INSTRUCTIONS TO OFFERORS
1. SOLICITATION DESCRIPTION
1.1 Indefinite Delivery Type Contracts: As part of the Advanced Contract Initiative (ACI) Emergency Temporary Roof Repair acquisition strategy, the Government intends to issue two (2) solicitations and award four (4) subsequent single award task order contracts (SATOCs) for the Commonwealth of Puerto Rico to include the Islands of Vieques and Culebra:
Acquisitions to be awarded under this solicitation:
Primary Region Secondary Region Set-Aside Capacity
West East and remaining area in Puerto Rico to include Vieques and Culebra
Small Business $45,000,000.00
East West and remaining area in Puerto Rico to include Vieques and Culebra
Small Business $45,000,000.00
Acquisitions to be awarded in 2021: (For informational purposes only)
Primary Region Secondary Region Set-Aside Capacity West East and remaining area in Puerto Rico to include Vieques and Culebra Unrestricted $45,000,000.00
East West and remaining area in Puerto Rico to include Vieques and Culebra
Unrestricted $45,000,000.00
Total Capacity 2020-2021 $180,000,000.00
This solicitation is for the 2020 contracts only. A separate solicitation will be issued for the 2021 contracts at a later date. The geographic scope of this solicitation allows for work on the entire island of Puerto Rico if needed.
All task orders issued under the SATOCs will be Firm Fixed Price.
Each SATOC will not exceed $45,000,000.00 in capacity, with a minimum guarantee of $2,500.00 (to include the base and option period). Award will be made to the two (2) most responsible offerors whose proposals conform to the criteria established in this solicitation, and are considered most advantageous to the Government for each region; price and other factors considered. In any case, the Government may not award any contract if the resulting contract would not represent the “best value” to the Government using trade-off selection procedures as required by the DFARS and using guidance as prescribed by the Department of Defense (DoD) Source Selection Procedures. I t is strongly encouraged that the provisions stated in the solicitation be fully studied prior to assembly of the proposal.
The period of performance for the SATOCs consists of a 5-year base period and a 2-year option period for a total 7-year performance period. The Government’s decision to exercise an option will be contingent on satisfactory contactor performance and an informal survey of current market conditions. The decision to exercise the option is at the discretion of the Government.
An offeror will only be considered for one (1) $45,000,000 SATOC in Puerto Rico. This includes any combination of teaming arrangements, Joint Ventures or mentor-protégé arrangements as prime contractors.
This restriction does not include subcontracting. If an offeror is awarded a SATOC under this solicitation, it will not be considered for award in the 2021 solicitation for Puerto Rico. An offeror will still be considered for SATOCs in solicitations for areas other than Puerto Rico. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.
1.2 Set-Aside: This solicitation is set aside for small business participation only.
1.3 Eligibility Verification: The System for Award Management or (https://www.SAM.gov) website will be checked to verify an offeror’s current classification under North American Industry Classification Code (NAICS) 238160, Roofing Contractors with a small business size standard of $16.5 million.
1.4 Awards: The U. S. Army Corps of Engineers intends to conduct this acquisition by use of competitive source selection procedures in accordance with the provisions set forth in this solicitation.
These contracts will be awarded to fulfill the Government’s anticipated need for numerous rapid-response temporary roofing projects in the Commonwealth of Puerto Rico to include the Islands of Vieques and Culebra.
The effect will be to have numerous capable and responsible contractors that can facilitate and maximize the Government’s response capability in the event of an emergency, as it is the Government’s intent to maximize the number of contracts, and thus contractors to draw upon, to respond to a catastrophic event. Having numerous contractors with contracts that have scopes with overlapping geographic coverage is crucial to meeting the Government’s needs here, which is to ensure that the Government has adequate coverage and contract capacity in the event of an emergency event in any one (1) location.

Do not submit PPQs for projects evaluated via CPARS. In the event an Offeror submits a PPQ for a project for which a CPARS evaluation is available, the CPARS evaluation will be considered authoritative.
The Government reserves the right to contact any persons who may be knowledgeable about the project or projects (this is not limited to contracts identified by the Offeror) submitted in an Offeror’s proposal. The effect of subcontracting to other firms, if anticipated, should be addressed as well.

6. NOTICE REGARDING BUY AMERICAN ACT
The Buy American Act (41 U.S.C. 10a-10d) generally requires that only domestic construction material be used in the performance of this contract. Exception from the Buy American Act shall be permitted only in the case of non-availability of domestic construction materials. A bid or proposal offering non-domestic construction material will not be accepted unless specifically approved by the Government. When a bidder or offeror proposes to furnish non-domestic construction material, the bid or proposal must set forth an itemization of the quantity, unit price, and intended use of each item of such non-domestic construction material. When offering non-domestic construction material pursuant to this paragraph, bids or proposals may also offer, at stated prices, any available comparable domestic construction material, so as to avoid the possibility that failure of a non-domestic construction material to be acceptable under this paragraph will cause rejection of the entire bid. All bidders are cautioned that, prior Government conduct notwithstanding, the Contractor's selection of a domestic construction material (as defined in FAR 52.225-9, Buy American - Construction Materials) which would require the subsequent selection of a foreign construction material for compatibility is not a justification for waiver of the Buy American Act. It is the Contractor's responsibility to verify, prior to submitting the materials for approval that each system can be built to meet the contract specifications without the use of foreign construction materials.

1. INITIAL REVIEW OF PROPOSALS
Proposals will be reviewed upon receipt for conformance with the solicitation requirements. Proposals that do not conform to the solicitation requirements may be considered to have a “deficiency”, i.e. a defect that cannot be remedied by exchanges and/or permitted proposal revisions. If a proposal is suspected of having a deficiency, it will be brought to the immediate attention of the Source Selection Evaluation Board (SSEB) Chair, the appropriate advisor, and the Source Selection Authority (SSA). If the Source Selection Authority determines a proposal to be noncompliant with submission instructions making it thereby deficient, the proposal will not be evaluated further and will be eliminated from further consideration. The affected offeror shall be promptly notified of the decision.

All proposals conforming to the solicitation requirements will be evaluated in accordance with the requirements of Sections 002100, Instructions to Offerors and 002200, Supplementary Instructions. The principal objective of the evaluation process is to make award of a contract to the responsible offeror(s) whose proposals are determined to be the "best value" to the Government, price and other factors considered. Should the Government determine that the award of the contract is not in the best interest of the Government, contract award will not take place.
3. SOURCE SELECTION EVALUATION BOARD (SSEB)
A Source Selection Evaluation Board (SSEB) will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal and any subsequent discussions required, as well as information obtained from other sources, e.g. past performance information. The SSEB will not ordinarily evaluate information or data incorporated by reference or otherwise referred to, except for past performance. The identities of the SSEB personnel are confidential, and any attempt by the offerors to contact these individuals is prohibited.

As established in Sections 002100 and 002200 of the solicitation, the following criteria will form the basis of proposal evaluation. Volume I – Technical Proposal is divided into four (4) factors. Volume II – Price Proposal will be subjectively evaluated in accordance with paragraph 4.3. The following table reflects the relative importance of areas that the SSEB shall thoroughly review and evaluate.
Technical evaluation factors are listed in descending order of importance.
