RESPONSES TO RFIS
MEMORANDUM For: CENAP-CTC 3 September 2021
SUBJECT: Requests for Information Consolidated for Solicitation W912BU21R0016
In reviewing the solicitation requirements and bona fide office requirements, I would like to confirm our ability to bid, as we are located in New Jersey, which is SBA Region 2 and Pennsylvania is located in SBA Region 3. Do I have to clarify this with my SBA representative or is this a question that can be answered by the USACE?
Answer: On August 25, 2021, in reference to attached SBA Policy Notice 6000-819056, a moratorium of the Bona Fide Place of Business (BFPOB) was issued. Accordingly, this policy is effective until September 30, 2022. The Acceptance letter for this procurement is dated 11 August 2021. Bona Fide Office rules apply per the guidance of the SBA. Acceptance is through the SBA Eastern Pennsylvania District Office; SBA Requirement Number –0303- 21-081121-03 How does this change effect the District Office? 1. A request for a Bona Fide Place of Business determination received prior to August 25, 2021, should be processed in accordance the Bona Fide Place of Business procedures. 2. A request for a Bona Fide Place of Business determination received after August 25, 2021, should not be processed. 3. Competitive Offer letters received prior to August 25, 2021, where a BFPOB is required, will continued to be required. The acceptance letter should include the BFPOB requirements. 4. Competitive Offer letters received after August 25, 2021, will not include the BFPOB requirements. (updated language to be provided). 5.
Sole Source offer letters received prior to August 25, 2021, where a BFPOB is required, we would not require new sole source offerings. Any sole source eligibility determination conducted on or after August 25th would simply disregard the requirement under 13 CFR 124.501(g)(4).
My understanding of the Bona Fide Office rule from my SBA BOS is that firms are eligible to perform work in neighboring States. This has also been stated on other solicitations recently. Can you please confirm that a firm located in a neighboring state such as Maryland is eligible.

We noticed that the official solicitation for the SRM MATOC was posted today to sam.gov. After reviewing the documents we were not able to locate in the notice or the solicitation documents regarding which geographic boundaries for 8(a) bona fide offices would apply in order to be eligible for award. We have reviewed the SBA document regarding bona fide offices however the document or the RFP do not state which states are eligible.
Typically the RFP's state which 8(a)'s are eligible for award based on which SBA office they are serviced by. Could you please clarify for this solicitation which 8(a)'s are eligible for award based on which SBA office they are serviced by or which 8(a) firms are eligible based on which states they are located in?

I could not find any information on how to submit questions in the solicitation. I listed our questions below. If you would like for me to submit them in a different format, please let me know.
1. Magnitude of task orders is between $2,500 and $10,000. Can you let us know the range of typical task orders that will be issued on this MATOC?
2. Please confirm that only Phase 1 proposals will be due on Sep 13, 2021.
3. Please confirm the expected award date for the MATOC
Answers:
1. The Magnitude of task orders ranges between a minimum $2,500 to a maximum $10,000,000.
The guaranteed minimum order value is $10,000 for awardees of the MATOC. The typical task order is expected to have a magnitude between $1,000,000 and $5,000,000 classified as SRM Construction for Firm Fixed Price Design Build and Design Bid Build projects.
2. It is confirmed. Only Phase 1 Proposals are due 13 September 2021.
3. The expected awards of between 3 and 7 firms are expected to be awarded on or about 22 January
2022 in the Fiscal Year 2022.
1. Will USACE allow the submittal of CPARS in lieu of a PPQ?
2. Will USACE allow the submittal of previously completed PPQs in lieu of requesting a new PPQ from the client, if it is in the NAVAC/USACE format?
3. The PPQ provided within the RFP has alignment issues and boxes are covering the text on the first page.
Please provide a revised version.
4. The RFP provides conflicting instructions regarding how the proposal should be submitted to USACE. RFP
pg. 88, Section 1.7 states that Offerors shall submit their proposals by DoD SAFE, however RFP pg. 70 states that Volume I and II shall be submitted in original, plus 2 copies, and 1 CD. Please advise how the proposal should be submitted to USACE.
5. RFP Pg. 88, Section 1.6.1.b states “Volume I maximum page limit includes all Project Past Performance & Experience Forms.” It then goes on to state “The 20-page maximum does not include: past performance information/evaluation questionnaires, substitute correspondence from references, and resumes.”. This is conflicting guidance. Please advise if Project Past Performance & Experience Forms are counted in the 20-page limit.
6. RFP Pg. 88, Section 1.6.1.b states “The Volume II maximum page limit includes all Factor 3 Subfactors.”
Factor 3 is shown later in the RFP to be included within Phase 2, in Volume III. Per other guidance Volume 2 is Phase 1 and titled ProForma and has no page limit. Please confirm.
7. RFP pg. 89, Section 2.1.1, Factor 1: Past Performance, section c. and pg. 103, section 5.1.3 states that relevant project types examples as “(f) Fire alarm or mass notification systems” and “(g) Other significant SRM projects, such as utilities or paving”, however these examples are not listed in RFP pg. 72 Section 4.4.
Please confirm the Government wishes to see project experience for these items.
8. Please confirm that a bonafide office in the state of Virginia would meet the requirements for this solicitation as it is located less than 250 miles from the Philadelphia District AOR.
9. RFP pg. 89, Section 2.1.1 and RFP pg. 91 Section 2.1.2 states Past Performance projects shall be at least 50% complete, however RFP pg. 103, Section 5.1.1 and RFP pg. 104, Section 5.1.6 state projects must be 95% complete. Please advise the required percent of completion.
10. Subfactor 1A/2A Past Performance and Subfactor 2A/2B Corporate Experience both request identical information: “Provide title, location and a description of the scope of from three (3) to five (5) projects substantially complete or completed by the prime contractor as of the date of this solicitation or within the last 5 years which are similar in size and scope to the seed projects or SRM projects to be awarded as task orders under the MATOC.” Should Factor 1 Past Performance only include any PPQs, ratings, letters, awards, etc.? Should Factor 2 Corporate Experience be the section where the title, location and a description of the scope are provided? Please advise if USACE wishes to receive duplicate information in these sections.
11. The Phase 1 Proposal Requirement has conflicting subfactor titles throughout the RFP as shown below.
Please advise the correct titles of these subfactors.
RFP SECTION 00 21 00
Factor 1 – Past Performance:
o Subfactor 1A: Offeror’s Past Performance o Subfactor 1B: Designer’s Past Performance
Factor 2 – Experience:
o Subfactor 2A: Offeror’s Corporate Experience o Subfactor 2B: Designer’s Corporate Experience
RFP SECTION 00 21 16
Factor 1 – Past Performance:
o Subfactor 1A: Offeror’s Past Performance o Subfactor 1B: Design Associate’s Past Performance
Factor 2 – Experience:
o Subfactor 2A: Offeror’s Experience o Subfactor 2B: Design Associate’s Experience
RFP SECTION 00 21 18
Volume I – Factor 1: Past Performance o Sub-factor 1A: Prime Contractor o Sub-factor 1B: A/E Designer of Record (DOR)
Factor 2: Corporate Experience o Sub-factor 2A: Prime Contractor o Sub-factor 2B: A/E Designer of Record (DOR) o
Answers:
1. Yes.
2. Yes.
3. Yes
4. Offerors should submit their proposals by DODSAFE request from brian.w.cox@usace.army.mil
5. Project Past Performance & Experience are not counted in the 20-page limit. Offeror’s description of projects, however, are within the 20-page limit.
6. The ProForma is in phase 1 and only applies to phase 1. Phase 1 has a 20 page limit. Presuming 5 projects per sub factor, 1 page could be submitted per relevant project. The 20 page limit may not be exceeded for Phase 1 proposals.
7. The Government does wish to see project experience for the suggested project types such as Fire Alarms and Mass Notification, Paving, Oil Water Separators and HVAC Systems
8. On August 25, 2021, in reference to attached SBA Policy Notice 6000-819056, a moratorium of the Bona Fide Place of Business (BFPOB) was issued.
9. 95% counts as complete and we are evaluating 50% complete projects if the project is active.
10. The Offeror can submit duplicate projects, but Past Performance and Corporate Experience are separate factors.
11. Offeror and Prime Contractor are the same entity. Designer, Designer Associate and Designer of Record are the same entity. Factors are the same: Past Performance and Corporate Experience.
1. Designated email point of contact is Elicia Karras - eliciakarras@puyenpa.com.
2. SF 1442 does not include the due date for the proposal. Sam.gov provides a due date of September 13, 2021, 04:00 PM EDT and 11:00 PM EST. Will the Government please provide the official due date and time on the
SF 1442?
3. Section 00 22 00, paragraph 2.2 (page 70 of 172) states, “Volume I shall be submitted in original plus two
(2) paper copies and one electronic copy on CD*;” however, Section 00 21 16, paragraph 1.7 (page 86 of 172) states “Offerors shall transmit an electronic copy by DoD SAFE to the Philadelphia District.” Furthermore, in Section 00 21 18, paragraphs 2.2, 2.3, etc. all state that the proposal “shall be submitted electronically in accordance with the Proposal Submission Instructions in Section 00 21 00 of the solicitation.” Please clarify the method of submission.
4. If the method of proposal submission is via DoD SAFE, from whom should we request the necessary link?
5. Section 00 22 00, paragraph 4.4 (page 72 of 172) lists relevant project types (a) through (e); however, Section 00 21 16, paragraph 2.1.1.c (page 90 of 172) and Section 00 21 18, paragraph 5.1.3 (page 104 of 172) list relevant types of projects (a) through (g). Will the government please clarify which list is correct?
6. Section 00 22 00, paragraph 5.0 Volume I – Factor 1 – Past Performance (page 76 of 172), requires the offeror to “provide title, location and a description of the scope…” Is there a government form that the offeror should use to provide this information?
7. Section 00 22 00, paragraph 5.0 Volume I – Factor 1 – Past Performance, Subfactor 1B, second note (page 77 of 172) states, “Offeror must show designer has agreed to participate in Design-Build projects for Offeror over the five-year duration of the MATOC ordering period.” Will the government please indicate how the contractor is to show this commitment (i. e., commitment letter, teaming agreement)? Also, if the government requests such an agreement will it be excluded from the 20 page count for Volume I?
8. Section 00 21 16, paragraph 2.1.2.b states, “In the case of an Offeror that is a prime-sub team, the project must have been completed by the prime or the committed subcontractor. At least three projects submitted by Offeror must have been performed as an Offeror/prime and not a committed subcontractor.” Is the contractor correct in presuming that this last sentence refers to a proposed committed subcontractor on this solicitation; and furthermore, is it acceptable for the Offeror/prime to submit a project that they (the offeror/prime) completed in the role as a subcontractor on that project?
9. Section 00 22 00, paragraph 4.4 (page 74 of 172) and Section 00 21 18, paragraph 2.4 (page 99 of 172) refer to Factor 2 as “Corporate Experience” yet, Section 00 21 16, paragraph 2.1.2 refers to Factor 2 as “Relevant Experience.” Should the Offeror label Factor 2 Corporate Experience or Relevant Experience?
10. Section 00 21 16, paragraph 1.6 (page 86 of 172) states, “Offeror’s Phase 1 proposal shall consist of two
(2) volumes in a binder.” However, paragraph 1.6.1. a (page 88 of 172) states, “Each Volume shall be submitted in a separate computer directory/binder.” It is unclear if the government wants one binder or two and/or if it is an electronic submittal, one file or two. Will the government please clarify the desired form of submission for the proposal?
11. Section 00 21 16, Proposal Submission Requirements for Phase 1 and Phase 2, paragraph 2.1.2
h. (page 92 of 172) states that “Information provided on the Project Experience Form will be evaluated for this factor and may also be used to support the evaluation of Past Performance.” Will the Government please provide the referenced Project Experience Form?
12. Section 00 21 18, paragraph 5.1.6 (page 104 of 172) requires that the Past Performance (PP) project information include items (a) through (h). In addition, paragraph 5.1.1 lists the relevant items to be addressed, paragraph 5.1.5 discusses additional consideration, and paragraph 5.1.7 requires information on problems encountered. A similar amount of information is required for Corporate Experience. With the current 20 page limit for Volume I, this allows 1 page for each project, presuming 5 projects per subfactor. Since there is quite a bit of information required per project, would the government consider increasing the page limit to 40 pages?
13. Should the Project Experience Form referenced in Section 00 21 16, paragraph 2.1.2 include the information required in Section 00 21 18, paragraph 6?
14. Section 00 21 18, paragraph 6.1.7 requires past performance information. Given that this section applies to Corporate Experience, is past performance information required for these Factor 2 projects?
Answers:
1. Provided Point of Contact
2. 13 September 2021 is the due date for proposals by 2300 hours
3. DOD Safe is the method of submitting proposals https://safe.apps.mil/
4. The Contracting Specialist, Brian Cox, brian.w.cox@usace.army.mil and send password for encrypted files to Brian Cox
5. Use both lists and list any relevant projects including Fire Alarm and Mass Notification, Paving, Oil Water Separators and HVAC systems
6. There is no specific form, but we have provided a template.
7. The agreement is made by accepting an SRM MATOC award.
8. Yes, it is acceptable to submit the completed portion of a project in which the offeror served as a subcontractor.
9. Corporate experience.
10. Two files submitted electronically through DOD Safe is the appropriate method of submission
11. Past Performance Questionnaire form will be provided at request.
12. No, the page limit is 20 for Phase 1 proposals.
13. Yes
14. Yes, Past Performance Information is required for both Factor 1 and Factor 2 projects.
1. A number of our evaluators have been asked to complete multiple PPQs for the same projects to respond to various MACCs/MATOCs/IDIQs and they are refusing to complete the same PPQs. Can we submit recently completed PPQ within the last 18 months or CPARS?
2. Please confirm the level of bonding support USACE - Philadelphia would like to see demonstrated in Phase I to comply with the solicitation requirements.
Answers:
1. Yes, you may submit either CPARS or PPQs
2. There is no specific amount for Phase 1 requirements for proposals. The seed task orders will require appropriate bonding capability or assignment capability in IAW FAR Part 28
1. Can previously submitted PPQs be submitted?
2. Can projects that have been completed within the past 5 years, but awarded outside of the last 5 years, be submitted for consideration? (For both offerors and design firms)
1. Yes.
2. Yes.
1. 00 21 18, Section 1 indicates work is to be performed is U.S. Army Reserve 99th Readiness Division facilities, Dover Air Force Base, Tobyhanna Army Depot, Naval Surface Warfare Center facilities in PA and MD, plus other Military and Interagency facilities within the area of contract coverage. Other discussions, including the pre-solicitation notice indicate work will be performed at military facilities and other project locations within the states of Pennsylvania, New Jersey, Delaware, Maryland, Massachusetts, New York, Rhode Island, Vermont, New Hampshire, Connecticut, Maine, West Virginia, and Virginia.
NAP’s customers include the 99th Reserve Division throughout NAD and the Naval Surface Warfare Center (NSWC), Bethesda and the NSWC detachment at Gaithersburg, Maryland. Would the Government please provide insight into the percentage of work will fall in PA, MD, and DE compared to the other states/locales?
2. Please clarify the pre-solicitation language that indicates 8(a) Bona Fide office requirements are approved through the (Small Business Administration) SBA for each individual awarded Task Order. Typically, offeror compliance are evaluated on a contract level, not the task order level?
3. Will an offeror with a Bona Fide Office in Virginia be eligible to submit on a Task Order in, for example, Rhode Island?
4. Please confirm no information in accordance with Phase II evaluations are due at this time, and that only Phase I requirements are to be submitted.
5. What is the geographic district determined by the SBA to meet the requirement for a bona fide office location?
6. Would the Government please consider allowing electronic submission to facilitate compliance with various safety measures in place due to COVID-19? There are instructions that indicate electronic SAFE submittal is accepted, but those same sections cross-reference instructions that indicate hard copy submission is required.
7. The solicitation states the size range of projects to fall within $250K and $10 million. What is the average project size anticipated (e.g. most will be under $3 million, between $5 and $10 million, etc.)
8. For relevancy of past projects, is “SRM” used as a specific designation or are new construction or renovation projects of similar facilities considered relevant?
9. Will design efforts for a D/B/B project by the designer be considered as relevant as design-build design efforts?
10. For clarity, what locations are considered a project performed in the Northeast? Will projects in VA, WV, MD, DC, etc. meet this requirement?
11. Please clarify the Volumes that comprise this proposal. In some places it indicates Phase I is comprised of a single Volume I with Volumes II and III to be submitted in Phase II. However, in other places it indicates Phase I includes a Volume I and Volume II, with Volumes III and IV in Phase II. In these contradictory instructions, Volumes II and III have different inclusion requirements. Which do we follow?
12. Are previously-obtained PPQs in the same or substantially similar format acceptable to meet past performance submission requirements, provided they can be included in their entirety and are not just incorporated by reference?
13. Please confirm that a project with a CPARS record does not need a new PPQ. With Federal year end, many of our customers are not willing to submit an additional evaluation.
14. Please confirm the projects in 1A and 1B do not need to be the same projects used to respond to 2A and 2B.
15. If Company A/C is a joint venture proposer for this contract and Company A previously performed their same function in a different joint venture, Company A/B, will the past performance of Company A/B be considered relevant for this submittal by Company A/C provided an explanation of the role of Company A is provided?
16. There are conflicts within the solicitation regarding number of projects to be submitted for past performance and corporate experience of both the offeror and designer. In some sections it references 3 to 5, in others it states no more than 3. How many projects are to be submitted?
17. May multiple designers be submitted as part of the offeror’s team?
18. Will projects in excess of $10 million be considered relevant corporate experience and/or past performance?
19. May offerors select that Paragraph D to applies for the Representations and Certifications? There are two sets of Reps and Certs included in the solicitation and one indicates yes and one indicates no.
20. Will there be a price preference on future task orders for HUBZone small business concerns?
21. Please confirm this is an 8(a) procurement and that there are no other reserved portions of the award pool for other socio-economic concerns. (Included FAR provisions seem to indicate otherwise (e.g. 52.219-31))
22. Would the Government please consider reopening the RFI period for 48 hours after you issue responses so that any requests for clarification of changes may be submitted?
23. Is this a reprocurement of an existing contract?
24. What other vehicles are available to the Government to obtain this type of work at these facilities?

Answer:
The Government is using a MATOC contract vehicle because the timing, location or amount of projects cannot be accurately forecast. In the past 3 fiscal years, the Philadelphia District has an average of 25 SRM projects/ $24M per year for all customers, although there has been wide year-to-year fluctuations. The Philadelphia District anticipates awarding an average of 12 task orders/ $18M per year under this MATOC, subject to fluctuating customers' requests and funding. The below pie chart, which comes from market research, show Builder Database data of deferred and current SRM work required at a representative installation broken down by UNIFORMAT code. While the Government has not funded (and does not anticipate funding) all of this work, the pie chart does show the need for SRM work and the relative breakdown.
