52.214-19 CONTRACT AWARD--SEALED BIDDING--CONSTRUCTION (AUG 1996)

(a) The Government will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the Government, considering only price and the price-related factors specified elsewhere in the solicitation.

(b) The Government may reject any or all bids, and waive informalities or minor irregularities in bids received.

(c) The Government may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.

(d) The Government may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Government even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing an advance payment.

Tab 8: Small Business Participation Proposal/Subcontracting Plan:

Small Business Subcontracting Plan is required (FAR 52.219-9 (Deviation 2018-O0018)).

Other than U.S. Small Business Offerors must also submit a subcontracting plan with the bid meeting the requirements of FAR 52.219-9 ALT 1 and DFARS 252.219-7003 (or DFARS 252.219-7004). Other than U.S. Small Businesses must submit acceptable subcontracting plans to be eligible for award.

FAR 19.702 provides: Any contractor receiving a contract with a value greater than the simplified acquisition threshold must agree in the contract that small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts with small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns.

FAR 19.702(a)(2) provides: In sealed bidding acquisitions, each invitation for bids to perform a contract that is expected to exceed $700,000 ($1.5 million for construction) and that has subcontracting possibilities, shall require the bidder selected for award to submit a subcontracting plan. If the selected bidder fails to submit a plan within the time limit prescribed by the contracting officer, the bidder will be ineligible for award.

As such, the apparent low bidder, as identified at the bid opening (See SF1442 Block 13.A. for date and time), shall provide a subcontracting plan within three calendar days from the bid opening.

Regarding evaluation of subcontracting plans, see FAR 17.705-4(b). Each bidder's plan must cover each of the 15 required elements (see 19.704). If the bidder does not submit a plan that incorporates the required elements within the time allotted, the bidder shall be ineligible for award. If the plan, although responsive, evidences the bidder’s intention not to comply with its obligations under the clause at 52.219-8, Utilization of Small Business Concerns, the contracting officer may find the bidder non-responsible.

Questions on the Subcontracting Plan requirements or the Electronic Subcontracting Reporting System (eSRS) requirements as required by FAR 52.219-9, shall be submitted via Bidder Inquiry in ProjNet at https://www.projnet.org/projnet.

The Corps of Engineers highly encourages all bidders/offerors to meet the recommended subcontracting goals as follows:

Small Businesses: 23%

The recommended breakdown to support the various small business subcategories is as follows:

Small Disadvantaged Businesses: 6% Women-Owned Small Businesses: 3% HUBZone Small Business: 4%

Veteran-Owned Small Business: 8% Service Disabled Veteran Owned: 2%

The goals are calculated as a percentage of the TOTAL SUBCONTRACTING DOLLARS, NOT THE TOTAL

CONTRACT AMOUNT.
