1. General: This is a non-personal services contract to provide mowing fertilization services on the embankments at Canyon Lake, Texas. The Government will not exercise any supervision or control over the contract service providers performing the services described herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
1.1 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform mowing and fertilization services on the embankments as defined in this Performance Work Statement
(PWS). The Contractor shall perform to the standards in this contract.
1.2. Scope: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform mowing and fertilization services on the embankments at Canyon Lake, Texas. The Canyon Lake office will have soil testing conducted prior to fertilization. The results and recommendations will be utilized by the contractor for proposing formulation and quantity of fertilizer to be used at each site.
1.2.1 Embankment Mowing Requirements:
1.2.1.1 General: Mowing services shall be performed in accordance with the following specifications and the Mowing Maps (ATTACHMENT 4) as directed in the Embankment
Mowing Schedule in section 1.3 The Contractor will receive at least forty-eight (48) hours advance notice before the work start date. The Embankment type mowing covers a larger area as depicted on the Mowing Maps (ATTACHMENT 4). Prior to commencement of mowing operations in each area, the Contractor shall survey the park or area and submit a Pre-mowing
Report of all damage or vandalism to the Government. Any damage found thereafter by the
Government that has not been previously reported by the Contractor shall be assumed to be damage caused by the Contractor's operation and shall be repaired, replaced or deducted from the

Government requires the Contractor to uniformly mow and trim vegetation between four (4) and six (6) inches in height for Embankment Mowing. Edging and trimming shall be performed as necessary along concrete walkways, curbs, guardrails, fencing and roads. All debris generated from mowing services displaced onto hard surfaces such as roadways, parking lots, sidewalks, slabs, impact areas, etc. shall be removed. All trash (i.e. paper and plastic products) that are shredded from the mowing process shall be picked up and disposed of.
1.2.1.2 Lake Elevation Fluctuation: Lake Elevations will fluctuate dependent upon precipitation amounts and operations related to flood risk management and water supply missions. During extended periods of heavy rain, mowing may be rescheduled after the embankments have dried out to prevent accidents and damage to embankment turf.
1.2.1.3 Inspections: All mowing operations required in the parks or on the embankments shall be completed and inspected by the Contractor's Quality Control Inspector prior to contacting the
Government Quality Assurance Inspector for inspection. The Contractor shall notify the
Government immediately upon completion of services so that the Quality Assurance Inspector may schedule inspection within one (1) working day of the notification. As a minimum, sufficient equipment to remedy any deficiency found shall remain available for use until work has been accepted by the Government. The Contractor shall be responsible for re-performance of any and all deficiencies discovered during the quality assurance inspection within twenty four (24) hours of report of said deficiencies at no additional cost to the Government. If re-inspections by the Quality Assurance Inspector become necessary, a re-inspection/administration cost of one hundred dollars ($100) will be applied by the Government in accordance with the Quality
Assurance Surveillance Plan (QASP) as provided in ATTACHMENT 3.
1.2.1.4 Safety Meetings: The Contractor shall hold a safety meeting with all employees prior to each mowing operation and shall notify the Government of locations and time of each meeting.
Any Contractor employee that works in an unsafe manner shall be removed from the job at the request of the Government. A copy of safety meeting reports shall be submitted to the
Government prior to performing mowings.
1.2.1.5 Performance Standard: All vegetation within areas designated Embankment mowing shall be uniformly cut between four (4) and six (6) inches above the ground, leaving no damage to the turf, concrete edges, signs, fences, trees, facilities, persons or other property. All hard surfaces such as roadways, parking lots, sidewalks, slabs, impact areas, etc. shall be free of all debris produced during mowing services.
1.2.1.6 Traffic Regulations and Safety: The work to be performed under this contract shall be within the boundaries of land administered by the U.S. Army Corps of Engineers. The Contractor and contract employees are subject to all Title 36 regulations while completing work under this contract. If the Contractor demonstrates that the requirements of this contract can be met with less equipment or a different kind of equipment after work commences, the amount and/or type of equipment may be modified upon written approval of the Contracting Officer (KO). If the Contractor is unable to accomplish work in accordance with the requirements of this contract within the times specified, the Contractor shall immediately obtain additional equipment necessary to fulfill the requirements of this contract at no additional cost to the Government.
1.2.1.8.1 Additional Requirements: Equipment shall be sufficient to meet requirements and in compliance with Section 18 of Safety Manual. Embankment type mowing for the main dam and dikes requires mowing equipment that must be certified in writing by the manufacturer as safe for operation on a maximum twenty-seven (27) degree angle of incline. Certification shall address the stability of the equipment on these inclines and slopes and shall be specific in nature as to address the applicability of the design or factory modification for the prevention of equipment roll-over. This certification shall be submitted as part of Contractor’s bid. All equipment must be operated in such a manner as to not cause damage to facilities, persons or property. One (1) 2-½ pound ABC dry chemical fire extinguisher shall be required on all tractors and mowers capable of being ridden.

Government to ensure compliance with Section 18 of Safety Manual. The Contractor shall present all equipment to the Government for inspection whenever equipment is brought to the
Lake. The Contractor shall notify the Government at least two (2) days prior to bringing equipment on-site so that the time and place of these inspections may be scheduled. The
Government may inspect equipment at any time it is operated on Government Property. Any equipment found deficient shall be taken out of service immediately until faulty conditions have been corrected and passed by the Government. No such removal will reduce the Contractor's obligation to perform all work required within the time scheduled under this contract. This requirement shall not be made the basis of any claim for compensation or damages against the
United States or any of its officers or agents.
1.2.1.10 Vehicles: All vehicles, including the Contractor’s and any Subcontractors’ utilized under this contract shall be presentable, serviceable and shall comply with insurance and safety standards as required by the State of Texas. Vehicles shall be identified with company name or logo conspicuously displayed on door panels. Professionally prepared hand-lettering, magnetic signs or pressure sensitive decals shall be used.

Quality Control Reports as specified. The Contractor shall develop and provide their own reports. A Daily Activity Report shall be completed each day work is performed and shall be submitted to the Government as directed no later than the following day. A Quality Control
Report shall be submitted to the Government at the end of each work week as directed. Quality
Control inspectors shall ensure all reports are complete, legible and comprehensible.
1.2.1.13 Area Sizes and Tabulation of Facilities: Mowing Maps provided in ATTACHMENT 5 and the Tabulation table provided in ATTACHMENT 6 depict mowing areas and provide acreage estimates and facility quantities within each park. Lake personnel will show the
Contractor the service limits and requirements during an on-site visit of the areas where required mowing services shall be performed. If the number of facilities listed on the tabulation sheets and maps differs from the number of facilities actually on the ground, then the tabulation sheets and maps will be used for contract purposes. This tabulation depicts current conditions only and does not reflect any future work such as remodeling, re-design upgrades, new construction, demolition or moving facilities within areas which may occur within required service areas during performance of contract. Government reserves the right to perform any future work at its discretion and to modify any and all Schedules within contract for any resulting impact upon the
Contractor and Contractor’s required services.
1.2.1.14 Work Sequence: The Government will provide the Contractor with a preferred mowing sequence for parks and/or embankments with each Letter Order.
1.2.1.15 Work Completion: Work under this Contract will be requested by Letter Order. The
Contractor will be allowed a specified number of working days, exclusive of Saturdays, Sundays and Federal holidays to accomplish mowings dependent upon the number of geographic locations to be mowed simultaneously. All work will commence on the date specified in the Letter Order.
The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date the Contractor shall provide written notification to the
Government and submit for Government approval of a revised schedule. Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the
Contractor's control may only be allowed with the approval of the Government.
1.2.1.16 Additional Service Work Requirements:
1.2.1.16.1 Occupied Facilities: If a facility is occupied by the public at the time of the scheduled servicing, Contractor shall ask their permission to service the facility. If the public objects to the performance of the service, Contractor shall immediately record the unit (by park, facility type and number) on the Quality Control Daily Report as a non-serviced unit. If the facility becomes unoccupied while Contractor is still in the park, Contractor may service the unit as required and remove the unit from the Quality Control Daily Report. If the facility is still occupied, Quality Control Daily Report shall remain as is and shall be turned into the
Government for non-payment. The Daily Activity Report must be kept current during work performance so that a unit which has not been serviced and was later rejected by the
Government's Quality Assurance Inspector can be verified as non-performed because facility was occupied by the public. A site that is confirmed as being occupied may then be counted as non-performance, rather than as a reject.
1.2.1.16.2 All Quality Control Inspectors and subcontractors, if used, shall possess as a minimum a copy of that portion of the contract which governs the work in which they are engaged. Failure to comply will result in the stopping of work and removal of employees until such time that this requirement can be met.

Distribute fertilizer in such a manner to insure complete and even coverage. If liquid fertilizer is used, a suitable dye which is highly visible after drying will be added to the fertilizer to indicate where application has occurred.
1.2.2.3 Weather Conditions: Fertilization will be dependent on weather conditions. If embankments are wet due to rain or likelihood of heavy rain, fertilization may be rescheduled after the embankments have dried out to prevent accidents and damage to embankment turf.
Wind speeds and other factors may prevail to such an extent that unsatisfactory results might occur, the COR may at their discretion stop all phases of the work. The work shall resume when, in the opinion of the COR, the desired results are likely to be obtained.
1.2.2.4 Inspections: All fertilization operations required on the embankments shall be completed and inspected by the Contractor's Quality Control Inspector prior to contacting the Government
Quality Assurance Inspector for inspection. The Contractor shall notify the Government immediately upon completion of services so that the Quality Assurance Inspector may schedule inspection within one (1) working day of the notification. The Contractor shall be responsible for re-performance of any and all deficiencies discovered during the quality assurance inspection within twenty four (24) hours of report of said deficiencies at no additional cost to the
Government. If re-inspections by the Quality Assurance Inspector become necessary, a re-inspection/administration cost of one hundred dollars ($100) will be applied by the Government in accordance with the Quality Assurance Surveillance Plan (QASP) as provided in
ATTACHMENT 3.
1.2.2.5 Performance Standard: Fertilizer will be distributed evenly on the embankments.
1.2.2.6 Equipment: The embankment slopes range up to 2:1. Any equipment to be used on these slopes must be certified for use on such slopes and certification submitted to the COR prior to use.

Government reserves the right to perform any future work at its discretion and to modify any and all Schedules within contract for any resulting impact upon the Contractor and Contractor’s required services.
1.2.1.15 Work Completion: The Contractor will be allowed a specified number of working days, exclusive of Saturdays, Sundays and Federal holidays to accomplish mowing dependent upon the number of geographic locations to be mowed simultaneously. All work will commence according to the schedule in 1.3. The starting and completion dates are critical in the performance of this contract. If work cannot be commenced on the starting date the Contractor shall provide written notification to the Government and submit for Government approval of a revised schedule. Delays in service requiring an extension to the completion date due to inclement weather or conditions beyond the Contractor's control may only be allowed with the approval of the Government.
1.2.2.16 Payment: Payment will be made upon completion and acceptance of requested services.
