QUESTIONS & ANSWERS

Question 1: PWS Tech Exhibit 7.3A-D: A question was posed on the site visit that the contractor could proposed alternate collection schedules for the collection of solid waste containers. We believe the Government obliged this request; however, we do not believe this would be fair to all other offerors as the IFB calls to propose on the schedules outlined in the PWS. Please confirm that offerors are to bid on the collection schedules/SOW outlined in the PWS, as the Government has already indicated that the schedules provided are adequate.

ANSWER: Offerors are to bid on the collection schedules as outlined in the PWS.

Question 2: The IFB requires the winning bidder to plan, program, and provide all personnel, equipment, supplies, facilities, transportation, tools, materials, collection systems, supervision, and other services and items necessary to perform a complex solid waste collection contract. Such services are generally procured through a negotiated procurement (through an RFP) where past performance an expertise in this field can be considered, and not through a sealed bid IFB where only price is considered. What rationale did the agency rely on to choose an IFB as opposed to an RFP to procure these services?

ANSWER: The services required for this acquisition are well defined in the PWS and are readily available in the commercial marketplace, making this acquisition most suitable for an IFB where price is the most important factor.

Question 3: Does the agency reasonably believe that it will be able to sufficiently and properly evaluate bidders’ ability to perform the work without evaluating their past performance or expertise?

ANSWER: Yes, the Government will.

Question 4: Did the agency consider using an RFP and if so, why was it not selected as the procurement method?

ANSWER: No, an RFP was not considered.

Question 5: With regard to the limitation on subcontracting requirements for this contract, please describe whether the requirements of 13 CFR 125.6, FAR 52.219-14, or both regulations apply to the performance of this contract. These regulations are inconsistent with how the limitation on subcontracting metric is supposed to be calculated and tracked.

ANSWER: The award is set-aside for a small business and a subcontracting plan is not required.

Question 6: If subcontracting, please clarify whether the labor split or contract cost split of 51% of the concern is applicable.

ANSWER: Not applicable to this acquisition.

Question 7: What information will the agency request to determine whether bidders are responsible to perform the work under FAR 9.104-1?

ANSWER: A written Determination of Responsibility will be made by the Contracting Officer. Any information required to be verified will be verified by the contracting office, whether thru SAM’s, the Small Business Administration or other available sources.

Question 8: How will the agency evaluate whether a bidder has the necessary organization, experience, accounting and operational controls, and technical skills to perform the contract if these qualities are not subject to evaluation as part of the award decision through a formal proposal evaluation process?

ANSWER: If a bid is accepted and if there are any questions from the Contracting Officer that offeror will be required to provide clarification to the contacting office.

Question 9: How exactly will an offerors past performance be evaluated? Would the Government please considering adding past performance evaluation factors?

ANSWER: There are no evaluation factors that are part of this IFB.

Question 10: What information are you going to require from the winning bidder to determine if they are responsible?

ANSWER: See question 7 above.

Question 11: What information are you going to require to submit with the bid to prove that you are an

EDSOWB?

ANSWER: The offerors are to submit their certifications per FAR Clause 52.212-3 as part of the IFB submission which will be verified in SAM’s and by the SBA.

Question 12: Please confirm that WOSB’s cannot bid this requirement?

ANSWER: This requirement is set-aside for an EDWOSB only.

Question 13: Section 1.12.1 Project Manager: Please clarify that the project manager must be on site and the timeframe that he/she must have to respond to be onsite, and that a “by phone” PM will not suffice for this project.

ANSWER: There is no requirement to have an on-site project manager. Contractor is only required to meet the items identified in paragraph 1.12.1 Project Manager and subsequent sections.

Question 14: 5.2.3 Areas around Containers:

Please confirm that bulk collection is not required under this contract, e.g. collection of couches, dressers, mattresses, pallets, etc.

ANSWER: Bulk collection services are covered under paragraph 1.4.1.3 TE 7.3C.

Question 15: The PWS states, “Excess waste or waste beyond the normal quantity shall be collected and disposed of by the Contractor at no additional cost to the Government.” To what end is the contractor truly responsible for excess waste? If a certain container(s) is continuously overflowing due to illegal dumping, an unidentified excess waste stream, or certain individuals only utilizing one dumpster when others are available, how will the Government remedy the situation other than saying the contractor is responsible for it?

ANSWER: The Contractor has the responsibility to monitor collection locations and adjust contractors approved schedule to meet changing requirements, or to provide additional dumpsters as required to meet waste stream. Paragraph 5.4, Route and Collection Schedule states: “The Contractor shall monitor ALL collection locations and shall modify collection locations and approved collection schedules, as required, to ensure that no collection location becomes overused or underutilized. Conditions that may impact approved schedules may be relocation of customers, new tenants, changes in staffing and work load at facilities and other situations.”

Question 16: In addition to question above, isn’t this statements intention to keep occasional spillage off the ground?

ANSWER: Yes

Question 17: It appears that this contract falls under the Service Contract Act. Can the government provide the wage determination for this contract?

ANSWER: US Department of Labor (DOL) Wage Determination # 2015-4631(Rev 3) dated 11 May 2017 is applicable to this solicitation and subsequent contract. It may be acquired from the DOL web site at:

Question 18: Will the awardee be required to give the current "first right of refusal" under the Service Contract Act?

ANSWER: Per Federal Acquisition Regulation, (FAR) 22.1202(a): When a service contract succeeds a contract for performance of the same or similar services, as defined at 29 CFR 9.2, at the same location, the successor contractor and its subcontractors are required to offer those service employees that are employed under the predecessor contract, and whose employment will be terminated as a result of the award of the successor contract, a right of first refusal of employment under the contract in positions for which they are qualified. Executive Order 13495 generally prohibits employment openings under the successor contract until such right of first refusal has been provided, when consistent with applicable law.

Question 19: Is there a location on base where the containers can be washed?

ANSWER: No

Question 20: The contract calls for unscheduled and scheduled pickups; what Item No./Clin No do we provide the cost in as there is no separate Item No or Unscheduled and Scheduled pick-ups.

ANSWER: Paragraph 5.5.1 states: Refuse collection for scheduled events shall be provided at no additional cost to the Government. Paragraph 5.5.2 Unscheduled Requirements states: “Unscheduled requirements shall be ordered on an “as needed basis” under the “As Required” line items, and is billed against CLIN 0006 and 0007.

Question 21: Will you be posting a current Wage Determination as one was not provided in current documents?

ANSWER: See the answer at question 17 for the Wage Determination information.

Question 22: When will question and answers be posted?

ANSWER: Questions will be addressed in Amendment 0001.

Question 23: Do you anticipate an extension on IFB due date?

ANSWER: Any extension will be announced in the amendment to the solicitation.

Question 24: Will a container location or building map be provided? Since the base in so large (90 square miles), a map would be beneficial to properly determine the number of trucks needed.

ANSWER: Maps of are attached.

Question 25: Can contractor vehicles be parked overnight on the base in the fenced in area?

ANSWER: No. Refer to Part 3, Government Furnished Items and Service, item one.

Question 26: What CLIN should the costs for the scheduled special events be charged to (i.e. I understand that there are CLINs designated for the unscheduled special events)?

ANSWER: These costs are to be accounted for in the overall proposal and not as a separate CLIN.

Paragraph 5.5.1, Scheduled Special Events states. “Refuse collection service for scheduled events s h a l l b e p r o v i d e d at no additional cost to the government.” Refer to paragraph 1.4.1 and Technical Exhibit 7.3E.

Question 27: Can you confirm that the wet containers need to be cleaned every other day?

ANSWER: Cleaning frequency is dependent on the conditions of the dumpsters. The dumpsters shall be emptied on a daily basis. Paragraph 5.2.7 Collect and Dispose Waste at Food Service Facilities states:

“The containers shall also be rotated with clean containers, as required, or cleaned, as required, to meet contract requirements. The e m pt ie d containers shall be free of food residue and trash and shall not develop a buildup of soil or become attractants for insects and rodents

Question 28: What is the estimated start date for the contract?

ANSWER: August 1, 2017. See CLIN 0001.

Question 29: Will the incumbent contractor be responsible for all pickups during the Phase-In period?

ANSWER: Refer to paragraph 1.15 Phase-In / Phase-out. It states: “The Contractor shall, upon the Contracting Officer's written notice of award, (1) furnish phase-in and phase-out services for up to 30 days, and (2) negotiate in good faith a plan with a successor to determine the nature and extent of phase-in and phase-out services required. The plan shall specify a training program and a date for transferring responsibilities of work described in the plan, and shall be subject to the Contracting Officer's approval.”

The contractor who is awarded the contract will need to coordinate with the incumbent to develop a joint plan to submit to the KO for approval.

Question 30: If the residual water can be captured, can a wash truck be used to clean the containers at the container location?

ANSWER: Yes

Question 31: What is the approved installation color scheme for Ft. Rucker?

ANSWER: Painted containers shall be Pantone #18-1222TPX Nutmeg Brown.

Question 32: What color scheme will the containers need to be for this solicitation?

ANSWER: Painted containers shall be Pantone #18-1222TPX Nutmeg Brown.

Question 33: What age (1-15 years) is acceptable for the containers for the new contract?

ANSWER: The containers shall meet the requirements in the PWS and receive COR approval.

Question 34: Will refurbished units be acceptable?

ANSWER: Yes, if the containers meet the requirements in the PWS and receive COR approval.

Question 35: Would the use of a new type of plastic manufactured container, approved for Commercial-industrial waste collection be permitted for dry locations?

ANSWER: The use of new plastic manufactured commercial-industrial waste containers is an acceptable alternative to the metal waste containers, for use in both dry and wet locations. Color to be approved by the COR.

Question 36: If the awarded EDWOSB contractor was to partner with the incumbent to service the new contract, or awardee was to purchase existing containers from the incumbent; would the government allow the current containers in place, to be utilized AS IS, on AUG 1 start date?

ANSWER: NO, some of containers do not meet the minimum standards as set forth in the current

PWS.

Question 37: Who is responsible for the cleaning of the existing rust and garbage drainage stains from the current services?

ANSWER: The current contractor is responsible.
