PART ONE Q&A: Question #14: Are costs for role players, construction materials, etc., fixed price or cost plus?
Answer #14: All ODC CLINs are firm fixed priced for the proposal, but will be paid on the quantities actually used. The unit price for each item in the Other Direct Cost CLINs (CLINs ##0004, 1003, and 2003) should include any additional offeror's charges (i.e. material handling, profit, etc). The payment on these CLIN quantities will be verified and approved by Contractor Officer Representative (COR). If the demand of the quantities increases, it will be changed by a contract modification.
PART ONE Q&A: CLARIFICATION ON Q&A #10:
- How many full time are in place? Can we get a list of their qualifications?
- How many part time are in place and where are they located? Can we get a listing of their qualifications?
The Government can provide the numbers for full time and part time personnel. It is up to the offeror to propose and provide qualified personnel IAW the RFP. We would like to keep them in place, however, "Can you please provide us the number of personnel and a copy of names of all the FT & PT personnel?"
"Can I now contact the incumbent’s employees to ascertain if they want to be a part of my team?"
Answer #10: 1) our office doesn't know if the current contractor rehired all personnel from the previous one, nor we have the list of the current employees. You can try contracting the incumbent, L2Defence, directly for the list and qualifications.
2) the Solicitations provides the historical quantities. Please, read Part 9 on workload and Part 10, Paragraph 10.1 for part-time employees and Para 10.5 for full time employees.
PART TWO Q&A: CLARIFICATION ON Q&A#26: Response #26 of Part Two of the Q&A reads, "How many FEMA Urban Search and Rescue sets of equipment recurrently provided by the incumbent contractor?". The Government responded, "One".
This is incorrect. In negotiations for our bridge contract, we removed the FEMA equipment set and are not providing it under the bridge contract. With this being an LPTA competition (and coupled with the Government's response to Question #9 or Part One), this is an important point for setting price targets for all offerors.
Answer #26: it should read “NONE”. The current bridge contract has no Urban Search and Rescue sets of equipment. However, the government is requesting the vendor to have access to "One" set of equipment for the upcoming contract under W9124J-16-R-0024.
PART TWO Q&A: CLARIFICATION ON Q&A#1: "Am I correct to understand that as with the acceptance of the use of both prime and sub team's past performance, that if any team member (prime or sub) has an FCL, that this would satisfy the requirement for an FCL?"
Answer #1: All full time employees and certain key part time employees must possess a facility clearance as specified in the PWS:
Paragraph 4.2 of the PWS reads:
4.2. The Contractor requires a SECRET facility clearance with NO safeguarding from the Defense Security Service for full time employees and Incident Commanders (part time employees, under key personnel, para 1.6.11.1).
In response to the question by the vendor: Having 1 person with a facility clearance does not meet the requirement. A facility Clearance is for the Company. Not an individual employee of a prime or sub-contractor. A facility security clearance (FCL) is provided to a defense contractor as a result of a contract requiring performance on a classified effort.
Though the contractor does not have to possess an FCL prior to bidding on a contract, it is necessary perform on the classified effort. A defense contractor can bid on and win the contract as long as they are eligible to apply for and receive the FCL. Once they win the contract, the rewarding activity provides justification for the security clearance.
The FCL is also tied to the personnel security clearance (PCL) process. A company cannot have an FCL unless key employees are eligible for a PCL Subsequently, PCLs cannot be granted without the FCL. The Key Management Personnel are required to have clearances for the FCL, with the remainder of employees requested as needed.
For more information, see the DSS website for the security clearance checklist and starter package http://www.dss.mil/isp/fac_clear/fac_clear_check.html
