5.2.1 FACTOR 4: Offeror’s Past Construction Performance -
5.2.1.1 Submission Requirements
Submit past construction performance evaluations on the two (2) projects submitted under Paragraph 6.1, above. The Government reserves the right to contact the evaluator of those projects to verify the firm’s construction performance and performance rating. Federal Government projects presented in Paragraph
5.1.1 should be in the Contractor Performance Assessment Reporting System (CPARS) database. For projects cited in Volume 1, Factor 1: Offeror’s Construction Experience that are not covered in the CPARS database or other Government Design Performance Rating System, submit a Past Performance Questionnaire (attached to this section).
Firms are requested to retrieve their CPARS past performance information directly from CPARS available at: http://www.cpars.gov. CPARS is an electronic repository of performance information collected by all the major federal performance reporting systems. Logging onto CPARS will require the following:
All Department of Defense (DoD) employees (military and civilian), including DoD Contractors that are working on site (military/government facilities) or contractors working offsite using Government Furnished Equipment (GFE) are required to use certificates from DoD Public Key Infrastructure (PKI) to access CPARS. If the contractor doesn't work on site or with GFE they are encouraged to obtain and use a certificate from an External Certificate Authority (ECA). For DoD users, the use of PKI Login is Mandatory.
Federal and Contractor users can use the PKI login category if they have PKI.
5.2.1.1.1 External Certificate Authority
External Certificate Authorities (ECAs) and Interim External Certificate Authorities (IECAs) provide digital certificates to the DoD's private industry partners, contractors using their own equipment or working in non-government facilities, allied partners, and other agencies.
Additional information about the PKI certificate is at https://www.cpars.gov/pki_info.htm web page.
You will also need your DUNS number and Marketing Partner Identification Number (MPIN) to log onto CPARS. The MPIN number was selected by whoever registered your firm in the System for Award Management (SAM) Registry at https://www.sam.gov/portal/public/SAM/. If you do not know your MPIN number, you will need to contact the SAM help desk by emailing them from the email link on the https://www.sam.gov/portal/public/SAM/ web page. Please be aware that they will only release the MPIN number to the person who originally registered your firm.
5.2.1.1.2 Past Performance Questionnaire (PPQ)
Section 00 22 00- Page 6
The Past Performance Questionnaire (Attachment 1) is provided for the offeror or its team members to submit to the client. The Past Performance Questionnaire should be completed by an owner or owner’s representative not affiliated with your firm. Ensure correct phone numbers and email addresses are provided for the client point of contact.
Completed Past Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment 1), which will provide contract and client Information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, via email at Brian.C.Finerty@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
5.2.1.2 Evaluation of Construction Past Performance
There are two aspects to the construction past performance evaluation. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired. The criteria to establish what is recent and relevant are unique to this LPTA source selection. Therefore, the solicitation establishes the criteria for recency and relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration was given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
Acceptable: The proposal demonstrates that a final project performance rating of “Satisfactory” or above for work performed on each of the two (2) construction projects cited in Paragraph 5.1.1 was received by the construction entity.
Unacceptable: The proposal does not demonstrate a final project performance rating of “Satisfactory” or above for work performed on each of the two (2) construction projects cited in Paragraph 5.1.1 was received by the construction entity. Any personnel receiving an “Unacceptable” will render the entire proposal as “Unacceptable”.

All proposals must comply with the instructions in the solicitation. Those proposals, which are properly submitted, will be evaluated to determine technically acceptable contractor(s). A proposal that fails to comply with any minimum technical requirements will not be eligible for award regardless that it may offer the lowest price.
7. TECHNICAL EVALUATION
Proposals will be evaluated by a Source Selection Evaluation Board (SSEB). Pricing data will not be part of the technical evaluation. Criteria for the technical evaluation as set forth in the solicitation will be the sole basis for determining the technical merit of proposals. Past Performance Evaluation Ratings for Volume 2
Rating Description
Section 00 22 00- Page 8
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable
Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonable assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
8. CONTRACT AWARD
Subject to provisions contained herein, award will be made to one Offeror. The Government will select for award the responsible Offeror providing a technically acceptable proposal with the lowest price. To be considered for award, proposals shall conform to the terms and conditions contained in the solicitation.
No proposal shall be accepted that does not comply with all technical requirements specified in this solicitation or which includes stipulations or qualifying conditions.
9. SELECTION AND AWARD WITHOUT EXCHANGES
It is the intent of the Government to evaluate proposals and make award based upon initial offers received, without further exchanges (clarifications, communications, discussions; reference FAR 15.306 concerning exchanges with offerors after receipt of proposals) or additional information. Therefore, proposals should be submitted initially on the most favorable terms of price and technical requirements.
Do not assume an opportunity will be afforded to clarify, discuss, or revise proposals. If award is not made on initial offers, exchanges will be conducted as needed.
10. SELECTION AND AWARD WITH EXCHANGES
If exchanges are conducted, the Source Selection Evaluation Board (SSEB) will evaluate supplemental information provided by the Offeror and may adjust a proposal’s acceptability as required. The SSEB will provide a list of the technically acceptable offers to the Source Selection Authority.
11. PROPOSAL EXPENSES AND PRECONTRACT COSTS
This solicitation does not commit the Government to pay costs incurred in preparation and submission of proposals or for any other costs incurred prior to execution of a formal contract.
12. DEBRIEFINGS
Debriefings will be conducted in accordance with FAR 15.505 and 15.506. In accordance with Class Deviation 2018-O0011 and FAR 15.506(d), the Contracting Officer will provide unsuccessful Offerors an opportunity to submit additional questions related to the postaward debriefing within two business days
Section 00 22 00- Page 2 after the debriefing. The agency will respond in writing within five business days after receipt of the questions and comply with the requirements of FAR 33.104(c).

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.
There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable
No information or did not apply to your contract Rating will be neither positive nor negative.
