PERFORMANCE WORK STATEMENT

TREE REMOVAL FOR FIREBREAK ZONES AT

PAPIO CREEK SITE 18 – LAKE ZORINSKY OMAHA,

NEBRASKA

30 July 2021

General: This is a non-personnel services contract to provide tree and vegetation removal to create a 30- foot-wide firebreak at Papio Creek Dam Site 18 – Lake Zorinsky. All work shall be completed 365 calendar days after contract award. All trees identified in this Performance Work Statement (PWS) shall be felled between September 1 and April 1. Contractor shall follow all Local, State, and Federal wildlife laws and regulations regarding the Bald and Golden Eagle Protection Act, Migratory Bird Treaty Act, and the Endangered Species Act. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

Description of Services: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform tree and vegetation removal at Papio Creek Dam Site 18 – Lake Zorinsky as defined in this PWS. For the project maps see Attachment 1. The amount of effort varies for each area defined in this PWS, the density of trees and level of work shall be determined by the contractor during the arranged site visit. The contractor shall perform to the standards in this PWS.

1. BASE BID – AREA 00 - 30 FOOT FIREBREAK ZONE:

The work includes creating a 30-foot-wide firebreak zone identified as Area 00 around the perimeter of the Papio Creek Dam Site 18 – Lake Zorinsky government fee property line. Area 00 is approximately

3.0 acres and is shown in the drawings on Sheet A-1 and will be marked in the field. All trees 6 inches in diameter and larger are required to be removed to a minimum of 6 inches below existing ground surface by saw cutting, stump grinder, root ball removal, or other approved methods. All trees and vegetation 6 inches in diameter and smaller shall be cut flush with the ground surface and treated. All tree stumps and cut vegetation shall be treated with an herbicide to kill all vegetation in accordance with Federal, State and Local laws. The contractor shall submit for approval the quantity and type of proposed herbicide. The Contractor shall submit within 24 hours after application a completed pesticide application report (Attachment 2).

All trees and vegetation 6 inches in diameter and smaller shall be cut flush with the ground surface and treated. All tree stumps and cut vegetation shall be treated with an herbicide to kill all vegetation in accordance with Federal, State and Local laws. All trees 6 inches in diameter and larger are required to be removed to a minimum of 6 inches below existing ground surface by saw cutting, stump grinder, root ball removal, or other approved methods. All trees and vegetation 6 inches in diameter and smaller shall be cut flush with the ground surface and treated. All tree stumps and cut vegetation shall be treated with an herbicide to kill all vegetation in accordance with Federal, State and Local laws. 11. PERIOD OF PERFORMANCE: All work shall be completed 365 calendar days after contract award. All trees identified in this PWS to be removed must be felled between September 1 and April 1 in accordance with Section 15 of this PWS. The Contractor shall be required to complete services during normal duty hours of work, 7:00 a.m. to 5:30 p.m., Monday through Fridays, except Federal holidays.

12. RECOGNIZED HOLIDAYS: Contractors shall not work on the Federal Holidays. These holidays include:

13. FIREBREAK ZONE: The firebreak zone consists of an area clear of all trees, woody vegetation, vegetation, grasses, underbrush, debris, trash, and potential fuel for forest fires a minimum of 30 foot wide along the Government fee property line and a minimum 30 foot high canopy. The firebreak zone includes the perceived Government boundary fence and the contractor shall clear the Government boundary fence of all trees, woody vegetation, vegetation, grasses, underbrush, debris, trash, and potential fuel for forest fires along the Government boundary in accordance with this PWS. The firebreak zone shall be cleared of all remnant debris, trash, prepared and seeded as stated in this PWS.

14. EXISTING EROSION CONTROL STRUCTURES: The existing erosion control structures may be reinforced concrete structures, riprap, or wire tied gabion baskets designed and placed to mitigate backward erosion at natural drainage swales along the property line. The Contractor shall coordinate with the Government POC for work near the erosion control structures and NO vegetation or tree removal efforts shall be performed within 10 feet of any erosion control structure. The contractor shall protect all erosion control structures from damage related to the work in this PWS for the duration of the contract. If any erosion control structure is damaged, the structure shall be repaired to preconstruction condition at no additional costs to the Government.

15. CLEAN-UP & DISPOSAL: At the end of each workday all dirt, mud, leaves, limbs, branches, brush, trash, and other debris shall be removed from walkways, paths, roads, and recreational areas. All trees, woody vegetation, vegetation, grasses, underbrush, debris, trash, and potential fuel for forest fires shall be disposed of by the contractor at an approved landfill, recycling center, or mulched on- site. All trees, woody vegetation, vegetation, grasses, underbrush that is mulched onsite shall be spread outside the 30-foot firebreak zone evenly throughout the adjacent timber to leave a natural appearance with no visible disposal piles. All vegetation mulched and spread evenly onsite into the adjacent timber shall not exceed 8 inches in depth in any area.

16. FINISHING DISTURBED AREAS: All disturbed areas from this PWS shall be filled with cohesive lean clay and compacted prior to seeding. Disturbed areas shall be topped with topsoil and graded to blend with the surrounding area and approved by the government POC prior to seeding.

17. SEEDING: Contractor shall prepare ground surfaces, fertilize, seed, provide erosion control and mulch all disturbed ground surfaces as shown on the drawings or in all areas disturbed as a part of the work in this PWS. Contractor shall ensure all weed plants are controlled and killed during all phases of the work. Prior to seeding operation’s, the soil must be tilled to a depth of no less than 6 inches to allow root penetration in all areas that have been compacted by equipment. The prepared surface shall be blended to the existing surrounding areas. The prepared surface shall be finished with a light raking to remove remnant mulch and other debris outside the seeding area. Remnant mulch debris, stones, trash and other debris over a minimum 2 inch in any dimension shall be removed outside the seeding area.

Areas with the prepared surface must be protected from compaction or damage by vehicular or pedestrian traffic and surface erosion. Prepared surface shall be subject to approval by the COR and any deficiencies shall be corrected prior to seeding.

SEEDING TIME/SEASONS:

Seed Mix "A" must be installed from April 1 to May 30 for spring establishment, and from August 1 to September 15 for fall establishment. Seeding operations must be performed only during periods when beneficial results can be obtained. When drought, excessive moisture, or other unsatisfactory conditions prevail, the work must be stopped when directed at no additional cost to the government.

The contractor shall guarantee the seed to be established for one full year after planting. The contractor shall reseed any areas greater than 50 square feet of failed seed establishment as determined by the COR.

SEED MIX: State-certified seed of the latest season's crop shall be submitted in original sealed packages bearing the producer's guaranteed analysis for percentages of mixture, purity, germination, hard seed, weed seed content, and inert material. Labels shall be in conformance with all applicable state seed laws. Seed mixtures shall be free from any State listed noxious weeds including but not limited to plumeless thistle, Canadian thistle, diffuse knapweed, purple loosestrife, and leafy spurge.

Prior to purchasing the seed, a complete list of seed varieties (common name and botanical name) shall be submitted for approval. Prior to the delivery of materials, certificates of compliance attesting that materials meet the specified “Seed Mix A” below shall be submitted for approval. Certified copies of the material certificates shall include the following: Classification, botanical name, common name, percent pure live seed, minimum percent germination and hard seed, maximum percent weed seed content, and date tested shall be submitted for approval. Signed statement certifying that seed mixtures have been tested within the last 6 months prior to the date of delivery for seed type and weed content shall be submitted for approval.

Seed species and mixtures shall be proportioned by weight: Computation of quantity of seed required is based on the percent of purity and percent of germination. Pounds of pure live seed (PLS) = pounds of seed x germination x purity.

Seed Mix "A" below shall be applied in all areas disturbed as a part of the work in this PWS.

FERTILIZER: Fertilizer shall be incorporated into the soil to a maximum 4-inch depth or may be incorporated as part of the tillage operation. The nutrients ratio shall be 18 percent nitrogen, 24 percent phosphorus, and 6 percent potassium. The fertilizer shall supply no less than 80 lbs. per acre of Nitrogen, 120 pounds per acre of Phosphorous and 80 pounds per acre of Potassium.

EROSION CONTROL: Surface erosion control material shall be installed within 24 hours of seeding, in accordance with manufacturer's instructions. Soil erosion control material shall be placed on all seeded surfaces shown on the plans with slopes steeper than 1V:4H and all swales concentrating water leading to culverts, inlets and surfaces around culvert entrances and exits. Placement of the material shall be accomplished without damage to installed material or without deviation to finished grade.

MULCH: Mulch shall be utilized in all seeded areas. Prairie hay mulch shall be spread uniformly, in a continuous blanket, at the rate of 2 tons per acre. Mulch shall be spread by hand, blower-type mulch spreader or other approved method. All seeded areas shall be mulched on the same day as the seeding.

Hay mulching is not required in areas to receive erosion control blankets. Mulch materials shall be native to the region. Prairie hay shall be native prairie hay from alfalfa or clover furnished in an air- dry condition suitable for placing with commercial mulch-blowing equipment. Hay shall be free of noxious weeds, mold or other objectionable material.

18. PROTECTION OF EXISTING FACILITIES AND WORKS: The contractor will be responsible for the protection of private property and structures from any damage during the construction operations. Private property, structures, roads and surfaces shall be protected from damage by the work, or if damaged, shall be repaired to preconstruction condition at no additional costs to the Government. At all times, the work areas shall be kept in a condition conducive to safety of workmen and the public and neat in appearance. The Contractor must place caution/men working signs when working within 250 feet of a public walkways, paths, roads, and recreation areas. Waste and surplus materials shall not be allowed to accumulate in the construction areas.

Private landowners may have encroached onto Government property in some identified work areas. The contractor shall notify the Government POC regarding private landowner’s personal property located within the identified work areas. The contractor shall protect the private landowner’s personal property from any damage. The contractor shall not touch, disturb or move the private landowner’s personal property for the duration of the contract.

19. SECURITY REQUIREMENTS: The contractor shall be responsible for safeguarding the construction site, construction equipment, all government property, equipment, and information provided. At the close of each workday, construction equipment, materials, government property, and facilities shall be secured.

20. WILDLIFE LAWS AND REGUALTIONS: Contractor shall follow all Local, State, and Federal wildlife laws and regulations. All trees identified in this PWS to be removed must be felled between September 1 and April 1 in accordance with the above stated laws and regulations.

21. SITE VISIT: Contractors are encouraged to attend the arranged site visit. The site visit will be conducted where services are to be performed to satisfy the Contractor regarding the required performance work statement and all general and local conditions that may affect the cost of contract performance to the extent the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for claim after contract award. The prescribed site visit will be coordinated by Tommy Aldmeyer. Site Visit will be conducted on September 1, 2021 at 10:00 a.m. Contact Thomas Aldmeyer at (402) 966-3757 during normal business hours to register and get meeting location.

22. POST AWARD, PRECONSTRUCTION, & PERIODIC PROGRESS MEETINGS: The Contractor agrees to attend any conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor’s performance. At these meetings the contracting officer will apprise the contractor of how the Government views the contractor’s performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

23. ACCIDENT PREVENTION PLAN: In accordance with EM 385-1-1, the contractor shall prepare and submit an Accident Prevention Plan (APP) no more than 10 days after award and before any work begins. The APP shall be followed by all contractor personnel during performance of the work. The plan shall be developed only after a careful analysis of the work involved and shall be tailored specifically to the conditions of this contract and shall address the following items:

The contractor is responsible for complying with all applicable safety requirements and practices set forth in the USACE Manual EM 385-1-1 entitled “Safety and Health Requirements Manual”, dated 30 November 2014 and available on-line at:

The contractor is responsible for the safety of his employee(s), and for any injury or damage done by said personnel and shall protect the government from any claims. All personnel are required to wear the manufacturer’s recommended personal protective equipment during all work activities conducted in completion of this PWS. The contractor's equipment shall meet or exceed all current federal, state, and local safety requirements. The contractor and his employee(s) shall be required to use the personal protective devices recommended by the manufacturer during all work activities conducted in completion of this PWS. The contractor shall provide the minimum on-site safety equipment/requirements as follows:

A. The contractor shall provide at least one nonfreezing-type A-B-C fire extinguisher in each vehicle, vessel, and piece of motorized equipment (ATV, UTV, etc). Place in a location readily accessible to personnel.

B. The contractor shall provide and maintain a first aid kit commensurate with the size of the project and with items necessary for first-aid treatment of all injuries.

C. The contractor shall advise personnel of the location of first-aid kits and fire extinguishers.

D. The contractor shall visually post the route and telephone number of nearest hospital or ambulance service and fire station in a conspicuous location and advise all personnel of locations and telephone numbers.

24. WORK PLAN: The contractor must prepare and submit a detailed work plan no more than 10 days after award and before any work begins. Approval of the detailed plan must be obtained from the Contracting Officer’s Representative prior to starting the work. If necessary, modify the plan as required to meet field conditions. Modifications to the work plan must be approved by the COR prior to use. As a minimum, the plan must contain the following:

a. The schedule of work.

b. The sequence of work.

c. Methods for completing the work.

d. Proposed seeding/fertilizing methods

e. Erosion control plan for controlling erosion from surface runoff at the work areas.

f. Proposed access locations, staging areas, and hauls routes within the project limits and other information required to demonstrate compliance with the PWS.

g. Proposed tree/vegetation disposal plan.

25. QUALITY CONTROL PLAN: The Contractor shall submit a Quality Control Plan no more than 10 days after contract award and before any work begins. The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s quality control program is the means by which they assure that their work complies with the requirement of the contract.

Quality Assurance. The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards of this PWS. The POC shall be allowed at any time or place the contractor is on government property, to observe and photograph all work activities conducted through the duration of the PWS. If the contractor is found to be operating in an unsafe and delinquent manner, the contract will be terminated, and the contractor shall be held liable for any damages and pay for the completion of the contract by a different source. The POC may inspect the work and equipment as contract progresses. The contractor shall not be paid for any work performed that is deemed defective to the POC. Any defective service(s) noted by the POC shall be corrected at no additional cost to the Government. The contractor shall be responsible to perform only the work specified within the PWS and shall receive no compensation for work performed that is not specified within the PWS. No government personnel will be allowed to assist the contractor in actual work performed as a part of this PWS or supervision of the contractor’s personnel.

26. HERBICIDE/PESTICIDE and WEED CONTROL PLAN: The Contractor shall submit an Herbicide/Pesticide and Weed Control Plan no more than 10 days after contract award. The plan shall include but is not limited to:

• Nebraska State Chemical Application License

• List of all herbicides and pesticides proposed as a part of this work.

• Schedule of application

• Manufacturer product labels

• Safety Data Sheets.

• The proposed process that ensures all vegetation and weed plants are killed and controlled during all phases of the work.

• The proposed process that ensures all tree stumps and cut vegetation are killed in accordance with this PWS, Federal, State and Local laws.

27. STORM WATER POLLUTION PREVENTION PLAN: The contractor shall prepare and implement a Storm Water Pollution Prevention Plan in accordance with National Pollutant Discharge Prevention Plan-NPDES General Permit No.2. A copy of the Storm Water Pollutant Prevention Plan shall be submitted to the Contracting Officer’s Representative at least 2 days prior to the commencement of construction activities. The NPDES Construction Storm Water permit and related forms are available at www.deq.state.ne.us.

28. FINAL INSPECTION: Work will not be considered ready for final inspection until all work required has been completed (including cleanup of the premises and removal of all of the contractor’s equipment, materials, and supplies). The contractor shall notify the COR a minimum of 2 business days prior to the anticipated date of completion to schedule the final inspection. The contractor shall be required to attend the final inspection with the Government POC.

29. LIQUIDATED DAMAGES: If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $850 for each calendar day of delay until the work is completed or accepted. See FAR 52.211-12

LIQUIDATED DAMAGES-CONSTRUCTION (SEPT 2000).

If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.

(f) Late submissions, modifications, and revisions of quotes. (1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.

(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is late and will not be considered unless it is received before the government issues the purchase order and the Contracting Officer determines that accepting the late quotation would not delay the acquisition.

(g) Issuance of purchase order. Quotations should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR part 15.

(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.

52.212-2 ADDENDUM; EVALUATION--COMMERCIAL ITEMS

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. Quotations will be evaluated using the following factors:

1. Past Performance:

a. Contractor’s proposals will be evaluated on their past performance in jobs of same or similar magnitude.

b. Provide three references of tree removal/land clearing projects (similar magnitude) with the point contact information, to include name, telephone number, e-mail address, and physical address.

c. Additionally, past performance may be based on the contracting’s officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Governmentwide Past Performance Information Retrieval System (PPIRS), contained at www.ppirs.gov.

2.Technical Evaluation

a. Contractors will be evaluated on their abilities and current equipment.

b. Please provide a written narrative of your company’s abilities and current equipment. This shall include a list of equipment, loaders, bunchers, mulchers, ariel equipment, etc.

3. Price Evaluation:

a. Price will be evaluated for low price.

b. The quoted price shall be inclusive of all costs that might be incurred by the contractors during the contract such as, but not limited to, mobilization, fuel, labor, mileage, equipment, equipment rental fees, licenses, insurance, required plans and training, etc.

The award will be based on whether the lowest priced of the quotations having the highest past performance and technical rating possible represents the best value when compared to any lower priced quotation or offer.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
