SCOPE OF WORK

CONTRACT NO. W9127N-16-Q-0052

TITLE: ELK CREEK CULTURAL INVESTIGATIONS

STATEMENT OF WORK

1. PROJECT BACKGROUND.

a. The U.S. Army Corps of Engineers (USACE), Portland District (Corps) intends to conduct a Fuels Treatment at Elk Creek Project for the purpose of forest health. The Corps is responsible for compliance with Section 106 of the National Historic Preservation Act (NHPA). The Corps works closely with interested and affected Tribes, State Historic Preservation Offices (SHPOs), and other agencies for cultural resource management in compliance with Section 106 of the NHPA. As part of this responsibility, the Corps has a requirement to inventory the Fuels Treatment area for cultural resources.

Work outlined in this Statement of Work (SOW) includes a task for archeological inventory. The archeological inventory includes up to 331 acres at Elk Creek (See Attachments 3 and 5 for survey area maps). Elk Creek Fuels Reduction Project (165 acres) is located in Township 33 South, Range 1 East Section’s 17 and 20. Attachment 4 is a map of the identified sites within the project area. The Elk Creek Riparian Habitat Project (166 acres with a 50 foot buffer) is located in Township 33 South, Range 1 East Section’s 8, 17 and 20. Attachment is 6 is a map of the identified sites within the project area.

The study area for at Elk Creek is located in Jackson County, OR. Previously recorded archeological sites within the Fuels Reduction area include the following: two precontact sites (35JA27a-c (Eligible) and 35JA28 (Eligible).

Previously recorded archeological sites within the Riparian Habitat area include the following: five precontact sites [35JA100, 35JA234/35JA11 (Eligible); 35JA106 and 35JA113 (Unevaluated), also included is Undocumented Site #1 (see Minor 2012)]. Attachment 6 is a map of the identified sites within the project area. Site descriptions and their associated National Register eligibility status, if determined, from previous surveys are included in Attachment 9.

b. Project Area Conditions. Inventory is to be conducted in a reservoir environment where the field crew may encounter mucky field conditions and areas of dense rye grass. How the Contractor (KTR) plans to work through these conditions should be identified within the KTR’s project proposal for work; identifying crew safety as well as field inventory processes.

2. PROFESSIONAL SERVICES TO BE PROVIDED.

a. General Requirements. The Contractor (KTR) shall furnish:

1) A proposal outlining how they propose to conduct all aspects of the proposed work within this SOW.

The proposal shall include field management, background research, report writing, and site recordation and site updates.

2) All resources, personnel, logistics, global positioning systems, software, materials, and supplies necessary to conduct an archeological inventory and prepare a technical report.

b. Task 1: Kick Off Meeting.

The KTR shall schedule a mutual date and time for a kick off two hour teleconference meeting with the TL prior to the start of work. The purpose of the kick off meeting is to clarify tasks and methods, set a schedule, and to minimize issues or problems that might arise over the course of the contract.

c. Task 2: Field Work.

The KTR shall conduct an archeological surface survey of up to 331 acres in accordance with the Department of the Interior Standards for Identification and OR SHPO fieldwork (http://www.oregon.gov/oprd/HCD/ARCH/docs/Master_Final_FieldGuidelines_January2016.pdf). Linear resources will follow the 2013 OR SHPO Guidelines for Recording and Evaluating Linear Cultural Resources (http://www.oregon.gov/oprd/HCD/SHPO/docs/ORLinearResourcesGuidancev2.pdf). Reporting standards (state standards) is listed in task four below. The KTR shall record up to 10 newly discovered archeological resources and up to 10 isolated finds; update site records on nine previously recorded archeological sites if accessible (sites are indicated in Attachment 9). The KTR shall update the site forms to reflect current condition utilizing the current Oregon (OR) SHPO online format. A map depicting the survey areas are included in Attachments 3-6. The KTR shall not exceed 331 acres. The survey is strictly a pedestrian survey below the high water mark or maximum conservation pool level. Subsurface excavation is not authorized under any circumstance.

Survey shall be conducted where surface visibility is adequate (i.e. greater than 20% ground surface visibility) and where survey is feasible (slopes less than 30%, safe for pedestrian survey access). Transect intervals shall be no greater than 20 meters in high probability areas. The Corps considers high probability areas those areas identified during the records search or field survey that could contain archeological deposits, or where surface archeological materials have been observed. Any deviation from state standards needs to be coordinated and approved by the TL Point of Contact (POC) and Contracting Officer (KO), and should be adequately explained and justified in the survey report (e.g., nature of field conditions, ground surface visibility, slope, landforms, etc.). Transect intervals may be increased at the Field Director / Principal Investigator’s discretion in areas that exhibit hydric soils, or are disturbed. If the KTR encounters low surface visibility in a high probability area, and believes shovel testing is necessary, the KTR shall show these areas on maps in the survey report and provide recommendations for areas that should be shovel tested in the future.

Crew Chiefs and Surveyors shall be capable of the following:

1) Rigorous physical exercise.

2) Working in extreme weather conditions and rough terrain.

3) Appropriate responses to health and safety situations.

The KTR shall utilize qualified Crew Chiefs and Surveyors who are experienced in conducting intensive pedestrian surveys and who can apply field survey methods and techniques according to current OR SHPO standards and the Secretary of Interior’s Standards and Guidelines, (http://www.cr.nps.gov/local-law/arch_stnds_9.htm). The Field Director / Principal Investigator is expected to directly supervise survey in the field for at least 25% of the field work, in order to ensure compliance with the standards and guidelines.

Crew Chiefs shall plot daily survey transect locations on field maps, record daily observations in field notebooks, identify and describe historic and prehistoric artifacts and features, complete site and isolated find forms, record site boundaries using sub-meter global positioning system equipment, and record survey areas and sites using digital photography. Survey crews shall map areas surveyed, areas not surveyed and reason, and identify areas of high probability that may contain cultural resources but are inaccessible because of current conditions.

The Crew Chiefs shall maintain handwritten notes in a field notebook that includes the date, transects and intervals, information about area surveyed, names of Surveyors, and what was observed during daily survey efforts (e.g., vegetation, cultural materials and archaeological sites, man-made developments, disturbance etc.). A photograph log shall be maintained for all photographs taken during the survey effort. The log sheet shall contain columns for the date, photographer name/initials, subject matter, aspect, film/digital frame numbers and roll number (as appropriate).

For the purposes of this SOW, it is estimated that up to 10 new archaeological resources will be recorded and up to 10 isolated finds. Work shall be performed only on those sites, or portions of those sites, located on Corps land where access has been approved; however, where portions of sites extend beyond the contracted survey area, this shall be noted on site documentation.

Crew Chiefs and Surveyors shall complete individual maps (e.g., pace and compass field maps) of all newly recorded sites. These maps shall contain a scale, north arrow, legend, date, basis of bearing, name of individual responsible for the map, and temporary site number. KTR shall also point provenience diagnostic artifacts, features, and artifact concentrations within the site map. The maps shall contain critical elements present such as vegetation, shoreline, slope, probable site boundary and areas of development and/or disturbance. These maps should be included in site forms, as well as in the final report.

Crew Chiefs and Surveyors shall conduct preliminary site evaluations considering site information recorded in the field using the National Register of Historic Places significance criteria. The preliminary site evaluations shall be conducted by qualified personnel meeting the Secretary of Interior’s Standards and shall be recorded on the site forms.

Evaluations shall be fully justified no matter whether the recommendation is “eligible”, “not eligible”, or whether “additional information is needed to make the evaluation determination (i.e. testing or research of existing curated collections)”. The placement of a site in a “needs testing” category should not be used as a catch-all; rather placement of a site in this status requires rigorous justification. The justification statement, including a site condition assessment as it relates to depositional integrity under Criterion D of the National Register of Historic Places, shall be included on the site form.

Digital data collection by electronic instruments and equipment shall be utilized to the fullest extent possible. Crew Chiefs and/or Surveyors shall capture Global Positioning Systems (GPS) positions at transect start-finish points at enough frequency to establish survey boundaries for all areas surveyed. The GPS positions documenting site boundaries shall be polygons. All GPS data shall be downloaded and corrected frequently throughout the field effort to ensure data preservation. GPS data shall be corrected and converted into shape files and provided to the TL digitally at the completion of fieldwork. The KTR shall also provide raw and corrected GPS data. The KTR shall provide Geographic Information Systems (GIS) site boundaries and survey area boundaries shown on United States Geological Survey (USGS) topographic maps submitted in the final report.

The KTR shall coordinate with the TL regarding the need to cross private landowners and/or ad-joiners land to access federal lands proposed for survey if they cannot be accessed by road. The need to cross private land is not anticipated at this time. The KTR has the right to enter and conduct necessary survey and site recording activities on all Corps lands. However, the KTR must coordinate with the TL to insure that Corps Rogue Valley Project personnel are notified when survey crews are working within Corps Project boundaries.

Crew Chiefs and Surveyors shall note all cultural items observed but not formally recorded on field maps (i.e., items that may be approaching 50 years of age). Text describing all cultural items not formally recorded and any associated photos and maps shall be included in field notebooks and the final report.

All information generated during field surveys (e.g., handwritten notes, field maps, field notebooks, logs, etc.) shall be submitted to the TL at the completion of all project tasks.

A “no collection/excavation” policy shall be followed. If single artifacts are observed outside of known site boundaries and they are not in danger of loss or damage, they shall not be collected and shall be recorded as isolated finds (e.g., field map location, GPS position, local condition description, etc.). However, prior to collection the KTR shall contact the TL and KO if the diagnostic artifacts/features are in immediate danger of loss or damage for whatever reason(s) to discuss collection option. Those artifacts approved for collection shall be collected but only after all readily available and pertinent provenience data on each item is recorded (e.g., field map location, GPS position, local condition description, etc.), and the District Archeologist has coordinated with the appropriate Tribe(s) that the item is not considered sacred or a potential funerary item. The KTR will notify the TL as soon as possible if excavation is required to remove artifacts/features in danger of loss. An assessment of the situation will be made to determine the best course of action, including whether any excavation will be done. If it is determined by the Corps that excavation is the best course of action the KTR will receive approval from the KO prior to excavating or removal of any items. The reason(s) for collection shall be noted as part of the data accompanying each artifact and as part of the site form and final report. The artifacts will be transferred to Corps prior to contract expiration; or shall be prepared for curation by the KTR. Excavation and curation will be conducted under a contract modification.

NOTE: If the actual number of newly recorded sites exceeds 10, or newly recorded isolates exceed 10, the KTR should take a GPS point and note the find. The KTR should contact the TL and KO to inform them of the additional resources. The Corps will make a decision at that time, to either modify this contract or not.

If human remains are discovered on Corps land, they shall not be disturbed but protected in place. The Contractor shall immediately notify a Corps District Archeologist (Mike Flowers 503-808-4762, Dan Mulligan 503-808-4768, Tara Gauthier 503-808-4754, or Sally Bird-Gauvin 503-808-4778). The Corps will follow identified internal procedures to address the situation. (This will include notifying appropriate Indian Tribes, law enforcement, and Coroner’s or Medical Examiner’s offices.) If the remains are determined to be Native American, the Corps will comply with the terms of its Inadvertent Discovery Plan and the Native American Graves Protection and Repatriation Act.

d. Task 3: Site Forms. KTR shall prepare all new site forms and site update forms in accordance with OR SHPO survey and reporting standard guidelines (Link below). KTR is responsible for submitting documentation to OR SHPO, as stated in the SHPO standards, for new site trinomial numbers and providing those trinomials within the final report.

e. Task 4: Draft Report. The report will be clearly marked DRAFT throughout and shall include: front matter (title page, executive summary, tables of contents, figures, plates, tables, and appendices); body of report (introduction, basic research design, methods, environmental overview, cultural context, results of investigations including acreage surveyed, site descriptions, number of new sites recorded, and number of previously documented site records updated, recommendations for future site management, conclusions, and references cited); and appendices (USGS 7.5’ map sheets showing survey areas and sites, UTM coordinates for sites, photographs of survey areas, photographs of diagnostic artifacts, etc.).

The executive summary shall include survey results, major findings, and statements of National Register significance for identified and recorded cultural resource sites, and proposed management recommendations. The cover of the report shall include the Corps contract number and also a statement indicating: “Work funded by the U.S. Army Corps of Engineers”.

Text materials shall be typed on bond paper, 8.5 inches by 11 inches with a 1.25-inch binding margin on the left side, .75 inch on the right side, 1 inch at the top and 1 inch at the bottom. Larger graphics may be submitted on 11 x 17 inch paper.

All pages, photographs, tables, etc. shall be consecutively numbered throughout the report and where applicable, shall have titles and appropriate explanatory notes. A Draft Report shall be submitted, along with draft GIS data, and draft site forms, to the TL for review and comment.

The Report shall adhere to requirements of the Oregon SHPO survey and inventory guidelines are located at the following website address: http://www.oregon.gov/oprd/HCD/ARCH/docs/Reporting_Guidelines_FINAL.pdf (http://www.oregon.gov/oprd/HCD/ARCH/Pages/index.aspx). On-line site forms and instructions are located at the following website address: http://www.oregon.gov/oprd/HCD/ARCH/docs/online_site_form_for_field.pdf

g. Task 5: Final Report. KTR shall address Government comments and submit Final Report, GIS Data, and Site Forms in both hard copy and digital media format. The final report, any final site forms not previously submitted and appendices incorporating the Government’s comments shall be submitted within 45 calendar days of receipt of Government comments. Six bound hard copies shall be submitted, and one unbound hard copies with the appropriate SHPO cover page shall be submitted. Two sets of CDs electronic copy of the report with site records in PDF formats shall be submitted on two compact disks neither disk shall be a copy of the other, one disk shall contain the report and site forms and one disk shall contain the GIS data). Note: The pdf file shall have all graphics, maps and appendices included in the file.
