Questions & Answers F. This amendment provides responses to industry questions received as a result of the original solicitation as follows:
Question(s)
Answer(s)
1. Is the agency still allowing for questions to be asked and answered?
1. The Government will not be accepting any more questions in response to this solicitation. The cutoff for questions is July 6th @ 4:00 PM EDT.
2. There are no CLINs provided for the two items below that are listed in the Performance Work Statement.
· 5.1.5.4 – Familiarization session for DLI OPI experts. Two parts. Each 5 days
· 5.1.5.13 – Two annual ILR elicitation cross-Trainer workshops.
2. Training Summit CLINS 1015 - Base Year, 2014 - Option 1, 3014 - Option 2, 4014 - Option 3 and 5014 - Option 4 should be used for tasks 5.1.5.4 and 5.1.5.13. Revised CLIN Structure incorporates missing CLINS. Refer to Summary of Changes for details.
3. To which area does “Face to Face Loc” refer? (Base Year Items 1007, 1008, 1009, 1010)
3. Revised CLIN Structure incorporated. Refer to Summary of Changes for details.
4. What does “Face to Face Monterey 7” mean?
4. CLINs 1011, 2010, 3010, 4010, 5010 revised from “Face to Face Monterey 7” to "Face-to-Face DLIFLC-Monterey, CA 7 or more.”
5. A CLIN for the license and hosting fee for the test management system is missing. Can this be added?
5. No, license and hosting fee cannot be added because it is not a part of this requirement.
6. Can a CLIN be added for ‘late cancellation’? This is especially critical for face-to-face testing.
6. No, a late cancellation CLIN cannot be added because it is not necessary since appropriate CLINs exist to capture face-to-face testing.
7. For face-to-face testing, should the tester and coordinator travel expenses be included in the per test rate or invoiced separately under the travel CLIN?
7. Coordinator expense should be charged to CLIN 1016, Travel. Tester expense should be included in the price per test.
8. Are Face to Face testing no show fees only for situations where there are no minimums?
8. Yes, Face-to-Face testing no show fees are for situations where there are no minimums.
9a. If the Monterey Face to Face is to be priced at the Language Tier price, how is the cost of the on-site Testing Coordinator to be covered?
9b. How is the Honorarium for the Tester to be covered?

11. What are the actual primary locations?
· PWS para 1.6.6 it states DC, Tampa, the DLIFLC and other locations.
· PWS para 1.6.17 states DC, Tampa and the DLIFLC.
· PWS para 5.1.13 states DC and Tampa “but other locations...may be required.”
11. The Primary locations are Washington D.C., Tampa, and DLIFLC (Monterey). Tampa testing is to be charged under the CLIN for “Other” locations.
12. PWS Para 5.1.7.2 - Contractor shall not exceed three (3) DLIFLC Monterey Face to FAce (F@F) tests when using one (1) tester.” Having only three (3) tests a day would be a waste of the government’s money. A single tester traditionally can do six (6) tests in one (1) day. Is that a change that can be made to the PWS?
12. Yes, PWS Para 5.1.7.2 has been revised to read “Contractor shall not exceed three (3) DLIFLC Monterey Face-to-Face (F2F) tests per day when using one (1) tester.". Testing will not exceed 3 tests per day when using one tester at DLIFLC Monterey.

14a. PWS Paragraph 5.1.8.1 revised to read as follows to clarify: from “Contractor shall provide final score to the Government no less than 24 hours after completion of the OPI and shall not exceed five (5) business days.” to “With the exception to DLIFLC resident students, AFPAK-Hands and MAVNI OPIs, Contractor shall provide final score to the Government no less than 24 hours after completion of the OPI and shall not exceed five (5) business days.”

(a) Certain experienced professional and/or technical personnel are essential for successful accomplishment of the work to be performed under this contract. These "Key Personnel" were identified by name within the contractor’s proposal and their resumes were submitted for evaluation during the source selection process. The contractor agrees that such personnel shall not be removed or replaced within the performance of this contract unless the following measures are taken:
(1) If one or more of the key personnel, for any reason, becomes or is expected to become unavailable for work under this contract for a continuous period exceeding 30 work days, or is expected to devote substantially less effort to the work than indicated in the proposal or initially anticipated, the contractor shall, subject to the concurrence of the Contracting Officer (KO) or designated Contracting Officer Representative (COR), promptly replace personnel with personnel who possess equal, or better, qualifications as the original employee
(2) All requests for approval of substitutions hereunder must be in writing and provide a detailed explanation of the circumstances necessitating the proposed substitutions. The request must contain a resume for the proposed substitute, and any other information requested by the KO or designated COR. The KO or designated COR must concur in writing with the change.
(b) If the KO or designated COR determines that suitable and timely replacement of Key Personnel who have been reassigned, terminated or have otherwise become unavailable for the contract work is not reasonably forthcoming or that the resultant reduction of productive effort would be so substantial as to impair successful completion of the contract, the KO may terminate the contract for default or for the convenience of the Government, as appropriate, or make an equitable adjustment to the contract to compensate the Government for any resultant delay, loss or damage.
(c) The Key Personnel in this contract are as follows: [fill-in at time of award].

5152.233-4000 AMC-LEVEL PROTEST PROGRAM (Feb 2014) (LOCAL CLAUSE)
Prior to submitting an agency protest, it is preferable that you first attempt to resolve your concerns with the responsible contracting officer. However, you may also file a protest to the Headquarters (HQ), Army Materiel Command (AMC). The HQ AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 35 calendar days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the HQ AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below.

The contractor shall perform to the standards in this contract.
1.2 Background: The Department of Defense (DoD) launched the Defense Language Transformation Initiative in 2004 with the objective of improving the Armed Forces’ capacity to work effectively with international partners. In January of 2005, the Defense Language Transformation Roadmap was published requiring that military departments, combatant commands, defense agencies, DoD field activities and all other organizational entities within the DoD train and maintain personnel with language skills capable of responding for operations with the correct levels of proficiency. In August 2005, the Undersecretary of Defense for Personnel and Readiness (OUSD) (P&R)) issued a memorandum tasking the Defense Language Institute Foreign Language Center (DLIFLC) with providing program funds for test development and field testing. DoD Directive (DoDD) 5160.41E charged DLIFLC with overseeing the standardization, testing, research, development and evaluation of all foreign language training and education.
The requirements for foreign language testing have increased exponentially. Many more end-users, external to DLIFLC, continue to request Oral Proficiency Interviews. DLIFLC needs to continue serving these end-users by covering current and anticipated testing needs for the foreseeable future.
