6.3 TIME LIMITATION- The Contractor will be allowed a specified number of working days, (exclusive of Saturdays, Sundays, federal holidays, and rain days) to accomplish the mowings.

6.3.1 A complete mowing of either Park, Project or Natural Resource mowing would include all items listed on the respective bid schedules. The time limitation for a complete Park mowing is eight (8) days, for a Project mowing five (5) days, for a Boundary Line mowing thirty (30) days, for a Hunting Access Road mowing fifteen (15) days, and for a Food Plot mowing fifteen (15) days.

When a partial mowing of either Park, Project or Natural Resource mowing is ordered from the bid items the COR will negotiate the time and will have the delivery date listed on the work order.

6.3.2 All work will be started on the date specified in the delivery order. The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date, the Contractor shall provide written notification to the COR and submit for COR approval a revised schedule. Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the Contractor's control may only be allowed with the approval of the Contracting Officer Representative. If the Contractor does not complete the required mowing within the time specified on the delivery order, without prior approval, deductions may occur and/or the contract may be terminated. The government reserves the right to request mowings in selected areas if the growth of vegetation warrants. The estimated number of mowings for Park and Project mowings and the estimated miles and acreage for Natural Resource mowings and Right-of-Way mowings are as shown on the bid sheets.

6.5 MOWING, TRIMMING, EDGING, AND POLICING REQUIREMENTS- Cut, trim, and mow grass to a height of not more than two and one half (2 1/2) inches or less than one and one half (1 1/2) inches in Park mowing; and not more than three (3) inches or less than two (2) inches in Project mowing.

All mowing and trimming activities should be uniform in cut; with smooth transitions between different mowing equipment areas; grass shall be mowed even throughout the mow areas maintaining the required height, if after mowing an area individual plants (stickups) or strips of uncut vegetation remain in the mowed area, the area will be re-mowed, even though it may be several days before the stickups or strips are visible. Mowing with tractor-mounted mowers will not be permitted within twenty (20) feet of any people, building, picnic/camping unit, camper hook-up, or under trees with low hanging limbs. All rocks and branches resulting from mowing operations must be removed from roadways. All rocks, branches, grass, dirt, or other debris resulting from mowing, trimming or edging operations must be removed from all developed surfaces, including but not limited to sidewalks, impact sites, picnic pads, etc. In areas where mowers or tractors would cause rutting due to ground saturation, weed-eating operations will be used to ensure grass height conformity. The Contractor will be required to trim around guard rails, traffic counters, trees, shrubs, culverts, all signs, guard posts, posts and cable, boat ramps, parking lots, curb stops, rip-rap, fences, and any other natural or manmade objects that protrude above the ground line to such a height as to prevent passage of the larger mowing equipment over them without damage to the equipment or the object. In lieu of weed-eating operations, Contractor may use herbicide applications where damage from weed-eaters may occur around guardrail, rip rap, fence posts, traffic counters, and sign posts. Herbicide shall be applied by a licensed applicator and shall follow guidelines outlined in the EM 385-1-1 USACE Safety and Health Requirements Manual.

Herbicide shall be sprayed in small amounts, not to exceed 6 inches from around guardrail, fence posts, and sign posts. Applications that do not produce a minimum of a 95% mortality to target vegetation will be re-performed as soon as it is safe to do so, according to the label instructions. Herbicide applications shall not be used in lieu of any other mowing operations, other than weed-eating. Any area where herbicide is used, must still meet the height requirements stated at the beginning of this section. If Contractor chooses to use herbicide application in lieu of weed-eating operations, invoice shall not be submitted until desired results have been met. The Government reserves the right at any time to plant additional trees and/or shrubs in any park or area which will require trimming as described above at no additional cost to the Government. Edging and trimming will be accomplished each time mowing is performed. Edging will be accomplished with a gasoline or electrically operated edger capable of making vertical cuts a minimum of one-half (1/2) inch below soil level along all walkways and concrete curbs located within the mowing area, a weed eater will not be allowed for this function. The Contractor shall be responsible for policing the specified work area prior to and following all specified tasks.

The Contractor shall remove all man-made trash, tree limbs, rocks, and foreign debris in the work areas. All litter/trash or other discarded man-made materials/items shall be disposed of in the receptacles or dumpsters located in each park. All tree limbs shall be disposed of in a designated area with prior approval from the Government or removed from government property at the Contractor’s expense. The Contractor shall notify the responsible Government personnel of any man-made items, limbs, or rocks that are too large to be reasonably moved by hand. A major defect in this requirement shall be evidence of a combination of (5) pieces of litter/trash or limbs longer than 3 feet in length, or rocks large enough to become engaged in the mower blades and become projectile. Policing grounds before and after performing work is considered incidental to other tasks and is not billed separately. Contractor shall include this in the quoted price of each line item.

The Government is not responsible for the condition of the mowing area (grass height, rocks, etc.) at the time the contract or delivery order becomes effective.

(NOTE: During spring season mowings, clusters of wildflowers shall remain unmowed in those areas designated on site by the COR.)

6.6 MAPS- Maps for the areas in which the work will be accomplished are attached. Park, Project, and embankment maps indicate the approximate areas to be mowed by appropriate legend or note. 6.7.3 The contractor will conform to all traffic and other regulations as found in Section 327, Chapter III, Title 36 of the Code of Federal Regulations, available from the COR. Should the contractor use a developed camp area for overnight occupancy, all applicable regulations will adhered to. Vehicles and trailers will be parked in designated parking areas when not in use, and off road travel by vehicles other than tractors will be limited to loading/unloading and repair work.

6.7.4 Keys issued to the contractor for access to mowing areas will be returned upon completion of each mowing work order. Gates opened by the contractor for access to mowing areas shall be locked when the contractor completes mowing operations in the area.

6.7.5 SPECIAL MOWING AND TRIMMING REQUIREMENT: If a camping/picnic unit is occupied by the public at the time of the scheduled mowing and trimming of camping/picnic unit areas, the contractor will inform the occupants of safety measures which need to be followed by the occupants to prevent any personal injury or damage to personal property. Only weedeaters or special approved equipment will be used on the restricted steep slope areas. Any special type equipment must be approved in writing by the COR prior to use and shall be used in accordance with manufacturers recommendations at all times.

6.8.2 Safety Meetings -The Contractor shall hold a safety meeting with all employees prior to each mowing, and will notify the COR of location and time of each meeting. When a new employee is hired, the Contractor will thoroughly brief that person in all safety procedures and requirements. Any Contractor employee who persists in unsafe performance will be removed from the job at the request of the COR. A copy of the safety meeting report shall be submitted to the COR prior to performing mowing.

6.8.3 Personal Safety Equipment - The contractor shall be required to furnish at no expense to employees, all necessary personal safety equipment such as face shields, eye goggles, rain suits, steel-toed boots, and hard hats. All safety equipment shall meet all safety requirements as set forth in EM 385-1-1, Safety and Health Requirements Manual and shall be maintained in accordance with manufacturers recommendations at all times.

PART 7. QUALITY ASSURANCE SURVEILLANCE

Should it become necessary for the Quality Assurance inspector to perform re-inspections of defective work that was required to be redone, (due to failure of Contractor Quality Control System to locate and cure these deficiencies prior to the QA's initial inspection), there will be a re-inspection charge. This will be based on the Actual Government Cost at the Effective Hourly Rate. These charges will be deducted from the Contractor's monthly invoice. Deductions for re-inspection will be taken based on the following examples:

EXAMPLE:

a. Re-inspection of Area Mowing is required on 2 areas. The re-inspection deduction is made as follows:

(Effective Hourly Rate / 60 minutes) X Inspection Minutes = Deduction

$20.00 / 60 x 45 = $ 15.00

PART 8. DAMAGE RESPONSIBILITY

8.1 The Contractor shall be responsible for restoring any Government facilities or structures damaged as a result of performance. The Contractor shall survey the park or area and submit a report of all damage or vandalism to the COR prior to commencement of mowing or trimming in each area.
