Set Aside, NAICS Code & Size Standard: This solicitation is being procured as a 100% Small Business Set-Aside. The NAICS Code is 561730, Landscaping Services, which has an applicable size standard of $9.5M.

Description of requirements for the items to be acquired: Contractor shall perform maintenance on the boundary line on Nimrod Lake and the boundary line on Blue Mountain Lake to ensure the government boundary is clearly defined and visible to the public, adjacent landowners, and government representatives. The waters and lands of Nimrod and Blue Mountain Lakes are actively managed under the Nimrod Blue Mountain Project Office of the U.S.

Army Corps of Engineers, located in Plainview, Arkansas. The boundary line runs along diverse terrain, ranging from steep banks to flat agricultural lands. In some instances, hip boots will be required during line maintenance.

Vegetation varies from open agricultural land to heavy underbrush areas. This should be a consideration when bidding on the contract.

PERFORMANCE WORK STATEMENT (PWS)

BOUNDARY LINE MAINTENANCE

NIMROD-BLUE MOUNTAIN LAKES

PART 1

General Information

1. General: This is a non-personnel services contract to provide boundary line maintenance. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform boundary line maintenance as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2 Background: The Contractor will furnish all labor and necessary supplies, materials, and equipment required to perform maintenance on 18.50 miles of boundary line on Nimrod Lake and 18.7 miles of boundary line on Blue Mountain Lake in the Base Year, in strict accordance with the following specifications. The purpose of this maintenance is to ensure the government boundary is clearly defined and visible to the public, adjacent landowners, and government representatives. The waters and lands of Nimrod and Blue Mountain Lakes are actively managed under the Nimrod Blue Mountain Project Office of the U.S. Army Corps of Engineers, located in Plainview, Arkansas.

1.3 Boundary Line Description/Location

The boundary line runs along diverse terrain, ranging from steep banks to flat agricultural lands.

In some instances, hip boots will be required during line maintenance. Vegetation varies from open agricultural land to heavy underbrush areas. This should be a consideration when bidding on the contract.

Nimrod Lake

Base Year (2025) – The work covered by this contract period consists of one area of boundary line which totals 18.5 miles, as specified below:

Beginning at Monument No. 322-R8, which is located in section 16, T3N, R23W (Yell County) and will end at monument number 219-2, which is in section 30, T4N, R22W (Yell County).

Option One (2026) – The work covered by this contract period consists of one area of boundary line which totals 15.3 miles, as specified below:

Beginning at Monument No. 219-2, which is in section 29, T4N, R22W (Yell County) and will end at monument number 153-R6, which is in section 23, T4N, R22W (Yell County).

Option Two (2027) – The work covered by this contract period consists of one area of boundary line which totals 17.2 miles, as specified below:

Beginning at Monument No. 153-R-6, which is in section 23, T4N, R22W (Yell County) and will end at monument number 30-2, which is in section 35, T4N, R21W (Yell County).

On this option, maintenance will be omitted between 4-2 and B-1A, B4D and 4-4A, 30-2 and 39-D-2.

Option Three (2028) The work covered by this contract period consists of one area of boundary line which totals 16.7 miles, as specified below:

Beginning at Monument No. 39-D-2, which is in section 6, T3N, R21W (Yell County) and will end at monument number 343-R-2, which is in section 18, T3N, R23W (Yell County).

Option Four (2029) The work covered by this contract period consists of one area of boundary line which totals 17.7 miles, as specified below:

Beginning at Monument No. 343-R-2, which is in section 18, T3N, R23W (Yell County) and will end at monument number 279-4, which is in section 1, T3N, R23W (Yell County).

Blue Mountain Lake

Base Period (2025) - The work covered by this contract period consists of one area of boundary line which totals 18.7 miles, as specified below:

Beginning at Monument No. 78-1, which is in section 19, T5N, R25W (Logan County) and will end at monument number 184-2A, which is located in section 24, T5N, R27W (Logan County).

Option One (2026) - The work covered by this contract period consists of one area of boundary line which totals 19 miles, as specified below:

Beginning at Monument No. 184-2A, which is located in section 24, T5N, R27W (Logan County) and will end at monument No. 228-1, which is in section 34, T6N, R27W (Logan County).

Option Two (2027) - The work covered by this contract period consists of one area of boundary line which totals 22.4 miles, as specified below:

Beginning at Monument No. 228-1, which is in section 34, T6N, R27W (Logan County) and will end at monument No. 118-2B, which is in section 15, T5N, R26W (Yell County).

Option Three (2028) The work covered by this contract period consists of one area of boundary line which totals 19.4 miles, as specified below:

Beginning at Monument No. 118-2B, which is in section 15, T5N, R26W (Yell County) and will end at monument number 43-1-A, which is in section 17, T5N, R25W (Yell County).

Option Four (2029) The work covered by this contract period consists of one area of boundary line which totals 21.4 miles, as specified below:

Beginning at Monument No. 43-1-A, which is in section 17, T5N, R25W (Yell County) and will end at monument number 184-2A, which is in section 24, T5N, R27W (Yell County).

1.4 Objectives: Objectives of this contract include the following:

• Clear boundary of all vegetation, and paint witness trees every 100 feet

• Install steel “T” posts to replace missing, bent, or damaged witness posts at monuments.

• Give diligent effort to find missing monuments.

1.5 Scope: The Contractor shall work uninterrupted along the line from an agreed starting point, working in 2-mile increments from monument to monument, continuously and expeditiously, subject to weather or other excusable delay, as agreed by the Contracting Officer’s Representative (COR).

1.6 Pre-Work Conference: Not later than 5 working days from award of this contract, the contractor is required to contact Devin Deaton at (501) 324-6825 to schedule a pre-work conference to discuss the contract terms and work performance requirements. The pre-work conference may take several hours, and any costs incurred by the Contractor will be his.

The coverage specified in FAR 28.307 is the minimum insurance required.

1.7 Period of Performance: The Contractor shall begin services for the Base Period after date of award and will complete all work in Base Period no later than 31 March 2026.

Renewal Options One, Two, Three, and Four work will be performed between 01 January and 31 December during years 2026 through 2029. Performance period extensions may be allowed due to rain, snow, temperature below paint application specifications or other weather related conditions, when an extension request, in writing, is received from the Contractor.

1.8 General Information

1.8.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The QCP is to be delivered within 30 days after contract award or with the contractors’ proposal if it is an evaluation factor, three copies of a comprehensive written QCP shall be submitted to the KO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

1.8.2 Supervision: The Contractor shall provide supervision of his/her employees or shall have a superintendent or foreman on the job site while services are being performed. The superintendent or foreman shall be designated in writing by the Contractor and shall have full authority to direct the work and to obtain supplies and equipment necessary to complete the work as required by these specifications. This individual may also serve as a Quality Control Inspector, provided that job performance in each category is maintained at an acceptable level to the COR. The superintendent and quality control personnel shall be required to have a copy of the contract in their possession at all times for referral concerning questions of contractor responsibility. In addition, the Contractor may designate a responsible employee to act as work leader, and to complete a daily activity report. The superintendent/foreman or Quality Control Inspector shall have a cellular telephone so that Project personnel may contact him/her during working hours. The telephone number shall be provided to the Nimrod, Blue Mountain Project Office.

1.8.3 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.8.4 Recognized Holidays: The below listed holidays are those observed by the Federal Government. If shown on the schedule of service days, the contractor will be expected to perform services on these days.

1.8.5 Hours of Operation: The contractor is responsible for conducting business, between the hours of 6:00 am and 6:00 pm Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.8.6 Place of Performance: The work to be performed under this contract will be performed at areas to receive boundary line maintenance are shown on the attached maps. The successful bidder will be given a copy of survey plats with maps to show the work area for Nimrod Lake and/or Blue Mountain Lake. The length of boundary line work for the base period on Nimrod Lake is 18.50 miles and Blue Mountain Lake is 18.7 miles.

1.8.7 Type of Contract: The government will award a firm fixed price contract.

1.8.8 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use.

1.8.9 OPSEC: No Security Requirements

1.8.10 Reserved for OPSEC

1.8.11 Key Control: The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.

In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor.

In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.

The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.

1.8.12 Lock Combinations The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.

1.8.13 Special Qualifications: Those submitting bids to perform this work must be able to demonstrate an ability to read and understand Corps of Engineers survey sheets and segment maps and possess a general knowledge of land surveying practices and real estate property lines.

1.8.14 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.8.15 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies;

coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.8.16 Key Personnel: The following personnel are considered key personnel by the government, Contract Manager and Crew Supervisor. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 8:00 a.m. to 4:30p.m, Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons.

1.8.17 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.8.18 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government.

These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

1.8.19 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

1.8.20 Damage to Government Facilities: The Contractor shall be responsible for any damages to government property and facilities that occur as a result of work performed as part of this contract. Caution shall be taken when working in or around government facilities. If damages occur, the Contractor shall repair or replace damaged features or facilities to the standards or specifications for which they previously existed, as determined by the COR. If the Contractor fails to perform adequate restoration, the government reserves the right to have the work completed, and take the necessary actions, including withholding payment, to ensure restitution is made.

1.8.21 Certification of Familiarity with Specifications: The Contractor shall certify that all employees who work under this contract have been familiarized with these specifications prior to performance of required services. A signed statement of certification listing those employees who perform work under this contract shall be submitted to the COR. An orientation for new employees must include this familiarization and a certification shall be submitted for these new employees prior to work being performed by the employee.

1.8.22 Basis of Measurement and Payment: Measurement and payment for the work covered in these specifications shall be as specified below, and all costs in connection therewith shall be included in the contract price.

a. Measurement – The unit of measurement for clearing and marking previously surveyed boundary line will be the mile of fee line work satisfactorily completed. Actual number of miles will be computed from the fee line distances indicated on the Government furnished survey sheets. Non-surveyed areas (i.e. railroad tracks, bluff edges) are not included since no maintenance will be required at these locations.

b. Payment - Payment for locating, clearing, and marking previously surveyed boundary line will be made at the contract unit price. The Contractor shall be paid only for actual miles of boundary completed in accordance with the specifications set forth and accepted by the Contracting Officer's Representative. Partial payment during contract period can be requested upon satisfactory completion of each quarter of the contracted unit. Payment requests will include, an invoice containing the number of miles completed, a list of missing monuments and encroachments, along with a description of the finished line offered for payment by starting and ending monument number, Section, Township, Range and County. The original invoice, along with a copy, shall be submitted to the Nimrod Blue Mountain Project Office, 3 Highway 7 south Plainview, Arkansas 72857. Payment will be made approximately 45 days from the date the contractor submits an invoice and work is verified and accepted.

PART 2

DEFINITIONS & ACRONYMS

2.1. DEFINITIONS

2.2.1. BOUNDARY LINE. - See Fee Line.

2.1.2. CLEARING AREA. - The area to be cleared along the boundary line (fee line) which is to extend a minimum of four (4) feet but no more than six (6) feet on the government side of the fee line and to a height of eight (8) feet above the ground.

2.1.3. CONTRACTOR. - A supplier or vendor having a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.4. CONTRACTING OFFICER. - A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government.

Note: The only individual who can legally bind the government.

2.1.5. CONTRACTING OFFICER'S REPRESENTATIVE (COR). - An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications.

This individual does NOT have authority to change the terms and conditions of the contract.

2.1.6. DEFECTIVE SERVICE. - A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.7. DELIVERABLE. - Anything that can be physically delivered but may include non-physical things such as meeting minutes.

2.1.8. ENCROACHMENT. - Any unauthorized activity on fee or easement land.

Encroachments include buildings and structures, roads, septic systems, steps, fences, etc.

2.1.9. FEE LINE. - The property line which separates privately owned land from land owned by the Corps of Engineers in fee simple title. This line is determined by drawing a straight line between two adjacent monuments.

2.1.10. KEY PERSONNEL. - Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.11. MONUMENTS. - Brass caps, which are placed at angle points and “points-on-tangent” on the fee line. These caps are stamped and labeled with Corps of Engineers identification and monument number. The first four or five digits of the monument number denote the tract acquisition number.

2.1.12. PHYSICAL SECURITY. - Actions that prevent the loss or damage of Government property.

2.1.13. QUALITY ASSURANCE. - The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.14. QUALITY ASSURANCE Surveillance Plan (QASP). - An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.15. QUALITY CONTROL. - All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.16. SUBCONTRACTOR. - One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.17. SURVEY SHEETS. - Information that lists monument numbers, course numbers, course bearings and distances, and elevations for monuments.

2.1.18. WORK DAY. - The number of hours per day the Contractor provides services in accordance with the contract.

2.1.19. WORK WEEK. - Is defined as Monday through Friday, unless specified otherwise.

PART 3

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3. GOVERNMENT FURNISHED ITEMS AND SERVICES:

3.1 Materials: The Government will provide:

a. Survey Plat sheets/segment maps shall be furnished to show boundary previously surveyed and monumented, including the distance and angles between the monumented survey markers.

b. Aerial maps depicting government property boundaries and ArcView GIS shapefiles may also be provided upon request.

c. The government will also furnish all boundary (U.S. Government and AGFC WMA boundary) signs.

3.2 Access: Right-of-entry on Government-owned land for purposes of this purchase order is available to the Contractor. The Contractor shall provide right-of-entry on any privately owned land as required. No damage to government property shall occur in conjunction with this access.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.

4.2 Equipment: The Contractor shall furnish the necessary tools and equipment to satisfactorily complete the services outlined in this PWS. Tools and equipment include but is not limited to, a shovel, machete, chainsaw, compass, paint, paint brush, wire brush, etc., to meet the requirements under this PWS. A metal detector, GPS, hand-held compass and measuring tape will be necessary to locate hard to find monuments.

5. Specific Tasks:

PART 5

SPECIFIC TASKS

5.1 Basic Services. The contractor shall provide services for completion of the following maintenance specifications.

5.2 Boundary Maintenance Specifications.

a. The Contractor shall clear the boundary line to a width of four (4) feet on the government side of the fee line and to a height of eight (8) feet above the ground, except that no trees greater than two (2) inches in diameter (measured at breast height) are to be cut unless authorized by the Government Representative. Where fences exist and are located on the property line, the contractor shall clear the government side of the fence in accordance with the specifications herein. All brush from the clearing shall be disposed of on Government property outside the cleared area. Vegetation cleared will be cut to within 6" of ground level. No grass will require cutting. Woody brush, vines, high weeds, river cane and briars will be cut when such items are in the above specified clearing zone.

b. Where trees are available adjacent to the boundary on Government property, they will be marked at intervals not to exceed 50' between markings along the fee line. Trees to be marked shall be no further than four (4) feet from the fee line. In addition to these trees, any trees which are a) over two (2) inches (measured at breast height), b) located on the government side within four (4) feet of the line, and c) within ten (10) feet either side of a monument, shall be painted. Markings will be a 4" wide, horizontal, white, painted ring at chest height (approximately 4.5' from the ground). Paint is to be applied evenly by brush producing a solid coating of paint sufficient to cover the tree bark. A vertical white stripe, 12" long and 4" wide, will be painted across the horizontal stripe on the side of the tree adjacent to the boundary line. Line trees shall consist of a 4-inch vertical blaze bisecting a 4-inch band encircling the tree. The bands will be uniform and continuous, with no gaps present. Rough bark will be smoothed on all trees to be painted. Special care will be exercised to assure that bark is not removed into the cambium or living layer, which lies below the bark. On some species of trees with smooth bark, no material need be removed.

In instances where no trees and only a fence row exists on the government side of the boundary line then posts should be painted every 50'. Only the top 8" of the post should be painted. At no time is it acceptable to paint any portion of a fence post not located on government property.

c. Contractor will furnish all paint. The quality of the paint shall equal or exceed Nelson’s

Boundary Marking Paint (white, brushing type). Use of any other paint must be approved by the Government representative. As noted, before, trees (where present) will be painted no less than 50' intervals, and all posts will be painted. Existing posts will be prepped to provide a clean, smooth surface for the paint. This may require scraping, brushing with a wire brush, and/or wiping to remove rust, flaked paint, or algae. Posts must be dry prior to painting. It is estimated that two (2) gallons of white paint will be needed per mile of boundary.

d. Monument locations are marked with white painted steel T-post set near the monument.

Care will be taken not to hit or disturb the monument or allow paint on the monument cap. Work in the field must proceed from monument to monument. Skipping an area is not allowed unless approved by the Government representative.

e. The Contractor will record presence or absence of all monuments located within the scope of this contract on the issued boundary survey plat sheets. The plat sheets list monuments in sequence. Notations indicating presence/absence of each monument must be recorded. One member of the crew will be responsible for keeping this information updated daily. These will be delivered to the Nimrod Office, upon the completion of each 5-mile section of boundary. Any remaining plats/notes will be handed in at the end of the contract work.

f. Missing witness posts will be replaced by the Contractor. 5' T-posts shall be reset a minimum depth of 12", unless otherwise approved by the Government Representative.

Posts replaced will be set on the Government side of the fee line 6" from the monument.

The “cleats” on the post will point in the direction of the monument. All existing and replacement posts will be painted white. If two posts exist at a monument and one or both posts are damaged, then all damaged posts will be replaced. Damaged witness posts that are replaced shall be removed from Government property.

g. The use of a metal detector, GPS, hand-held compass and measuring tape will be necessary to locate hard to find monuments. Digging and using a metal detector will routinely be necessary to locate monuments that may be covered with leaves or soil, especially when the post is missing. When monuments are missing, the course lines intersecting the missing monument shall not be cleared or painted. The present condition of the boundary line may be poor in many locations and show little evidence of past clearing, painting, or the existence of witness posts.

h. Boundary monuments will not be reset, or in any other manner disturbed.

i. Government boundary signs and AGFC Cooperative Wildlife Management Area signs

(9” x 10”) shall be attached to the T-posts at ½ mile intervals and at each access point.

Also, in pasture or tilled areas every post will have both boundary signs attached.

Attachment hardware shall be rust proof.

j. Stump killer will be applied to all stumps. The contractor shall hold a valid State of

Arkansas Pesticide Applicator Commercial License. The stump killer will be applied the same day as cutting using a sprayer to thoroughly wet the freshly cut surface, the cambium ring primarily. A suitable dye must be added to the herbicide to aid in complete application and for inspection purposes. The stump killer shall not be applied to limbed trees. The Contractor shall follow the manufacturer’s safety precautions in all aspects of use and handling of the stump killer.

k. The Contractor shall contact the government representative no less than weekly to report on work progress.

PART 6

APPLICABLE PUBLICATIONS

6. APPLICABLE PUBLICATIONS (CURRENT EDITIONS)

6.1 Compliance with Regulations

The Contractor must abide by all applicable regulations, publications, manuals, and local policies and procedures. The following paragraphs outline required procedures for compliance with the Corps of Engineers Safety Manual, EM385-1-1.

6.2 Safety

1. Safety Manual.

The Contractor shall comply with all current provisions of the Occupational Safety and Health Act (OSHA) (www.osha.gov), in addition to the standards of the Corps of Engineers manual, EM 385-1-1, Safety and Health Requirements Manual (http://www.usace.army.mil/inet/usacedocs/eng-manuals/em385-1- 1/toc.htm). At least two employees on each shift must be trained to administer Cardiopulmonary Resuscitation (CPR) and First Aid. Particular emphasis will be placed on the Contractor's safety plan and the reporting provisions. The safety plan must be submitted to the COR prior to work beginning.

2. Accident Prevention Plan.

Before work begins, the contractor is required to develop an Accident Prevention Plan and an Activity Hazard Analysis in accordance with EM 385-1-1. This plan is to address all phases of work within the bounds of government property with specific attention towards the identification of potential hazards associated with each individual work phase and must be submitted before any work begins.

3. Safety Meetings.

The Contractor shall conduct a safety meeting weekly with the Contractor's personnel to discuss potential safety hazards. All employees shall be briefed on safety procedures including such things as vehicle operation, use of equipment, first-aid, visitor protection, and reporting accidents or injuries.

4. Personal Protective Equipment (PPE).

Adequate PPE will be worn at all times while conducting contract services. All individuals involved in contract operations shall be dressed fully to include shoes, pants, and shirts. All of the Contractors’ operations and equipment are to comply with the Corps of Engineers Safety Manual, EM 385-1-1.

5. Vehicle Usage.

Extreme caution shall be exercised at all times and especially when operating vehicles to prevent accidents and injuries to the Contractor, Contractor’s employees, and private parties and their property.

6. Correction of Deficiencies.

The Contractor shall be required to correct any Safety deficiencies as directed by the Contracting Officer's Representative.

6.3 Accident Reporting

The Contractor shall maintain an accurate record of, and shall report to the Contracting Officer's Representative, all incidents and accidents within 24 hours of the occurrence, and all serious accidents (those resulting in death or injury requiring medical attention) shall be reported immediately.

6.4 Title 36 – Rules and Regulations

While performing work under this contract, the Contractor and his/her employees’ vehicle operation and conduct shall conform to Title 36, Code of Federal Regulations, and other applicable state regulations. Specifically, no vehicles shall be operated off developed roadways (unless authorized by the COR), or in excess of posted speed limits and directional signs, or in a careless, reckless, or negligent manner.

6.5 Environment

The Contractor shall comply with all Federal, State, and Local environmental laws, rules, and regulations. Any apparent conflict between compliance with such Federal, State, or Local laws, rules, and regulations and compliance with the requirements of the contract shall be immediately brought to the attention of the Contracting Officer or the COR for final resolution. The Contractor shall notify the Contracting Officer or COR in writing in addition to any verbal notification of such conflicts. The Contractor shall be liable for all fines, penalties, and costs that result from violations of, failure to comply with, all such Federal, State, or Local laws, rules, and regulations.

Performance Requirements Summary The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

QUALITY ASSURANCE SURVEILLANCE PLAN

The government will perform an 100% inspection of the contract area. The inspections will consist of evaluating for properly identified survey markers, accurate clearing and painting, application of herbicide (on cut stumps), and recovery of reported missing monuments. In instances where monuments are missing, the Corps of Engineer personnel will search for these monuments. If it is found that monuments reported by the contractor as missing actually exist, then the contractor must return to the site and perform the required maintenance. A penalty of $25.00 for each monument located by the Corps of Engineers will be deducted from the total payment of the contract.

If monuments which were reported missing from the first, second, or third quarter of the contract are found by the Government after payment has been made then a deduction from payment will be taken from the last payment period.

All work shall be performed in accordance with the specifications herein and is subject to inspection to ensure strict compliance with contract requirements. If the services are found to be defective in workmanship or otherwise not in conformity with the specifications and requirements, the Government shall have the right to reject such service and the work shall then be performed to be in accordance with the requirements without additional cost to the Government.

Am I understanding the intended quoting method? Additionally, Is mechanical clearing (brush cutting/mulching head mounted to a skid steer or similar setup) authorized, where practical, while observing the guidelines set forth in the Performance Work Statement for cutting trees based upon diameter measurements? Would it be possible to have a site visit with a knowledgeable representative to discuss methods, clarify expectations and assess terrain/ground conditions in order to provide a more accurate quote? It’s going to be really hard to get a skid steer in most of these work locations. This clearing work is typically done with chainsaws, pole saw and machetes. We are only wanting a cleared boundary line to a width of 4 feet wide by 8 feet high, on the government property side of the survey line. It’s going to be hard to get a skid steer down a 4 feet wide path.
