4. VOLUME CONTENT

Proposals submitted in response to this solicitation shall consist of the contents required in the sub-paragraphs described below to be rated in descending order of importance:

4.1 Volume I, Section A – Mobilization/Strategic Management Plans

4.1.1 Volume I, Section A, Tab 1 – Deployment Plan

This portion of the proposal is a detailed narrative that describes your firm’s strategic ability to plan and execute a temporary roofing mission of varying magnitude. The following are suggested but not all inclusive of items that may demonstrate proficiency in this area:

Provide a corporate plan that demonstrates the firm’s ability to deploy and mobilize effective teams to include the number, types of disciplines, levels of expertise of each employee that may be required to deploy in response to a disaster. Include any established corporate policies or programs that demonstrate the offeror’s ability to plan, prepare, and execute the work. Offeror’s are encouraged to identify when and how subcontractors will be used and how these relationships are developed. The contractor is also responsible to verify key management personnel each year the contract is in place. The plan might include a description on corporate policy regarding rotational assignments for employees. The plan should demonstrate how the contractor will achieve the targeted production rates as stated in Sections 007300-5.0 and 011100-1.2.

4.1.2 Volume I, Section A, Tab 2 - Organizational Structure

The organizational structure of the offeror's proposed team (all key subcontractors shall be included in this organizational structure) for this contract shall be outlined through a narrative and a diagrammed organizational chart. The relationship of these capabilities to the offeror shall be described; i.e. owned, subcontracted effort, joint venture, member of consortium, etc. The corporate/organizational narrative should include a list of the projects, which have been executed under this organizational structure and the length of time the sub-organization(s) not owned by the offeror has been a part of the organizational structure (or the team). It is important that the offeror clearly define the organizational roles/responsibilities and the contractual/legal responsibilities of the team or joint venture units and describe how the project(s) will be accomplished under the proposed organizational structure. The offeror should be aware of that 30% of roofs installed must be self-performed as stated in Section 011100, Paragraph 1.2.

Small businesses are encouraged to form teaming arrangements, joint ventures, or consortiums involving two or more small businesses. For consolidated acquisitions, the size standard is applied to the individual person or concerns, not to the combined assets of the joint venture. Note: This type of strategy allows members of the small business community to leverage their capabilities to participate at the prime level without invalidating their status as small businesses. See Attachment #1 Additional Small Business Information.

4.1.3 Volume I, Section A, Tab 3 – Safety Programs

The offeror shall provide a narrative that describes its corporate Safety Program.

4.1.4 Volume I, Section A, Tab 4 – Quality Control (QC) Programs The offeror shall provide a detailed narrative of its corporate Quality Control (QC) Program and its business practices, which demonstrates adherence to the QC Program as stated in Section 014502.0010.

If further key management personnel are required to perform any work under this contract, the contractor will be required to submit their resumes for approval by the Contracting Officer. The following key personnel shall be identified:

4.2.1.2 Operations Manager - The offeror shall designate one individual as the Operations Manager that will be assigned to this contract. The Operations Manager shall be competent, experienced, and knowledgeable in the field of disaster recovery operations and available by telephone 24 hours per day during hurricane season (1 June through 1 December). The offeror shall designate an Operations Manager to act as a single point of contact (POC) for coordination with USACE. The Operations Manager shall be prepared to pre-deploy to a disaster site or participate in partnering and planning meetings as needed and requested by USACE Contracting Officer. The contractor may be notified verbally by the Contracting Officer of a forthcoming task order, to be later confirmed in writing. If required to deploy or pre-deploy to a disaster site, travel costs associated with the Operations Manager’s travel will be authorized upon the award of a task order, based on lowest available cost for airfare on the given date (coach or business class only), as well as mileage and per diem in accordance with the current Joint Travel Regulations. The Operations Manager shall be responsible for the overall management of the contract including negotiation of task orders, schedule, and technical quality.

Accordingly, the Operations Manager must have the capacity and authority to act on behalf of the offeror and legally bind the contractor. Consequently, the Operations Manager must be employed by the offeror. The Operations Manager shall take immediate corrective action when performance is not acceptable to USACE. The Contractor shall oversee the development and implementation of necessary record keeping, administrative and quality control programs.

The purpose of this submittal is to identify the level of expertise available for this contract. Key personnel that result from a subcontract arrangement should be clearly annotated as such.

4.2.2 Volume I, Section B, Tab 2 - Experience

Provide at least five (5) and not more than ten (10) examples of completed projects which should demonstrate the offeror's and its team members' experience in performance of the work similar to that described in this solicitation. Each project identified must include a contract number, a reference contact name, address and telephone number, as well as email address if available. The projects must have been completed within the last six (6) years. A completed project is defined as: Work performed under a “project” that is physically complete and has been accepted by the customer. The offeror may provide additional narrative on any or all projects provided the offeror does not exceed the page count as specified in Section 002100 paragraph 3.2. The offeror should present projects, which demonstrate its experience in project management and execution of disaster recovery related work, with preference given for residential roof replacement or roofing repairs in response to hurricanes or other natural disasters. The offeror may include both federal and commercial work. The offeror must indicate whether it was the prime or subcontractor on each project. If the offeror was the prime contractor, the offeror shall also describe its primary role/duties in execution of the work (i.e. the major components of the project which were completed by the prime’s staff and major components which were subcontracted out). The offeror shall also provide information on the project as to the size, complexity, and distinctive and/or unique features of the project. The offeror should provide specific information to demonstrate that it has relevant experience to all of the possible activities for this project as listed in this solicitation.

4.2.3 Volume I, Section B, Tab 3 - Best Practices to Minimize Damage to Metal Roofs Best practices shall be developed for metal roofs that are sloping aluminum or steel, standing seam or corrugated roofing, or trailer houses and mobile homes with integral metal roofs.

4.2.4. Volume I, Section B, Tab 4 - Best Practices to Repair Small Areas of Damage on Roofs Best practices shall be developed to repair small areas of damaged roofs for either asphalt shingle or rolled asphalt roofs that minimize damages to property thereby enhancing customer satisfaction.

For Small Area Repairs, provide innovative practices that effectively implement alternatives to the use of Government furnished plastic. Define how proposed practices will be shared with contractor staff and implemented in the field during responses.

4.2.5. Volume I, Section B, Tab 5 - Best Practices to Develop/Maintain Electronic Database Tracking and Scheduling Assigned Work Best practices shall be developed to develop/maintain electronic database tracking and scheduling assigned work. Describe an electronic tracking and database system for work assigned that provides continuity and efficiency in the field, and allows for enhanced documentation. It is suggested the offeror include their past performance information in their proposal to document historically the use of such systems in related work. The offeror shall clearly define roles and responsibilities associated with said proposal.

4.3 Volume I, Section C, Tab 1 - Capacity

The offeror should provide details regarding the fiscal, organizational, managerial, and physical capacity of the firm to manage disasters of varying magnitudes in conjunction with normal business operations and ongoing commitments. Contractual commitments, including subcontracts, with any government or commercial entity related to natural disaster response (not only temporary roofing) must be declared. If other contractual commitments exist, the offeror must discuss management of key personnel and resources and the ability to fulfill multiple contractual commitments. Corporate production standards, strategic business plans for future expansion, and sales projections may be included.

4.4 Volume I, Section D - Past Performance

4.4.1. Volume I, Section D, Tab 1 – Past Performance

The offeror shall provide an official performance evaluation from the customer (state, federal, local, or commercial) for each project cited in Section 002100, Paragraph 4.2.2 of this solicitation.

The title of the project shall be consistent with the project experience description as required in Section 002100, Paragraph 4.2.2 of this solicitation.

For contracts with the U.S. Army Corps of Engineers or Department of Defense agencies, an official performance evaluation would be DD Form 2626 “Performance Evaluation

(Construction)”. If an official performance evaluation is not available, the offeror may submit an equivalent survey from a prior source selection previously completed by the customer. The offeror shall not complete the evaluation for the customer. Offerors shall include the name, address, telephone number, and e-mail address of the customer evaluator who issued the evaluation or survey. The Government reserves the right to contact the customer to verify the offeror’s performance.

During past performance evaluation, the Government reserves the right to consider information outside of the proposals for past performance of the offeror. The Government will consider information submitted by the offeror, as well as any other relevant and reliable information obtained from any other source (including information from Government personnel and databases). The Government will evaluate the currency and relevancy of the information, the source of the information, and general trends in performance, along with any other information, which may help the Government assess performance risk. Information on significant problems encountered, customer dissatisfactions, and corrective actions taken should be provided. This evaluation of past performance is separate from the responsibility determination.

A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Source Selection Evaluation Board (SSEB). Therefore, it is incumbent upon the offeror to include all relevant information, including demonstrated corrective actions, in its proposal.

In addition to the project information requested in this section, the offeror shall also provide notification and information concerning any projects where it’s right to proceed was terminated for default during the last three (3) years, or so state that there were none.

In rating past performance, the SSEB may consider available past performance information on predecessor companies, employment histories of key personnel, or major subcontractors performing key elements of the project.

4.5 Volume I, Section E - Subcontracting

4.5.1 Volume I, Section E, Tab 1 – Subcontracting with Local Entities

Any contract resulting from this solicitation will be subject to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (FAR 26.2). Therefore, the offeror’s subcontracting efforts must identify the procedures that will be established to identify and award subcontracts to those organizations, firms, or individuals residing or doing business primarily in the affected area. All offerors must comply with this requirement.

4.6. Volume II, Section F – Cost/Price Proposal

4.6.1. Volume II, Section F, Tab 1 – SF1442, Solicitation, Offer, and Award The offeror shall fill out in its entirety all of SF1442 that applies to the offeror and it shall be signed and dated by an official that is able to legally bind the company.

4.6.2. Volume II, Section F, Tab 2 – Cost/Price Schedule

The offeror shall fill out Section 001100, Pricing Schedule, in hard copy Volume II and Excel spreadsheet in the CD. Prices stated must be inclusive of all overhead, markups, profit, labor, prevailing wages, escalation, equipment and supplies for the line items identified based on the performance period and the event size. Pricing must be included for each line item in the Price Schedule being proposed on.

In addition, the offeror shall include a written narrative explaining how pricing was determined.

The offeror should account for annual Davis-Bacon wage decision increases and assume work will be performed primarily in urban coastal areas where wage decisions are generally higher. The offeror should also account for escalation, inflation, and general supply and demand problems associated with a natural disaster when completing the Price Schedule. The effect of subcontracting to other firms, if anticipated, should be addressed as well.

The offeror should not expect approval of a request for equitable adjustment or claim due to the omission of pricing information that could have reasonably been anticipated in a natural disaster.

4.6.3. Volume II, Section F, Tab 3 - Representations and Certifications The offeror shall fill out in its entirety all of Section 004500 that applies to the offeror. The offeror’s responsibility will be reviewed in accordance with FAR Part 9. The offeror shall complete all representations and certifications in Section 004500 and also complete the required Annual Representation and Certification through the On-line Representation and Certification Application (ORCA) at http://ocra.bpn.gov.

4.6.4. Volume II, Section F, Tab 4 – Bonding Capability

The offeror shall include a letter from their surety stating the total bonding capacity and current available bonding capacity. The offeror must demonstrate the ability to submit performance and payment bonds in the amount of $3 million (minimum) in a single instance within 3 days of task order award.

5. SOLICITATION RESTRICTIONS

This solicitation is set-aside for HubZone Businesses.

6. APPROPRIATION AND AUTHORITY

Appropriation: Presidential Declaration specific to an event.

7. PERFORMANCE AND PAYMENT BONDS.

See Section 007200, Contract Clauses, Clause No. 52.228-15, PERFORMANCE AND PAYMENT BONDS.

Bonds are not required in the proposal, but will be required for each task order awarded under the contract. To have the bond considered valid, both the bond and the Power of Attorney must be original. Facsimile copies will not be acceptable.

8. NOTICE REGARDING BUY AMERICAN ACT.

The Buy American Act (41 U.S.C. 10a-10d) generally requires that only domestic construction material be used in the performance of this contract. Exception from the Buy American Act shall be permitted only in the case of non-availability of domestic construction materials. A bid or proposal offering non-domestic construction material will not be accepted unless specifically approved by the Government. When a bidder or offeror proposes to furnish non-domestic construction material, the bid or proposal must set forth an itemization of the quantity, unit price, and intended use of each item of such non-domestic construction material. When offering non-domestic construction material pursuant to this paragraph, bids or proposals may also offer, at stated prices, any available comparable domestic construction material, so as to avoid the possibility that failure of a non-domestic construction material to be acceptable under this paragraph will cause rejection of the entire bid. All bidders are cautioned that, prior Government conduct notwithstanding, the Contractor's selection of a domestic construction material (as defined in FAR 52.225-9 Buy American Act- Construction Materials) which would require the subsequent selection of a foreign construction material for compatibility is not a justification for waiver of the Buy American Act. It is the Contractor's responsibility to verify, prior to submitting the materials for approval that each system can be built to meet the contract specifications without the use of foreign construction materials.

In order to expedite award of task orders and issuance of NOTICE TO PROCEED, it is required that contract documents (including Performance and Payment Bonds) be executed and submitted within three (3) days after the successful offeror is notified of task order award.

52.204-7 CENTRAL CONTRACTOR REGISTRATION (APR 2008)

(a) Definitions. As used in this clause--

Central Contractor Registration (CCR) database means the primary Government repository for Contractor information required for the conduct of business with the Government.

Data Universal Numbering System (DUNS) number means the 9-digit number assigned by Dun and Bradstreet, Inc.

(D&B) to identify unique business entities.

Data Universal Numbering System +4 (DUNS+4) number means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.)

This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same parent concern.

Registered in the CCR database means that--

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record ``Active''. The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number--

(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business.

(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(iii) Company Physical Street Address, City, State, and Zip Code.

(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).

(v) Company Telephone Number.

(vi) Date the company was started.

(vii) Number of employees at your location.

(viii) Chief executive officer/key manager.

(ix) Line of business (industry).

(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(g)(1)(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the CCR database; (B) comply with the requirements of Subpart 42.12 of the FAR; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (g)(1)(i) of this clause, or fails to perform the agreement at paragraph (g)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the CCR information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the CCR record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the CCR database. Information provided to the Contractor's CCR record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.

(h) Offerors and Contractors may obtain information on registration and annual confirmation requirements via the internet at http://www.ccr.gov or by calling 1-888-227-2423, or 269-961-5757.
