RS MEANS ESTIMATING SOFTWARE:

a. The Estimating Software for use under this contract is the facility construction and maintenance estimating system “ RS Means CostWorks” (RS Means). The RS Means estimating system is a windows XP or later operating system. Under the terms of this contract the Contractor will be required to purchase the RS Means estimating system software and provide two (2) copies of the license agreement to the Government. Additionally, the contractor will be required to pay for software training on the RS Means estimating system.

Contractor/Government Training will be conducted at the Little Rock Corps of Engineers District Office subsequent to contract award. Further information may be obtained by contacting RS Means CostWorks, 700 Longwater Drive, Norwell, MA 02061, 1-800-334-3509, www.rsmeans.com.

b. The Contractor will also be required to purchase and provide two (2) copies of annual updates to RS

Means to the Government on January 01 of each calendar year, commencing on January 01, 2019 through

January 01, 2021, during the active term of the contract. Cost of all software license agreements and training will be factored into the offeror’s coefficient.

http://www.rsmeans.com/

c. Throughout the life of this contract the most current RS Means software shall be used in pricing the work to be performed. This eliminates the need for annual adjustments to the contractor coefficients to adjust for inflation. Contractor coefficients shall remain the same for the duration of this contract (Base period and all option periods). Pricing for all “pre-priced” line items will be based on the bare cost for the task from the RS Means estimating system multiplied by the Weighted Average City Cost Code applicable to a given task order, multiplied by the Contractor’s coefficient. City cost codes for locations not specifically stated in the RS Means estimating system will be determined by mutual agreement between the contractor and the Contracting Officer.

COEFFICIENTS:

a. “Coefficient” means a numerical factor that represents costs (generally indirect costs) not considered to be included in RS Means cost data (e.g. general and administrative and other overhead costs, insurance costs, protective clothing, and also Contractor’s profit). Contingencies such as changes in wage rates and the effect of inflation in option years are NOT TO BE INCLUDED in the coefficient. Coefficients proposed by the Offeror are multiplied by the sum of all applicable unit prices in the RS Means estimating software multiplied by the weighted average city code to price each individual Task Order.

Example: Total RS Means cost X Weighted City Average X Coefficient

The coefficients proposed by the offeror and accepted by the Government are incorporated in to the Job Order

Contract (JOC). Updated versions of the RS Means estimating software will be incorporated on January 01 of each calendar year eliminating the requirement to make annual adjustments to the contractor’s coefficients.

b. The coefficient factors should include, but not be limited to, the items listed below, and all contingencies in connection therewith.

field and home office overhead for prime and subcontractors profit for prime and subcontractors taxes and workman’s compensation insurance costs all costs associated with bonding and alternative payment protection, including the bond premiums employee payroll taxes, insurance and fringe benefits protective clothing / equipment mobilization and close out for the total contract and each task order compliance with environmental laws (overhead {indirect} costs associated with performing work in compliance with EPA/OSHA regulations, including obtaining any necessary licenses and permits, reporting requirements, etc.)

compliance with protection and safety laws (i.e., safety rails, face and clothing protection, etc.)

project signs, traffic and work site signs and barriers daily and final cleanup daily quality control and reports operation and maintenance manuals (4 copies required on major equipment) moving furniture barricades for work site electricity, water, and restroom facilities not readily available at the project site.

all waste and excess material

CAD and as-built drawings project management and supervision protection of and/or moving of government property quality control office management and equipment depreciation of mobile offices(s) interest associated with funding of equipment and payroll submittal preparation permits, licenses, and fees (Cost of RS Means software and Updates) other risks of doing business (i.e., risk of a lower than expected contract dollar value; risk of poor subcontractor performance and reperformance

c. All costs included in the Offeror’s coefficients should be fully identified in their cost proposal, as no allowance for change will be made after contract award.

d. Coefficients shall be carried out no further than two decimal places.

COEFFICIENT FACTORS:

a. Normal Working Hours - Offerors shall perform any or all functions during normal working hours, not in excess of 40 hours per week, in the quantities specified in individual task orders against this contract for the unit price sum specified in RS Means, multiplied by the applicable weighted average city cost code, multiplied by the coefficient factor.

b. Other Than Normal Working Hours - Offerors shall perform any or all functions called out in RS

Means, during other than normal working hours which requires work to be performed in excess of 40 hours per week in quantities specified in individual task orders against this contract for the unit price sum specified in RS

Means, multiplied by the applicable weighted average city cost code, multiplied by the coefficient factor.

c. "Non-prepriced" items - Items of work not supported by any RS Means pre-priced line items, but within the scope of work of an individual Task Order, may be incorporated into the task order cost as a non-prepriced (NPP) Line

Item. Proposed NPP Item costs shall be reflected as raw Material/Equipment and/or, if applicable, installation cost only. NPP line items, as required by the contracting officer, shall be supported by a minimum of two competitive and verifiable written price quotes obtained from independent sources. NPP items shall also meet the regulatory requirements of AFARS 5117.9004-3(e)(2) and (3). Proposed cost of NPP line items are subject to negotiation by the Contracting Officer or his designated representative. NPP line items accepted by the Government will be paid at the raw material cost multiplied by a fixed rate not to exceed 10% in lieu of a coefficient or any other allowance for overhead or profit for the NPP item. Because the contractor’s NPP item cost reflects the raw material cost of the item it will not be subject to the weighted average city cost index. Repetitive NPP items may be negotiated and incorporated by modification to the contract, executed by the Contracting Officer.

NOTE: The contractor shall include in the price proposal a detailed description of the types of costs included in the coefficient factors.

Uncertainty - Any aspect of a non-cost/price factor proposal for which the intent of the offeror is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).

Clarification - Limited exchanges between the Government and offerors that may occur when award without discussions is contemplated.

PAST PERFORMANCE RELEVENCY RATINGS

In performing the past performance evaluation, evaluators will apply the following relevance levels to assess the relevance of the prior contract effort(s) of offerors.

Very Relevant - Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant - Present /past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant - Present/past performance effort involved some of the scope and magnitude of effort and

Not Relevant - Present/past performance effort involved little or none of the scope and magnitude of effort and

RATING AND PERFORMANCE CONFIDENCE ASSESSMENTS

The government will evaluate past performance information to determine the quality and usefulness as it applies to performance confidence assessment. Each offeror will be assigned one of the ratings below for past performance.

Substantial Confidence - Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence - Base on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence - Base on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence -Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

Unknown Confidence (Neutral) - No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

TECHNICAL EVALUATION WEIGHTS

For the purpose of this evaluation, the following terms will be used to establish the relative importance of the technical factors:

More Important: The criterion is greater in value than another criterion.

Equal: The criterion is of the same value or nearly the same as another criterion.

Less Important: The criterion is less in value than another criterion.

Weight among technical factors:

Factor 1 - Project Management -This Factor is Equal in Importance to Factor 4, and More Important than

Factors 2 and 3, and Price.

Factor 2 - Personnel Qualifications - This Factor is Less Important than Factors 1 and 4, and more important than Factor 3 and Price.

Factor 3 - Experience - This Factor is Less Important than Factors 1, 2, and 4, and more important than

Price.

Factor 4 - Past Performance - This Factor is Equal in Importance to Factor 1, and More Important than

Factors 2 and 3, and Price.

Price - Price is less important than Factors 1, 2, 3, and 4.

EVALUATION

Each member of the Source Selection Evaluation Board (SSEB) will independently consider all information provided in the technical proposal. Once these individual analyses are completed, the team will meet and determine a rating for each of the evaluation factors by consensus decision. The evaluation team will document strengths (e.g., advantages), weaknesses (e.g., disadvantages), and other comments (e.g., deficiency and/or clarification) to support the rating for each factor, as well as the overall rating. The ratings for Technical Factors will be expressed in an adjectival assessment of Outstanding, Good, Acceptable, Marginal and Unacceptable. Documentation and comments are required for all ratings. This consensus rating will be provided to the Source Selection Authority.

BASIS OF AWARD

Proposals must meet the criteria stated in the RFP in order to be eligible for award, to include responsiveness, technical acceptability and responsibility.

The Government intends to award without discussions based on initial proposals received; therefore, the proposals shall contain the offeror’s best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions in accordance with FAR 52.215-1. The Government reserves the right to address any pertinent issues in the proposals.

The Government will award a firm fixed-price contract to the responsible Offeror(s) whose proposal the Source

Selection Authority determines conforms to the request for proposal, is fair and reasonable with regard to pricing, and whose proposal offers the best overall value to the Government. The Government reserves the right to accept other than the lowest priced offer or to reject all offers. If the Government accepts other than the lowest offer, it must be significantly more advantageous than the lowest offer to justify the payment of additional amounts.

The combination of all technical (non-price) evaluation factors are significantly more important than the price. As technical ratings and relative advantages and disadvantages become less distinct, differences in price between proposals are of increased importance in determining the most advantageous proposal. Conversely, as differences in price become less distinct, differences in rating and relative advantages and disadvantages between proposals are of increased importance to the determination.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

W9127S18R0003

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

Rating will be neither positive nor negative.
