SOLICITATION INSTRUCTIONS
This solicitation will be awarded as a firm-fixed price commercial item supply contract on the basis of best value evaluation. The technical criteria is located in clause 52.212-2 “Evaluation – Commercial Items”. PLEASE READ
THIS SOLICITATION IN ITS ENTIRETY.

MIDDLE DECATUR BEND
1. Scope.
Contractor shall provide all equipment, labor, riprap and trucking to supply up to 6,000 tons of fractured riprap from a certified quarry to the specified location which is to 2-miles West of Onawa, Iowa on Highway 175 then proceed
Southwest on County Road Cypress Avenue for 3- miles where the riprap can be unloaded. The specific area is the access road adjacent to the project area, which will be flagged, and the Missouri River Project Office (MRPO) staff will available assist the trucks to unload which is at the point of entry on the access road to the site. A pre-delivery conference will be conducted to ensure the trucks are not held up for unloading. Contractor will be required to provide equipment at the site to stockpile the material to approximately 10 feet in height. The delivery date shall be between January 14, 2019 and February 22, 2019 for the 2-week period with requirements stated an on-site meeting with MRPO staff to determine the time and delivery location before any material arrives on site.
2. Quantities:
The contract will consist of a total of 6,000 tons of riprap material, delivered in intervals over a two-week period.
3. Riprap:
All stone for riprap protection shall be durable ledge rock or field stone. Fieldstone shall be mechanically fractured on a minimum of three (3) sides and shall meet the grading requirements set forth in these specifications. Stone shall be in pieces rectangular in cross section, free from thin slabby pieces having maximum dimension more than four times the least dimension. Stone for riprap shall be reasonably, well-graded from coarse to fine. Dirt and fines of less than ½-inch maximum cross section, accumulated from inter ledge layers or from blasting or handling operations shall not exceed 5 percent by weight.
The contractor shall be responsible of all sampling and testing specified herein. The Government may perform verification tests as determined necessary for final approval of the riprap material. All samples including samples taken during production shall be representative of the riprap material furnished or proposed to be furnished.
Samples shall be taken in accordance with ASTM D 75 or other approved method. No rock shall be furnished from any source, which has not been sampled, tested, and approved for delivery to the site.
Tests for specific gravity shall be performed on samples of material obtained from each source proposed for use as riprap prior to start of delivery. Bulk specific gravity shall be computed in accordance with COE CRD-C 107 except that the total sample shall weigh 5000 grams +2 percent and individual particles shall weigh approximately 300 grams each. Riprap material shall be tested in a saturated surface-dry (SSD) condition. The computed bulk specific gravity so determined shall not be less than 2.7. Testing of stone shall be waived if the stone is obtained from a certified quarry. Riprap shall be a well-graded fractured stone with the following gradations and weights:

4. Stockpile Area:
Riprap shall be stockpiled specified location which is to 2-miles West of Onawa, Iowa on Highway 175 then proceed Southwest on County Road Cypress Avenue for 3-miles where the riprap can be unloaded.
A location map is attached for reference of the stockpile sites, the exact locations shall be shown by the Missouri
River Project Staff. Riprap quantities shall be split evenly between the stockpile location. It shall be the contractor’s responsibility to track the amount of stone in each pile. The contractor shall have equipment on site to keep the riprap pushed up at all times. Riprap shall be piled in the designated areas to approximately 10 feet in height. The contractor shall keep the stockpile site neat and orderly to facilitate the truck traffic flowing easily and safely.
5. Protection of Existing Facilities:
Contractor shall be responsible for protection of all existing facilities during delivery of the riprap. Any damage done to the facilities during delivery shall be repaired at the cost of the contractor.
6. Safety Requirements:
The Contractor shall ensure that safe working practices are utilized and that all equipment meets the requirements of the US Army Corps of Engineers, “Safety and Health Requirement s Manual”, EM 385-1-1, 30 November 2014, before work begins. A copy of this manual is available at the Missouri River Project Office, 9901 John J Pershing
Dr., Omaha, Nebraska 68112. The contractor shall submit a site-specific safety plan for approval prior to commencement of work.
7. Submittals:
The successful contractor’s stone supplier shall be submitted to the Contracting Officer’s Representative for approval prior to commencement of delivery of the riprap along with providing the test result.
8. Measurement and Payment:
Per Ton. Riprap material will be measured for payment by the number of tons satisfactorily delivered and stockpiled. The riprap material shall be weighed: (1) on public or private scales which have been certified by the
State. The contractor shall furnish the government inspector a copy of each printed weigh bill when self-printing scales are used, or a copy signed by a public or bonded weigh master as each load is delivered; or (2) riprap material may be weighed on the Contractor-furnished scales under the supervision of the Government inspector. Each printed weigh bill shall contain the following; date, unit number, time of gross, tare and net weight, name of project, contractor, contract number and signature of bonded weigh master. All riprap shall be weighed to the nearest 20 pounds and the net weight reduced to the nearest hundredth of a ton.
The contractor shall be paid within 30 days of successful delivery of the specified riprap and upon the receipt to the project office a proper invoice and proper weigh tickets containing the fore mentioned information.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during testing.
(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.
(f) Late submissions.
(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is
4:30 p.m., local time, for the designated Government office on the date that quotations are due.
(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is late and will not be considered unless it is received before purchase order issuance and the
Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.
(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(g) Issuance of purchase order. Quotations should contain the quoter’s best technical and price terms. The
Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The
Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR part 15.
(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the
Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.

And, when contract performance involves use of vessels, the Contracting Officer shall require, as determined by the agency, vessel collision liability and protection and indemnity insurance. The contractor is responsible for contacting the state for compliance with its workman’s compensation laws.
(n) State and Local Taxes:
The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-
107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142.
Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors.

52.212-2 ADDENDUM; EVALUATION--COMMERCIAL ITEMS
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. Quotations will be evaluated using the following factors:
1. Past Performance – The quoter shall provide three (3) references of projects completed within the past five
(5) years. These references need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all references.
Additionally, past performance may be based on the contracting’s officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Governmentwide Past
Performance Information Retrieval System (PPIRS), contained at www.ppirs.gov.
2. Price – The bid sheet shall include unit proce, amount and total costs to perform the work specified in the
SOW.
The award will be based on whether the lowest priced of the quotations having the highest past performance rating possible represents the best value when compared to any lower priced quotation or offer.
