About this file

This is a Justification for an Exception to Fair Opportunity document for iPERMS Computing Systems Innovations (CSI) Intellidact Software Licenses and maintenance support at Fort Knox, Kentucky. The U.S. Army Human Resources Command (USAHRC) is requesting a firm-fixed-price contract for brand name software maintenance support, with an anticipated award in December 2024 using Operations and Maintenance Army (OMA) funds.

The procurement includes three components of annual Intellidact AI maintenance and support: Intellidact AI Yearly Software Maintenance and Support, Additional Software Component for Handprint OCR Software Maintenance and Support, and Additional Software Component for Containerization Software Maintenance and Support. The period of coverage is December 19, 2024 through December 18, 2025. The justification cites FAR 8.405-6(b) for brand name restriction, as the software is currently integrated with iPERMS workflows and changing vendors would incur additional costs and technical complications. The previous contract (W9124D-21-F-0442) was awarded to Iron Bow Technologies, LLC on August 9, 2021, also as an exception to fair opportunity under FAR 16.505(a)(4).

b. This justification is for brand name software iPERMS CSI Intellidact Software Licenses maintenance support. The same brand-named software is currently used within the iPERMS program, and the software has been customized to work specifically with the iPERMS workflows associated with the program.

c. To use other than the brand name supported items would incur additional cost and time for technical team personnel to ensure the other named items would be compatible with the existing iPERMS infrastructure and customized to process data using the iPERMS workflows. Also, these brand name supported items are the requirement, anything else would not be fulfilling the requirement developed by the iPERMS requirements team, in conjunction with the functional customer. Failure to provide this equipment would negatively impact the iPERMS application’s ability to provide 24/7 records support to promotion boards, soldiers, veterans and other USAHRC applications that need records.

6. Efforts to Obtain Competition: The support for the CSI Intellidact products to be acquired with this acquisition mesh within the framework of a larger end to end application, therefore, no other brands can be/were considered. Upon end-of-life cycle of the entire system, all available software packages available from CHESS vendors will be considered.

7. Actions to Increase Competition: The product to be acquired with this acquisition fit within the framework of a larger end to end system therefore, no other brands were considered. Upon end-of-life cycle of the entire system, all available hardware/software packages available from CHESS vendors will be considered.

8. Market Research: Information Technology hardware and software is required to be purchased through the Army CHESS program unless a waiver is approved, the current items are not available, and a statement of non-availability (SONA) has been approved.

HRC will continue to research all possible avenues available to determine if another product can provide a similar solution.
