PERFORMANCE WORK STATEMENT

NRHP Archaeological Determination of Eligibility of 45KL328 within the USACE Portland District, John Day Project Boundaries

1.0 GENERAL

a. The US Army Corps of Engineers (Corps) and Bonneville Power Administration (BPA) are jointly responsible for compliance with Section 106 of the National Historic Preservation Act (NHPA) under the terms of the 2009 Systemwide Programmatic Agreement (SWPA) for management of Historic Properties affected by operations of the Federal Columbia River Power System (FCRPS). The John Day Project is managed by the Corps, Portland District, and is located within the FCRPS. The FCRPS Cultural Resource

Program works closely with interested and affected Tribes, SHPOs, and other Agencies for cultural resource management in compliance with Section 106 of the NHPA.

b. Work outlined in this Performance Work Statement (PWS) includes a task to compile a Determination of

Eligibility (DOE) for the John Day Project site 45KL328 under criteria A-D. The site maps can be found in Attachment 2. A DOE is a legally recognized finding that a property meets the criteria for listing in the National Register. Under Section 106, properties that are eligible are given the same consideration as properties formally listed in the National Register, requiring that the Federal agency official "take into account" the effects of an undertaking upon them. In the case of sites located within the FCRPS, the ‘effect’ has already occurred and/or continues to occur due to the on-going nature of the undertaking, which is the operation of the dams and reservoirs for all authorized purposes. Therefore, Determinations of Eligibility are required for sites prior to development of mitigation strategies and for long term site management.

c. Site 45KL328 is located on the north shore at the confluence of the Columbia River and Alderdale Creek on land owned by the Corps. Originally recorded in 1983 by David Ellis as the historic Alderdale town site consisting of a foundations and historic refuse on a floodplain. In 2003, AINW did an assessment of multiple sites in the John Day Reservoir; they recommended subsurface probing and further historical research be conducted at 45KL328. The site was monitored in 2003 thru 2006 by the Confederated Tribes of the Umatilla Indian Reservation (CTUIR). The site was updated during a 2004 survey by the CTUIR (Steinmetz 2013a). The area has been identified as a Historic Property of Religious and Cultural Significance to Indian Tribes (HPRCSIT) to both the CTUIR and Yakama Nation (Engum 2013;

Shellenberger and Kiona 2012). In 2010, the CTUIR conducted oral history interviews and monitored the HPRCSIT (Steinmetz 2013b). The site has not been evaluated for the NRHP. Site 45KL328 is to be assessed for eligibility to the NRHP under criteria A-D.

d. The study area includes federal land managed by the Corps located within the Project on the Washington side of the Columbia River. If access requires crossing non-Federal land or if monitoring is required on non-Federal land within the established April 2016 Project APE, the Corps must obtain rights-of-entry prior to the Contractor accessing non-Corps land. The Contractor shall not conduct work on lands not owned by the Corps without first coordinating with the Contracting Officer (KO) or Contracting Officer’s Representative (COR).

e. The period of performance for this firm fixed priced contract is 365 days after award.

2.0 DEFINITIONS

Subsurface Shovel Test Excavations. The Contractor shall conduct up to fifty (50) 50-cm subsurface shovel test excavations (SPs) in order to assess site eligibility to the NRHP. The Contractor shall determine: (a) the presence/absence of any archaeological materials, (b) the depth and nature of previous soil disturbances (or lack thereof), (c) stratigraphic/geomorphic contextual information, and (d) information about the nature, integrity and significance of any identified resources. The Contractor shall follow the Washington Department of Archeology and History Preservations Standards for the testing purposes of a DOE.

All archaeological items exposed by the SP excavations shall be thoroughly documented and evaluated following DAHP field reporting standards. The Contractor shall delineate and record the site boundaries to the extent possible. All SP locations and the perceived site boundary shall be recorded with GPS coordinates.

The Contractor shall excavate all SPs in 10-cm levels to a minimum depth of 1.0-meter below surface and to a depth at which at least two cultural sterile levels have been encountered or until encountering impenetrable deposits. All excavated soils shall be screened though 1/8-inch mesh hardware cloth. Based on the excavators’ professional discretion if soil conditions (i.e. high clay content, extreme rockiness, saturated/muddy consistency) are problematic for 1/8-inch mesh, screening shall be switched to 1/4-inch mesh. The Contractor shall include justifications for switching to a larger mesh screen in the field notes and report documents.

In locations where SP excavation by shovel is not feasible, excavation shall continue with a 15-cm (6-inch) diameter bucket auger probes (AP). In general, maximum AP depths shall extend to at least two culturally sterile levels or the length of available extension rods (i.e. 2 meters). The Contractor shall terminate SPs and APs at shallower depths only if impenetrable deposits (i.e. gravel or cobble layers) or poor soil conditions (i.e.

high clay content, rockiness, saturated/water table) are encountered, based on the Contractor’s professional judgment. Locations of deep construction-related excavations shall be coordinated at the pre-work meeting (Task 5.2).

All artifacts, non-human bone or other cultural materials (other than conclusively modern items) on state lands recovered from the SPs and/or in the screens shall be provided to the USACE for curation, per Corps Regulations ER 1130-2-540 and Corps Guidance EP 1130-2-540, following appropriate or approved laboratory analyses. The Contractor shall document all observed and collected artifacts according to SP (or AP) and level.

All modern artifacts shall be similarly recorded by level in order to document evidence of disturbance. Artifacts provided to the USACE for curation will be ready for curation per the Burke Museum guidelines. The Corps will ascertain an accession number after provided by the Contractor.

If human remains are discovered on Corps land, they shall not be disturbed but protected in place. The KTR shall immediately notify a Corps District Archeologist (Vanessa van der Borg 503-808-4684, Tara Gauthier 503-808-4754, or Sally Bird-Gauvin 503-808-4778). The Corps will follow identified internal procedures to address the situation. (This will include notifying appropriate Indian Tribes, law enforcement, and Coroner’s offices.) If the remains are determined to be Native American, the Corps will comply with the terms of its Inadvertent Discovery Plan and the Native American Graves Protection and Repatriation Act.

5.5 Task 5: Additional Work Statement. After a thorough review of the existing documentation and previous work, the Contractor will determine if additional work is necessary to continue, such as an oral history study to identify traditional cultural uses. If additional work is needed, specific tasks and recommendations for further work (field, ethnographic, etc) will be listed and described in a written narrative along with the draft GIS field data. The narrative will be delivered to the TL and COR as a contract deliverable. If it is found that additional field work is needed to develop a formal determination, this contract may be modified to include that work or the work may be competed and awarded under a separate contract, at the discretion of the Contracting Officer.

5.6 Task 6. Site Evaluations, Site Update and Draft Report. Using the National Register Criteria and guidance on Historic Contexts and Traditional Cultural Properties (see references and guidance in Attachment 5) make a recommendation regarding whether the sites are eligible for listing in the National Register of Historic Places.

The Contractor will also need to integrate FCRPS Cultural Resource Program policies and guidance into the evaluation process. The evaluation will be based on the most complete and current information available. This task will include the following steps:

For each site:

a. Determine the period of significance; "prehistoric" (pre-contact), "historic" (post-contact), or containing components from both periods.

b. Determine if the site is a good representative within the historic contexts for the area.

c. Determine under which criteria (A thru D) the site is eligible and provide data to support eligibility or reason why it does not meet eligibility for each criteria.

d. Determine if the site retains integrity, for all criteria.

e. Complete an updated Washington state site form for the site. Including current photos of site, meeting all

NPS and corresponding SHPO guidelines for archival quality. Contractor will discuss photographs for site record updates with COR. Current digitalized map of the site depicting site boundaries.

f. Complete the NPS 10-900 form for each site. See Attachment 6.

g. Create a comprehensive bibliography of the reports, studies, articles and other literature referencing the site.

h. Provide NRHP eligibility and management recommendations for each site based on results of field evaluation in draft and final report.

The cover of the report shall specify if the document is a draft or final, and include the USACE contract number and also a statement indicating: “Work jointly funded by the U.S. Army Corps of Engineers and Bonneville Power Administration under the FCRPS Cultural Resources Program”.

Text materials shall be typed on good quality bond paper, 8.5 inches by 11 inches with a 1.25-inch binding margin on the left side, .75 inch on the right side, 1 inch at the top and 1 inch at the bottom. Larger graphics may be submitted on 11 x 17 inch paper.

All pages, photographs, tables, etc. shall be consecutively numbered throughout the report and where applicable, shall have titles and appropriate explanatory notes. Continuous Line Numbers, located under Page Layout, will be utilized for the report. The NPS 10-900 form shall be submitted, along with draft GIS data, and draft site form update, to Corps for review and comment.

The draft report, National Parks Service Form 10-900, and the updated site form shall be submitted electronically in a *doc(x) format via email, secured on-line file exchange, or on CD.

5.7 Task 7: GIS Data. The contractor shall collect, edit, and differentially correct GPS files and then prepare projected ESRI geodatabase feature classes with tabular information and FGDC metadata as a deliverable. The deliverable will include one geodatabase containing all deliverable feature classes. The deliverable will include one feature class for each type of feature. All feature class names, field names, and value choices must match the naming conventions in Attachment 5: GIS Data Dictionary. Each feature class in the GIS deliverable will have metadata. The required metadata format is ESRI ArcCatalog Metadata using the FGDC standard: North American Profile (NAP) of ISO 19115 2003. The ESRI ArcCatalog Metadata will have these fields populated;

Tags, Summary, Description, Credits, Citation Contact(s), Resource Citation Date(s). One electronic copy of GIS generated information is due seven (7) days after the completion of fieldwork. The draft GIS shall at minimum have the “sdsFeatureName” entered in the metadata. The GIS information shall be in ESRI shapefile or ESRI feature class format.

5.8 Task 8: Government Review. The Government will provide review comments to the Draft Report 35 calendar days after receipt of the report. Upon receipt of Government review comments to the Draft Report, the KTR shall incorporate any additional necessary or appropriate revisions and updates into a revised Draft Report, which shall then be forwarded to the Government for further review and approval.

5.9 Task 9: Final Report and Forms. The KTR shall address all Government comments and submit the Final

Report, GIS Data, and Site Form in both hard copy and digital media format. The final report, final site form update, and appendices incorporating the Government’s comments shall be submitted within 45 calendar days of receipt of Government comments. Text materials shall be printed on good quality bond paper, 8.5” by 11” with a 1.25” binding margin on the left side, 0.75” on the right side, 1” at the top and 1” at the bottom. Larger graphics may be submitted on 11 x 17 inch paper. Three unbound hard copies shall be submitted. Three electronic copies of the 10-900 form in MS Word and *pdf formats shall be submitted on three CDs (neither disk shall be a copy of the other). Note: The pdf file shall have all graphics, maps and appendices included in the file. The 10-900 form will not be considered final until accepted by the DAHP. All data gathered (field notes, photo, draft GIS data), will be provided to the Government with the Final Report.
