About this file
This is a Statement of Work (SOW) for advanced online music subscription and Christian music licensing services to support the Installation Management Command (IMCOM) Religious Support Office (RSO).
The Government requires an advanced online music subscription and Christian music licensing platform that enables storage, reproduction, distribution, public projection or display, derivative works, and performance of digitally transmitted sound recordings for military chapel worship services. The requirement consists of two primary elements: Element 1 is a SongSelect Online Streaming Music Subscription and Element 2 is Copyright Licensing to legally authorize public display and printing of lyrics, storage, and other music-related functions. The contractor must be an authorized retailer or administrator of music labels' licensing. The base year consists of 12 months with four optional 12-month extension years. This is a follow-on requirement to Contract W9124J-21-P-0008.
The requirements specify three Contract Line Items (CLINs) with consistent quantities across all contract periods: CLIN 001 Church Copyright License (57 units), CLIN 002 SongSelect Advance (24 units), and CLIN 003 SongSelect Premium (33 units). Although federal copyright law provides a Religious Service Exemption (17 U.S.C. § 110(3)) for musical performances during worship services, this exemption does not protect the reproduction of lyrics or their public display. Therefore, the Government requires licenses to legally cover reproduction, public display, projection, bulletin inclusion, and other specified uses of music and lyrics across all 57 military installations.

Statement of Work (SOW) Advanced Music Subscription and Christian Music Licensing
Installation Management Command (IMCOM), Religious Support Office (RSO)
1. Scope. This is an award for an advanced online music subscription and Christian music licensing services.
1.1. Background. The Installation Management Command (IMCOM) Religious Support Office (RSO) requires an advanced online music subscription and Christian music licensing for the storage, reproduction (like recording or copying music, video, and other works), distribution, public projection or display, derivative works (adaptation like an arrangement or translation), and the performance of digitally transmitted sound recordings in support of military religious and worship activities. Government-provided Chapel Worship Services ensure the free exercise of religion for Soldiers, their family members, Department of Defense civilians, and other authorized personnel in the military community. Music is a crucial part of worship elements and plays an important role in enhancing the worship experience of participants.
1.2. There are two elements most relevant to this requirement. Element 1 is SongSelect Online Streaming Music Subscription and Element 2 is Copyright Licensing which will enable the Government to use SongSelect music and its lyrics in public settings, publicly display and print lyrics, store, and perform other functions with the music.
Offeror must supply streaming Christian music subscriptions and be an authorized retailer or administrator of labels’ (music producers) music licensing. Because the subscriptions are for online streaming music there are no distribution concerns or geographic and location limitations and issues because items are instantly available upon transfer. This is a unique requirement for religious Christian music. There are several suppliers in the market who offer Christian music streaming services; however, not all of the suppliers are authorized to sell reproduction and rebroadcasting licensing.
2. Period of Performance. The anticipated period of performance will be one (1) base year consisting of 12-months, and four (4) 12-month option years. This is a follow-on requirement to Contract W9124J-21-P-0008.
3. Requirements. The contractor shall supply an advanced online music subscription and Christian music licensing for the storage, reproduction (like recording or copying music, video, and other works), distribution, public projection or display, derivative works (adaptation like an arrangement or translation), and the performance of digitally transmitted sound recordings.

3.1. This is a unique requirement based on Federal Copyright Law. Under federal copyright law, religious organizations are exempt from copyright restrictions for music when a song or selection is played or rendered during worship services at a house of worship. This exemption is known as Religious Service Exemption (17 U.S.C. § 110(3)) of the U.S. Copyright Act. The exemption reads: “…performance of a non-dramatic literary or musical work of a dramatic or musical work of a religious nature or display of a work, in the course of services at a place of worship or other religious assembly shall not constitute infringement of copyright.”
Although this exemption exists, it does not offer protection for the reproduction of lyrics, public display of lyrics (such as projecting them on a screen or reproducing them in a church bulletin for the congregation to follow). Therefore, the Government requires licenses for these, and the other actions listed in the agency’s requirements.
