About this file

This is a U.S. Army Corps of Engineers solicitation for the Bonneville Navigation Lock Upstream Stoplogs project located in Cascade Locks, Oregon. The contract (W9127N25BA013) involves dredging the navigation lock site, fabricating and installing twelve concrete stoplogs, and placing excavated sediment in designated placement sites. The project will require specialized marine equipment including a 1200 horsepower twin-screw tugboat, a floating clamshell dredge, and bottom dump or split hull scows.

Key contract requirements include precise dredging to specific depths (34.6-40 feet NGVD29), high-resolution underwater imaging, pre- and post-dredge surveys, and careful material placement. The sediment is predominantly sand (72%) with some silt, gravel, and clay. Contractors must follow strict environmental and safety guidelines, including handling potential lamprey larvae and coordinating with marine traffic. The contract includes multiple contract line item numbers (CLINs) for mobilization, dredging, stoplog fabrication and installation, with payment based on cubic yard quantities and specific job tasks. Bid submissions are electronic-only, with a telephonic bid opening scheduled.

SPECIAL CONTRACT REQUIREMENTS

FAR provision 52.229-11 and FAR clause 52.229-12

FAR provision 52.229-11 and FAR clause 52.229-12 are included in this solicitation. This provision and clause concern the imposition of a 2 percent Federal excise tax withholding on any resultant contract award or payment request. This rule applies to Federal Government contracts for goods or services that are awarded to foreign persons - such as foreign contractors. It implements the Department of the Treasury's final regulations published in the Federal Register at 81 FR 55133 on August 18, 2016, under section 5000C of the Internal Revenue Code relating to the 2 percent tax on payments made by the U.S.

Government to foreign persons pursuant to certain contracts.

Pursuant to the FAR 52.229-3 Federal, State, and Local Taxes, taxes imposed under 26 U.S.C. 5000 C may not be included in the contract price or reimbursed.

Exemptions from this excise tax must be claimed by an Offeror when it submits, with its offer, a U.S.

Department of Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/W14. If not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent on each contract payment. Failure to submit an IRS Form W-14 with each payment request will also result in an automatic withholding of 2 percent from the payment request.

When filling out the IRS Form W-14 the following information may be used to complete Part I, Lines 6 and 7.

Line 6 Contract/reference number: W9127N25BA013 Line 7 "Name and address of the acquiring agency": Portland District, 333 SW 1st Avenue, STE 10, Portland, OR, 97204

Any exemption claimed and self-certified is subject to audit by the IRS. Any disputes concerning this tax are adjudicated by the IRS because the Section 5000C tax is a tax matter not a contract issue.

Offerors are encouraged to seek guidance from their own tax professionals for advice concerning the provision, clause, and exclusions exclusion/submission of IRS Form W-14. Additional information is also available at:

Notwithstanding the above, the USACE does not have a means of withholding this excise tax at this time.

As a result, contractors are expected to comply with the instructions above and to properly complete and return the W-14 at proposal submission, and with each pay application. The amount due for each withholding will be confirmed by USACE, BUT WILL NOT BE WITHHELD. It is the contractor's responsibility to set aside, or remit to the IRS, the amount confirmed by USACE. Whether the contractor sets the money aside for future payment to the IRS, or makes payment to the IRS, is the contractor's discretion, based on its analysis of the regulations regarding the excise tax. In the event that USACE is able to withhold during contract performance, it will notify the contractor and make such a withholding (including any catch up withholdings); no advance notice is required to the contractor prior to the withholding. Under no circumstances is USACE liable for any tax not paid by the contractor. The contractor is liable for the tax, to the extent required by law, regardless of whether USACE makes a withholding.

FAR 29.204 expressly states that "[a]gencies merely withhold the tax (section 5000C tax) for the Internal Revenue Service (IRS). All substantive issues regarding the underlying section 5000C tax, e.g., the imposition of, and exemption from the tax, are matters under the jurisdiction of the IRS." Therefore, we cannot help you determine how the tax law applies to you. We strongly recommend that you contact the IRS and/or a tax professional should you have any questions of this nature. To be clear, this information does not constitute tax advice or a representation of your tax liability. Furnishing this information does not create liability for the USACE for any Federal, state, or local taxes applicable to the above-referenced contract or any other contract.

For submission requirements and basis of evaluation:

Executed FAR Provision 52.229-11.

Completed IRS Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, if applicable. If not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent on each payment.

3.1.4 Excavation Depths

The required dredging depth will be variable with the structural profile of the Navigation Lock as indicated on the cross section, located on the associated Contract drawings.

3.1.5 Equipment

a. Perform all work under this Contract using a tugboat, dredge and scow(s) in accordance with requirements outlined within this Subpart.

(1) Tugboat: The tug must be twin screw, with a minimum of 1200 horsepower, or of sufficient power to make headway in a max flood or ebb. In the event the fully loaded scow can't be controlled, a replacement boat or an assist boat will be required. The tug must have a good field of vision beyond the scow, when the scow is being pushed ahead. In the event the scow obstructs the vision of the tug operator, an experienced deckhand must be stationed as a lookout and that lookout must be in constant radio communication with the tug operator. In work areas that preclude use of a minimum 1200 horsepower, twin screw tug due to project depth, an alternate smaller tug may be utilized for scow handling within the project limits. The primary tug must be used for all loaded scow movements in areas where depth allows.

(2) Floating Clamshell Dredge: A floating clamshell dredge is required for all work areas within this Contract. Equipment must be of appropriate size and capacity to perform the work at all work areas with special consideration given to both the Oregon Coastal environment and shallow side channels adjacent to the Columbia River, and in accordance with Section 01 35 26.00 82, GOVERNMENTAL SAFETY REQUIREMENTS (DREDGING).

(3) Scows: All scows used to transport material must be either bottom dump or split hull and in good working condition to prevent any loss of material during loading and transporting of dredged material. Contractor personnel are not to be permitted on-board scows during transit to or from the material placement sites during the actual placement operation. The technique of "sandbagging" bottom dump seals is acceptable providing that all such sandbagging materials are of organic composition and are fully biodegradable. Equipment must be of appropriate size and capacity to perform the work at all work areas with special

AMD #0003 SECTION 35 20 23.00 82 Page 4 consideration given to both the Oregon Coastal environment and shallow side channels adjacent to the Columbia River, and in accordance with Section 01 35 26.00 82, GOVERNMENTAL SAFETY

REQUIREMENTS (DREDGING).

b. Failure to comply with the above conditions will be cause to require the replacement of such equipment with floating plant that can meet the requirements.

3.1.6 Layout of Work

A layout chart will be provided for the navigational lock site preparation area based on the schedule of work and the hydrosurvey requests. Depths at Bonneville Navigational Lock 1 are measured in NGVD29. The most current hydrosurvey information will be displayed on the layout charts. Other pertinent information to be included with each layout package will be coordinates for the material placement site, supplemental tide gauge information, horizontal control locations, and computed quantities.

Government hydrographic survey personnel may be available during their normal working hours to assist in locating control points and tidal gauges.

3.1.7 Pre-Installation Inspection

a. Conduct a pre-installation dive on the sill to ensure that the sill is sufficiently cleared and prepared to receive the stoplogs.

b. Provide 48 hours notice of inspection to allow the Government to observe the dive.

3.2 PLACEMENT OF EXCAVATED MATERIAL

3.2.1 General

Place all sediment removed from the Bonneville Navigational Lock 1 work areawithin the Government provided material placement area as shown in the associated Contract drawings.

3.2.2 Dispersal of Material
