About this file
This document is a justification and approval for other than full and open competition related to a federal contract opportunity for the expansion and repair of the Midfield Facility at the United States Air Force Academy in Colorado. The project involves constructing an 8,150 square foot addition and renovating 3,800 square feet of an existing facility to accommodate increased training mission requirements. Systems and equipment totaling approximately $30,000 are required from Siemens and Notifier due to the need to integrate them with existing proprietary systems already in use at the Academy. Using alternative systems would result in substantial duplication of costs estimated at $300,000 that are not expected to be recovered. The justification cites FAR 6.302-1 and notes that competition will be obtained for acquiring the individual items. The contracting agency is the U.S. Army Corps of Engineers, Omaha District and the solicitation number for the project is W9128F-20-R-0078.

LIMITED SOURCES JUSTIFICATION AND APPROVAL
PROJECT: USAFA Expand Midfield Facility
JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
06 Aug 2020
1. CONTRACTING AGENCY: The responsible contracting agency is the U.S. Army Corps of Engineers, Northwestern Division, Omaha District, Contracting Division (CENWO-CT), 1616 Capitol Avenue, NE 68102.
2. DESCRIPTION OF ACTION: Approval is being requested for name brand equipment in support of a future construction and renovation contract action relative systems and equipment for the United States Air Force Academy (USAFA) Expand Midfield Facility, using FY20 Operations and Maintenance and FY20 MILCON funds, for which design is currently underway by Yaeger Architecture Inc (Construction via the Omaha District Contracting Division and Contracting Officers is anticipated for FY20).
This brand name justification is for systems and equipment integral to the function of the facility. All the systems and equipment below are included as part of CLIN0001 “Entire work complete to Construct Expand Midfield Facility at USAFA, Colorado” and CLIN0004 “Entire work complete to Construct Repair Midfield Facility at USAFA, Colorado.” This project involves the construction of a new 8,150 square foot (sf) addition to the existing facility and renovation of 3,800 square feet of the existing air traffic control tower and administration facility utilizing conventional design and construction methods to accommodate increased training mission requirements. This facility will be the main facility for training in support of the USAFA glider program. The addition will include administrative, briefing, and lounge spaces. Sustainability and energy enhancement measures are included. The estimated period of performance for this contract is 730 calendar days from Notice to Proceed.
Estimated total of systems and equipment associated with this J&A: $30,000.
3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:
This project involves the construction of a new 8,150 square foot (sf) addition to the existing facility and renovation of 3,800 square feet of the existing Midfield Facility at USAFA utilizing conventional design and construction methods to accommodate increased training mission requirements. This facility will be the main facility for training in support of the USAFA glider program. The addition will include administrative, briefing, and lounge spaces. Sustainability and energy enhancement measures are included.
4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, gives
DoD the authority to set aside requirements when there is only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1(a)(2)(iii) states:
“For DoD, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in—
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.”
5. REASON FOR AUTHORITY CITED: AUTHORITY:
The J&A is based upon FAR 6.302-1 and is necessary for this requirement based on the following rationale:
a. BACKGROUND: See section b below for background on each system.
b. JUSTIFICATION:
i. Direct Digital Control (DDC), Energy Management Control System (EMCS) and
Java Application Control Engine (JACE) systems: Siemens name brand. Estimated Cost: $15,000
All new Air Force facilities require that the HVAC control systems be tied into the existing EMCS. In order to operate seamlessly within the facility and with the existing broader EMCS, the new system will need access to proprietary Siemens information. Because the controls information, and system programming is proprietary to Siemens, no other system manufacturer would be able to seamlessly tie into the existing system. Other systems, such as Johnson Controls, could be used.
However, this new system would require a new backbone and interface, duplicating an already existing system for the base. This duplication of costs to the Government are not expected to be recovered through competition. Thus, Siemens is the only responsible entity able to provide the required equipment and systems for this project.
Johnson Controls estimated duplication of costs: $50,000
ii. Fire Alarm Equipment: Notifier name brand. Estimated Cost: $15,000
During the kickoff meeting, USAFA stated that all fire alarm panels are currently Notifier systems. All systems added onto the existing system should be Notifier.
This will ensure all fire alarm systems continue to operate without technical issues in the future, will simplify on-site maintenance, and all systems installed be compatible with and connectible to the existing systems at USAFA.
Fire alarm equipment are critical Life/Heath/Safety features of a facility. The Fire alarm equipment systems communicate from the facility back to the main Fire Dispatch Center. It is critical for this system to operate flawlessly to ensure prompt and proper response to any activation by the local Fire and Emergency Services.
The current system operated at USAFA is a Notifier system. Due to the proprietary nature of the programming and equipment, only Notifier equipment will integrate seamlessly with the current system. Thus, to furnish a compatible systems requires proprietary paragraphs in the specifications.
Other manufacturers are capable of providing Fire alarm equipment, such as
Honeywell. However, installing a different system than Notifier will cause a significant duplication in equipment and effort, and complicate Fire Dispatch Operations by having to maintain and monitor two completely different systems.
This complication will lead to delayed response of Fire and Emergency Services, and will put life and property unnecessarily in danger.
Honeywell estimated duplication of costs: $250,000
The project identified above is a currently programmed project at USAFA under design by Yaeger Architecture Inc. Proprietary systems addressed in this J&A match existing/current systems in use at USAFA, and are systems that will remain in place for the foreseeable future to maintain critical mission requirements at USAFA.
c. IMPACT IF NOT APPROVED: If this Justification and Authorization is not approved, the Government will incur substantial duplication of costs for existing systems, costs that are not expected to be recovered through competition. Duplicat ion of costs are estimated at $300,000. There will also be an increased risk of delayed response for Fire and Emergency Services, unnecessarily putting life and property at risk.
d. ALTERNATIVES: There are two other alternatives to implementing this J&A: 1) remove references to name brand requirements, or 2) do not build the facility.
Alternative 1 will incur substantial duplication of costs for existing systems, costs that are not expected to be recovered through competition. Alternative 2 is not acceptable as this project has already been approved and funded by Congress with the associated justification for the new facility to meet mission requirements.
6. EFFORTS TO OBTAIN COMPETITION: Based on information in paragraph 5 above, competition for this action is best obtained through competition in sourcing the systems and equipment. Competition will be possible in the acquisition of the items. Each item is available from multiple suppliers.
7. ACTIONS TO INCREASE COMPETITION: Future acquisitions will continue to seek sources sought to identify other name brands which are compatible with the current systems.
8. MARKET RESEARCH: Request for approval has been submitted for name brand equipment in support of a future construction contract action relative systems and equipment for the USAFA Expand Midfield Facility. As previously described and listed (in section 4, b, Justification), the estimated total of systems and equipment associated with this J&A is lower than the duplication of cost.
Market Research Summary: Proprietary systems addressed in this market research match existing/current systems in use at USAF Academy, Colorado and are systems that will remain in place for the foreseeable future to maintain critical mission requirements at the
USAFA, Colorado. Cost and other factors such as proprietary system, duplication of costs, protocols, integration, delayed response, critical Life/Heath/Safety, and risk of life and property stipulate the need to keep the current systems in place. The items listed above will satisfy agency requirements and it is the best interest and value for the government.
9. INTERESTED SOURCES: To date, no other sources have expressed an interest in writing however, all offers received shall be considered. All notices required by FAR 5.201 shall be/have been published and any bids or proposals received shall be considered.
