(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:

(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

52.212-2 EVALUATION--COMMERCIAL ITEMS

(a) Basis for Contract Award

This is a lowest priced technically acceptable source selection conducted in accordance with Federal Acquisition Regulation (FAR) 13.106-2, Evaluation of Quotations or Offers, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).

Award will be made to a single quoter who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose quote conforms to the solicitation requirements, and is determined to be the lowest priced technical acceptable quote.

(b) Evaluation Criteria: Each quote will be evaluated under three evaluation factors: Technical Expertise, Past Performance, and Price. Trade-offs between price and non-price factors are not permitted.

(1) Technical Expertise Factor. The Technical Expertise evaluation provides an assessment of the quoter’s capability to satisfy the Government’s minimum requirements as specified in the PWS and elsewhere in this solicitation.

Quoters shall describe their relevant expertise to prove competency in performing the described tasks in the PWS.

For this evaluation, technical expertise shall be demonstrated through the expertise gained by the performance of projects of similar magnitude.

(a) The expertise gained from experience should be from projects of similar magnitude that have been successfully completed. Similar magnitude can be demonstrated by the performance of an individual project, or contract, with similar quantities for unit rentals and servicing frequencies. Similar magnitude can also be demonstrated by the performance of simultaneous separate projects, or contracts, in which the total sum of the quantities for unit rentals and servicing frequencies is similar to this requirement. The intent of similar magnitude experience is to determine that the quoter has demonstrated that they have the ability to perform the necessary tasks in the required quantities for this requirement. The description of technical expertise provided in the quote for evaluation shall at a minimum include: Under what company the experience was obtained, the period of performance, the project description including tasks performed, the size of the project including estimated coverage area (in acres or square miles), dollar value, number of units, service intervals, crew size, etc. and how this experience will directly transfer to the success completion of this requirement.

(b) In evaluating this element, the assessment will concentrate on the quoter’s experience and/or their the proposed partner/subcontractor’s experience, in performing this requirement to ensure they have the depth and breadth of experience necessary to satisfactorily perform the requirements in the PWS. Experience obtained as a subcontractor or work performed as part of a team or joint venture may also be considered in the absence of relevant experience in your company’s current state. The quote must demonstrate technical expertise associated with the requirement. Failure to provide technical expertise similar to the requirement may result in a determination that quote is unacceptable. The quote is acceptable when the quoter demonstrates experience in meeting or exceeding the PWS requirements without introducing unacceptable risk to the project. The assessment, at a minimum, will be based on the following technical requirements.

- Demonstrates experience as either the prime or partner/subcontractor providing portable chemical latrine services with projects of similar magnitude, nature, size, and complexity.

- Demonstrate experience of the project(s) in which this experience was gained, including dates, nature, size, and complexity, customer supported (i.e. DoD, commercial, state, local etc).

- Demonstrates experience in simultaneously performing multiple projects.

(c) The Technical Factor will receive one of the ratings defined below:

(2) Past Performance: The Past Performance evaluation will assess the quoter’s probability of meeting the solicitation’s requirements as indicated by that quoter’s record of past performance. Quoters should be aware that in conducting the performance risk assessment, the Government may use data provided in the quote and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems. Past performance areas of evaluation include: Quality of Service, Business Relations, Cost Control, and Customer Satisfaction. In evaluating this element, the assessment will concentrate on the recency and relevancy of the past performance information.

(i) Recency: An assessment of the past performance information will be made to determine if it is recent.

To be recent, the effort must be ongoing or must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

(ii) Relevancy Assessment: The Government will conduct an evaluation of all recent performance information obtained to determine if it is the same or similar in nature, size, and complexity to the services/products being procured under this solicitation. A relevancy determination of the quoter’s past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the quoter or subcontractor whose contract is being reviewed and evaluated. The past performance information provided in the quote and information obtained from other sources will be used to establish the degree of relevancy of past performance.

Quoters without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Neutral.” The Past Performance Factor will be assigned one of the ratings defined below:

Rating Description

Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

Rating Description

Acceptable Based on the offeror’s past performance record, the Government has a reasonable expectation that the quoter will successfully perform the requirement, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the quoter will be able to successfully perform the required effort.

(3) Price: Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques the Government will determine whether prices are realistic, reasonable, complete and balanced.

(i) Price Realism and Reasonableness: Quoters will be evaluated to determine if they are unreasonably high or unrealistically low in relation to other quoters. Proposed prices will also be evaluated against the market value for other services currently being performed and the Independent Government Estimate (IGE). Quoters with prices that are unreasonably high, unrealistically low, unbalanced (IAW FAR 15.404-1(g)), or do not support the technical solution may be eliminated from competition on the basis that the quoter does not understand the requirement or the quote represents too great a risk.

(ii) Option Pricing: The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the quoter's final option period price to the total quoted price. Thus, the total price for the purpose of evaluation will include the base period, all options, and 1/2 of the last option.

Quoters are not required to enter a price for this six-month period.

(End of provision)
