About this file
This is a Contracting Officer's Determination justifying a sole-source procurement under FAR Part 12 for the Portland District, U.S. Army Corps of Engineers (USACE). The procurement is for a Miller ProHeat35 Liquid-Cooled Induction Heating System and associated components totaling $71,751.00 to support critical structural welding operations at Bonneville Lock & Dam. The system will be used for powerhouse infrastructure maintenance and repairs, specifically Headgate and Tail Log repairs, which directly control water flow to powerhouse turbines during operational outages. Currently, Bonneville borrows outdated contact weld heater equipment from The Dalles Dam, creating severe logistical bottlenecks and scheduling conflicts.
The justification establishes that the Miller ProHeat35 possesses unique engineering specifications unavailable from competitors, including 35 kW continuous-duty power output (versus 3.5-15 kW alternatives), 5-30 kHz output frequency for deep metal penetration (versus 30-100 kHz alternatives that cause surface-only heating), integrated multi-channel thermocouple temperature control for code compliance, and flexible liquid-cooled cables adaptable to complex structural geometries. Market research confirms Miller Electric Manufacturing is the original equipment manufacturer and patent holder, maintaining a direct-sales-only policy. The determination identifies three SAM.gov-active small business authorized distributors as potential sources. The Contracting Officer certifies the cost is fair and reasonable, and approves procurement on an other-than-full-and-open-competition basis pursuant to RFO Part 16.507-7, contingent upon funds availability. The determination was executed August 2026 and reviewed by Legal Counsel before approval.

4. Authority Cited: RFO FAR 12.102(a)) The contracting officer must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer). A brand-name item, even if available on more than one contract, is an item peculiar to one manufacturer. Brand-name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government's requirements and market

research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
5. Reason for Authority Cited:
a. Background: Bonneville Lock & Dam (BONN) requires this system to support critical structural welding operations for powerhouse infrastructure maintenance and repairs, specifically Headgate and Tail Log repairs. These assemblies directly control water flow to the powerhouse turbines during operational outages.
Currently, Bonneville lacks an organic pre-heating system, and the BONN team must borrow an outdated contact weld heater from The Dalles Dam. This creates severe logistical bottlenecks, multi-project scheduling conflicts, and delayed repair timelines.
b. Justification: The technical requirements of hydroelectric infrastructure welding dictate precise, uniform, and deeply penetrating heat. The Miller ProHeat 35 possesses unique engineering specifications that cannot be met by any other commercially available alternative:
Table 1 - Commercially Available Alternatives
Technical Parameter Miller ProHeat 35 Specification Alternative Commercial Systems / Market Standard Operational Mission Impact
Power Output & Duty Cycle
35 kW at 100% duty cycle (Continuous operation)
Alternative portable units average 3.5 kW to 15 kW or cannot maintain a 100% duty cycle
Inadequate power fails to penetrate thick-section steel common in hydroelectric facilities, risking weld failure under hydrostatic pressure.
Output Frequency 5 kHz to 30 kHz High-frequency induction heaters typically operate at 30 kHz to 100 kHz
Higher frequencies heat only the immediate surface ("skin effect"). ProHeat's lower frequency ensures deep, uniform heating through the entire metal thickness
Thermoregulation & Code Compliance
Built-in temperature controller with 4 control and 2 monitor thermocouple inputs
Typical commercial heaters utilize manual dial/power percentage adjustments without closed-loop feedback.
Ensures precise ramp, hold, and cooling rates required to conform to structural weld standards (AWS/HSS) and prevent hydrogen-induced cracking
Cooling & Geometry Integrated liquid- Most portable units Flexible liquid-cooled cables
Flexibility cooled output cables are strictly air-cooled allow technicians to wrap that easily wrap or limited to rigid, pre- complex turbine parts, around complex, sized induction headgates, and tail logs that irregular structural blankets air-cooled blankets cannot fit geometries
Market research confirms that Miller Electric Manufacturing, LLC is the original equipment manufacturer (OEM) and patent holder of the ProHeat 35 induction heating technology. Miller maintains a strict, direct-sales-only policy to end-users for this system.
It is not available via third-party commercial distributors, resellers, or on the GSA
Schedule. No other manufacturer produces a portable, liquid-cooled, 35 kW induction heating system with integrated multi-channel thermocouple temperature control. The
ProHeat 35 is available through authorized distributors per the Miller website
(https:/lwww.millerwelds.com/en-us/ site millerwelds/where-to-buy?buy=1 &tab=induction-heating]. and MRR has determined three (3) vendors that are
SAM.gov active, with no exclusions, who are smalls as defined by this NAICS.

c. Impact of Disapproval:
• Direct Labor Waste: Wastes $15k annually in labor and logistical costs to transport outdated equipment from adjacent projects.
• Grid and Power Generation Risks: Failure or delay of a weld repair on Headgates or Tail Logs directly delays turbine restoration. Replacement power purchases during unplanned outages cost the government and the regional energy grid between $50,000 to over $100,000 per day depending on seasonal demand.

Safety Hazard: Continuing to use contact resistance or flame heating exposes service members and civilian personnel to open flames, explosive gases, and severe contact burn risks.
6. Efforts to Obtain Competition: As discussed in 5b above, the manufacturer’s website was used to find SAM.gov active small businesses that are authorized distributors (reference Table 2 above).
7. Actions to Increase Competition: SAM.gov published pre-solicitation statement with the intent to solicit directly to small business per RFO FAR Part 12.
8. Market Research: Market research identified potential small businesses that would be capable of sourcing Miller ProHeat35 Induction Heating System.
