STATEMENT OF WORK

STATEMENT OF WORK

Dated 11 February 2016

1. PROJECT DESCRIPTION

1.1. DESRIPTION OF SERVICES: The Contractor will produce a sandbox-style video game, which will enhance users’ critical thinking and scientific reasoning skills, as well as awareness and understanding of the complexities of water management and flood risk. The Corps will provide code and a set of models and games to the Contractor to begin the effort of connecting the models and games with the GUI.

The Contractor will also produce in game scenarios, and tools and/or documentation to create game scenarios that will provide information on how to play the video game, flooding and/or water management issues addressed in the video game, and what residents should know about flood risk in their communities. Key messages will be developed by the Corps, the Nevada Department of Water Resources, the Nevada Department of Conservation and Natural Resources

- Division of Water Resources, and others, in collaboration with the Contractor.

The products will not make recommendations for investment decisions, flood management projects, flood insurance or products. The goal of the products is to increase public awareness about flood risk in Nevada.

Video game products will be produced in a high-definition format, and also made available in a low-resolution format, appropriate for streaming and to a standard that meets the need for distribution online. Additionally, the video games will be produced in an accessible manner (e.g.

with closed captioning/subtitles).

Services in this contracted effort include:

- Attending meetings with project delivery team (PDT) members to confirm scope and outline ideas

- Developing or utilizing an existing graphical user interface and/or model, for use in creating the simulation video game

- Developing a scope and draft products to present to PDT for approval

- Record appropriate supplemental footage as needed

- Acquire and incorporate music and/or background audio (sound effects) where appropriate

- Produce in game scenarios.

- Produce a final video game with GUI that can work on web-based or mobile gaming platforms.

7. SPECIAL CONSIDERATIONS

7.1. The Contractor will obtain all necessary licenses and permits for compliance with Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work.

Any permits and formal training necessary to perform work under this contract will be in place prior to beginning fieldwork. Copies of required permits will be presented to the Corps upon request.

7.2. The Contractor will be responsible for all damages to persons or properties that occur as a result of the Contractor’s fault or negligence.

7.3. The Contractor will be responsible for conducting quality control on all products developed as part of this task order. As part of the Contractor’s Quality Control procedure, the Contractor will perform the internal ITR in a seamless manner to assure that approval can be assured upon completion of the work. The review should be documented but documentation does not need to be submitted to the Government except upon request.

7.4. The Contractor will be responsible for the accuracy and completeness of the data requested within this scope of work, and for any liability resulting from the Government’s reliance on data that is found inaccurate or incomplete. The Contractor will promptly advise the Contracting Officer of any significant developments encountered in performance of work under this contract.

7.5. The Government may undertake or award other contracts for additional work. The Contractor will not commit or permit any act that will interfere with the performance of work by any other contractor or by Government employees.

7.6. Any problems that endanger the fulfillment of contractual requirements will immediately be brought to the attention of the Contracting Officer. The Contractor will not perform services requested by any person that he/she considers to be beyond this scope of work or that constitutes a change in work or services required by this contract and may necessitate an adjustment in contract price until the Contractor has (1) made a proposal to the Corps covering such extra services; (2) negotiated a mutually satisfactory fee; and (3) received a contract modification from the Contracting Officer.

7.7. All data and materials produced under or relative to this scope will become the property of the Government and will not be released to other agencies, their representatives, or members of the public without consent of the Government.

7.8. The in-game scenarios and written instructions are intended to augment the video game, in a way that helps the user understand the purpose of the game, how to play it, and what results users should be looking for. A few preliminary concepts include:

- Why water management is hard to do (what are the problems in water management)?

- What does “winning” the game look like?

- What happens in the real world of water management (live interviews with subject matter experts)

7.9 Current computer models and games developed by the Corps (known as the Simulated Water Management Model, or SWMM) are available online, here:

http://www.spk.usace.army.mil/Missions/FloodRiskAwareness/EducationResources.aspx

The proposed concept for the video game, using one or more of the four modules in the current SWMM model, is to aim to solve basic water management problems, based on one of the STEM concepts, and using critical thinking skills. Two examples include:

Earth Science: how big (and expensive) a reservoir is needed for flood management? Win the game by spending as little money as possible without under-sizing the dam.

Physics: how much water needs to be released to produce adequate hydropower for the town? Win the game by producing enough power without running out of reservoir water.

The game that is developed in this PWS will address basic water management questions, and both illustrate consequences to negative performance and promote positive performance of the game player to “win” at the challenge of responsible water management (including flood management).

8. INVOICES

Invoices for payment will be submitted upon completion of tasks as outlined in the attached payment schedule. Invoices will be submitted electronically to the COR, who will be determined at the time of award.

9. CONTRACT PAYMENTS

The Government shall pay the Contractor upon submission of proper invoices for services delivered and accepted for the portion of the work actually performed under the contract.

Payment shall be made as indicated in the contract's Payment Schedule, not on percentage of completion. Deliverables as defined in the Payment Schedule of the contract must be accepted by the Government before payment will be made.

10. AUTHORITIES

The Contractor will take no direction from any Government employee or any other person other than the Government Contracting Officer that changes the terms and conditions of this contract action, the scope, or any change that impacts the cost, price or schedule. Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor will act upon those changes.

The Contractor will comply with the Changes clause of this contract when the contractor believes direction has been given from persons other than the Government Contracting Officer that equate to a change by notifying the Contractor Officer as directed by the clause. Any direction given by any Government employee or any other person outside their authority must be reported to the Contracting Officer. Contracting Officer Representatives (CORs) are limited to the authorities stated in the COR appointment letters. If a COR is appointed under this contract, they will be appointed by written letter from the Contracting Officer to the Contractor and COR specific to this contract only. COR appointment letters from previous contracts at this installation are not valid for this contract.

CLAUSES INCORPORATED BY FULL TEXT

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. (5) references for previous projects to include but not t limited to point of contact name, title, company name, phone number and email address. The Government may contact the offeror’s references for information and may review performance ratings on file for prior Government projects the offeror may have performed.

Past performance will be based on the Government’s knowledge of performance under current and previous contracts, information provided by references directly to the Government or through other means, or based on any other reasonable basis. If past performance information is not available for the offeror; the offeror shall be assigned a neutral rating which is neither favorable nor unfavorable.

Factor 4 – Price Contractor shall provide a Firm-Fixed price. Contractor shall break out all labor categories and labor rates.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. The proposed delivery order will be awarded using an informal best value analysis as described in FAR 13.5.

2. The factors that will be evaluated for award are:

Factor 1 – Technical:

Contractor will be evaluated on their ability to develop games of similar type from concept to final product as required by the Statement of Work.

Factor 2 – Critical Thinking:

Contractor will be evaluated on their ability to demonstrate a clear understanding of the critical thinking component of this requirement and the ability to incorporate critical thinking into the game as described in the Statement of Work.

Factor 3 – Past Performance

Contractor will be evaluated using an acceptable past performance record. The Government may contact the contractor’s references for information and may review performance ratings on file for prior Government projects the contractor may have performed.

Past performance information obtained from sources other than those identified by the contractor may be used. All relevant facts and circumstances gathered from information from the contractor’s listed references and other sources of information available to the Government will be used to evaluate whether the contractor’s overall past performance and quality of performance is acceptable. If an contractor has not had a chance to comment on negative past performance evaluation obtained, it will be given a chance during clarifications. An contractor without a record of relevant past performance for whom past performance is not available will be given a neutral rating.

The Government may also use past performance information obtained from other than the sources identified by the contractor. Information obtained from the Past Performance Information Retrieval System (PPIRS) database located at http//www.ppirs.gov is one of the sources that will be utilized. PPIRS functions as the central warehouse for performance assessment reports received from several Federal performance information collection systems and is sponsored by the DOD E-Business Office and administered by the Naval Sea Logistics Center Detachment Portsmouth.

The technical factors and the past performance factor are of equal importance.

Factor 4 – Price Price will be determined by adding the firm-fixed price for all CLINS to find the bottom line price.

Technical and Critical Thinking combined are significantly more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful contractor within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
