Ques ons and Answers Solicita on no. W9124823Q0007
Published at SAM.GOV on 31 August 2023, Responses Due by 15 Sept 2023 at 10:00 AM (CDT) Descrip on: Resource Conserva on Recovery Act (RCRA) and Spill Preven on, Control and
Countermeasure (SPCC) Compliance Support
1. PWS Sec on 5.3.14.6 states that the Contractor shall perform minor tank maintenance. AST includes, but is not limited to, rust removal, pain ng/sealing, gauge replacement, and tank component replacement. UST includes but is not limited to sensor/cap/lid replacement and Veeder-Root bulbs/printers/modem replacement. Will the contractor be responsible for purchasing supplies (i.e: paint/sealant, gauges, tank components, sensors, Veeder-Root bulbs etc.) and need to include costs for the purchases in our proposal or will the supplies be provided by the government as necessary?
Answer: Per PWS paragraph 1.1 Descrip on of Services/Introduc on. The Contractor shall provide all personnel, equipment, supplies, facili es, transporta on, tools, materials, supervision, and other items and non-personal services necessary to perform RCRA Sub tles C, D, and I, SPCC Management Support, and Emergency Spill Response Technical Services as defined in this PWS except for those items specified as government furnished property and services.
2. PWS Sec on 5.4.4.1.1 states the government an cipates up to 150 small illicit discharges/minor spills per year, but the Pricing Schedule lists the number of spills as 100. There is a similar issue with PWS Sec on 5.4.4.2.1 sta ng 100 spills annually but the Pricing schedule sta ng 150. Is the PWS or the Pricing Schedule correct in regard to the appropriate amount of spills for both cases?
Answer: Generally small spills are equal or more than 55 gallons. We have split this to 20 gallons or less and for 21 to 500 gallons. Just follow the Pricing schedule. Paragraph 5.4.4.1.1 is just an es mate. It could be 20 gallons more or less in quan ty.
3. PWS Sec ons 5.4.4.2 – 5.4.4.5 state that contractor shall respond to the site, perform an assessment, and ini ate a report outlining spill cleanup and remedia on, but unless otherwise nego ated with the Government, the Contractor is not required to cleanup/remediate the spill. The Pricing Schedule requires the pricing of 5 “JOBS” for each of these sec ons. Can the government provide more detail on what is bring priced as part of these “JOBs” if we are nor required to cleanup/remediate the spill? Is it just the labor associated with responding to the site, performing an assessment and ini a ng a report outline spill cleanup and remedia on or is there something else that needs to be factored into the JOB pricing?
Answer: This solicita on is for an ordering agreement with the Government. Funding is provided for each Task Order placed against this ordering agreement, that is why the government needs to nego ate/approve the proposed cost of the spill cleanup and remedia on process, issue a contract to the contractor prior to start of the clean-up. Normally, there is funding set-aside for emergencies and turnaround is quick.

Answer: There is no restric ons for Joint Ventures, as long as your joint venture is registered in SAM.gov. About teaming partners, the government has no issue about that either as long as the prime contractor adheres to the subcontrac ng limita on.
5. General: Sec on L – Instruc ons asks for an ‘approach in mee ng the requirement while adhering subcontrac ng limita ons.’ What are the subcontrac ng limita ons the government is referring to?
Answer: Please refer to 52.219-14 Limita ons on Subcontrac ng. Since this solicita on is set-aside to WOSB (Women Owned Small Business), a prime contractor cannot sub-contract more than 50% of the contract price to a non-WOSB. Please contact you Small Business Administra on office for more informa on regarding this subject.
6. General: Please provide clarifica on on any ODC required for each scope element of the contract.
Answer: The government do not understand this ques on.
7. Pricing: Please provide clarifica on on how costs for personnel rates, equipment, and supplies should be prepared and submi ed.
Answer: You have to work it out on your own.
8. 5.2.2.1 The Contractor shall review Fort Campbell’s Waste Management Plans. – Please provide clarifica on as to the designated meframe or number of reviews annually required.
Answer: The paragraph shows monthly repor ng, but the input and tracking of that informa on is daily for the waste diversions. Fort Campbell an cipates review of up to 175 waste management plans and reviews are completed usually within one calendar week.
9. 5.2.2.2 The Contractor shall ensure waste minimiza on metrics are progressing as necessary to adhere to established meline. Waste minimiza on metric accomplishments shall also be reported monthly. – Please provide clarifica on on the established meline.
Answer: The government don’t understand the ques on “Please provide clarifica on on the established meline”. The paragraph says monthly.
10. 5.2.13.3 The Contractor shall conduct sampling IAW the approved SSHP when containers of unknown content are found at the SAP/90-day storage accumula on area/orphaned drums.
Analysis for waste determina on will be provided by others. – Please provide clarifica on on how many samples will be required.

Answer:
UST Operator Requirements
The Energy Policy Act of 2005 amended RCRA-I to require state-specific training for three classes of operators, iden fied as Class A, Class B, and Class C, who operate and maintain federally regulated UST systems. Each UST facility must have a Class A, Class B, and Class C operator designated and trained accordingly.
Class A - Persons having primary responsibility for on-site opera on and maintenance of underground storage tank systems.
Class B - Persons having daily on-site responsibility for the opera on and maintenance of underground storage tank systems.
Class C - Daily, on-site employees having primary responsibility for addressing emergencies presented by a spill or release from an underground storage tank system.
UST facility owners or operators must maintain records documen ng the training received for all Class A, Class B, and Class C operators and make training records available for inspec on, and/or report Class A, Class B, and Class C operator compliance to the state. KY and TN state-specific requirements are summarized in the following sec ons. Addi onal informa on is available from the USEPA UST Operator Training website.
1.1.1 Kentucky Operator Training and Requirements
Kentucky has amended its UST rules (401 KAR 42:020) by adding Opera onal Training Requirements and UST Facility Employee Training Requirements. Prior to June 8, 2012, Fort Campbell designated at least one individual trained as the primary designated compliance manager (DCM) for registered UST systems. Fort Campbell has ensured that all employees associated with the opera on of UST systems received training by August 8, 2012 and every 12 months therea er.
Kentucky Tank Operator Online Learning System (TOOLS) was released in 2014. Revised deadlines were established for DCM designa on and comple on of Kentucky UST operator training. The revised deadlines were officially communicated to UST owners and operators by mail a er May 2014 and were posted on the UST Branch website. Per federal law, states are to ensure that UST operators are trained according to state-specific training requirements. Addi onal informa on is provided on the Kentucky UST Operator Training Web Site.
1.1.2 Tennessee Operator Training and Requirements
Published at SAM.GOV on 31 August 2023, Responses Due by 15 Sept 2023 at 10:00 AM (CDT)
Tennessee has amended its UST rules by adding UST operator training requirements. Effec ve August 8, 2012, every facility having one or more petroleum UST systems subject to TN UST requirements (Chapter 0400-18-01) must have one or more persons who have been designated by the tank owner as Class A, Class B, and Class C Operators (Chapter 0400-18-01-.16 Cer fied Operator Program)
Anyone who is assigned by Fort Campbell as a Class A, Class B, or Class C Operator will need to take training appropriate for the responsibili es of that Operator Class designa on. TDEC has created a free web-based interac ve applica on called Tennessee Tank Helper which will allow Fort Campbell to select their designated operators and allow operators to sign up and take training. Addi onal informa on is provided on the TDEC UST Operator Training Website.
Fort Campbell is responsible for:
Ensuring Class, A and Class B Operators are registered with TDEC for each facility where petroleum UST systems are located using TDEC’s web-based operator training database on or before August 8, 2012.
Verifying in the TDEC’s web-based operator training database that a trained individual mee ng the requirements for a Class C Operator will be on site whenever the facility is opera ng.
Ensuring that if a UST facility has a person(s) on site, at least one person on site must be a Class C Operator whenever the facility is opera ng. Unmanned facili es must have a designated Class A and Class B Operator, but are not required to have designated operators on site. Class C Operator requirements for unmanned facili es may be met through appropriate conspicuously posted signage.
Repor ng any changes in Class A or Class B Operators to the TDEC DUST within thirty (30) days of said change in the TDEC’s web-based training database.
