The government reserves the right to change the cubic yard capacity at any collection station or change the number of collection stations as long as it does not increase the overall total cubic yard capacity requirement of this PWS. The government may also reduce the frequency of collections.

6.0 Performance Requirement Summary.

6.1 To ensure that the Government receives the services for which it contracted, the Government will only pay for services received. The Performance Requirements Summary (PRS) determines if the contractor meets the performance standards of the contract, as well as provides guidelines for how and when surveillance will be performed. It ensures timeliness, effectiveness, and that the contractor is delivering the results specified in the contract. Government contract quality assurance will be performed per the PRS surveillance schedule.

6.1.2 If the Contractor fails to perform at any time and the work is deemed critical by the COR, a replacement contractor shall be hired to perform the work. If this occurs, the Contractor shall be required to reimburse the Government for the full costs of the work performed including labor, materials, transportation, and supervision.

b. Reduce the contract price to reflect the reduced value of the services performed.

c. If the Contractor fails to promptly re-perform the services, or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may:

COR.

6.2.5 Standard. Recurring defects are not permitted for any of the above service items. For example, if the

COR discovers litter left in the vicinity of dumpster area covered under the contract, the contractor is required to correct the defect through re-performance. Work Schedule shall indicate Contractor’s activity on the project at least ten days in advance and shall be subject to adjustment upon notification by the COR that a conflict with necessary project maintenance work has developed.

The COR will notify the Contractor of necessary schedule changes two business days in advance where possible. The normal working hours on BLD shall be 0700 to 1700 hrs without prior written approval by the COR. The COR maintains the authority to adjust the working hours to meet Government needs.

In accordance with EM 385-1-1 Appendix D, Section 11, the Contractor shall prepare an Activity Hazard Analysis for approval by the COR prior to commencement of work. The online link to the 2008 Corps of Engineers Safety Manual EM 385-1 is as follows:

http://publications.usace.army.mil/publications/eng-manuals/em385-1-1/2008_English/toc.html

7.2 The Contractor shall determine those areas and activities in which possible safety hazards exist during the on-site visit of the BLD and note such information on the Activity Hazard Analysis (example in EM-385- 1). When completed, the Contractor shall identify hazards in each phase of services performed, what preventative measure the contractor proposes to take to prevent such accidents and then return to the COR to retain on file.

7.3 The COR and the Project’s Environmental Compliance Coordinator shall approve all cleaning and maintenance products. The contractor shall use only environmentally friendly cleaning products.

Employees shall be briefed in hazardous communication – proper labeling and storage, MSDS Sheets, etc.

– by the Environmental Compliance Coordinator. This shall be conducted at the Pre-Work Meeting.

7.4 Accidents. The Contractor or the Contractor’s employees shall report any circumstances of needed repair of the facility or unusual soiling of any area which may affect the performance of the work and unhealthful or hazardous conditions or any delays or interference with the work caused by the employees or the Government.

The report shall include, but not be limited to; location, nature of the injury or accident, authorities notified, and the action taken along with any other pertinent information. The report shall be accompanied by sketches, graphs/drawings, and photographs as needed and forwarded to the COR within 24 hours.
