Dwg Sheet/ Spec Section Request for Information Response
1 Drawings
The plans do not indicate specific locations for split rail or I-5 installation.
Typically the plan sheets include a spreadsheet showing the approximate quantities to be installed at each crossover. Are we to assume that all of these quantities for each town are if and where directed? Please provide approximate quantities for each location that is to be constructed/ reconstructed.
The plans do indicate where the split rail and I-5 installation is required. The plan views, enlarged plan views and details clearly show this. Bid per the requirements of the plans and specs.
2 Drawings
The plans do not indicate where the sand fence is to be installed other than at the toe of the dune and along the crossovers in AC and Ventnor. There is a significant cost and production difference between sand fence installed at the toe of the dune and sand fence installed on the slope of the dune. Please clarify how many LF will go along the toe and on the slope.
The plans do indicate where the sand fence installation is required. The plan views, enlarged plan views and details clearly show this. Bid per the requirements of the plans and specs.
Section 32 15 00 Paragraph 3.8.1.1
3.8.1.1 states that I-5 will be measured along the centerline of the crossover for payment. How will the “viewing area” in AC and Margate City be paid for? Will the contractor not be paid for this area?
Not separately. All costs shall be included in the square footage unit cost (measured along the centerline of the crossover) of the crossover constructed.
Section 32 15 00 Paragraph 3.8.1.1
3.8.1.1 states … and shall include all costs associated with constructing the I-5 material surface, including demolition, excavation, geotextile and additional beach fill material, which are incidental to this item. How can the contractor be responsible for the above items when the locations for I-5 installation are not listed? Please list the locations of crossover construction.
The plans indicate where the I-5 crossover installation is required. The plan views, enlarged plan views and details clearly show this. Bid per the requirements of the plans and specs.
Section 32 15 00 Paragraph 3.8.1.2
3.8.1.2 states that all work associated with construction of the standard pedestrian crossovers in Longport will be paid under the item “Stabilization Mats”. What is item 61 Construct Standard Pedestrian Crossover (Longport) used for?
The measurement and payment paragraph in Section 32 15 00 has been revised. See Amendment No. 0001.
Plan Sheet C-506
Plan Sheet C-506 does not show enough detail for the lower cribbing and bracing for the Tee Support. Please provide a cross-sectional view with information regarding the timber dimensions.
Detail was revised with a note to construct as per Type "A" Pipe Support but to only construct one side of crib support.
See Amendment No. 0001.
Plan Sheet C-503
Plan Sheet C-503 Detail No.2 does not show a bolt pattern for securing the top cribbing on the upper right side of the detail.
Detail was revised to show bolt pattern at this location. See Amendment No. 0001.
The plan sheet items “Existing Pile of Sand to be graded into existing beach” are heavily vegetated. Are these piles of sand to be screened prior to spreading on the beach?
No. However, Contractor shall be aware and vigilant to remove any large items if encountered and be in contact with the COR.
Please provide a list of locations where “Section -5 Bulkhead” and “Section-3 Bulkhead” will be required. The current drawings and specs to not address the number of locations where bulkhead construction will be needed.
Detail 5 on sheet C--401 was revised to show location of the timber bulkhead. See Amendment No. 0001
Plan Sheet C-502
How is the “bulkhead” installation on sheet C-502 measured for payment. The spec is silent on this issue.
See measurement and payment paragraph 3.13 in Section 01 50 00. Contractor access requirements have been revised in this section. See Amendment No. 0001.
MHW and MLW do not appear to be correctly shown on sheet C-304 through sheet C-311. Please verify that they are correct.
MHW and MLW shown on sheet C-304 through sheet C- 311 are correct.
No equipment access between New Hampshire and Albany Ave. The Outfall at 46+37 is not accessible without access in between the Steel Pier and Central Pier. The Outfalls at 68+72 and 84+80 are not accessible without access between the Central Pier and the Ocean One Mall Pier. Previous access was provided through vehicular crossover at Arkansas Ave. Please verify how access to these outfalls is to be gained.
Revised Sheet C-105 to add Contractor access point. See Amendment No. 0001.
What is the as-built survey requirement for crossovers and fence? The spec is silent on these items.
Specification Section 01 78 39 is clear that "ANY" changes from the contract plans shall be captured in marked-up plans and then placed in the As-Built Drawings.
Plan Sheet C-115
Sheet C-115 Note 10 requires that the contractor remove a section of bulkhead at the “contractor access”. There are two contractor access points on sheet C- 115 and neither indicates that note 10 applies. Please clarify the location of the bulkhead removal.
Revised sheet C-115 to show location of the timber bulkhead removal. See Amendment No. 0001.
Plan Sheet C-403
Note 6 states “If it is determined that the material quality is poor or if the production rate is adversely affected due to material quality, contractor may move” Previous projects that utilized BA B have experienced material not suitable for beachfill. How will it be determined if material is unsuitable? Please confirm that contractors will be compensated for dredge relocations related to unsuitable material classification.
See Specification Section 35 31 00, Paragraph 1.5 for borrow area material requirements. Bid per the requirements of the plans and specs.

WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which
Amendment No.0001
Section 00 73 15 Page 14 these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS

The Contractor must protect these resources and be responsible for avoiding impacts within these areas to ensure their protection throughout the life of the Contract. Resources covered by this paragraph include, but are not limited to: submerged or buried maritime vessels;
submerged or buried aircraft; any human skeletal remains or burials;
artifacts; shell, midden, bone, charcoal, lithic debitage or other deposits; rock or coral alignments; submerged or buried structures such as foundations, paving, walls or other constructed features; and any indication of agricultural or other human activities. Upon such discovery or find, immediately notify the Contracting Officer so that the appropriate authorities may be notified and a determination made as to their significance and what, if any, special disposition of the finds should be made. Cease all activities that may result in impact to or the destruction of these resources. Secure the area and prevent employees or other persons from trespassing on, removing, or otherwise disturbing such resources. The Government retains ownership and control over archaeological resources.
3.3.2 General
Both the Corps and the Contractor's quality control personnel shall regularly examine newly deposited sand for items of potential historical or archaeological interest. Upon discovering any item of interest, the Contractor shall immediately notify the COR. Upon discovering an item of interest, or upon receiving notification from the Contractor that an item of interest has been discovered, the COR shall immediately notify Nikki Minnichbach of the Philadelphia District Environmental Resources Branch at
(215) 656-6556 or cell (215) 834-1065. If possible, digital images of the discovered items shall be taken and forwarded to the Environmental Resources Branch to expedite their archaeological evaluation.
3.3.3 Recording and Preserving Historical and Archaeological Finds
If, during dredging or beachfill activities, any previously unidentified or unanticipated historical, archaeological or cultural resources are discovered or found, all activities that might damage or alter such resources shall be temporarily suspended. The area where the find was discovered shall be cordoned off by the Contractor to preserve the find;
the Contractor will be directed to immediately move within the borrow area
Section 01 57 19 Page 11 to avoid any further disturbance of the source of the find. If the Contractor cannot move within the designated borrow area, all pumping shall cease until directed otherwise by the Contracting Officer. Any material stockpiled on the dredge, originating from the possible source of the find, shall not be placed on the beach without prior approval by the CO.
3.3.4 Archaeological Monitoring
The Contractor's CQC System Manager and any approved alternate CQC System Managers shall be required to attend a Corp of Engineers facilitated 1 day training class, or to view the training course (on 3 DVDs) on archaeological monitoring. A person trained in archaeological monitoring shall be on the site at all times during construction and shall be employed by the prime contractor. Certificates valid for two years will be issued to those completing the archaeological monitoring class. If viewing the 3 DVD training course on archaeological monitoring, please email Nikki Minnichbach (nicole.c.minnichbach@usace.army.mil) upon completion of the course. Ms. Minnichbach will keep this information on file for two years.
3.3.5 Historical Resources
Existing historical resources within the work area are shown on the drawings. Protect these resources and be responsible for their preservation during the life of the Contract.
3.4 BIOLOGICAL RESOURCES
At all times, perform all work and take such steps as required to minimize interference with, disturbance to, and damage to fish, wildlife, and plants including their habitat. The Contractor will not be permitted to alter water flows or otherwise disturb native habitat adjacent to any disposal area which, in the opinion of the Contracting Officer, are critical to fish and wildlife. The protection of threatened and endangered animal and plant species, including their habitat, is the Contractor's responsibility in accordance with Federal, State, Regional, and local laws and regulations.
3.4.1 Seabeach Amaranth
Take all necessary actions to ensure protection of the seabeach amaranth plant, which is a Federally threatened species. The seabeach amaranth growing season runs from May through November. Ensure that all employees are aware of the potential presence of a threatened species and provide sufficient information describing the seabeach amaranth. Immediately notify the COR if any seabeach amaranth plants are located within the project area. State/Federal personnel will conduct amaranth surveys and delineate any plant locations within the project area prior to construction activities. If any plants are found, the Contractor shall establish a minimum 3 meter buffer zone around each plant. Construction activities shall avoid any delineated locations of seabeach amaranth until the plant dies back or can be relocated by the appropriate agency. Construction activities are defined as, but not limited to; surveys; the movement of equipment and vehicles; and the placement/storage of materials. No stockpiling or staging will be allowed in this area. Take additional action, as directed by the Contracting Officer, to ensure adequate protection of the seabeach amaranth. A picture of seabeach amaranth has been attached at the end of this section for detail.
Section 01 57 19 Page 12
3.4.2 Piping Plover Protection
Take all necessary actions to ensure protection of the piping plover bird, which is a Federally threatened species, and beach nesting birds consisting of one or more of the following state rare species: least tern, American oystercatcher, common tern, royal tern, and black skimmer. The nesting season begins approximately on 15 March and ends approximately on 15 August. Ensure that all employees are aware of the potential presence of these species, and provide sufficient information describing them.
Immediately notify the COR if any piping plovers and/or beach nesting birds are sighted in the vicinity of the project area. If construction activities occur during the nesting season, the Contractor is responsible for ensuring that a piping plover monitor is on site to monitor construction activities. During the nesting season, the Contractor shall also be responsible for establishing a buffer zone of up to 1,000 meters between all construction activities and piping plover nests. If necessary, the buffer zone may be expanded if the 1,000-meter buffer zone is found to be inadequate. For species other than piping plovers (i.e. least terns, American oystercatcher, black skimmer, etc.), the Contractor shall be responsible for establishing, at a minimum, a 100 meter buffer zone during the nesting season. This buffer area may increase once chicks have hatched and become mobile. The New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program (ENSP) and the plover monitor will evaluate nesting situations to determine if the 100 meter buffer is sufficient or needs to be increased.
Construction activities are defined as, but not limited to, the movement of equipment and vehicles, dredging operations, surveys, and the placement/storage of materials. The Contractor shall delineate the buffer zones by erecting orange plastic fencing. All Contractor personnel, vehicles and equipment shall remain outside the buffer zones. Absolutely no access is permitted within these zones. The Contractor shall be responsible for taking any additional action, as directed by the COR, to ensure adequate protection of the nests and chicks. Piping plovers and other beach nesting birds have the potential to nest anywhere within the contract limits. The Contractor shall be prepared to take all necessary action to ensure protection of these species, regardless of the nesting location within the contract limits or overlapping buffer zone if outside of contract limits, in accordance with the specifications herein. While there are currently no active nesting areas within the project area, highly suitable potential nesting habitat does exist that could be utilized by plovers during the 2017 and 2018 nesting seasons. Prior to the nesting season(s), ENSP will delineate the portions of the project area that contain highly suitable nesting habitat. These are the areas that require monitoring during the nesting season. Monitoring of these areas shall begin a minimum of 2 weeks prior to construction activities within the suitable nesting habitat.
3.4.2.1 Monitoring Requirements
The primary role of the piping plover monitor shall be to ensure that no previously undetected piping plover nest or broods are located within the construction area and to monitor movements of unfledged chicks from adjacent known nesting areas that may disperse into the construction area.
The plover monitor shall also detect any territorial or breeding behavior exhibited by any plovers discovered outside of historic nesting areas. A secondary role of the piping plover monitor shall be to ensure that appropriate protective buffer areas are established and maintained
Section 01 57 19 Page 13 surrounding historical nesting (which includes courting and territorial) and chick foraging areas. The plover monitor shall coordinate with New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program (ENSP) to become familiar with the locations of highly suitable nesting habitat, known or suspected territorial pairs, nest sites, and chick foraging areas. The plover monitor shall notify the ENSP immediately if any territorial or breeding activity is observed or any new nests found and the ENSP shall assist in fencing off nesting or foraging areas and erecting predator exclosures.
There shall be no entrance of these fenced areas by the piping plover monitor or any other contractor personnel unless authorized by the ENSP or the U.S. Fish and Wildlife Service (USFWS). Piping Plover monitoring shall begin on 15 March and continue until all chicks from adjacent nesting sites have fledged or construction related activities have terminated. With written concurrence from USFWS and the ENSP, work greater than 1,000 meters from a known nesting area may proceed in non-nesting portions of the project area after 1 July, provided no piping plover activity has been observed within the remaining construction area after 8 alternate days of monitoring over the previous 2-week period. If these conditions are met, no further monitoring will be required.
3.4.2.2 Qualifications
Provide qualified piping plover monitors and support staff that have been approved by the U.S. Fish and Wildlife Service for construction monitoring. All monitors used shall be biologists with a minimum of 2 years experience in the type of work being performed on this project or person(s) with a minimum of 5 years related experience that have the necessary education and/or experience in accordance with the requirements listed herein.
3.4.2.3 Monitoring Schedule
The monitor shall be present on the beach, in the area of active construction, a minimum of every other day, to include weekends, weather permitting, for a minimum of 2 hours per day in order to determine the arrival and use of the area by piping plovers. Monitoring times shall vary in order to cover the full tidal cycle. If plovers are (or become) present in the area, behavioral observations with regard to establishing territories and initiating nesting shall be observed and documented. In the event that plovers establish active nests in the construction areas, further coordination between the Corps, USFWS, and ENSP shall be required to document nests and establish buffer areas. Monitoring frequency shall be increased from every other day initially to several times daily in the event that breeding and/or nesting activity is observed within the monitored activity area in order to determine if impacts from construction activities are occurring.
Monitoring activities shall take place in and around the immediate construction disturbance area (vehicle staging, sand placement, sand stockpiling, grading, nearshore dredging operations, etc.), the area to where the construction will be progressing, and the buffer areas around the historical nesting area.
3.4.2.4 Establishing Buffer Areas
If a piping plover is observed during the nesting season, in a previously unoccupied area within the contract limits, the plover monitor shall immediately notify the project biologist, ENSP and USFWS, through the COR, Section 01 57 19 Page 14 to determine necessary protective actions, and a temporary buffer shall be established. These contact numbers will be provided after contract award.
Prior to 15 May, a temporary buffer of 300 meters shall be established around areas newly occupied by foraging adult plovers and plovers displaying territorial behavior. From 15 May to 15 August, the temporary buffer shall be 1,000 meters. If nesting behavior (i.e. active scrapes, courtship or copulation) is confirmed, or if nests or chicks are found, a buffer sufficient in size to prevent disturbance to nesting birds and/or to protect unfledged broods shall be established based on site-specific conditions and shall remain in effect until the conclusion of breeding activity. If birds are not displaying any signs of nesting behavior (i.e., are likely to be non-nesting birds or spring migrants) or are no longer sighted after observations are conducted over one week, the temporary buffers shall be removed. Once piping plover nests have hatched and chicks are mobile (possibly as early as approximately 15 May), no construction shall take place within 1,000 meters of chick foraging areas until after the chicks have fledged. The same procedures shall be used to establish the 100 meter buffer area required for other beach nesting birds (least tern, black skimmer, American oystercatcher, common terns and royal terns). All construction related activities (e.g., vehicle use, surveying, framing, equipment set-up, etc.) shall adhere to the appropriate buffer area restrictions. Buffer areas shall extend from the water's edge landward to the furthest seaward extent of the natural or man made feature which would prohibit piping plover chicks from traversing the area (e.g., dunes, boardwalk or bulkhead).
3.4.2.5 Surveying Operations
When conducting beach profile surveys, the Contractor shall be cognizant of nesting areas, and shall not enter any fenced-off areas for any reason unless authorized by the ENSP or the USFWS. If a sled is being used during the survey efforts, it shall remain below the water line at all times.
Notify the Contracting Officer if a sled will be used during the surveying operations, prior to the start of survey operations.
3.4.2.6 Reports
Provide daily field reports, with detailed observations of breeding behavior, nesting piping plovers and other beach nesting birds previously discussed, survey results, weather and other environmental conditions, any disturbances of nesting birds, and construction activities.
3.4.2.7 Records
The plover monitor shall maintain complete contemporaneous field notes and complete daily field reports with detailed observations of nesting piping plovers and other beach nesting birds, survey results, weather and other environmental conditions, any disturbances of any birds exhibiting breeding or nesting behavior, and construction activities. The monitor shall provide these notes to USFWS and the ENSP through the COR upon request.
The monitor shall provide a weekly summary updates of construction activity and nesting in a timely manner by e-mail to the COR, USFWS, ENSP and appropriate municipal officials as directed by the Contracting Officer. If breeding and/or nesting behavior is observed, daily reports must be provided to the COR, the USACE project biologist, USFWS and ENSP within 24 hours of the observed behavior. Daily reporting shall continue until the nest and buffer areas have been established or the breeding behavior has been discontinued and verified by ENSP. At the completion of the nesting season and/or construction activities, a complete copy of all field notes
Section 01 57 19 Page 15 shall be provided to the Corps, USFWS and ENSP.
3.4.3 Whale Monitoring
3.4.3.1 Avoidance
Dredges and vessels shall not intentionally approach whales closer than 100 feet when in transit. If listed species are present within a distance equal to 500 yards, then speed shall be reduced to 5 knots or less unless precluded by safety considerations. Unless positively identified as another whale species, any large whale shall be considered a suspected right whale, especially if one has been recently sighted by the vessel, or if the vessel is in an area where right whales could be present. The advice of the onboard National Marine Fisheries Service (NMFS)-approved observer, if present, shall be followed at all times when operating around listed species. If no NMFS observer is on board, the COR shall be notified of any whale activity.
3.4.3.2 Monitoring
Monitor for the presence of whales during all dredging activities in this contract. The presence of any whales shall be recorded on the Daily Report of Operations form. Immediately notify the Contracting Officer following the sighting of a whale.
3.4.4 Sea Turtle and Atlantic Sturgeon Requirements
3.4.4.1 Protection and Inspection
a. Take all necessary actions to ensure protection of sea turtles and Atlantic sturgeon. Ensure that all employees are aware of the potential presence of protected species. The Government will provide the Contractor with pamphlets and ID cards to aid in the identification of sea turtles or Atlantic sturgeon that may be encountered during contract activities.
b. Dredges and vessels should not intentionally approach sea turtles closer than 100 yards when in transit. If listed species are present within a distance equal to 500 yards, then speed should be reduced to 4 knots or less unless precluded by safety considerations. Dragarms of hopper dredges shall not be operated while in the water column, to minimize potential impacts to sea turtles and Atlantic sturgeon. Operation should begin when the dragarm reaches the sediment and end before the dragarm is removed from the sediment. Inspect the dragarm for impinged sea turtles or Atlantic sturgeons by someone familiar with identifying these species each time the dragarm is brought to the surface.
