SECTION 00010

BIDDING SCHEDULE

NOTES

1. PRODUCTION INCENTIVE PAYMENT

(a) For each individual dredging assignment on the Black Warrior- Tombigbee (BWT), Alabama River System, (ARS), and Tennessee-Tombigbee Waterway (TTWW), the government will pay an incentive of $1.00 for each cubic yard per hour of production for dredging rates that exceed a target rate of 500 cubic yards per hour. For dredging work accomplished under a given Task Order, the possibility of a production incentive payment will exist for every dredging assignment except for the last assignment issued under that Task Order. There will be no incentive payment for Coastal projects or work for others. The incentive payment will be calculated based on the average rate of dredge material removed (cubic yards per hour) at each dredging assignment or shoal location. That portion of the production rate that exceeds the target rate of 500 CY/HR will be multiplied times the number of actual 100% PAYTIME hrs worked at that dredging assignment to determine the actual incentive payment amount earned; (Cy/Hr above Incentive = Measured Production Rate (cy/hr) – 500 cy/hr; Incentive Payment ($) = Cy/Hr above Incentive x 100% Hours x $1/cy). This amount will be paid in addition to the regular 100% PAYTIME rate in bid item 1. The government will also require that the contractor maintain a minimum production rate of 100 Cy/Hr while in the 100% PAYTIME pay status for each individual assignment. In the event that the minimum production rate is not met, a decrease or deduction of $1.00 for each cubic yard per hour below the minimum will be made for each assignment. The deduction will be taken from the regular 100% PAYTIME rate in bid item 1.

(b) Incentive yardage calculations for the Black Warrior/Tombigbee River System and the Alabama River System will be based on government performed before and after dredged hydrographic sweep surveys using Ross Labs multi-transducer sweep survey vessels and HYPACK hydrographic software to collect and edit the data. Incentive yardage calculations for the Tennessee Tombigbee Waterway will be based on government performed before and after dredged hydrographic surveys. Those surveys will be collected with either single-beam, multi-transducer, and/or multi-beam surveying equipment. HYPACK hydrographic software will be used for data collection, post processing and volume calculations.

The HYPACK program will be used to calculate the actual cubic yards removed using the two surface method comparing the before dredging bottom surface to the after dredging bottom surface for materials removed for the assigned dredging limits. The incentive payment will only be made for quantities removed, within

Alabama, Mississippi and Florida

00010 - 4 these limits, but only for materials not exceeding the depth parameters stated in Section 1000, Paragraph 7.1.1., entitled: REQUIRED DREDGING.

(c) Where conditions such as high water or other unforeseen circumstances prevent the successful performance of the govt. hydrographic survey, the government will make every effort to resolve by attempting to perform an interim survey or by estimating the yardage removed using the existing before dredge survey. When this proves unsuccessful or impossible to reconstruct, the contractor will be paid at the regular 100% PAYTIME rate. Also, reference is made to Section 1000, Paragraph 5.2., entitled: CHARACTER OF MATERIAL which addresses the nature of dredged material expected to be encountered.

(d) Booster Pump use for Incentive Payment – The contractor may elect to use the booster pump to increase production during any period of the contract regardless of Govt. callout of the booster pump found in bid items 7a and 8a. For additional details, see section 2.2.10., entitled Booster Pump of SECTION 01000 - Statement of Work - Description/Specifications

(e) Special notice is given regarding upland disposal operations. In no event shall the production incentive cause the contractor to regulate and control activities in the disposal operations such that the physical condition of dikes and weirs are placed in potential danger of failing or of being operated in such a manner that efficient placement of material is not performed. When warranted, the govt.

reserves the right to control all upland disposal operations, including actual discharge locations and pipe placement, in order to assure complete site integrity.

Some dredging assignments will require special placement and handling of discharge material to the extent that dredged production is limited or slowed and in some cases reduced to the point that only the base hourly 100% rate of pay is earned.

2. BID SCHEDULE

(a) Bids based on dredges with smaller than a 20-inch inside diameter will be considered non-responsive. Dredges with a pump diameter discharge less than a 20 inch inside diameter are considered inadequate for satisfactory performance of the work required within the period of the contract. Dredges that have less horsepower than the minimum shown will be considered non-responsive. The dredge must be bid under the diameter discharge from the dredge pump as originally designed by the manufacturer. The discharge lines shall be the same diameter as the dredge pump discharge.

(b) Bidders must insert a price on all numbered items of the bidding schedule. Failure to do so will disqualify the bid.

Alabama, Mississippi and Florida

00010 - 5

(c) All the extensions of the unit price shown will be subject to verification by the Government. In case of variation between the unit price and extension, the unit price will be considered to be the bid.

(d) It is the intent of the Government to secure a dredge meeting the requirements set forth in the Statement of Work of the specifications. The table in the paragraph entitled DREDGE AND ATTENDANT PLANT REQUIREMENTS indicates the estimated average output for dredges of various power based on average theoretical conditions under which this work is to be accomplished. Bids will be evaluated and award will be made on the basis of employment of the plant that will result in the lowest overall total price, as described hereinafter, to the Government for the equipment. This is not to be construed by the Contractor that the Government guarantees this number of hours will be worked.

(e) Bidders should insert the appropriate number of hours for 100% Pay time from the table into the bid schedule.

(f) The Government will check the bidder's computation for accuracy and to insure that the bidder's computation was made in accordance with the above evaluation procedures. In case of variation between the bidder's computation procedures and those prescribed above, the Government will correct the bidder's computation and the bid will be evaluated by the corrected computation.

3. To better facilitate the public bid opening process, all modifications to bids are to be submitted on copies of the latest bid schedules as published in the solicitation or the latest amendment thereto. In lieu of indicating additions/deductions to bid items, all bidders should state their revised prices for each item. The company name should be indicated on the face of the bid schedule to preclude being misplaced.

4. The number of hours indicated on the Bidding Schedule is approximate. The Contractor may be required to work either more or less than the number of hours specified.

5. For Bid Item No. 6. Mobilization/Demobilization for the dredge and attendant plant shall be bid as one lump sum rate for the total effort of mobilizing and demobilizing the entire plant. The mobilization site shall be Sunflower Bar on the Black Warrior-Tombigbee Waterway, BWT Mile 78.0, unless otherwise directed by the contracting officer. The contractor shall be required to mobilize their dredge plant to the first assignment no later than 20 calendar days after issuance of the Notice To Proceed.

6. For Bid Item No. 7a. Mobilization/Demobilization Booster-Pump will be to/from BW&T Navigation Mile 90 at the Jackson/Lower Princes dredging reach.

Alabama, Mississippi and Florida

00010 - 6

7. For Bid Item No. 9. Intermediate Mobilization and Demobilization of Pipeline, each UNIT is equivalent to 1,000 feet of pipeline.

8. For Bid Item No. 10, MISSISSIPPI STATE TAX, the Government will reimburse the Contractor for the actual taxes collected by the State of Mississippi for work performed under this contract. Also, the State of Mississippi will enforce an equipment tax on equipment new to the State of Mississippi. This equipment tax will not be reimbursed by the Government.

9. The dividing line between the coastal and inland navigation projects is the Cochrane-Africatown Bridge, Mobile, Alabama.

Alabama, Mississippi and Florida

00010 - 7

INSTRUCTIONS

1. Individual sureties on bonds executed in connection with Government contracts must complete and submit this form with the bond. (See 48 CFR 28.203, 53.228(e).) The surety must have the completed form notarized.

2. No corporation, partnership, or other unincorporated association or firm, as such, is acceptable as an individual surety. Likewise, members of a partnership are not acceptable as sureties on bonds that a partnership or an association, or any co-partner or member thereof, is the principal obligor. However, stockholders of corporate principals are acceptable provided (a) their qualifications are independent of their stockholdings or financial interest therein, and (b) that the fact is expressed in the affidavit of justification. An individual surety will not include any financial interest in assets connected with the principal on the bond that this affidavit supports.

3. United States citizenship is a requirement for individual sureties for contracts and bonds when the contract is awarded in the United States. However, when the Contracting Officer is located in an outlying area or a foreign country, the individual surety is only required to be a permanent resident of the area or country in which the contracting officer is located.

4. All signatures of the affidavit submitted must be originals. Affidavits bearing reproduced signatures are not acceptable. An authorized person must sign the bond. Any person signing in a representative capacity (e.g., an attorney-in-fact) must furnish evidence of authority if that representative is not a member of a firm, partnership, or joint venture, or an officer of the corporation involved.

The Government must receive the acknowledgment by the time and at the place specified for receipt of bids.

(End of provision)

52.214-4 FALSE STATEMENTS IN BIDS (APR 1984)

Bidders must provide full, accurate, and complete information as required by this solicitation and its attachments.

The penalty for making false statements in bids is prescribed in 18 U.S.C. 1001.

(a) Bids and bid modifications shall be submitted in sealed envelopes or packages (unless submitted by electronic means) (1) addressed to the office specified in the solicitation, and (2) showing the time and date specified for receipt, the solicitation number, and the name and address of the bidder.

(b) Bidders using commercial carrier services shall ensure that the bid is addressed and marked on the outermost envelope or wrapper as prescribed in subparagraphs (a)(1) and (2) of this provision when delivered to the office specified in the solicitation.

Section 00100 Page 3

(End of provision)

52.214-7 LATE SUBMISSIONS, MODIFICATIONS, AND WITHDRAWALS OF BIDS (NOV 1999)

(a) Bidders are responsible for submitting bids, and any modifications or withdrawals, so as to reach the Government office designated in the invitation for bids (IFB) by the time specified in the IFB. If no time is specified in the IFB, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that bids are due.

(b)(1) Any bid, modification, or withdrawal received at the Government office designated in the IFB after the exact time specified for receipt of bids is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late bid would not unduly delay the acquisition; and--

(i) If it was transmitted through an electronic commerce method authorized by the IFB, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of bids; or

(ii) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of bids and was under the Government's control prior to the time set for receipt of bids.

(2) However, a late modification of an otherwise successful bid that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(c) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the bid wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(d) If an emergency or unanticipated event interrupts normal Government processes so that bids cannot be received at the Government office designated for receipt of bids by the exact time specified in the IFB and urgent Government requirements preclude amendment of the IFB, the time specified for receipt of bids will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(e) Bids may be withdrawn by written notice received at any time before the exact time set for receipt of bids. If the IFB authorizes facsimile bids, bids may be withdrawn via facsimile received at any time before the exact time set for receipt of bids, subject to the conditions specified in the provision at 52.214-31, Facsimile Bids. A bid may be withdrawn in person by a bidder or its authorized representative if, before the exact time set for receipt of bids, the identity of the person requesting withdrawal is established and the person signs a receipt for the bid.

(End of provision)

52.214-18 PREPARATION OF BIDS--CONSTRUCTION (APR 1984)

(a) Bids must be (1) submitted on the forms furnished by the Government or on copies of those forms, and (2) manually signed. The person signing a bid must initial each erasure or change appearing on any bid form.

(b) The bid form may require bidders to submit bid prices for one or more items on various bases, including--

(1) Lump sum bidding;

(2) Alternate prices;

(3) Units of construction; or

(4) Any combination of subparagraphs (1) through (3) above.

(c) If the solicitation requires bidding on all items, failure to do so will disqualify the bid. If bidding on all items is not required, bidders should insert the words "no bid" in the space provided for any item on which no price is submitted.

(d) Alternate bids will not be considered unless this solicitation authorizes their submission.

(End of provision)

52.214-19 CONTRACT AWARD--SEALED BIDDING--CONSTRUCTION (AUG 1996)

(a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government, considering only price and the price-related factors specified elsewhere in the solicitation.

(b) The Government may reject any or all bids, and waive informalities or minor irregularities in bids received.

(c) The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.

(d) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low evaluated bid, or if it is so unbalanced as to be…
