Clarification Questions for W9122F21Q0076, Zorinsky Tree Clearing
1. Would progress payments be approved during performance of this project? If so what requirements would need to be meet to allow contractor to submit a request for progress payment. What would be the frequency of progress payments?
USACE RESPONSE: See Amendment 002
2. Would there be any retainage held back after final inspection for the 1 year seed growth warranty period? If so, what would be the percentage of retainage for each line item?
USACE RESPONSE: See Amendment 002. 20% is retained until the final inspection and all work is completed and accepted for each CLIN item. The contractor shall be responsible to repair any areas greater than 50 square feet that did not establish during the 1 year warranty period after final acceptance.
3. Would maintenance during the 1 year seed growth warranty period be required such as mowing, trimming of fence lines, control of weeds, and control of any regrowth of trees be required? If the newly seeded areas are damaged due to vehicle traffic, weather, flooding or any other means would the contractor be required to repair or reseed affected areas if greater than 50 square feet in size?
USACE RESPONSE: Contractor shall ensure all weed plants are controlled and killed during all phases of the work as stated in the PWS. The contractor shall guarantee the seed to be established for one full year after the final inspection and acceptance. The contractor shall reseed any areas greater than 50 square feet of failed seed establishment as determined by the COR.
4. Referencing paragraph 17 of the Performance Work Statement please clarify if all areas will need to be tilled to a depth of at least 6" or just the areas that were compacted by heavy equipment. Would the areas close to and inside the woven wire fence need to be tilled to a depth of at least 6"?
USACE RESPONSE: Contractor shall prepare ground surfaces, fertilize, seed, provide erosion control and mulch all disturbed ground surfaces as shown on the drawings or in all areas disturbed as a part of the work in this PWS. All areas including the areas around the wire fence and disturbed as a part of the work in this PWS shall be tilled to a depth of 6 inches to allow root penetration and prepared.
5. Referencing Map Area 00 would a temporary creek crossing be allowed? If so, what requirements would need to be meet? Could a temporary culvert be installed?
USACE RESPONSE: Temporary creek crossing would have to be submitted for approval through the USACE regulatory office. Time for the approval would not be added to the period of performance.
6. Would weather delay days, or work restriction days imposed as a result of bird surveys conducted according to the Bald and Golden Eagle Protection Act and Migratory Bird Treaty Act, be added onto the performance period?
USACE RESPONSE: No, the period of performance is 365 days and unless unusual Midwest weather is encountered the contractor shall prepare for normal Midwest weather year when preparing his work plan and work schedule. All trees identified in this Performance Work Statement (PWS) shall be felled between September 1 and April 1 and the Contractor shall follow all Local, State, and Federal wildlife laws and regulations regarding the Bald and Golden Eagle Protection Act, Migratory Bird Treaty Act, and the Endangered Species Act.
