Question and Answer for Solicitation W9128F26QA015 – Big Bend Refuse Collection Updated 13 March 2026 & 16 March 2026
Q. Is there any incumbent/recompete or is this a brand-new project?
A. The incumbent contractor is Byre Brothers Inc.
Q. Could you please advise on who the incumbent is for the above solicitation, and it's awarded contract number?
A. Incumbent – Byre Brothers Inc and Contract # W9128F22P0033
Q. Could you please confirm whether subcontracting is permissible under this set-aside and, if so, whether there are any limitations or requirements related to the percentage of work that must be performed by the prime contractor?
A. FAR 52.219-14(e)(1) in the solicitation states the subcontractors must be similarly situated companies as the prime. This solicitation is a 100% small business set-aside and no more than 50 percent of the amount paid to the prime can be paid to subcontractors that are not a small business and not similarly situated entities as the prime contractor.
Q. Could you please confirm whether refuse collected under this contract is required to be disposed of at a specific landfill or disposal facility, or if the contractor may use the nearest appropriate licensed landfill?
A. Paragraph 5.1.5 Removal and disposal in the Performance Work statement states the contractor shall remove and dispose of all refuse collected. Disposal shall be off Government property. It shall be the contractor's responsibility to obtain and pay fees for use of an approved disposal site that meets all county, state and federal requirements. The government does not require a specific landfill or disposal facility.
