SPECIAL CONTRACT REQUIREMENTS, STANDARD

AMENDMENT NO. 0003

PART 1 GENERAL

1.1 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) (FAR

52.211-10)

The Contractor shall be required to:

(a) Commence work under this contract within 10 calendar days after the date the Contractor receives the Notice to Proceed;

(b) Prosecute the work diligently, and

(c) Complete the entire work ready for use not later than (AM#3) 400 calendar days after the date the Contractor receives the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

1.2 LIQUIDATED DAMAGES - CONSTRUCTION (SEP 2000) (FAR 52.211-12)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $3,516 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

1.3 PHYSICAL DATA (APR 1984) (FAR 52.236-4)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site surveys.

(b) Weather Conditions. Under ordinary conditions, the mean tidal range is about 2 feet. The height of tide is largely dependent on the force, direction, and duration of the wind. Strong northerly winds may depress the water surface as much as, and in some instances more than,

2.5 feet below NAVD 88, while southerly winds may raise the water surface as much as, and in some instances more than, one foot above

NAVD 88.

(c) Transportation Facilities. The immediate vicinity is served by highway, and shallow draft channels.

DOCUMENT 00 73 00.00 45 Page 2

1.4 QUANTITY SURVEYS (APR 1984) (FAR 52.236-16)

(a) Quantity surveys shall be conducted, and the data derived from these surveys shall be used in computing the quantities of work performed and the actual construction completed and in place.

(b) The Government shall conduct the original and final surveys and make the computations based on them. The Contractor shall conduct the surveys for any periods for which progress payments are requested and make the computations based on these surveys. All surveys conducted by the Contractor shall be conducted under the direction of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.

(c) Promptly upon completing a survey, the Contractor shall furnish the originals of all field notes and all other records relating to the survey or to the layout of the work to the Contracting Officer, who shall use them as necessary to determine the amount of progress payments. The Contractor shall retain copies of all such material furnished to the Contracting Officer.

1.5 BASIS FOR SETTLEMENT OF PROPOSALS (MAR 1995) (UAI 52.249-5000)

Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under FAR 49.206-2(b). In evaluating a terminations settlement proposal using the total cost basis, the following principals will be applied to determine allowable equipment costs:

(1) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the Contractor's accounting records to determine total actual equipment costs.

(2) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.

(3) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.

(4) Ownership costs (depreciation) will be determined using the Contractor's depreciation schedule (subject to the provisions of

FAR 31.205.11)

(5) License, taxes, storage, and insurance costs are normally recovered as an indirect expense and unless the Contractor charges these costs directly to contracts, they will be recovered through the indirect expense rate.

1.6 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE(UAI 31.105-101 MAR

1995)

(a) This special contract requirement does not apply to terminations. See 52.249-5000, Basis for Settlement of Proposals, and FAR Part 49.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each

DOCUMENT 00 73 00.00 45 Page 3 piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the con-tractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region VI. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

PART 3 EXECUTION

3.1 CONSTRUCTION

The Contract construction duration is based on the time needed for excavation, earthwork, handling, and drying of material as needed.

The soil profiles shown only represent general selective samples taken during initial subsurface soil investigation. Only if the designated borrow area materials are not suitable for a specified fill materials, the Contractor is permitted to relocate a different borrow area within the PA as a borrow source at the Contracting Officer's approval.

Be aware that the placement area has been utilized periodically through out the years, and anticipate extremely soft and wet newly dredged materials.

3.1.1 Lines and Grades

Containment dike raise, training dike raise and slope erosion repair are to be constructed to the lines, grades, and cross sections shown, unless otherwise directed. The Government reserves the right to make adjustments in dike alignments, foundation widths and slopes, or make other changes in the dike sections as may be considered necessary to produce safe, stable earthen structures. Changes in quantities resulting from revisions will not constitute justification for change in Contract unit prices, except as provided for in the CONTRACT CLAUSE entitled VARIATIONS IN ESTIMATED

QUANTITIES.

3.1.2 Drainage

Provide for the collection and disposal of surface and subsurface water encountered during construction. Completely drain construction site including dike foundation areas, and borrow excavations during periods of construction to keep soil materials sufficiently dry. Construct storm drainage features that can include ponds or basins, at the earliest stages of site development, and throughout construction, grade the construction area to provide positive surface water runoff away from the construction activity or provide temporary ditches, swales, and other drainage features and equipment as required to maintain dry soils. Once drainage of the Placement Area and sufficient drying of the foundation surfaces have been accomplished, borrow excavation and embankment construction can proceed.

When unsuitable working platforms for equipment operation and unsuitable soil support for subsequent construction features develop, remove unsuitable material and replace with satisfactory soil as specified herein, or work the existing soils in place to dry and recompact to provide suitable support for construction. It is the responsibility of the Contractor to assess the soil and groundwater conditions and to employ necessary methods that will permit construction to proceed at no additional cost to the Government.

3.1.3 Conduct of the Work

Maintain and protect the newly constructed perimeter containment dike raise, and training dike raise in a satisfactory condition during construction until final completion and acceptance of the work under this

SECTION 35 41 00.01 45 Page 7

Contract. If, in the opinion of the Contracting Officer, the hauling equipment causes horizontal shear planes or slickensides, rutting, quaking, heaving, cracking, or excessive deformation of the dikes or backfill berms, limit the type, load, or travel speed of the hauling equipment on the dike or backfill berm. The Contractor may be required to remove, at no additional payment, dike material placed outside of prescribed slope lines.

Approved dike or backfill material which is lost in transit or rendered unsuitable after being placed in the dike or backfill and before final acceptance of the work will be replaced using a satisfactory method at no additional cost to the Government. Excavate and remove from the dike or backfill material which is unsatisfactory, dispose this material, and refill the excavated area as directed, at no additional cost to the Government.

3.1.4 Stripping

Stripping is to be completed within the limits shown not more than 1,000 feet in advance of the embankment construction. Stripping is to be performed in accordance with SECTION 31 14 13.23 45 STRIPPING.

3.1.5 Volumes

Neat-line volumes of design templates for the embankment construction have been used by the U.S. Army Corps of Engineers to prepare the Government estimate. The volumes used are estimated based on the information available at the time of design. The Contractor is responsible for interpreting the provided plans and volumes provided to prepare his bid estimate. Adjustments for items such as overbuilding, compaction, settlement, foundation displacement, borrow factors, and waste are the Contractors responsibility. The neat-line volume is defined as the unadjusted, raw quantities computed using the dike templates.

3.1.6 Tolerances

Embankments are to be constructed to the grades, lines, and cross-sections shown. At every point a tolerance of 6-inches above or 0-inches below the prescribed grade will be permitted in the final dressing, provided that excess material is distributed to ensure that the crown of the dike drains to the PA interior and that there are no abrupt humps or depressions in the surfaces.

3.1.7 Haul Roads

Haul roads are to be constructed to facilitate transportation of borrow materials to the embankment construction areas as necessary and be located within the placement area limits. Haul roads are to be constructed to accommodate the intended traffic loads and frequency and be maintained in well-drained and functional condition during the Contract period. Haul roads are to be planned so as not to pond water or otherwise impede site drainage and be maintained during the Contract period to provide required drainage as described herein. The costs associated with construction of haul roads are to be considered a subsidiary obligation of the Contractor.

3.2 EXCAVATION

Excavation is to consist of removal of material in preparation of embankment foundations to the lines and grades shown, removal of material from ditches for drainage, removal of objectionable materials at the direction of the Contracting Officer, and obtaining required fill materials

SECTION 35 41 00.01 45 Page 8 from designated borrow areas within the placement area. If necessary, adjust the plan to account for field conditions as directed by the Contracting Officer.

3.2.1 Over Excavation

3.2.1.1 Within Limits of Dike Foundation

When over excavation occurs within the limits of the dike foundations, areas are to be backfilled to grade with satisfactory impervious fill and semi-compacted as specified.

3.2.2 Disposition of Excavated Materials

Satisfactory excavated material is to be incorporated in the appropriate zones of the dike templates. When direct placement is not practicable, satisfactory material from the excavation is to be stockpiled for subsequent use in parts of the work for which it is specified herein or as indicated. Excavated satisfactory material in excess of the quantity necessary to construct embankments are to be stockpiled for future construction work at locations designated by the Contracting Officer.

3.3 UTILITIES

The Contractor is responsible for movement of construction machinery and equipment over pipes and utilities during construction. For work immediately adjacent to or for excavations exposing a utility or other buried obstruction, excavate by hand. Start hand excavation on each side of the indicated obstruction and continue until the obstruction is uncovered or until clearance for the new grade is assured. Support uncovered lines or other existing work affected by the Contract excavation until approval for backfill is received. Report damage to utility lines immediately to the Contracting Officer.

3.4 BORROW AREAS

Approved borrow areas are to be excavated to the extent necessary to obtain satisfactory materials. The permissible depth(s) in the borrow areas vary based on field conditions during construction. Borrow areas are to be drained continuously and kept dry during excavation. Where possible, unsatisfactory materials in borrow areas are not to be removed. Borrow areas are to be graded to drain after completion of excavation.

Interior stockpile of satisfactory materials located within the placement area as specified in paragraph STOCKPILING is to be utilized as borrow materials if the material is suitable.

3.5 FOUNDATION PREPARATION

3.5.1 Containment Dike

The stripped containment dike foundation areas are to be semi-compacted before placing new fill materials for the containment dike raise and slope repair construction. Sinkholes, cavities and depressions in the stripped foundation areas are to be scarified and filled using satisfactory materials, placed in lifts, and semi-compacted in accordance with this Section.

SECTION 35 41 00.01 45 Page 9

3.5.2 Training Dike

Stripped training dike foundation areas are to be shaped to provide surfaces that will support the fill prior to placement of new fill materials. Sinkholes, cavities, and depressions in the stripped foundation areas are to be filled and shaped using suitable materials for the construction type as specified in this Section.

3.6 EMBANKMENT CONSTRUCTION

3.6.1 General

Prior to beginning placement of fill materials on the embankment foundations, notify the Government that the foundation is ready to receive fill. No fill is to be placed on the embankment foundation until these areas have been inspected and given final approval. Unless otherwise directed, the embankment is to be maintained at approximately the same elevation regardless of the number of types of materials being placed.

3.6.2 Placement

Before placing material for compacted fill, the foundation surface is to be cleared of existing vegetation and debris. Material not meeting the requirements for fill material as determined by the Contracting Officer will be removed. After filling depressions and immediately prior to placement of fill, the foundation surface is to be scarified to a depth of 6-inches. No fill material is to be placed in water. Soft or unsatisfactory material in the fill area will be removed as directed before placing the fill.

3.6.2.1 Equipment Traffic

Equipment traffic on a dike zone is to be routed to distribute the compactive effort as much as practicable. Ruts formed in the surface of a layer of spread material are to be filled before that material is compacted. If, in the opinion of the Contracting officer, the compacted surface of a layer of material is too smooth to bond properly with the succeeding layer, the surface is to be loosened by scarifying or other approved methods before material from the succeeding layer is placed.

3.6.2.2 Gradation and Distribution

The gradation and distribution of materials throughout each zone of the containment dike is to be so that the dike will be free from lenses, pockets, streaks, and layers of material differing substantially in texture or gradation from surrounding material of the same class. If lenses, pockets, or layers of materials differing substantially in texture or gradation from surrounding material occur in the spread material, the layer is to be mixed by harrowing or another approved method to blend the materials. During the placing and spreading process, continuously maintain a force of workers adequate to remove roots, debris, and oversize stones from the containment dike materials.

3.6.2.3 Uncompacted Random Fill

Uncompacted random fill is to be used for training dike raise construction. The location and extent of the fill is to be as shown.

Uncompacted random fill material is to be placed and spread in layers not more than 18-inches in uncompacted thickness, except that within 4-feet of

SECTION 35 41 00.01 45 Page 10 drop-outlet structure, the uncompacted layer thickness is to be reduced to 6-inches. The layers are to be uniformly spread, distributed, and otherwise manipulated during placement to such an extent that individual loads of material deposited on the fill will not remain intact, and large open voids in the fill will be eliminated. Fill layers are not to be placed in a manner which causes shrinkage cracks and open voids from developing in previously placed layers. Layers are to be started full out to the slope stakes and be carried substantially horizontal and parallel to the dike centerline with sufficient crown or slope to provide satisfactory drainage during construction.

3.6.2.4 Semi-Compacted Impervious Fill

Semi-compacted impervious fill is to be used for containment dike raise and slope erosion repair construction. The location and extent of the fill is to be as shown. Semi-compacted impervious fill is not to be placed in water. Fill material is to be placed and spread in layers not more than 12-inches in uncompacted thickness, except that within 4-feet of the drop-outlet structure, the uncompacted layer thickness is to be reduced to 6-inches. Layers are to be started full out to the slope stakes and be carried substantially horizontal and parallel to the dike centerline with sufficient crown or slope to provide satisfactory drainage during construction.

3.6.3 Moisture Control

The materials in each layer of the fill are to contain the amount of moisture, within the limits specified below or as directed, necessary to obtain the required compaction. Uncompacted random fill is to be placed at in-situ moisture content unless the in-situ moisture content is too wet or too dry to construct the required sections to the lines and grades shown;

in which case the fill is to be moisture adjusted as specified below.

Semi-compacted impervious fill is to be placed and compacted at uniform moisture contents that will allow suitable compaction and bond between layers.
