About this file

This document is a set of Questions and Answers related to a federal contract opportunity for Aerial Vegetation Control Spraying by Helicopter in North Dakota, South Dakota, and Nebraska.

The contractor inquired about using drones instead of the listed helicopter delivery mechanism, as the Merriam-Webster definition of a helicopter includes aircraft that derive lift from powered rotors. However, the Performance Work Statement (PWS) specifically lists helicopter spraying, and the contracting agency indicated they perceive an issue with using drones instead of helicopters for this requirement. The contract opportunity is solicitation number W9128F24Q0062, issued by the Department of the Army Corps of Engineers Engineering District Omaha. The solicitation does not provide information on required products or services, response dates, pricing terms, set asides, incumbents, or other key details beyond the helicopter spraying requirement.

Text version

1. Understanding your solicitation lists helicopters as the delivery mechanism, we believe drones meet the requirement based on the Merriam-Webster definition of a helicopter: "an aircraft whose lift is derived from the aerodynamic forces acting on one or more powered rotors turning about substantially vertical axes."

Do you perceive any issue with this approach?

The PWS only lists helicopter spraying to perform this work and not drones.
