QUESTIONS

1. Questions: Is center beam rail delivery acceptable or flatbed trucks only?

Answer: Flatbed trucks. CSX will not deliver on the tracks in Fort Stewart or Hunter Army Airfield. Only to the side track.

2. Question: The standard composite railroad ties, is the length 8-1/2’ or 9’? I have typically supplied 9’ to the Army, but have also supplied 8-1/2’.

Answer: The standard is 9 feet.

3. Reference: Bid price schedule (BPS) line item 0005 Furnish and Install Composite Railroad Ties 3,000 Track Feet and line item 0006 Furnish and Install Composite Switch Tie (7” Grade) 1,800 Board Feet

Question: The requests I have been getting is for 3,000 ties. Is it 3,000 ties or is track feet correct?

On the switch ties, what lengths are the ties?

Answer: Line item 0005, 1005, and 2005 are for 3,000 ties. Line items 0005, 1005, and 2005 have been updated to reflect a unit of issue/measure of Each. Switch ties range in size from 9 feet to 18 feet. These will be ordered by the board foot as prioritized by track inspectors.

4. Reference: BPS line item 0001

Question: What size ballast are they wanting to use?

Answer: Use No.4 angular stone for the track areas. Use No.5 angular stone for the yard area.

5. Reference: BPS line items 0003 and 0035

Question: Can the surfacing and realign be done in one trip or will there be multiple mob and demobilization with our equipment?

Answer: Multiple trips as required by the work to be completed.

6. Reference: BPS line item 0006

Question: What are the actual lengths of the switch ties and how many?

Answer: Reference Question 3.

7. Reference: BPS line item 0019

Questions: What size are the switches and tracks?

Answer: Reference BPS line item 0019, 1019, and 2019; 115lb rail, #8 frogs.

8. Reference: BPS line item 0033

Question: When it says 400 TF of section is that saying replace all ties and rail, and if so will it be Composite Ties?

Answer: This is to pull out an existing section of tract to effect a repair; for example bed, steam line, or drainage.

Then replace that section of track with the existing components.

9. Reference: BPS line item 0029

Question: Is it wanting thermite welds or rail build up by welding rods?

Answer: Line item 0029, 1029, and 2029 refer to thermite joining if a section at a grade crossing needs to be replaced.

10. Reference: FAR 52.228-14, Irrevocable Letter of Credit

Question: We understand that the Irrevocable Letter of Credit (ILC) can be used instead of bonding. Could you please clarify, as an 8a contractor, are we required to put up the value of our bid in a bank account in order to secure the ILC? If so, as an 8a company, would this then limit the 8a companies that could bid for this opportunity; as 8a companies do not have the financial resources to have $1-5 million deposited into an account for the duration of the contract?

Answer: An irrevocable letter of credit is correspondence from a financial institution that guarantees payment for goods or services. The irrevocable letter of credit assures the Government that the financial institution will make payment, or in this case guarantee the bid, in the event the contractor fails to meet their obligation to the contract.

The Government cannot assume or provide guidance on how your financial institution issues irrevocable letters of credit or the requirements it places on you as their customer.

11. Question: Would the government consider an ILC for work actively being performed, but not invoiced?

Answer: Reference the answer to question 12.

12. Question: As a follow up to our second question, would the Government consider dividing up the project into several task orders, which combined, make up the full project and allow the contractor to maintain an ILC in the amount which covers 100% of the current task order on which work is being performed? Under this approach the ILC providing surety could be release when the work under the current task order has been performed, inspected and deemed eligible for payment by the government. The ILC would then be assigned to the government for the next task order in the sequence of the work requirements.

Answer: This is an indefinite delivery/indefinite quantity fixed price contract, meaning that task order will be issued for the work to be performed. Reference line items 0001, 1001, and 2001. Also reference clauses in the solicitation;

FAR 52.216-18, Ordering and 52.216-22, Indefinite Quantity. However, the bid guarantee or irrevocable letter of credit or are only valid on the base contract, not individual task orders. Performance and payment bonds are required on task orders valued $150,000.00 or greater. In accordance with FAR 28.204-3(a), Any person required to furnish a bond has the option to furnish a bond secured by an irrevocable letter of credit (ILC) in an amount equal to the penal sum required to be secured (see 28.204). A separate ILC is required for each bond.
