1.0 OVERVIEW
This Request for Proposal (RFP) solicits for the design and construction of an approximately 947,000 square foot replacement hospital at Fort Hood, TX. The project requires the design and construction of a state-of-the-art full service medical treatment facility, and associated site work and utilities infrastructure. The contract will be a Firm- Fixed Price (FFP).
Proposal Submission and the Two (2) Phase Design-Build Process. This process requires potential contractors to submit their performance and capability information initially (Phase I) for review and consideration by the Government. Following the review, evaluation and rating of these proposals, the Government will select up to three of the highest rated Offerors to receive the technical requirements package and provide a technical and cost proposal for consideration by the Government at Phase II. The technical and cost proposals of the selected contractors will be reviewed by the Government. The technical information contained in the Phase II proposal will be reviewed and evaluated by the Government in accordance with the evaluation criteria set out Section 00 22 20. The final evaluation rating used for comparison, selection and award will reflect both the rating received in Phase I and the evaluation rating received in Phase II. Cost information will not be rated in either phase but will be evaluated in response to the funding limitations set out in Section 00 11 00 – PRICE PROPOSAL SCHEDULE and Offeror’s price proposals.
FOR ALL THOSE CONTRACTORS WHO COMPETE IN BOTH PHASE I AND PHASE II,
THE CONTRACTOR’S PROPOSAL SHALL BE DEFINED AS ALL INFORMATION
WHICH WAS SUBMITTED IN RESPONSE TO THE REQUIREMENTS OF BOTH
STEPS OF THE SOLICITATION.
In Phase II of this process, the Government will evaluate both technical capability and price. In accordance with Section 00 21 00, Local Clause 52.227-4001 TWO-PHASE
DESIGN-BUILD STIPENDS AND LIMITED RIGHTS TO TECHNICAL DESIGN
PROPOSALS (5/14/2005), this solicitation uses the Two-Phase Design-Build selection procedures, as described in FAR Sub Part 36.3, and provides for payment of a “stipend” to those unsuccessful Phase 2 Offerors, not selected for award of the resulting Design- Build contract. Payment of the stipend will be initiated ten (10) calendar days after contract award provided the award has not been protested.
Only those Offerors who receive a written notification from the Ft Worth District Contracting Officer that their firm has been selected to participate in Phase II of this solicitation are invited to submit a Phase II proposal. The Government intends to announce the names of Offerors selected for Phase II in the FEDBIZOPPS website. An Offeror that does not want this information released must provide a written notification and explanation of its objections to release of the information. Those Offerors selected for Phase II will be provided the technical requirements package anticipated to be issued under any resultant contract.
2.0 GENERAL INSTRUCTIONS
Firms formally organized as design-build entities, design firms and construction contractors that have associated specifically for this project, consortia of firms or any other interested parties may submit proposals. Associations may be as joint ventures or as key team subcontractors. Any legally organized Offeror may submit a proposal. All designs must be under the direct supervision of appropriately licensed professionals for each discipline involved.
Contractor Team Arrangements. Contractor Team Arrangements are considered an arrangement in which (1) two or more companies form a partnership or joint venture to act as a potential prime contractor; or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program. In accordance with FAR Subpart 9.6, the Government will recognize the integrity and validity of contractor team arrangements;
provided, the arrangements are identified and company relationships are fully disclosed in the offer. The Offeror shall identify the major or critical aspects of the requirement to be performed by those identified in the Contractor Team Arrangement. The submission must contain a narrative that clearly explains the relevance to a particular factor of information concerning a company that is part of a Contractor Team Arrangement. The Government will consider the adequacy of this explanation in deciding the relevance of the information to this procurement.
Any Offeror submitting an offer in the name of a joint venture, shall include a fully executed copy of the joint venture agreement with the offer. Joint venture agreements which require SBA approval may be submitted absent the requisite SBA Servicing Agency approving authorities’ signature; however, the Offeror shall submit evidence from the Offeror’s SBA Servicing Agency that the Offeror has notified and discussed the proposed joint venture for this project with the appropriate SBA personnel. For 8(a) set-aside procurements, all prospective Joint Ventures must comply with Title 13 Code of Federal Regulations (CFR) Part 124.513. For HUBZone set- aside procurements and awards to HUBZone SBCs through full and open competition after a price evaluation preference in favor of qualified HUBZone SBCs, a Joint Venture must comply with 13
CFR 126.616.
Offerors shall submit their proposal to the address shown in Block 7 of Standard Form 1442.
Proposals are due no later than the time and date specified in Block 13 of Standard Form 1442.
2.1 GENERAL PROPOSAL FORMAT:
Title Page. Include the title of the solicitation, solicitation number, Offeror name, and date of the submittal.
Table of Contents. Each volume of the proposal shall contain a detailed table of contents. If more than one binder is used, the complete table of contents shall be included in each. Any materials submitted but not required by this solicitation (such as company brochures) shall be relegated to appendices.

Written material shall be on 8 ½ x 11 inch paper printed in no less than a 10 pitch or 10 font. 11 x 17 pages will be allowed only if the written material is provided in 8 ½ x 11 format and the remainder of the page is used for illustrations to assist in conveying the narrative message. Page limitations, where specified in the RFP, shall be considered a maximum. Pages in excess of any specified limitation shall not be evaluated. A single 8 ½ x 11 or 11 x 17 inch sheet with written material on one side only shall constitute one page. However, if both sides of the sheet bear written material then this single sheet shall be counted as two pages.
Binders. Proposals shall be submitted in tabbed, three ring binders.
Number of Copies. Offerors shall submit an original and eleven (11) hard copies of their proposal for Phase I to include 1 CD with each copy.
Electronic Submission. In addition to the hard copies required, all Offerors that advance to Phase II shall submit their submittal on a CD-ROM. This includes the Phase I submission and Volume II of the Phase II submission, including all drawings. Written portions of the proposal should be in MS Word, Adobe Acrobat PDF, or WordPerfect format. The electronic version shall be either a single file tabbed in the same order as the hard copy or multiple files hyperlinked to a single table of contents. 5.0 TAB B – FACTOR 1 - SPECIALIZED EXPERIENCE
5.1 SUBMISSION REQUIREMENTS
5.1.1 The prime contractor and the design firm(s) (or prime contractor if design is to be self-performed) shall each demonstrate recent, relevant experience on similar projects, using Attachment 2 at the end of this section. The prime contractor and the design firm(s) shall each submit no more than five (5) projects each. Offerors may identify state and local government and private contracts that are similar to the Government’s requirements.
Design firms may list prime contractors they have worked for or government, private or commercial customers. If projects were design-build, so identify them. If the Offeror is a joint venture, each firm shall provide information, submitting no less than five (5) projects, with a maximum of ten (10) projects total demonstrating experience relevant to their role on this project. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer. Submit projects that are currently well underway (designers can submit fully designed projects and construction firms can submit 50% construction progress) or construction substantially completed within five (5) years preceding the date of this Solicitation.
5.1.2 Projects will be considered similar to this procurement if they are similar in complexity in type, scope and magnitude. The projects submitted should include the following criteria.
Projects do not have to include all of the criteria; however, projects that meet all of the criteria may be more highly rated.
5.1.3 Design and construction of Hospital Complexes. Multi-function hospital facilities designed to accommodate inpatient care functions and outpatient care clinics. All work must be new construction.
5.1.4 Project minimum size should reflect 400,000 square feet of gross space.
5.1.5 Project construction value of at least $350,000,000.00.
5.1.6 Additionally, projects should reflect the following features in terms of complexity:
(a) Private or Government Medical Facilities with a full range of inpatient and outpatient medical services arrange in a campus environment.
(b) General office space with reconfigurable walls and partitions.
(c) Conference rooms with audio-visual conferencing capabilities.
(d) Exterior covered loading areas and/or work spaces.
(e) Executive and general administrative offices.
(f) Significant Information Technology (IT) operational areas.
(g) Building associated utility infrastructure.
(h) Parking area and/or facilities to accommodate required occupancy.
5.1.7 The Offeror may provide a supplemental narrative (not project lists), not to exceed two pages, explaining how any corporate experience that is not directly related to the specific projects above is applicable to this project and how the Government will benefit.
5.1.8 The Offeror should describe any previous teaming experience between current team members, if not described in Attachment 2. Design Firms should describe their experience on LEED or SPiRiT projects, if not included on the project list. Offeror may describe design-build experience on other type projects. The other type projects must be currently well underway (designers can submit fully designed projects and construction firms can submit 50% construction progress) or construction substantially completed within five (5) years preceding the date of this Solicitation.
5.2 EVALUATION CRITERIA:
5.2.1 The Government will evaluate the extent of recent, related experience of the prime contractor and design firms in design, construction or design-build. Experience on the projects identified through the use of Attachment 2 will receive more consideration than experience provided in the supplemental narrative. The Government may place greater importance on projects performed as a prime contractor than as a subcontractor, depending upon overall role and relevancy of the project. Federal Government project experience will not be rated inherently more important than non-Federal Government project experience.
5.2.2 The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Corps of Engineers Construction Contractor (or Architect-Engineer) Appraisal Support System (CCASS/ACASS), other DOD or Government appraisal systems or by contacting owners or references. The Government may check any or all cited references to verify supplied information.
5.2.3 The relevant experience of key personnel proposed for this project will not be evaluated or considered under this factor.
5.2.4 Previous design-build experience is not necessary for a satisfactory rating. The
Government may consider previous design-build experience a strength, even if the experience is on different type projects than this project. Similarly, the Government may consider previous recent teaming experience among the team members as value added, even if on different type design and/or construction projects than this project. However, the more relevant the experience, the more consideration it will be given.
5.2.5 Design firms must demonstrate qualifications and experience in sustainable development and design based on the US Green Building Council’s LEED Green Build Reference Guide or the Corps of Engineer’s SPiRiT Rating Tool for a satisfactory rating.
5.2.6 If the Offeror cannot provide information concerning recent, relevant experience on similar projects or the Offeror has no relevant experience, a determination will be made as to the risk this lack of experience presents to the Government and the Offeror will be given an appropriate rating for this factor.
6.0 TAB C – FACTOR 2 - PAST PERFORMANCE
6.1 SUBMISSION REQUIREMENTS:
6.1.1 Past performance refers to the quality of recent project experience from the owner’s perspective. The prime construction contractor and the design firm (or prime contractor if design is to be self-performed) shall each complete and provide a Past Performance Information Sheet on three (3) projects which meet the criteria described in Section 5.1 Submission Requirements above using Attachment 3. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer. Additional Past Performance Information Sheets may be submitted for consideration on any other member of a Teaming Arrangement as defined in Section 2.0 that will perform a major or critical aspect of the project. Projects cited on the Past Performance Information Sheets shall be currently well underway (designers can submit fully designed projects and construction firms can submit 50% construction progress) or construction substantially completed within five (5) years preceding the date of this solicitation. The Government may contact and interview the points of contact and reserves the right to interview other individuals if the point of contact is not available utilizing the sample questionnaire shown at Attachment 5. The Offeror or the design firm may briefly provide information on problems encountered on identified projects and any corrective action.
6.1.2 For reference and additional evaluation purposes, Offeror’s shall provide a Past Performance Questionnaire, shown at Attachment 5, to the Points of Contact specified on each of the Past Performance Information Sheets that is submitted. A sample Transmittal Letter to accompany the questionnaire is provided at Attachment 4.
Completed questionnaires shall be submitted directly from the reference(s) to the Fort Worth District Contract Specialist identified in Block 9a of the 1442 either via email, facsimile, or mail. This authorization for email or facsimile submission does not extend to any other aspect of the proposal. Completed questionnaires must be received by the date and time established for receipt of proposals. It is incumbent upon the Offeror to ensure completed questionnaires are timely received.
6.1.3 Other Sources. The Government may contact sources other than those provided by the Offeror for information with respect to past performance. These other sources may include but are not limited to: CCASS (Construction Contractor Appraisal Support System), ACASS (Architect-Engineer Contractor Appraisal Support System), and telephone interviews with organizations or individuals familiar with the Offeror’s performance.
6.1.4 The past performance of individuals will not be credited under this factor.
6.2 EVALUATION CRITERIA:
6.2.1 The Government will evaluate the Offeror's past performance using the sources available to it including but not limited to: the example projects identified by the Offeror and submitted on the Past Performance Information Sheets and Past Performance Questionnaires received from references. ACASS, and CCASS will be used only for projects completed within three years from the date of the solicitation. Offerors may be provided an opportunity to address any negative past performance information about which the Offeror has not previously had an opportunity to respond if such information is determined to present an impact on the rating to be assessed.
6.2.2 The Government will consider past performance of the prime construction contractor and the design firm, (or the prime contractor if design is to be self-performed). If a firm has multiple functions or divisions, the Government will only evaluate the past performance of the unit or division submitting the offer. The Government may also consider the past performance information submitted on any other team member. However, in accordance with Section 2.0, above, the consideration and weight given to past performance information concerning other than the prime contractor will be based on the extent of involvement of the team member in the project and the adequacy of the proposal in identifying and addressing such arrangements and roles.
6.2.3 The Government will consider relevant projects that are currently well underway (designers can submit fully designed projects and construction firms can submit 50% construction progress), or construction substantially completed within five (5) years preceding the date of this solicitation. Projects should include the criteria in Section 5.0.
Projects do not have to include all of the criteria; however, projects that meet all of the criteria may be considered more relevant and may be more highly rated. The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance. The Government places higher value on projects for which successful performance can be confirmed through sources such as telephone interviews with the contacts identified in the proposal, CCASS/ACCASS or other agency performance databases, Offeror furnished references or personal knowledge. The Government places a higher value on projects which provided particularly difficult or unique challenges and the innovative methods the Offeror used to resolve problems successfully.
6.2.4 The Government will evaluate past performance based on the elements listed below:
(a) Quality of Construction and Safety Record. The Government will evaluate all information available with respect to the quality of the actual construction undertaken and the standards of workmanship exhibited by the Offeror. The Offeror’s safety record and overall safety program will also be evaluated.
(b)Timeliness of Performance. The Government will evaluate all information available with respect to the completion of projects within the scheduled completion times.
(c) Customer Satisfaction. The Government will evaluate all information available with respect to customer satisfaction, cooperation with customers, and interaction on past projects.
(d) Subcontractor Management. The Government will evaluate all information available with respect to effective management of subcontractors on past projects.
6.2.5 If the Government does not obtain past performance information for the projects identified by the Offeror and cannot establish a past performance record for the Offeror through other sources, past performance will be rated neither favorably nor unfavorably.
7.0 TAB D – FACTOR 3 - ORGANIZATION AND TECHNICAL APPROACH
7.1 SUBMISSION REQUIREMENTS:
7.1.1 This information considers the Offeror’s intended technical approach to design and construction of the type facilities specified in the RFP. Limit the submission to twenty pages or less, clearly but concisely describing the technical approach to execution of the contract. At a minimum the narrative should respond to the questions, or address the topics, outlined below:
(a) Does the Offeror’s team demonstrate an understanding of the fundamental design-build problem, i.e. a design and construction proposal that meets the RFP requirements while still meeting the funding constraints identified?
(b) Does the Offeror demonstrate a suitable understanding of the process to enable it to adequately address and anticipate the risks associated with Design/Build processes?
(c) Identify and explain the roles and responsibilities of team members that will perform major or critical aspects of both the design and construction phases. Also, include a general description of the work the Offeror will self-perform to be compliant with the requirements of Federal Acquisition Regulation (FAR) clause 52.236-1, Performance of Work by Contractor.
(d) How does the Offeror continue the design phase of the project and incorporate User comments and reviews into the process?
(e) Briefly describe the Offeror’s Design Quality Control Program.
(f) What is the design team’s involvement throughout the construction period?
(g) How does the Offeror integrate construction subcontractors into the design process?
(h) What are the Offeror’s processes for handling construction and design problems?
(i) Describe the Offeror’s implementation plans to utilize “fast track” procedures on this project whereby preliminary site construction activities can begin prior to 100% completion of the design documents.
7.2 EVALUATION CRITERIA:
7.2.1 The Government will evaluate the strengths, weaknesses and any deficiencies in the submission. Based on the submission provided, the Government will evaluate the Offeror’s overall understanding of the design-build process and its capability to execute an awarded contract.
7.2.2 Offerors are cautioned that the Technical Approach Narrative shall not exceed (20) pages and that Government evaluators will review and evaluate only the information contained on the first twenty pages.
8.0 TAB E – FACTOR 4 – EVIDENCE OF ABILITY TO OBTAIN BONDING
8.1 SUBMISSION REQUIREMENTS
8.1.1 Evidence of Bonding Capacity: Submit a letter of commitment from a surety, signed by an officer or agent authorized to bond, that identifies the offeror’s available bonding capacity and limits that the surety will bond the Offeror, as the successful awardee for this project, taking into consideration the Cost Ceiling Limitation described in this Solicitation. The surety must be acceptable to the Government and must appear on the Department of Treasury Circular 570 “Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and Acceptable Reinsuring Companies.” If the Offeror submits evidence from an individual Surety, the individual surety must include documentation meeting the requirements of FAR 28.203 and contract clause 52.228-11.
8.1.2 If the joint venture involves a constructor and an A-E firm and the constructor intends to provide the bond, provide a complete explanation with confirmation from the surety.
8.2 EVALUATION CRITERIA:
8.2.1 The offeror must show satisfactory bonding capacity and access to a surety listed on the Department of the Treasury’s Circular 570 for at least the amount stated in the Solicitation in the Funds Limitation provision. Individual sureties must be acceptable per the requirements of FAR 28.203 and contract clause 52.228-11.
9.0 PHASE 1 EVALUATION PROCEDURES
9.1 SOURCE SELECTION EVALUATION BOARD (SSEB)
9.1.2 The SSEB will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal, proposal corrections and any information obtained from other sources, e.g. past performance information. The SSEB will not consider any proposal incorporated by reference, except as expressly allowed by this solicitation.
9.2 EVALUATION
9.2.1 The SSEB will evaluate the proposals and assign a consensus rating for each evaluation factor and subfactor. Offerors are cautioned to put forth their best efforts for the Phase 1 submission, and to furnish all information clearly to allow the Government to determine their performance capability. Offerors should not assume that they will have an opportunity to clarify or correct anything in their proposal after submitting it in response to Phase 1.
9.2.2 The Government reserves the right to allow proposal corrections, if deemed necessary to determine the most highly qualified offerors to shortlist for Phase 2.
9.2.3 The Contracting Officer, independently exercising prudent business judgment, will determine the most highly qualified offerors to short-list for Phase 2.
9.3 DEFINITIONS
9.3.1 Deficiency
-A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
9.3.2 Weakness
- A flaw in the proposal that increases the risk of unsuccessful contract performance.
9.3.3 Significant Weakness
-A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
9.3.4 Strength
-Means an aspect of a proposal that appreciably decreases the risk of unsuccessful contract performance or that represents a significant benefit to the Government.
9.3.5 Uncertainty
- Any aspect of the proposal for which the intent of the offeror is unclear because there may be more than one way to interpret the offer or because inconsistencies in the offer indicate that there may be an error, omission, or mistake.
9.4 EVALUATION AND RATING SYSTEM
9.4.1 General: The Government will review the proposals and rate the quality of each evaluation factor and subfactor (if any). The SSEB will rate each proposal against the specified evaluation criteria in the Solicitation requirements. They will not compare proposals at this time. After all proposals are rated, the Government will compare the ratings and relative advantages and disadvantages of proposals against each other in order to determine which Offerors are the most highly qualified under Phase 1 to short-list for participation in Phase 2.
9.4.2 Review Write-up: The Government will support each rating with a narrative, separately listing all strengths or advantages, weaknesses or disadvantages, deficiencies, and required clarifications.
9.4.3 Rating System: After listing proposal strengths, weaknesses and deficiencies, the SSEB will assign an adjective rating of “Unsatisfactory”, “Marginal”, “Satisfactory”, “Good” or “ Excellent” to each factor and subfactor (except those factors rated as GO/NO-GO and past performance), which reflect the Government's confidence in each offeror's technical ability, as demonstrated in its proposal, to perform the requirements stated in the RFP.
The adjectival ratings shall be assigned, using the following criteria:
(i) Excellent: Proposal demonstrates excellent understanding of the requirements and approach that significantly exceeds performance or capability standards. Has exceptional strengths that will significantly benefit the Government.
(ii) Good: Proposal demonstrates a good understanding of requirements and approach that exceeds performance or capability standards. Has one or more strengths that will benefit the Government.
(iii) Satisfactory: Proposal demonstrates acceptable understanding of the requirements and approach that meets performance or capability standards. Acceptable solution.
(iv) Marginal: Proposal demonstrates shallow understanding of requirements and approach that only marginally meets performance or capability standards necessary for minimal, but acceptable contract performance.
(v) Unsatisfactory: Proposal fails to meet performance or capability standards.
Requirements can only be met with major changes to the proposal.
9.5 PAST PERFORMANCE RISK RATINGS
9.5.1 Risk ratings shall be done for each Past Performance factor. Past Performance Risk Ratings assess the risks associated with each offeror's likelihood of success in performing the requirements stated in the RFP based on the offeror's demonstrated performance on recent contracts. SSEB members and the SSA may use personal knowledge or information from other sources in its evaluation of an offeror’s past performance, provided such information is consistent with the established evaluation criteria of the RFP. Offerors that have no relevant performance record will be given a neutral/unknown risk rating for these factors:
(i) Unknown Risk: No relevant performance record is identifiable upon which to base a meaningful performance risk prediction. A search was unable to identify any relevant past performance information for the Offeror or key team members/subcontractors.
This is neither a negative or positive assessment.
(ii) Low Risk: Based on the Offeror's past performance record essentially no doubt exists that the Offeror will successfully perform the required effort.
(iii) Moderate Risk: Based on the Offeror's past performance record some doubt exists that the Offeror will successfully perform the required effort.
(iv) High Risk: Based on the Offeror's past performance record extreme doubt exists that the Offeror will successfully perform the required effort.
9.6 GO/NO-GO RATINGS
9.6.1 Go/No-Go Ratings will be provided for those factors that the offeror must meet in order to perform the work under this contract. These are pass/fail evaluation factors. A proposal must either satisfy the evaluation factor or be ineligible for contract award. There is no additional consideration provided to those proposals that exceed the requirements for a GO/NO GO factor.
