elevation(s) of the State Route 1 bridge that crosses over the work area?

Clearances to the bottom of each steel anchorage cap are shown in the attached.

4 It is respectfully requested that the USACE, as the Designer/Engineer of record, provide sections (like was given for the HP 14x117) for the North side sheet pile (PZC26 ?) and the South side (PZC13 ?). Also please provide splicing detail for the sheet pile. This is requested so all GC`s will be bidding on the same items.

Bid as Shown, contractor shop drawings are to include splicing details for USACE review and approval.

5 Please provide bolting detail for attaching the lagging to the HP and the timber cap size and bolting detail for the same reason as question # 1.

Timber Cap size and bolting details shall be provided by contractor as a shop drawing submittal for USACE review and approval.

6 We have concerns as to the safe constructibility of the Post and Beam wall. You will have a cut of approx 14' to the bottom of # 57 stabilization/dewatering stone below high tide. This cut will be with-in feet of IRI. The GC will have to excavate through the existing tie rods and rock leaving very little material between the excavation and IRI. In running sand conditions this will not be possible without installing a steel sheet pile cofferdam. Trying to dewater without the safety of a steel sheet pile cofferdam this close to IRI would be an extreme hazzard.Installing a new sheet pile wall behind (landward) of the existing sheet pile would be a better option. This could be accomplished by welding SKPF & SKPM sheet pile interlocks to the HP flanges and then driving steel sheet pile interlocked fron HP to HP. The wood 4x12 x 4 EA lagging and timber cap could stay the same for the upper 6'- 7'. The USACE might also consider installing tie-rods from the Post & Beam wall back to the new 50' steel sheet pile wall.

Bid as shown.

7 The Post and Beam wall is in the zone of the 250 PSF area. The size of excavator needed to excavate in sand -locked in rock would be in the 120,000 - 160,000 # range.

The is the dead static weight of the machine and does not take into factor the extreme dynamic pressure this machine will be putting on the ground when excavating in sand locked rock.

Bid as shown.

8 Please provide a DEL DOT approved working clearance from the sides and underneath the RT 1 Bridge.

Clearances to the bottom of each steel anchorage cap are shown in the attached.

Proposed clearances of contractor equipment to the bridge shall be submitted in accordance with work plan requirements described in specfications for USACE and DelDOT review and approval.

9 Please consider a bid quantity for import borrow - sand fill for bringing backfill up to the new sidewalk subgrade.

Bid as shown.

10 Are the offsets for construction loading shown on sheet c- 003 of the plans only for the areas shown or for the entire bulkhead face.

The offsets for construction loading are for the entire north bulkhead face.

11 Can the contractor access shown on various sheets in the plans for the existing tower foundation be adjusted to follow the existing road rather than running through the beach dune.

Contractor access will be permitted around the beach dune to access the existing tower foundation for demolition.

12 What is the clearance from existing ground to the bottom of the RT 1 bridge.

Clearances to the bottom of each steel anchorage cap are shown in the attached.

13 What is the clearance from the existing concrete sidewalk to the power lines that are to the West of the Rt 1 bridge.

Bid as shown. Clearances to catenary lines are greater than clearances to bridge anchorage caps. Pile driving methodology approved for work under bridge will satisfy clearance requirements for work under catenary lines.

14 Can the existing conditions survey used for the design on the plans for the work on the north side of the site be provided to show more detail of the existing ground and features around the work area and near the bulkhead to aide in bidding for access to the work areas.

Bid as shown, no additional existing ground data will be provided.

15 Will the sign in sheet from the site visit be posted to the solicitation?

Sign in sheet is attached.

16 Will the contractor be allowed to drive mooring piles in the channel and/or construct a trestle for access to the rip rap placement area of work due the strong currents and depths that make a spud barge unsafe for the work site.

Bid as Shown, mooring piles are not permitted in the channel.

17 Can the 6 ADA compliant restrooms be in a trailer mounted unit with lights and power rather than normal jobsite Porta-Jon’s. If so, can the daily cleaning requirement be adjusted since the trailer unit would be like a permeant structure.

Bid as shown.

18 Can the timber wall be bolted to the h beams to keep them at grade.

Bid as shown.

19 Can the required potable water supply for the USACE trailer be covered with the water cooler & the bathroom use non potable.

Yes.

20 Can the Load Scale in a crane be sufficient for weighing of the stone removed from the existing shoreline.

Bid as Shown.

21 Is there an electrical source available in the staging areas for the office trailers and ticket booth to be hooked to.

Contractor shall erect a temporary power pole satisfactory to Delmarva Power adjacent to the trailers and ticket booth and pay for for temporary power.

22 Is there a fresh potable water source available on site for the bath rooms and trailers to be hooked to.

No, provide a refrigerated water cooler in the trailers and ticket booth.

23 What specification of seeding needs to be used during the demobilization phase for the laydown areas and other disturbed areas.

Seeding shall conform to "DelDOT Permanent Grass Seeding, Dry Ground" and "Permanent Grass Seeding, Stormwater" as applicable.

24 May a remote trench compactor be used in leu of a walk behind plate vibrator to prevent workers being in the excavated areas.

Bid as Shown.

25 Is the flowable fill required on the south jetty the same as what is mentioned in Section 31 23 00 Part 2 2.11

Bid as shown; Flowable fill for the South Jetty shall conform Part 2.1.1 of 31 23 00.

26 What is the vertical clearance between the existing sidewalk and the bridge where the sheet piles are to be installed?

Clearances to the bottom of each steel anchorage cap are shown in the attached.

27 What is the vertical clearance between the existing sidewalk and the catenary lines where the sheet piles are to be installed?

Clearances to catenary lines are greater than clearances to bridge anchorage caps. Pile driving methodology approved for work under bridge will satisfy clearance requirements for work under catenary lines.

28 Who owns the catenary pole / lines? What voltage are they?

Utility lines are owned by Delmarva Power, voltage unknown.

29 Please confirm if the contractor is to drive the sheet pile and H pile through the existing Matstone and/or Corestone, or excavate and replace the stone. Driving through it could create excessive vibration or ground movement and prove insurmountable with the vibration limitations.

Bid as shown. Limitations on excavations for installation of steel sheetpile apply to the South Jetty.

30 Drawing C-301 Note 18 – says to remove or cut existing timber buttresses to install the sheetpile. If the batter pile obstruct the sheet pile, this may require deep excavation and dive work. Please confirm the limits of removal.

Bid as shown.

31 Please provide a detail for bulkheading the existing MSE Wall under the sidewalk to remain at North Bulkhead Sta 0+16.89 and 3+40.00

Replicate the MSE existing bulkheading as shown in the reference drawings.

32 The natural angle of repose for rip-rap stone, especially in an underwater environment with turbulent currents is approximately 1V:2H. As such, the amount of rip-rap that would need to be installed in order to meet the design grades and tolerances is ~12,000 tons instead of the 4,040 tons provided for in the contract. As the spec is currently written, stone installed within template would be lost down the steep slope and into the scour hole until enough is built up to serve as a foundation to build the rip-rap blanket further up the slope. However, only the amount of stone that is placed within the limits of the design template would be payable to the contractor, with no means for the contractor to be paid for the extra stone incidentally placed. Will USACE revise the specifications to allow payment to the contractor for all stone installed in the construction of the rip-rap work?

Bid as shown.

33 Page 7 of the plans references construction loading limits.

Note 7 refers to specs, but the contract specifications are missing any further information related to the ground loading restrictions. Can this information be provided?

Do the 250 and 500 psf values only apply in the areas of the two dashed lines?

The offsets for construction loading are for the entire north bulkhead face.

34 Can we provide the bathymetry data included on the plans in XYZ format?

Bid as shown; no additional bathymetric data will be provided.

35 Who owns the tall utility lines that cross over the site? Utility lines are owned by Delmarva Power.

36 What are the bottom elevation(s) of the State Route 1 bridge that crosses over the work area?

Clearances to the bottom of each steel anchorage cap are shown in the attached.

37 I have reviewed the Davis Bacon rates provided for the Indian River Inlet Coastal Navigation Structure Repairs Solicitation # W912BU23B0010. This solicitation requires installation of sheet piles for bulkhead repairs, however the wage rates do not include a rate for Piledriver as an operator or a laborer/rigger classification. Please request the additional wage rate from the Department of Labor so that the pertinent wage requirements are known for this segment of the work.

An updated Heavy Construction wage determination has been provided, as well as a new Highway Construction wage determination that reflects construction positions mostly closely aligned with that of a piledriver.

38 What is the vertical clearance between the ground elevation and the bottom of the bridge deck (i.e. limiting vertical clearance) in the vicinity where the sheeting would be installed under the bridge? The concern is getting adequate equipment to install sheets and having adequate vertical clearance to fit that equipment under the bridge.

Clearances to the bottom of each steel anchorage cap are shown in the attached.

Proposed clearances of contractor equipment to the bridge shall be submitted in accordance with work plan requirements described in specfications for USACE and DelDOT review and approval.

39 What is the point of the post and panel wall? Is there a significant benefit to it instead of steel sheet piles? Would the government consider driving steel sheets in lieu of the post and panel design?

Bid as shown.

40 We would like to ask for the bid opening date to be postponed by a week to allow adequate time to receive and consider answers to questions.

The bid opening date is being extended to 11:00 a.m. on August 29, 2023.

41 Are there any limits of coating for both the sheet piles and H-piles, or shall all the pilings be coated full length?

All sheet pile and H piles shall be coated full length, all sides.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

* a survey underlying a wage determination

Write to:

Branch of Construction Wage Determinations Wage and Hour Division
