NOTES:

1. If a modification to a proposal based on unit prices is submitted, which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the CLIN Schedule must be stated. If it is not stated, the offeror agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the CLIN Schedule.

2. Offerors must bid on all items.

3. Costs attributable to Division 01 - General Requirements are assumed to be prorated among bid items listed.

4. Responders are advised that this requirement may be delayed, cancelled or revised at any time during the solicitation, selection, evaluation, negotiation and/or final award process based on decisions related to DOD changes in force structure and disposition of the Armed Forces.

5. 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

(a) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

(b) The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

6. EXERCISE OF OPTIONS (SWDR 715-1-1 (16 January 1996))

The Government reserves the right to exercise the option(s) by written notice to the Contractor either singularly or in any combination for up to 120 calendar days after award of the Base Offer without an increase in the Offeror's Price. Completion of added items shall continue at the same schedule as the Base Offer unless otherwise noted in Section 01 00 00.00 44 DESIGN AND CONSTRUCTION SCHEDULE, paragraph 1 entitled SCHEDULE.

7. The Offeror shall propose a total integrated contract duration in number of calendar days after the Notice to Proceed (NTP) is received by the Contractor, whether via electronic means or hard copy, whichever is the earliest method of delivery. The total number of proposed calendar days for design and construction through completion, ready for turnover shall not exceed the number of calendar days specified in Section 01 00 00.00 44 Design and Construction Schedule. The proposed duration shall become the required contract duration. The Government may issue the NTP via e-mail or Facsimile (FAX) or by other means. Day number 1 is the day after the date of receipt of the NTP.

5.1. SUBMISSION REQUIREMENTS

The Offeror’s construction and design entities should each demonstrate past performance through the submission of similar projects, using the Construction – Past Performance Form – (Attachment 2), and Designer – Past Performance Form – (Attachment 3). If the Offeror is a joint venture, limited liability corporation, or integrated design-build firm, provide past performance information for design and construction projects relevant to each of the proposed roles on this project. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Design firms may list prime contractors they have worked for or Government, private or commercial customers. If projects were design-build, so identify them. Both the prime contractor and the design firm(s) shall each submit no more than five (5) projects completed or substantially completed within 5 years from the date of this solicitation that best represent their experience similar to the scope of work for this solicitation. Two (2) of the five (5) projects submitted may be fully designed and at least 50% construction progress completed. If Offeror is proposing as a Joint Venture (JV) and past performance cannot be provided as a JV, each partner shall submit past performance information, with no more than five (5) projects each.

5.1.1. Projects will be considered relevant to this procurement if they are similar in complexity, in type, scope, or magnitude. Relevancy is defined as:

(a) Design/build a standardized dormitory or their equivalent or similar commercial or institutional housing type; and

(b) Typical project size should reflect a minimum of 40,000 square feet per building; and

(c) Construction value of at least $15,000,000.00.

(d) Additionally, projects should reflect the following features in terms of complexity:

(i) Design-build construction

(ii) Anti-Terrorism and Force Protection

(iii) Phased construction of multiple buildings

(iv) Concurrent construction of multiple buildings

(v) Building envelope air barrier system and building air leakage testing

(vi) LEED certifiable or LEED certification*

* The firm(s) preparing the design must demonstrate qualifications and performance in sustainable design, based on project performance on projects that have achieved US Green Building Council’s LEED certification or were certifiable at LEED Silver or better. Additional consideration will be given if both the constructor and the design firm(s) demonstrate qualifications and performance with LEED.

5.1.2. The Offeror may provide a supplemental narrative (not project lists), not to exceed two pages, explaining how any corporate past performance that is not directly related to the specific projects above is applicable to this project and how the Government will benefit. The following information may be considered:

5.1.2.1. Describe previous design-build past performance. The Offeror may include past performance on other types of projects.

5.1.2.2. Describe team members’ experience on LEED projects.

5.1.2.3. Describe team members’ experience with building envelope air barrier tightness design, construction and testing, including a discussion on air leakage rates achieved on previous projects.

5.1.2.4. The above information is limited to projects that are fully designed and at least 50% construction progress completed or that have been completed and turned over no longer than the past five years preceding the date of this solicitation.

5.1.3. Offerors are not required to submit any additional past performance information. The Government will utilize CCASS, ACASS, CPARS and any other information deemed relevant to assess confidence in the Offeror’s ability to perform.

5.1.3.1. Offerors may submit awards, award fee determinations, customer letters of commendation, or other forms of performance recognition relevant to the submitted projects to demonstrate the Offeror’s performance capabilities and customer satisfaction.

5.1.3.2. Offerors may submit information on past performance issues and corrective actions taken to prevent these issues from reoccurring. Discuss whether these corrective actions have been implemented on contracts awarded subsequent to the performance issues, the effectiveness of the corrective actions, and POC information for the subsequent contracts.

5.1.3.3. Past Performance Questionnaire. For each project submitted for Factor 1-1 Past Performance that does not have a final CCASS evaluation, the Offeror is provided a Past Performance Questionnaire (Attachment 4) to submit to the client. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires shall be submitted directly to the Government’s point of contact, Mr. Herman Le Jeune via email at herman.n.lejeune@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

5.1.3.4. Do not request past performance questionnaires on projects that have final CCASS evaluations.

If a CCASS evaluation exists and a Past Performance questionnaire is provided for the same project, the CCASS evaluation will be reviewed as the official past performance record for the project, and the Past Performance questionnaire will not be considered by the Source Selection Board or the Source Selection Authority.

5.1.3.5. For USACE or other DoD projects which are underway but do not yet have an interim or final CCASS evaluation, one past performance questionnaire per contract may be submitted; to be considered, the PPQ shall be signed by the Administrative Contracting Officer (ACO) for the contract.

5.2. RELEVANCY EVALUATION CRITERIA:

5.2.1. The Government will evaluate the Offeror’s past performance to determine how relevant the past performance is to the project under consideration. Past performance on the projects identified in the project forms will receive more consideration than past performance provided in the supplemental narrative.
